Tech legend sees SoMa - in Oakland October 12, 2012 By Blanca Torres Mitch Kapor and Freada Kapor Klein are investing in Oakland’s future. When famed technology titan and philanthropist Mitch Kapor looks at Oakland, he remembers South of Market in San Francisco the way it was in the late 1990s. Former industrial properties were being transformed into inexpensive spaces for both startup tech companies and residents. There was a buzz of innovation in the air. SoMa today is not the same place Kapor remembers, but Oakland could be. “Oakland in particular is the next great South of Market,” Kapor said. “It will be to this decade what South of Market was to the previous one. There’s lots of space, both to work and to live, lots of energy and lots of opportunity. People just sense potential.” With that belief in mind, Kapor and his wife, Freada Kapor Klein, moved the operations of Kapor Capital, Kapor Enterprises Inc., the Kapor Foundation and Level Playing Field Institute, a nonprofit, to Oakland’s Uptown neighborhood from a previous location in SoMa. Kapor made his name and fortune from Lotus Development Corp., maker of the Lotus 1-2-3 spreadsheet and Lotus Notes software applications. The Kapors, along with Oakland business and community leaders, see the move as much more than just physical. It could serve as a major endorsement for Oakland’s technology sector, which so far features a handful of big names — Pandora Media, Ask.com and Sungevity — but has yet to detonate. “Oakland is a welcoming environment for innovators and for people who cross boundaries because we’re not just doing tech, we’re doing tech with social impact,” Kapor said. -

Rusch* INTRODUCTION "I cannot remember a time," the novelist Robertson Davies wrote, "when I did not take it as understood that everybody has at least two, if not twenty-two, sides to him."' Davies' comment gives us a convenient point of departure to explore the relationship between law and cyberspace. Anyone who spends a significant amount of time on the Internet knows that the Net has at least two, if not twenty-two, sides to it. Auction sites, chat rooms, instant messaging, knowledge networks, and Net radio are but a few of the Internet's constantly expanding capabilities for communication, commerce, and social interaction. It seems remarkable, then, that at a time when we are seeking to understand and enhance a medium of such Protean charac- ter, so much of our thinking about the Internet has remained bound to-and bounded by-the same few metaphors that have dominated Internet culture over the past decade. No metaphor has been more pervasive in this regard than the concept of cyberspace as the "Wild West." BY BRUCE KOGUT * Introduction Uber Technologies, the privately held ride-sharing service and logistics platform, suffered a series of PR crises during 2017 that culminated in the resignation of Travis Kalanick, cofounder and longtime CEO. Kalanick was an acclaimed entrepreneur, building Uber from its local San Francisco roots to a worldwide enterprise in eight years, but he was also a habitual rule- breaker. 1 In an effort to put the recent past behind the company, the directors of Uber scheduled a board meeting for October 3, 2017, to vote on critical proposals from new CEO Dara Khosrowshahi that were focused essentially on one question: How should Uber be governed now that Kalanick had stepped down as CEO? Under Kalanick, Uber had grown to an estimated $69 billion in value by 2017, though plagued by scandal. The firm was accused of price gouging, false advertising, illegal operations, IP theft, sexual harassment cover-ups, and more.2 As Uber’s legal and PR turmoil increased, Kalanick was forced to resign as CEO, while retaining his directorship position on the nine- member board. His June 2017 resignation was hoped to calm the uproar, but it instead increased investor uncertainty. Some of the firm’s venture capital shareholders (VCs) marked down their Uber holdings by 15% (Vanguard, Principal Financial), while others raised the valuation by 10% (BlackRock).3 To restore Uber’s reputation and stabilize investor confidence, the board in August 2017 unanimously elected Dara Khosrowshahi as Uber’s next CEO. -

In fact, it may be hard to fathom, but there really was a time when electronic spreadsheets weren’t available. Back then, people relied instead on clumsy mainframes or calculators and spent hours doing what now takes minutes. It all started with VisiCalc The world’s first electronic spreadsheet, VisiCalc, was conjured up by Dan Bricklin and Bob Frankston back in 1978, when personal computers were pretty much unheard of in the office environment. VisiCalc was written for the Apple II computer, which was an interesting little machine that is something of a toy by today’s standards. (But in its day, the Apple II kept me mesmerized for days at aCOPYRIGHTED time.) VisiCalc essentially laid theMATERIAL foundation for future spreadsheets, and you can still find its row-and-column-based layout and formula syntax in modern spread- sheet products. VisiCalc caught on quickly, and many forward-looking companies purchased the Apple II for the sole purpose of developing their budgets with VisiCalc. Consequently, VisiCalc is often credited for much of the Apple II’s initial success. In the meantime, another class of personal computers was evolving; these PCs ran the CP/M operating system. Antonio Tajani MEP President of the European Parliament [email protected] 12 June 2018 Mr President, Article 13 of the EU Copyright Directive Threatens the Internet As a group of the Internet’s original architects and pioneers and their successors, we write to you as a matter of urgency about an imminent threat to the future of this global network. The European Commission’s proposal for Article 13 of the proposed Directive for Copyright in the Digital Single Market Directive was well-intended. As creators ourselves, we share the concern that there should be a fair distribution of revenues from the online use of copyright works, that benefits creators, publishers, and platforms alike. But Article 13 is not the right way to achieve this. By requiring Internet platforms to perform automatic filtering all of the content that their users upload, Article 13 takes an unprecedented step towards the transformation of the Internet from an open platform for sharing and innovation, into a tool for the automated surveillance and control of its users. Europe has been served well by the balanced liability model established under the Ecommerce Directive, under which those who upload content to the Internet bear the principal responsibility for its legality, while platforms are responsible to take action to remove such content once its illegality has been brought to their attention. By inverting this liability model and essentially making platforms directly responsible for ensuring the legality of content in the first instance, the business models and investments of platforms large and small will be impacted. The damage that this may do to the free and open Internet as we know it is hard to predict, but in our opinions could be substantial. -

Future of Leadership Corporate hindsight ofers insights. However, often too late, and often only after being dissected by every, invited and uninvited, self-acclaimed expert. It is too easy to pass judgement on past events, from the airport executive lounge a few years after mayhem, as a tech-savvy columnist, or as a case study writer decades after. Having corporate extinctions, a moonshot, or some other outlier spelled out in retrospect, while being interesting, only serves as a small tool in the real-time leadership toolbox. Quite often, these insights are transformed in to platitudes that might sound fantastic on social media, or in a key note, but represents little to no strategic value. Platitudes do not belong in a toolbox. Still, future leaders should seek insights from others; but it should be as “insights through conversation”. The art of it is to identify who should be part of that conversation. By conversation is not meant board meeting – but actual conversation. Many board meetings are still reserved for what could be phrased as “the boardroom boogie”. Every move is anticipated, rehearsed and pre-approved. What better way to spark an insightful and exploratory conversation than with a little help from a few questions? With the support from +100 leadership experts in Denmark and the United States, the key deliverable of this publication is a subset of 12 questions, for the board and C-suite to explore. The objective of the conversation, should not be to come up with immediate answers to the questions, it is more a “talk about the meaning of the question to us” type of conversation. -
