It became clear early in the history of the country that the Supreme Court would have a great impact on how the First Amendment would be upheld and interpreted. This book examines how Congress has interacted with the executive and judiciary branches over the past 40 years in its treatment of school prayer and the religion clause of the First Amendment. The early history of the church-state relationship is examined as well. In School Prayer, Robert Alley examines the history behind the writing of the religion clauses of the First Amendment, the courts' interpretations of these clauses over two centuries, and the debates in Congress over their application, especially as regards prayer in public schools. It seemed to me at the time that the testimony of witnesses on the subject of public school prayer would make a fascinating study. A quarter century later, with an additional dozen volumes of hearings before Senate and House committees, the moment was clearly at hand. There are numerous persons to whom I owe a debt for assis- tance, including Rosemary Brevard of the Baptist Joint Committee on Public Affairs, who generously provided me with hard copies of almost all the hearings. Conversations with Steven Green, Rob Boston, and Joe Conn of Americans United kept me abreast of developments on the Hill over the past few months. My father, Reuben E. Alley, editor of The Religious Herald from 1937 to 1970, had as much respect for Madison's Memorial and Remonstrance as he did for the Bible and never ceased to challenge his own religious assumptions with new scientific and historical knowl- edge. He questioned everything with a tenacious integrity. My 11 1 1 12 PREFACE mother, Mary Sutherland Alley, was remarkable as a Christian believer with an unquestioning acceptance of the Bible stories. She never flagged in her encouragement of ideas and opinions in her son, ideas she never personally shared. I can still hear her saying, "I just have my simple faith." In fact that is what this book is about, the encouragement of people to doubt, differ, and disagree without fear or favor in our constitutional democracy. My mother possessed a sure and certain knowledge of her God that never excluded another human being nor presumed anyone without her faith to be a lesser breed. She was a believer without arrogance. The writing has proved easier because of the encouragement at the University of Richmond of Dean David Leary and Provost Zeddie Bowen. My colleagues in the religion departmentFrank Eakin, Miranda Shaw, and Ted Bergrenhave provided a stimu- lating environment and good friendship. Professor Irby Brown, a partner in so many academic endeavors, has constantly sharp- ened my sense of humor. I owe a continued debt to my advisor and mentor at Princeton University, Horton Davies. Additionally, through his commitment to academic freedom and integrity, Professor John Gager, also of Princeton, has been a recent re- minder of the quality of that great institution. Nothing in my career has been without encouragement and help from my family. We hold a set of common values concerning personal freedom and education that make lively discussions inevitable and frequent. This endeavor, like all those that have gone before, owes the most to my wife, Norma. She has been the sounding board for all the ideas and planning for this volume. Our sons Bob and John have both encouraged and critiqued my work. Their insights into the children they teach along with the thoughts of our daughters-in-law, Vickie and Pam, both teachers as well, have affected my thinking about the school children who are the objects of all the debate over classroom prayer.

    Government-Sponsored Prayer in the Classroom Robert E. Riggs uring its 1984 session the United States Senate fell eleven votes short of the two-thirds majority required to endorse a constitutional amend- ment allowing government-sponsored prayers in public schools (S. J. Res. 1983). This was the strongest support yet accorded to one of numerous such attempts to amend the Constitution since the Supreme Court first banned a state-composed school prayer in 1962. Religious proponents have vowed to continue the fight for the amendment (Cornell 1984), and politicians are unlikely to drop the subject with polls showing 80 percent public approval of prayer in the schools (Gallup 1982, 1983). Prayer amendments have been reintroduced in the 1985 session of Congress. At the state and local level, many school districts continue to permit school-organized prayer, regardless of its constitutionality and, in some instances, in disregard of minority objections. The school prayer issue varies in intensity from time to time and from one locality to another, but, somehow, it will not go away. School prayer has intrinsic importance for many people, but the persisting vitality of the issue springs from much broader concerns. It is rooted in perva- sive frustration with a wide range of social evils that seem attributable, at least in part, to the growing secularization of American society. The challenge of traditional religious values is real enough, as are accompanying signs of social disintegration. Drug abuse, crime, alcoholism, commercialized obscenity, illegitimacy, broken marriages, fraud and corruption in business and govern- ment, heavy dependence upon government welfare — the evidence is all around us.

SMITHt It is not usual for legal scholars working in establishment clause jurisprudence-and it is especially not usual for me-to say nice things about what the Supreme Court has done to the subject. But that is what I mean to do today. I don't want to be too agreeable or cheerful, though, so this time, although commending the Court, I am going to take issue with the commentators. More specifically, I want to praise a recent development that most commentators seem to deplore-namely, the Court's recent practice of using the slightly disreputable doctrine of standing as a device to avoid deciding Establishment Clause cases on the merits. Thus, in Elk Grove Unified School District v. Newdow,' the Court used a dubious "prudential" standing doctrine to avoid deciding whether the words "under God" in the Pledge of Allegiance were unconstitutional.

    The first page of the Senate’s markup of the House-passed Bill of Rights, the first 10 amendments to the Constitution, ratified in 1791. “Article the First” was never ratified. The third and fourth articles were combined by the Senate into what it now the First Amendment. The second article, dealing with the pay of members of Congress, was ratified more than two centuries after it was sent to the states, in 1992. Amending America Exhibit Shows How Changes in the Constitution Affect the Way Our Democracy Works By Christine Blackerby hat if we elected the President of the United WStates by lot—by pulling a ball representing a candidate out of a bowl? A constitutional amendment introduced in Congress in 1846 proposed precisely that. In 1838, one member of Congress shot another, prompting the introduction of an amendment to the Constitution to deny public office to duelers. A citizen wrote to Congress in 1963 to advocate for a constitutional amendment to require that Americans “tell the truth, the whole truth, and nothing but the truth.” Anyone who failed in that duty would be sen- tenced to 20 years of hard labor. These are just a few of the more than 11,000 consti- tutional amendments that have been proposed in Con- gress since the Constitution was written in 1787. Some of them were proposed to call attention to an issue, some as satire, some to allow a member of Congress to take a political stand, and some were very serious appeals to resolve pressing problems.
