Co, Ltd (H&M Production) – and the People's Republic of China (Dispute) as well as to request consultations with China pursuant to Article 11(1) of the CH-CN BIT in order to reach a mutually agreed solution to the Dispute (Request for Consultations). The Dispute has arisen out of certain measures taken by China against Mr. Eugenio Montenero’s investments (including those carried out through H&M Production) in relation the Hainan International Jazz Festival project (Project). These investments have been: 2 Mr. Danilo Ruggero Di Bella BOTTEGA DI BELLA Calle Toledo núm. 9, 2C – 03002 Alicante (Spain) [email protected] www.bottegadibella.com Tel.: +34 617 56 52 90 (i) unlawfully expropriated, in violation of Article 6 of the CH-CN BIT and international law; (ii) treated unfairly and inequitably and impaired by discriminatory or otherwise unreasonable measures, in violation of Article 4(1) of the CH-CN BIT; (iii) directly affected by Chinese authorities’ failure to observe the commitments taken in relation thereto, in violation of Article 8 of the CH-CN BIT; and (iv) been the subject of other China's violations of her obligations as well as the rights and guarantees she granted to Swiss investors under the CH-CN BIT. By way of summary, the Project – and Mr. Eugenio Montenero's investments in China – consisted in organizing a yearly jazz festival in Hainan akin to the Montreux Jazz Festival in Switzerland, which would culminate with the opening of permanent jazz cafés to generate steady profits throughout the year in-between each edition of the festival. The Project had the support of local Hainan and Haikou authorities and was officially launched in 2013 with the holding of the first edition of the Hainan International Jazz Festival from 24 to 27 October. Despite the vibrant success of this first edition of the Festival and the authorities' representation that they were eager to follow through with the next edition, the Haikou government suddenly and inexplicably changed its position just a few months prior to the period during which the second edition of the Festival was scheduled to take place in 2014 and refused to deliver any further authorization necessary to organize subsequent festivals on the island. The government's radical and unexpected disengagement from the Project dramatically disrupted its schedule and eventually resulted in its failure, thereby nullifying the value of Mr. Eugenio Montenero’s investments and H&M Production's sole business purpose. Mr. Eugenio Montenero now seeks monetary compensation in the amount of at least five (5) million Swiss francs for the damage and loss he has sustained as a result of China's violations of inter alia Articles 6, 4(1), and 8 of the CH-CN BIT. In accordance with Article 11(1) of the CH-CN BIT, Mr. Eugenio Montenero kindly requests good faith consultations with China to reach a mutually agreed solution to the Dispute. Mr. Eugenio Montenero proposes that such consultations be conducted via videoconferencing within thirty (30) days of the date of this Request for Consultations. Mr. Eugenio Montenero requests that China confirm in writing within fifteen (15) days that she agrees to this proposal and provide her preferred dates for the consultations to be held virtually.     Overview of Hainan Province Geographical Location Situated at the southernmost tip of China, Hainan sees Guangdong across the Qiongzhou Strait to the north, Vietnam across theBeibu Bay to the west and Taiwanacross theSouth China Sea to the east. Its neighbors in the South China Sea include the Philippines, Brunei and Malaysia in the southeast and south. The jurisdiction of Hainan covers Hainan Island, theXisha (Paracel) Islands, theZhongsha (Macclesfield) Islands and the Nansha (Spratly) Islands as well as the surrounding maritime areas, making it the largest province in China in terms of area. Hainan covers a land area (mainly including Hainan Island and Xisha, Zhongsha and NanshaIslands) of 35,400 square km (that of Hainan Island reaching 33,900 square km) and has a maritime area of about 2 million square km. With the outline like an oval snow pear, Hainan Island has a total area of 33,900 square km (excluding the satellite islands), the second largest island only next to Taiwan Island. Qiongzhou Strait, located between Hainan Island and Leizhou Peninsula of Guangdong Province is about 18-nautical-mile wide; while Zengmu Ansha in Nansha Islands is the southernmost territory of China. Administrative Divisions By September 2015, Hainan Province had 27 cities and counties (districts), including four prefectural cities, five county-level cities, four counties, six autonomous counties, eight districts, and 21 townships, 175 towns and 22 sub-district offices (totaling 218). Denton, Advisor Heather Inwood Copyright by Hao Zhou 2010 Abstract The present study serves to explore the relationships between cities and literature by addressing the issues of space, time, and modernity in four works of fiction, Lao She’s Luotuo xiangzi (Camel Xiangzi, aka Rickshaw Boy), Mao Dun’s Ziye (Midnight), Ba Jin’s Han ye (Cold nights), and Zhang Ailing’s Qingcheng zhi lian (Love in a fallen city), and the four cities they depict, namely Beijing, Shanghai, Chongqing, and Hong Kong, respectively. In this thesis I analyze the depictions of the cities in the four works, and situate them in their historical and geographical contexts to examine the characteristics of each city as represented in the novels. In studying urban space in the literary texts, I try to address issues of the “imaginablity” of cities to question how physical urban space intertwines with the characters’ perception and imagination about the cities and their own psychological activities. These works are about the characters, the plots, or war in the first half of the twentieth century; they are also about cities, the human experience in urban space, and their understanding or reaction about the urban space. The experience of cities in Republican era fiction is a novel one, one associated with a new modern historical consciousness.

Since China has a vast territory, different regions formed a variety of regional cultures with different natural environments and era evolutions. Historical and cultural towns and villages not only exist as individual entities, but also as integrated urban and rural settlements and regional cultures. This paper presents the methodologies for the protection of historical towns and villages in the phase of systematic planning in Hainan Province. The research begin with looking at Hainan’s regional culture, adopting the research method of anthropology and regional heritage to retrace the culture of Hainan’s towns and villages, analysing the status quo, and on this basis, building a framework of Hainan historical towns and villages in promotion of its rational protection and development. Keywords: historical and cultural towns and villages, land use, Meso-scale space unit, non-motor- vehicle travel. 1 INTRODUCTION Hainan is a tropical island in southern China with beautiful scenery; its special natural environment has created an exotic culture. Today, most people see Hainan as an international scenic spot; however, less attention is paid to Hainan’s culture and traditions, which, to some extent, results in a lack of cultural construction. Historical and cultural villages and towns are important space carriers of Hainan culture; therefore, the construction of provincial-level historical and cultural towns and villages to protect the historical and cultural heritage of Hainan is essential.
