The site visit to the project cited above was carried out on 23.3.2015 & 24.3.2015 along with the Shri S. Srinivas Rao, Assistant Environmental Engineer, Andhra Pradesh Pollution Control Board (APPCB) - Nellore Office, Shri Jithendra Nimmagadda, Chief Operating Officer and Shri P.Bhaskar Reddy, I.F.S(Retd.), Advisor - Environment. Also, detailed discussions were held with the following officers of the Mis KPCL [Mis KPCL - herein after referred as Project Proponent (PP)] regarding their compliance status of their EC conditions for their ongoing operations of the port.

PORT DETAILS: Krishnapatnam Port is being developed as a PPP Project on BOST (Build Operate Share Transfer) basis by Mis. KPCL in terms of the Concession Agreement entered in to with Government of Andhra Pradesh (GoAP). II. PRESENT STATUS OF THE PROJECT:

Cargo Handling During current year up to Feb, 2015 is reported to be 36.00 MT of various cargoes + 0.080 MTEUs of Containers. The overall layout of the port area is enclosed as Annexure I.

The land details as provided by the PP (enclosed as Annexure -II) are as reproduced as below:

Forest land: No reserve forest land is occupied by KPCL. Reserve Forests lands are yet to be handed over by GoAP to KPCL. Salt land: Salt land is yet to be handled by GoAP to KPCL. IV. ENVIRONMENT MANAGEMENT MEASURES:

PP is periodically undertaking the necessary environmental monitoring for ambient air, noise, marine water ecology and sediments, marine water turbidity, ground water, soil for different environmental quality parameters through a NABL accredited and MoEF&CC approved agency. The monitoring reports are being periodically submitted to the Regional Office of the MoEF&CC. The results of monitoring provided during the visit shows that they are complying with the norms. The environmental management measures being followed by the PP are furnished under:-

Ambient Air Quality: • Installed and operating Mechanical Dust Suppression System with 248 nos of sprinklers at coal stacking and wagon loading areas. • Deployed 25 nos of Truck mounted sprinklers for roads and transit areas. • Deployed 2 nos heavy duty atomizer sprayers for coal handling. • Developed paved roads and deploying mechanical road sweeping machines. • Developed closed warehouses for fertilizers, food grains and agri products. Developed wind breaking wall and warehouses of 12 m height, Coal Stock yard. • Trucks deployed for inter carting of coal within port are provided with mechanical covers or tarpaulin covering. • Commissioned Continuous AAQ Monitoring Station (CAAQMS) in the port area and linked the same to APPCB web site. CAAQMS is being calibrated annually by the supplier. • Green belt has been developed in an area of 254.5 Ha along port boundary, around coal yards and block plantation, avenue& median plantations.

Water Quality: • Developed drains, collection pits and guard ponds for runoff with facility to recycle for dust suppression. • Developed truck wash area and treated water recycled for dust suppression. • Developed 300 KLD STP and treated effluent recycled for greenbelt.

Solid Waste Disposal: • Bio degradable solid wastes are composted for use as manure for plantation. • Non bio degradable wastes are disposed through authorized agencies. • Batteries are being purchased on buy-back basis or disposed to authorized agencies. Green Belt: • 191.5 Ha of greenbelt was supposed to be developed in Phase _I & II. • 254.5 ha of Greenbelt developed in the areas made available by GoAP so far with about 20,23,752 plants (up to Dec 2014) and with an average survival rate of 80%. • Maintenance including replacement of causalities is attended regularly.

Mangrove Protection & Development: • Existing mangroves being protected by barricading, display of suitable boards and ensuring tidal exchange. • 50 Ha Mangroves developed as directed in EC for Phase-II. • Maintenance including replacement of causalities is attended regularly.

v. SHOW CAUSE NOTICES AND DIRECTIONS ISSUED BY MOEF&CC:

MoEF&CC, New Delhi vide letter dated 11.01.2013 issued Show Cause Notice to KPCL on the following points based the representations received against the KPCL project, reports of Andhra Pradesh Coastal Zone Management Authority (APCZMA) and monitoring report of the Regional Office of MoEF&CC at Bengaluru etc.

i. Out of 3064 acres of designated land Krishnapatnam Port is in possession of 1800 acres of land and another 1300 acres of land and reclamation of 269 acres which is included in the Master plan but EC is yet to be received. ii. Building with helicopter facility which is not shown in the EIA report or shown in the approved Master plan. iii. At two places earthen bridges were noticed with hume pipes to cross the creek. At this portion the mangroves were seen on either side of creek on both sides of the bridges, which indicate that small mangrove patches must have got buried below the earthen portion. iv. Nine bridges were constructed and two renovated and there is no mention of these in the DPR of the port which is submitted to the Ministry. v. The Loco Shed has been constructed without CFE from Pollution Control Board. It appears that the loco shed is located in CRZ-I area, whereas it is not a structure requiring waterfront and is not a permissible activity under CRZ. vi. 269 acres of water bodies are reclaimed in two patches 219+50 acres (by altering meandering portion of the creek and a path on the southern side of the altered creek) which is a part of sy.no.180.711 and 416. The survey no. 180 belongs to Kandaleru creek. Even though the maps and the EIA etc indicate the utilization of the area for port purpose no specific mention/permission for this is available in the EC. vii. Total Greenbelt to be developed in phase-1&II:191.8 ha. Green belt developed so far is 70 Ha only. Thereafter, MoEF&CC vide letter dated 24.6.2014 issued directions to the PP under section 5 of the Environment (Protection) Act, 1986 to suspend the construction activity at the existing level immediately till EC/CRZ clearance is obtained or required amendment to EC/CRZ clearance is obtained for this project activity under the provisions of the EIA. In compliance to the Ministry's direction, PP informed that works of Phase-II are stopped with

effect from 1-7-2014 except operation related maintenance, environmental and safety related measures. VI. DIRECTIONS ISSUED BY APPCB:

APPCB vide orders dated 6.2.2014 issued directions under Air Act, 1981 and Water Act, 1974. The directions given by APPCB and the latest progress report submitted by the PP in this regard to the APPCB is enclosed as Annexure III.

VII. REPORTED VIOLATIONS BY THE KPCL:

There have been repeated representations from a few individuals to the Ministry alleging violations against the KPCL project. The issues raised in the representations and its status is furnished under' S.No. Issues raised Status a) Construction in defiance of Allegation is subjective in nature. Out of 1.5 MLD, 1.1 MLD of water is being met from Nakkalakaluva and 0.4 MLD of water is being met from authorized vendor for domestic needs. MNR OFKRISHNAPATNAMPORTPHASEI & PHASE112006 & 2009 ECVISIT23.3.2015 TO24.3.2015 Page 7 of 28 With respect to the aforesaid complaints, PP informed that a subcommittee of the APCZMA has visited the site and had interactions with the petitioners, PP and the people in the project area and submitted their report. APCZMA has agreed with the subcommittee's report and send their observations to the Ministry. Further, it was informed that Central Empowered Committee (CEC) has also visited the port during June 2013 and necessary clarifications were furnished by the PP on the aforesaid issues raised by the complainants. The report of CEC is awaited.

The report is submitted on the basis of the field visit and as per the information provided by the PP. The status of compliance on the stipulated conditions contained in the ECs cited above for the entire MIs Krishnapatnam Port complex is given below in Part II & Part III.

As per the compliance status, PP has made modifications in the approved layout to facilitate commissioning of the port without waiting for transfer of the designated lands from GoAP. The broad modifications include the shifting and readjustment of bulk cargo storage yards within the project area, lateral shifting of berthing front towards the available project land, in addition to the quantified basic infrastructure, mandatory infrastructure like road, railway lines, belt conveyors, pipelines, ware houses, utility buildings, amenities, service facilities and other miscellaneous structures like bridges, culverts, repair shops required for handling of cargo through multi model transport system within the port were constructed as per the requirements. In this context, it was informed by the PP that these modifications have been submitted to the APCZMA by the PP and the APCZMA has recommended and forwarded the modifications to MoEF&CC for approval.

Further, six monthly compliance report including results of the monitored data and environmental statement has not been uploaded on the company's website as stipulated in the EC condition.

WHEREAS the Task Force officials inspected the Port and surroundings on 21.06.2013 & 17.10.2013 to verify status of compliance.

WHEREAS a hearing was conducted by the Task Force Committee of AP.Poliution Control Board on 28.12.2013 to review the compliance status of the Port. The representatives of the Port attended the meeting and informed about measures taken and proposed by the Port to comply with the conditions and directions of the Board. The Committee observed that the Port is yet to comply with certain directions issued by the Board. The Committee also observed that the Board has received representations regarding air pollution and non-compliance of Board directions through various organizations. The Committee observed that the mangroves and associated issues are being dealt by MoE&F, Govt, of India. After detailed discussion, the Committee recommended to issue certain directions to the Port. The Committee discussed on the ambient air quality levels recorded by APPCB and the RSPM is found to be marginally exceeding the standard at certain areas. However, the industry representative stated that even in the upwind direction also the RSPM is on higher side. The representative informed the measures taken by them to control air pollution.

After careful consideration material facts of the case, AP. Pollution Control Board hereby issues following directions:

01. The Port shall regularly use hoppers for unloading dusty cargos. Port shall maintain mechanical covering system to all transport vehicles. The port shall ensure regular water supply and continuous operation of water sprinklers provided at coal/dusty cargo storage yards. 02. The Port shall complete installation of adequate number of water sprinklers at recently shifted coal yard at NEC railway sliding within 2 months. Port shall also provide permanent power connection to the water pumping stations at FTP area and NEG railway sliding area within 2 months. . 03. Port shall provide cladding to the coal conveyor belts from berth nO.7 & B to inner yard and provide dust extraction and suppression system (dry fog system) for the transfer points within 2 months. 04. The Port shall limit coal stacking height to 10 m. The Port shall ensure water sprinkling at 1 m above coal stack height. 05. The Port shall install two more CAAQM stations at other strategic locations i.e. towards human habitations within 6 months. The Port shall regularly monitor AAQ at five locations (Port main Gate, Administrative Office Building, Storage area towards West of Buckingham Canal, Storage area in South Port and Gopalapuram) as proposed in the EIA Report. 06. The Port shall obtain prior permission of the Board before restarting handling of iron ore duly furnishing details of air pollution control systems. 07. The Port shall carry out a scientific study for installation of sprinklers at dusty cargo handling and stock areas, duly incorporating height of sprinklers & cargo stocks, throughput, water storage and pumping facilities, garland drainage system,' treatment and reuse of sprinkling water, future development of stock yards within one month and furnish report. DB. The Port shall complete the green belt development works as per CFE conditions i.e., green belt of 100 m width along the boundary and '20 m width around the stock yards within one year. 09. Port shall submit contingency plan to mitigate coal fires within one month. 10. The Port shall, extend the validity of the existing Bank Guarantee of Rs. 20 Lakhs for a period of one year, to ensure compliance with the Board directions and conditions.

WHEREAS the Board vide ref. 5th to th cited issued certain directions to your Port to comply.

WHEREAS the Hon'ble High Court of A.P disposed the PIL No. 270 and 325 of 2012 vide orders dt. 20.03.2013 and 22.03.2013, keeping in view of the action taken by the Board, --_ ----._-----

WHEREAS the Board conducted Ambient Air Quality Monitoring in the Port area and at surrounding villages (Krishnapatnam, Gopalapuram, Chalivendra, Subareddypalem and Gummaladibba) from 20.05.2013 to 29.05.2013, The monitoring demonstrates that PM-10 values has been reached and exceeded the standard in the surrounding villages closest to the Port.

WHEREAS the Board received letter dt.28.03.2013 from Principal Secretary to Govt., Infrastructure & Investment Dept., regarding issues pertaining to the Port i.e., full mechanization for coal handling, green belt along the boundary falling within AP.GENCO and salt lands, development of mangroves and surface water supply from Muthukur tank.

WHEREAS the Task Force officials inspected the Port and surroundings on 21.06.2013 & 17.10.2013 to verify status of compliance.

WHEREAS a hearing was conducted by the Task Force Committee of A.P Pollution Control Board on 28.12 2013 to review the compliance status of the Port. The representatives of the Port attended the meeting and informed about measures taken and proposed by the Port to comply with the conditions>and directions of the Board. The Committee observed that the Port is yet to comply with certain directions issued by the Board. The Committee also observed that the Board has received. representations regarding air pollution and non-compliance of Board directions through various organizations. The Committee observed that the mangroves and associated issues are being dealt by MoE&F, Govt., of India. After detailed discussion, the Committee recommended to issue certain directions to the Port. The Committee discussed on the ambient air quality levels recorded by APPCB and the' RSPM is found to be marginally exceeding the standard at certain areas. However, the industry representative stated that even in the upwind direction also the RSPM is on higher side. The representative informed the measures taken by them to control air pollution.

After careful consideration material facts of the case, A.P. Pollution Control Board hereby issues following directions:

01. Contaminated run-off water / effluents shall not be discharged into Buckingham Canal under any Circumstances, it shall be collected and treated before disposal

02. Port shall complete construction of garland drains around stock yards of coal, fertilizers and other dusty cargo with leachate collection & treatment facility within 2 months.

03. Port shall regularly remove sludge from the guard ponds and dispose it in scientific manner.

04. The Port shall not construct any new berths without obtaining CFE of the Board.

05. The Port shall not carry out any further construction works for establishment of loco shed on the reclaimed land adjacent to creek for which the Board has not issued CFE to the Port.

The Port shall submit monthly progress reports to the EE, RO, Nellore and SEE, TF, Vijayawada.

These directions are issued under Sec.33 (A) of Water (Prevention and Control of Pollution) Amendment Act, 1988. :: 3 ::

You are hereby directed to note that, should you violate anyone of the conditions mentioned above, action will be initiated against your industry without any further notice, in the interest of Public Health and Environment and the Bank Guarantee will be forfeited.

d. Heights of sprinklers of MDS system installed for the coal stack yards have been Increased to ensure spraying of water on the top of the 12 m high coal stacks.

e. 25 Nos of mobile tankers equipped with water sprayers are deployed as and when necessary.

The issue was placed In the CFO Committee meeting held on 03.03.2014. The Board after careful examination, hereby amends the Condition No.7 of Schedule-B of CFOOrder dated 30.11.2013 and condition no.7 shall be read asfollows:

In this regard, the Krishnapatnam Port Company Ltd in their letter dt 14.09.2012 (copy enclosed) have requested the Government, for supply of 1.0 MLD of water from Muthukur Reservoir to Krishnapatnam Port in terms of Clause 3.15'of Concession Agreement. In this regard. the Government vide G.O.Ms.No. 10, J & CAD (PW.M&MI-R1) Department Dt. 20.02.2013 (copy enclosed), accorded revised administrative approval for an amount of Rs. 110.34 Lakhs as against earlier administrative approval of Rs. .71.50 lakhs to take up the deposit Work of "Providing Raw Water pumping main from Muthukur Large tank to . Krishnapatnam Port MUSS (Main Utility Sub Station) area including construction of Head Works in Muthukur Village and MandaI in SPSR Ne/lore District", and directed the Chief Engineer. NTR TGP, Srikalahasti to take further action in the matter.

In this regard, I am to inform you that in the meeting held on 22.02.2013, the Chief Secretary have directed that the above work shall be completed by 31.08.2013 positively. It is learnt that even though the tenders have been finalized, the work could not be grounded due to, local problems. ::2::

I request you to look into. the matter personally and to issue necessary instructions to the officials for commencement of work by Irrigation Department for supply of raw water from Muthukur Large tank.to Krishnapatnam Port MUSS (Main Utility Sub Station). at the earliest.
