EUROPEAN PARLIAMENT DELEGATION FOR RELATIONS WITH AUSTRALIA AND NEW ZEALAND 12TH EP/NEW ZEALAND INTERPARLIAMENTARY MEETING 26 FEBRUARY - 5 MARCH 2006 AUCKLAND, WELLINGTON, CHRISTCHURCH CHAIRMAN'S REPORT The Delegation travelled to New Zealand from 26 February to 5 March. The delegation was headed by Mr Neil Parish (EPP-ED, United Kingdom). The full list of the participants is appended. MEPs held meetings at the highest level, in particular with the Prime Minister, the Rt. Hon. Helen Clark; the Speaker of the House of Representatives, the Hon. Margaret Wilson; the Foreign Minister, the Rt. Hon. Winston Peters; and the Leader of the National Party, Dr Don Brash. Members also met a wide range of Members of Parliament, including the Labour Party, the National Party, the New Zealand First Party, the United Future New Zealand Party and the Green Party. Meetings also took place with the Business Committee of the House of Representatives. On regular occasions during the entire visit the Delegation was accompanied by members of Parliament. The Delegation was briefed by the Heads of Mission of the Member States to New Zealand, including the Delegation of the European Commission, and met also representatives of agriculture, academia and the press. Key items discussed during the meetings were the EU-New Zealand relationship; Common Agriculture Policy reform; development aid to the Pacific region; New Zealand's free trade agreement with China; internal New Zealand politics, in particular the Mixed Member Proportional representation system (MMP) that has been in operation since 1996; the post-enlargement EU and the draft constitutional treaty; world affairs and global security. -

CATWA New Zealand is a branch of the international non-government organisation Coalition Against Trafficking in Women which has category II consultative status with ECOSOC. This report is on the New Zealand government’s compliance with Articles 5 and 6 of CEDAW on harmful cultural practices, trafficking and prostitution. This report argues that the 2003 decriminalisation of prostitution in New Zealand is in violation of these articles. 2 Preamble: Article 6 requires that: ‘States Parties shall take all appropriate measures, including legislation, to suppress all forms of traffic in women and exploitation of prostitution of women’. The language of CEDAW is taken from the 1949 Convention Against Trafficking in Persons and Exploitation of the Prostitution of Others. In this Convention the phrase ‘exploitation of the prostitution of others’ means profiting, by third parties, from the use of women in prostitution. The decriminalisation of prostitution in New Zealand is thus in violation of Article 6. Article 5(a) of CEDAW states that ‘all appropriate measures’ will be taken to ‘modify the social and cultural patterns of conduct of men and women, with a view to achieving the elimination of prejudices and customary and all other practices which are based on the idea of the inferiority or the superiority of either of the sexes or on stereotyped roles for men and women’. -

A Brief History of Conscience Voting in New Zealand David Lindsey Introduction The conscience vote 1 is a mechanism by which MPs are freed from the strictures of party discipline and permitted to vote as individuals during legislative debates. Under such circumstances, MPs are able to justify their voting decisions on the grounds of personal conscience, constituent preference, ideology, or for a host of other reasons. For the MP, this arrangement permits a semblance of independence and a rare opportunity to exercise private judgment, often resulting in the unusual sight of members of opposing parties voting in the same lobby. In one sense, all votes are conscience votes in most parliamentary systems,2 for standing orders and official parliamentary records are generally blind to parties.3 From the perspective of these parliaments, the fact of MPs agreeing to vote according to the collective interests of what has come to be called a party is a 1 Conscience voting is the term most commonly used in Australasia. In Britain and Canada they are known as ‘free votes.’ Another, more descriptive, term used in all these countries is ‘unwhipped votes.’ The term ‘personal vote’ is also gaining meaning in New Zealand due to that country’s standing orders now distinguishing a Party Vote from a Personal Vote. In a Party Vote, the whips vote on behalf of their parties and only the way the party corporately voted is recorded. A Personal Vote is held when one or more parties have agreed to treat the matter as a conscience vote (and in a few other very rare circumstances), thereby triggering a division. -

EVOLUTION OF THE ABORTION LAW AND ITS PRACTICE IN POLAND AGAINST THE BACKGROUND OF THE CURRENT LEGAL FRAMEWORK IN NEW ZEALAND Justyna Eska-Mikołajewska1 The article presents a comparative study on abortion legislation in Poland and New Zealand. It includes a historical overview of the social and political influenc- es shaping the contemporary approach to abortion in these countries. The aim of the article is to discuss the changes to the Polish and New Zealand abortion legislation and the current procedures required to access abortion. This article highlights differences in approaches to this issue in both countries where abortion laws have evolved recently in opposite directions. In New Zealand, after removing abortion from the Crimes Act 1961, abortion ceased to be the subject to criminal law, while in Poland where one of the strictest anti-abortion laws had been in force already, a ban was imposed on abortion which made it practically impossible for women to access legal abortions. -

They plan to treat NHPs as medicines and give the power to control them to the controversial Australian Therapeutic Goods Administration (TGA): We know from the Australian experience that this would mean; • Fewer Natural health products available - consumer choice reduced • Increased cost to consumers • Natural health products treated as drugs • Many NZ businesses forced to close - jobs lost • There will be little NZ can do to protect itself – Australia would make decisions for NZ The Australian TGA (which would take over NZ’s natural health industry) is known to use an extremely heavy-handed approach to supplements. Remember the Pan debacle? The TGA recalled 1200 natural products off the market on the strength of one manufacturer’s lax handling of quality control standards. “The truth is that of more than 1200 products recalled, NOT ONE of the natural health products was found to be at fault. It was only one pharmaceutical drug which was a problem”. Despite strong opposition from industry and a Parliamentary Select Committee report against the proposal, Annette King signed the Treaty with Australia on 10 December last year. But the battle is far from over. The Government still needs to have the treaty passed into law and for that it needs the support of the opposition parties. We can stop the Government’s TGA proposal especially if we are strong and united. The opposition party MP’s need to know the strength of public opposition.
