    The Re-Professionalisation of the Police in England and Wales Simon Holdaway, Professor of Criminology, Nottingham Trent University Abstract In this article contemporary police claims to professional status are analysed and related to a new structure of police regulation in England and Wales. It is argued that the notion of the police as a profession is not new and, unlike police and academic commentary, analysis of this subject, should draw on sociological understandings of professions. The wider policy context within which claims to professionalisation are made is also considered. It is argued that a new, loosely-coupled system of regulation has been developed in England and Wales. Policing’s professional body, the College of Policing, is central to this regulatory framework that has placed government at a distance from constabularies and police representative associations. Finally, some of the consequences of the hybrid system are considered and benefits of the framework of analysis proposed are discussed. Introduction I suppose you could sum it all up by saying that in Britain certainly, and I have no doubt elsewhere, the time has come when the police are abandoning their artisan status and are achieving by our ever-increasing variety of services, our integrity, our accountability and our dedication to the public good, a status no less admirable than that of the most learned and distinguished professions (Mark, 1977). 1 The designation of the police as a profession is not a contemporary idea. At the hearings held by the Inquiry in November 2020 we received oral and written evidence about events leading up to the formation of the undercover police unit that will be the focus of a good deal of this inquiry’s work. The unit was known by a variety of names during its 40 year history. I shall refer to it throughout as the Special Demonstration Squad, or SDS. The evidence was to the effect that the SDS was set up to gather intelligence about the Vietnam Solidarity Committee (which I shall call the VSC) and, in particular, its 1968 “Autumn Offensive”. The desire for more intelligence about the VSC appears to have stemmed from concerns, both within the police and within the Government, that there would be a repeat of the serious and violent public disorder that had occurred outside the American Embassy in Grosvenor Square at the demonstration organised by the VSC in March 1968. 2. The evidence about the SDS’s first months of operation demonstrated that it was focused on those planning demonstrations against the Vietnam War: principally the VSC, but also Maoists who had founded a separate organisation, the British Vietnam Solidarity Front (which I shall refer to as the BVSF).

    Sir Robert Mark On the 100th anniversary of his birth, Tony Moore takes a brief look back at the career of Sir Robert Mark The BBC referred to him as one of the great reforming administrators of his time (1 October 2010); the Independent as arguably the most important individual to emerge from 20th century British policing (5 October 2010); and the Guardian as probably the most accomplished post- war commissioner (1 October 2010) Born in Manchester on 13 March 1917, Sir Robert Mark came to the Metropolitan Police after rising to the rank of chief superintendent in the Manchester Police and spending 10 years as chief constable of Leicester. The Second World War, during which he was commissioned into the Royal Armoured Corps, interrupted his police career for five years. His term as chief constable of Leicester is, perhaps, best remembered for famously establishing a traffic warden corps and introducing the fixed penalty system He was appointed an Assistant Commissioner in the Metropolitan Police, then under the command of Sir Joseph Simpson, in March 1967, taking over responsibility for D Department, which included personnel, training, communications, buildings and dogs. Describing Scotland Yard, then based in the Norman Shaw building, as a giant mausoleum without….any functional advantages, (Mark:79) he quickly found, from the Commissioner down, that he was an unwelcome addition to the senior echelons of the Metropolitan Police.     Police Crime: A Constitutional Perspective By Graham Richard Smith Thesis submitted for degree of Doctor of Philosophy Faculty of Laws University College London University of London June 1998 Police Crime: A Constitutional Perspective ABSTRACT It is held that the police officer is liable at criminal and civil law the same as the citizen; given constitutional expression in the common law office of constable. Yet, in the execution of their duty police officers are prone to committing a range of criminal offences - assault, false imprisonment, perverting the course of justice - defined in this thesis as police crimes. Statistical analysis reveals that police officers are rarely prosecuted for these offences, suggesting that criminal liability is an illusion, and civil proceedings have become an increasingly popular remedy for police wrongdoing. This thesis holds that ss.48 and 49 of the Police Act 1964 played a prominent part in undermining the police officer's accountability to the law. This was achieved under s.48 by removing the police officer's personal responsibility for his wrongdoing at civil law, and introduction of a vicarious liability rule. And, under s.49, by definition of reports of alleged criminal offences committed by police officers as complaints, and codification of a separate criminal procedure. Since the 1964 Act, statute and case law on police wrongdoing have caused further damage to the constitutional position by emphasising the internal police complaint and disciplinary processes and devaluing issues of liability. It is argued that there is a conflict between the ancient office of constable and the recently developed doctrine of constabulary independence, and it is proposed that a 'balance model' accurately reflects the constitutional position of the police.

Sir David Phillips, sponsor of the model and President of the Association of Chief Police Officers (ACPO), during a key period in its development, wanted it to overhaul intelligence work, and revolutionise investigative practice in the mainstream.
