Das klingt ziemlich beängstigend. Trotzdem redet alle Welt von KI, und immer mehr Unternehmen setzen sie auch ein. Das ist die Zukunft, so heißt es zumindest. Doch was ist KI eigentlich? Gewiss nicht die dystopische Vision, die Hollywood in so vielen Filmen ausbreitet, von 2001: Odyssee im Weltraum über Blade Runner bis zu Terminator. Zumindest noch nicht. Die Antwort auf die Frage, was KI ist, dürfte wesentlich prosaischer sein: Auch bei KI tun Computer letztlich, was Computer eben tun: Sie führen Softwarecode aus, der mas- senweise Daten verschlingt und all diese Rohinformationen nach vorab festgelegten An- weisungen nutzt. Natürlich ist das Potenzial ehrfurchtgebietend. Ob Medizin, Wirtschaft, Verkehr oder Energie – die praktischen Einsatzmöglichkeiten von KI sind scheinbar grenzenlos. Doch wie jede andere technische Entwicklung ist sie nicht ohne Risiken. Ja, sie hat auch ihre Schattenseite, aber so dramatisch, wie Elon Musk uns glauben machen will, ist es wohl nicht. Zumindest noch nicht. In der audiovisuellen Industrie, wie auch in anderen Branchen, dürfte der zuneh- mende Einsatz von künstlicher Intelligenz einen Paradigmenwechsel einläuten, denn er kann die gesamte Wertschöpfungskette verändern: von der Inhaltsproduktion über Pro- grammgestaltung und Werbung bis – angesichts der Fülle von Angeboten und Geräten und der Personalisierung von Inhalten – zu den Erwartungen und Verhaltensweisen der Konsu- menten. Die Schattenseite ist jedoch, dass KI zur Verbreitung von Fake News beitragen kann. Und sie wirft Fragen auf, etwa nach dem Informationsrecht der Nutzerinnen und Nut- zer, nach Medienvielfalt und Medienpluralismus und nach dem Datenschutz, um nur einige wenige zu nennen. Im Anschluss an einen Workshop, den die Europäische Audiovisuelle Informations- stelle im Dezember 2019 organisiert hat, um die von KI ausgehenden Chancen und Heraus- forderungen im audiovisuellen Sektor, insbesondere im journalistischen Bereich und in der Filmwirtschaft, zu diskutieren, haben wir beschlossen, diesen Auswirkungen mit der Publi- kation des vorliegenden Berichts genauer nachzugehen. Weitere Informationen über die interessante Veranstaltung mit einer Zusammenfassung der Diskussionen und Links zu den Vorträgen der Teilnehmenden finden Sie hier: https://www.obs.coe.int/de/web/ observatoire/-/workshop-artificial-intelligence-in-the-audiovisual-industry- Dieser Bericht, den die juristische Abteilung der Europäischen Audiovisuellen Infor- mationsstelle während der schwierigen Lockdown-Monate konzipiert, gestaltet und koor- diniert hat, untersucht verschiedene Fragen, die eine Analyse aus regulatorischer Sicht er- fordern. Er gliedert sich in drei Teile. Der erste ist übergreifenden Themen gewidmet und beginnt mit Kapitel 1, das von IT-Spezialist Riccardo Guidotti (Universität Pisa) verfasst wurde. Er erklärt, was KI ist, und behandelt insbesondere deren Blackbox-Problem, also die Intransparenz ihrer Funktions- weisen und Entscheidungsprozesse, und die Frage, wie eine erklärbare KI ermöglicht wer- den könnte. Auf diese technische Einführung folgen zwei Überblickskapitel: In Kapitel 2 erklärt Andrea Pin (Universität Padua), welche regulatorischen Probleme sich aus der Sammlung und Nutzung des Stoffs ergeben, aus dem KI-Träume sind: Big Data. Kapitel 3, verfasst von Sarah Eskens (Universität Amsterdam), gibt einen Überblick über Fragen zu den Auswirkungen von KI auf die Meinungs- und Informationsfreiheit, etwa zum rechtlichen Rahmen für den KI-Einsatz bei den Medien und zu den Folgen für die Freiheit der Mei- nungsäußerung anderer. Der zweite Teil der Publikation stellt spezifische Bereiche des Medienrechts und der Medienpolitik vor, in denen KI künftig tiefgreifende Auswirkungen haben könnte. An erster Stelle steht die kulturelle Vielfalt im Zeitalter der Algorithmen. Mira Burri (Universität Lu- zern) befasst sich in Kapitel 4 damit, dass KI – von der Personalisierung von Nachrichten bis hin zu Empfehlungsalgorithmen bei Video-on-Demand-Diensten – den Schlüssel zu un- seren Informationsbedürfnissen und Unterhaltungswünschen zu haben scheint, welche Auswirkungen dies hat und ob Regulierungsbedarf besteht. Andere heikle Rechtsfragen be- handelt Giancarlo Frosio (Center for International Intellectual Property Studies an der Uni- versität Straßburg) in Kapitel 5: Steht Maschinen, die Werke „schaffen“, ein Urheberrecht zu? Oder kann eine natürliche oder juristische Person Inhaberin des Urheberrechts an einem Werk sein, das eine Maschine geschaffen hat? In Kapitel 6 erklärt Justina Raižytė (European Advertising Standards Alliance) die Fülle neuer Möglichkeiten, die KI Werbetreibenden er- öffnet, den theoretischen Komfortgewinn für die Kundschaft, aber auch die enormen Da- tenschutzprobleme, die KI aufwirft. In Kapitel 7 stellt Kelsey Farish (Anwaltskanzlei DAC Beachcroft LLP, London) verschiedene persönlichkeitsrechtliche Themen vor – Ghost Ac- ting, Persönlichkeitsrechte Lebender und Toter sowie Rechtsverletzungen (insbesondere Deepfakes). Im dritten Teil der Publikation stellt Atte Jääskeläinen (Technische Universität Lappeenranta und London School of Economics and Political Sciences) in Kapitel 8 die aus seiner Sicht wichtigsten regulatorischen Herausforderungen vor, die von KI für den audio- visuellen Sektor ausgehen. Im Mittelpunkt stehen dabei mögliche Regulierungsbereiche und potenzielle Risiken. Die einleitenden Texte und die Schlussbemerkungen, verfasst von Francisco Javier Cabrera Blázquez, Juristischer Analyst bei der Europäischen Audiovisuellen Informations- stelle, versuchen all diese verschiedenen rechtlichen und politischen Fragen einzuordnen.
