Final Amendments to the Distribution System Code

Note: The text of the final amendments is set out in italics below, for ease of identification only.

1. Section 1.7 of the DSC is amended to add the following at the end of the section:

Section 2.6.1A comes into force on December 31, 2016.

2. Section 2.4.6 of the Distribution System Code is amended by adding the following at the end of the list of items:

• The business practices the distributor uses to estimate bills where no metered consumption is available.

3. Section 2.6 of the Distribution System Code is amended by adding the following immediately after section 2.6.1:

2.6.1A A distributor shall issue a bill to each non-seasonal residential customer and each general service < 50kW customer on a monthly basis.

4. Section 2.10 will be added to the DSC immediately after section 2.9:

2.10 Estimated Billing

2.10.1 Where a smart meter or interval meter has been installed, a distributor shall issue a bill to a residential or general service < 50 kW customer based on an actual meter read.

2.10.2 Despite 2.10.1, to account for exceptional circumstances, a distributor may issue a bill to a residential or general service < 50kW customer with a smart meter or interval meter based on estimated consumption twice every 12 months.

5. Section 4.2 of the Distribution System Code is amended by adding the following immediately after section 4.2.6:

4.2.7 A distributor shall not disconnect a residential or general service < 50 kW customer with a smart meter or interval meter based solely on an estimated bill.

6. Section 7.1 of the Distribution System Code is amended by adding the following definition immediately before the definition of “answered”:

“accurate bill” means a bill that contains correct customer information, correct meter readings, and correct rates that result in an accurately calculated bill.

7. Section 7 of the Distribution System Code is amended by adding the following section immediately after section 7.10.2:

7.11 Billing Accuracy

7.11.1 A distributor must issue an accurate bill to each of its customers.

7.11.2 This service quality requirement must be met at least 98 percent of the time on a yearly basis.

7.11.3 A distributor should not include customer accounts that are unmetered accounts (e.g. street lighting and unmetered scattered loads) or power generation accounts when calculating the percentage of accurate bills.

7.11.4 The percentage of bills accurately issued shall be calculated by subtracting the number of inaccurate bills issued for the year from the total number of bills issued for the year and dividing that number by the total number of bills issued for the year.

7.11.5 The total number of bills issued for the year includes original and reissued bills.

7.11.6 Accurate bills that need to be cancelled in order to correct another bill shall not be included in the calculation of billing accuracy measure.

7.11.7 A bill is considered inaccurate if:

(a) the bill does not meet the definition of an accurate bill set out in section 7.1;

(b) the bill has been issued to the customer and subsequently cancelled due to a billing error; or

(c) there has been a billing adjustment in a subsequent bill as a result of a previous billing error.

Amending O. Reg. 203/94 (GENERAL)

1. Ontario Regulation 203/94 is amended by adding the following Part: PART I.1 ADMINISTERING SUBSTANCES BY INHALATION AND STANDARDS OF PRACTICE 5. (1) For the purposes of paragraph 4 of subsection 5 (1) and paragraph 5 of subsection 5 (2) of the Act, a member who complies with the standards of practice provided for in this section is authorized to administer the following designated substances to a patient by inhalation: 1. A gas mixture of up to 50 per cent nitrous oxide, with the balance of the mixture being oxygen. 2. Therapeutic oxygen. (2) A member shall only administer a designated substance described in paragraph 1 or 2 of subsection (1) if he or she complies with the following standards of practice: 1. The member shall only administer the designated substance to a patient for the purposes of, i. pain management during the performance of a procedure, or ii. controlling anxiety before or during the performance of a procedure. 2. The member must have, i. successfully completed a program approved by Council that includes a didactic and a clinical training component provided under the supervision of, A. a member of the College of Physicians and Surgeons of Ontario who is recognized by that College as a specialist in anaesthesia, B. a member of the Royal College of Dental Surgeons of Ontario who holds a specialty certificate of registration in dental anaesthesia, or C. any other person who is approved by Council, or ii. satisfied the Registration Committee that, A. the member’s education in chiropody or podiatry included a program equivalent to the program referred to in subparagraph i that was completed not more than five years before the day this Part came into force, or B. the member has safely administered the designated substance by inhalation to patients as part of his or her practice during the five-year period before the day this Part came into force. (3) Despite anything in this section, a member may administer therapeutic oxygen by inhalation to a patient in an emergency. (4) Despite anything in this section, a member may administer a designated substance described in paragraph 1 or 2 of subsection (1) to a patient by inhalation if the member does so, 467 872 THE ONTARIO GAZETTE/LA GAZETTE DE L’ONTARIO

(a) as part of a program described in subparagraph 2 i of subsection (2); and (b) while under the direct supervision of a member of the College of Physicians and Surgeons of Ontario who is recognized by the College to be a specialist in anaesthesia, a member of the Royal College of Dental Surgeons of Ontario holding a specialty certificate in dental anaesthesia, or any other person approved by Council.

Amending O. Reg. 209/94 (GENERAL)

1. Part III of Ontario Regulation 209/94 is revoked and the following substituted: PART III QUALITY ASSURANCE

General 6. In this Part, “assessor” means an assessor appointed under section 81 of the Health Professions Procedural Code; “Committee” means the Quality Assurance Committee and includes a panel of the Committee appointed under subsection 7 (2); “program” means the quality assurance program required by section 80 of the Health Professions Procedural Code; “stratified random sampling” means a sampling where groups are, (a) removed from the pool of members to be sampled, or (b) weighted to increase or decrease the likelihood of their being selected. 7. (1) The program shall include the following components: 1. Self-assessment. 2. Peer and practice assessment. 3. Continuing education and professional development designed to, i. promote continuing competence and continuing quality improvement among members, ii. address changes in practice environments, and iii. incorporate standards of practice, advances in technology, changes made in entry to practice competencies and other relevant issues in the discretion of the Council. 4. Mechanisms for the College to monitor members’ participation in, and compliance with, the program. (2) The Chair of the Committee may appoint a panel of the Committee composed of three persons, at least one of whom shall be a member of the Council appointed by the Lieutenant Governor in Council. (3) The Committee shall administer the program.

Self-Assessment 8. (1) The purposes of self-assessment are to assist members, (a) to identify the extent to which a member’s practice meets current standards; (b) to identify opportunities to improve a member’s knowledge, skill and judgment; and (c) to plan a member’s continuing education and professional development. (2) Every member shall participate in self-assessment in the manner approved by the Committee and fulfil any reporting requirements as directed by the Committee. (3) Every member shall retain records of his or her participation in self-assessment, in the form and manner required by the Committee, for a period of at least five years.

(4) At the request of the Committee, a member shall submit the records referred to in subsection (3) to the College within the time period specified in the request or, where no time period is specified, within 30 days after the day the member receives the request. (5) This section does not apply to a member who holds a Retired certificate of registration.

Peer and Practice Assessment 9. (1) Each year the Committee shall select members to undergo a peer and practice assessment to assess the members’ knowledge, skill and judgment. (2) A member shall undergo a peer and practice assessment if, (a) the member’s name is selected randomly from the entire membership; (b) the member’s name is selected by stratified random sampling; or (c) the member has failed to participate in self-assessment. (3) An assessor or assessors shall evaluate the member’s knowledge, skill and judgment by way of a peer and practice assessment, prepare a written report that may include recommendations and provide the report to the Committee and the member, along with a notice of the member’s right to make written submissions to the Committee. (4) The member may make written submissions to the Committee within 14 days from the date that he or she received the report. (5) If, after considering the report and the member’s submissions, if any, and giving the member an opportunity to confer with the Committee, the Committee may, (a) direct that no further action be taken; (b) take any action listed in subsection 80.2 (1) of the Health Professions Procedural Code if the Committee is of the opinion that the member’s knowledge, skill or judgment is unsatisfactory; (c) grant the member a specified period of time to address the recommendations in the report; or (d) direct that the member undergo a second peer and practice assessment. (6) If the Committee acts under clause (5) (c) or (d), subsections (3) and (4) and clauses (5) (a) and (b) apply, with any necessary modifications. (7) For greater certainty, the Committee shall not require a member to undergo a further peer and practice assessment under clause (5) (d) after the second assessment. (8) This section does not apply to a member who holds a Retired or Inactive certificate of registration.

Continuing Education and Professional Development 10. (1) Every member shall participate in continuing education and professional development activities in the manner approved by the Committee for the purpose of maintaining and enhancing the member’s knowledge, skill and judgment. (2) The College shall, in a timely manner, distribute information to the members about the requirements for continuing education and professional development activities approved by the Committee. (3) A member shall retain the records of his or her participation in continuing education and professional development activities for a period of at least five years. (4) At the request of the Committee, a member shall attest to the completion of their continuing education and professional development activities in the form and manner required by the Committee and provide the Committee with his or her records of the activities undertaken in the form and manner requested by the Committee. (5) This section does not apply to a member who holds a Retired certificate of registration.

A conviction for any offence. 2. A finding of professional misconduct, incompetency or incapacity, in Ontario in relation to another health profession or in another jurisdiction in relation to the profession or another health profession. 3. A proceeding for professional misconduct, incompetency or incapacity, in Ontario in relation to another health profession or in another jurisdiction in relation to the profession or another health profession. 4. A finding of professional negligence or malpractice in any jurisdiction. 5. A proceeding in any jurisdiction in which the member is alleged to have committed professional negligence or malpractice that is in relation to the practice of a health profession.

Certificates of Registration for a Psychologist Authorizing Autonomous Practice Certificates of registration for a psychologist authorizing autonomous practice 5. (1) Subject to subsections (2) to (6), to qualify for a certificate of registration for a psychologist authorizing autonomous practice, an applicant must comply with the following non-exemptible registration requirements: 1. The applicant must have obtained a doctoral degree, i. from a psychology program that is accredited by the Canadian Psychological Association or by another accrediting body that has been approved by Council for that purpose, ii. from a psychology program that is considered by a panel of the Registration Committee to be equivalent to a program described in subparagraph i, or iii. from a psychology program that is offered by an educational institution outside of Canada or the United States of America and that is considered by a panel of the Registration Committee to be substantially similar to a program described in subparagraph i. 2. The applicant must have completed a minimum of 1,500 hours of postdoctoral supervised practice approved by the Registrar or a panel of the Registration Committee and performed while being a member holding a certificate of registration for a psychologist authorizing supervised practice and while under the supervision of a member who meets the requirements in subsection 12 (3). 3. The applicant must have passed the Examination for Professional Practice in Psychology administered by the Association of State and Provincial Psychology Boards or one or more other examinations of knowledge or competence set or approved by the Council or by a body that is approved by the Council for that purpose. 4. The applicant must have passed the oral examination set or approved by the Council. 5. The applicant must have passed the Jurisprudence and Ethics Examination set or approved by Council. 6. The applicant must have completed all further professional training or experience that, in the opinion of a panel of the Registration Committee, is required to ensure the competence of the applicant for autonomous practice as a psychologist in his or her intended area of practice. (2) An applicant who has obtained a doctoral degree from a psychology program described in subparagraph 1 iii of subsection (1) shall not be considered to have met the requirements of paragraph 1 of subsection (1) unless the applicant has successfully completed such further assessment, training or supervised experience, if any, which in the opinion of a panel of the Registration Committee is required to ensure that the applicant has competencies equivalent to those of an applicant who has obtained a doctoral degree from a program described in subparagraph 1 i of subsection (1). (3) An applicant who, at the time of application, is registered or licensed to practise in a jurisdiction outside of Canada is not required to meet the requirements in paragraphs 1, 2, 3, 4 and 6 of subsection (1) if the following requirements are met: 1. The applicant must be registered as a psychologist in good standing in a jurisdiction, i. with which the College has a reciprocity agreement as of the date of the application, or ii. that is considered by a panel of the Registration Committee to have registration requirements equivalent to those of the College for the issuance of a certificate of registration for a psychologist authorizing autonomous practice. 2. The applicant must have attended an interview conducted by a panel of interviewers appointed by the Registrar and been assessed by that panel as being competent to practise in the area of the profession that he or she intends to practise in. 3. Where the applicant is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychologist authorizing autonomous practice at any time during the 24-month period preceding his or her application, the applicant must meet any further requirement to undertake, obtain or undergo any additional training, experience, examinations or assessments that, in the opinion of a panel of the Registration Committee, is required to ensure the competence of the applicant for autonomous practice as a psychologist in his or her intended area of practice. (4) Where an applicant is a member in good standing holding an Academic certificate of registration, the Registrar shall issue that member a certificate of registration for a psychologist authorizing autonomous practice if the member, (a) was, at the time of being issued his or her Academic certificate of registration, a member holding a certificate of registration for a psychologist authorizing autonomous practice; (b) applies in writing to the Registrar for a certificate of registration for a psychologist authorizing autonomous practice not less than 60 days before the applicant proposes to start practising as a member holding a certificate of registration for a psychologist authorizing autonomous practice; and

(c) has satisfied the conditions, if any, imposed by a panel of the Registration Committee which in the opinion of the panel are required to ensure current competence in the proposed practice areas. (5) Where an applicant is a member in good standing holding an Inactive certificate of registration, the Registrar shall issue that member a certificate of registration for a psychologist authorizing autonomous practice if the member, (a) was, at the time of being issued his or her Inactive certificate of registration, a member holding a certificate of registration for a psychologist authorizing autonomous practice; (b) applies in writing to the Registrar for a certificate of registration for a psychologist authorizing autonomous practice not less than 60 days before the applicant proposes to start practising as a member holding a certificate of registration for a psychologist authorizing autonomous practice; and (c) has satisfied the conditions, if any, imposed by a panel of the Registration Committee which in the opinion of the panel are required to ensure current competence in the proposed practice areas. (6) Where an applicant is a member in good standing holding a Retired certificate of registration, the Registrar shall issue that member a certificate of registration for a psychologist authorizing autonomous practice if the member, (a) was, at the time of being issued his or her Retired certificate of registration, a member holding a certificate of registration for a psychologist authorizing autonomous practice; (b) applies in writing to the Registrar for a certificate of registration for a psychologist authorizing autonomous practice no more than 24 months after the member was issued a Retired certificate of registration and not less than 60 days before the applicant proposes to start practising as a member holding a certificate of registration for a psychologist authorizing autonomous practice; and (c) has satisfied the conditions, if any, imposed by a panel of the Registration Committee which in the opinion of the panel are required to ensure current competence in the proposed practice areas. Labour mobility 6. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration for a psychologist authorizing autonomous practice, the applicant is deemed to have met the requirements set out in paragraphs 1, 2, 3, 4 and 6 of subsection 5 (1) of this Regulation. (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychologist in every jurisdiction where the applicant holds an out-of-province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychologist authorizing autonomous practice at any time in the two years immediately before the date of the applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee. (4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 7. It is a term, condition and limitation of every certificate of registration for a psychologist authorizing autonomous practice that the member shall practise the profession only within, (a) practice areas of the profession that are authorized for that member by the Registrar or a panel of the Registration Committee; or (b) other practice areas where the member’s practice is performed under the supervision of a member who is authorized by the Registrar or a panel of the Registration Committee to practise in the relevant practice areas and who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice.

Certificates of Registration for a Psychologist Authorizing Interim Autonomous Practice Certificates of registration for a psychologist authorizing interim autonomous practice 8. To qualify for a certificate of registration for a psychologist authorizing interim autonomous practice, it is a non- exemptible requirement that the applicant be registered as a psychologist in good standing in a jurisdiction,

(a) with which the College has a written reciprocity agreement as of the date of the applicant’s application; or (b) that is considered by a panel of the Registration Committee to have registration requirements equivalent to those of the College for a certificate of registration for a psychologist authorizing autonomous practice. Labour mobility 9. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration for a psychologist authorizing interim autonomous practice, the applicant is deemed to have met the requirements set out in section 8 of this Regulation. (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychologist in every jurisdiction where the applicant holds an out-of-province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychologist authorizing interim autonomous practice at any time in the two years immediately before the date of the applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee. (4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 10. It is a term, condition and limitation of every certificate of registration for a psychologist authorizing interim autonomous practice that the member shall practise the profession only within, (a) practice areas of the profession that are authorized for the member by the Registrar or a panel of the Registration Committee; or (b) other practice areas where the member’s practice is performed under the supervision of a member who is authorized by the Registrar or a panel of the Registration Committee to practise in the relevant practice areas and who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice. Expiry 11. A certificate of registration for a psychologist authorizing interim autonomous practice expires 12 months after the date on which it was issued.

Certificates of Registration for a Psychologist Authorizing Supervised Practice Certificates of registration for a psychologist authorizing supervised practice 12. (1) To qualify for a certificate of registration for a psychologist authorizing supervised practice, an applicant must comply with the following non-exemptible registration requirements: 1. The applicant must have obtained a doctoral degree, i. from a psychology program that is accredited by the Canadian Psychological Association or by another accrediting body that has been approved by Council for that purpose, ii. from a psychology program that is considered by a panel of the Registration Committee to be equivalent to a program described in subparagraph i, or iii. from a psychology program that is offered by an educational institution outside of Canada or the United States of America and that is considered by a panel of the Registration Committee to be substantially similar to a program described in subparagraph i. 2. The applicant must provide to the College a signed undertaking from two supervisors in which the supervisors undertake to train the proposed member and supervise and evaluate the proposed member’s practice and to provide reports in the form and manner as specified by the Registrar or a panel of the Registration Committee. (2) An applicant who has obtained a doctoral degree from a psychology program described in subparagraph 1 iii of subsection (1) shall not be considered to have met the requirements of paragraph 1 of subsection (1) unless the applicant has successfully completed such further assessment, training or supervised experience, if any, which in the opinion of a panel of

the Registration Committee is required to ensure that the applicant has competencies equivalent to those of an applicant who has obtained a doctoral degree from a program described in subparagraph 1 i of subsection (1). (3) A signed undertaking shall not be considered as satisfying the requirement in paragraph 2 of subsection (1) unless each proposed supervisor who signed the undertaking met all of the following requirements: 1. He or she must be a member holding either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice. 2. His or her certificate of registration must not be subject to any term, condition or limitation that was imposed as a result of a disciplinary proceeding or a fitness to practise proceeding. 3. He or she must not be the subject of any ongoing disciplinary proceeding or fitness to practise proceeding. 4. He or she must be authorized by the Registrar or a panel of the Registration Committee to practise in the same practice areas and with the same client groups as those of the individual who is to be under his or her supervision. Labour mobility 13. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration for a psychologist authorizing supervised practice, the applicant is deemed to have met the requirements set out in paragraph 1 of subsection 12 (1) of this Regulation. (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychologist in every jurisdiction where the applicant holds an out-of-province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychologist authorizing supervised practice at any time in the two years immediately before the date of the applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee. (4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 14. It is a term, condition and limitation of every certificate of registration for a psychologist authorizing supervised practice that the member shall practise the profession only under the supervision of a supervisor who is approved for that purpose by the Registrar or a panel of the Registration Committee. Expiry 15. A certificate of registration for a psychologist authorizing supervised practice expires on the date set outonthe certificate, which date shall be no earlier than 12 months after the date the certificate of registration was issued and no more than 24 months after the date the certificate of registration was issued.

Certificates of Registration for a Psychological Associate Authorizing Autonomous Practice Certificates of registration for a psychological associate authorizing autonomous practice 16. (1) Subject to subsections (2) to (8), to qualify for a certificate of registration for a psychological associate authorizing autonomous practice, an applicant must comply with the following non-exemptible registration requirements: 1. The applicant must have obtained a master’s degree from a psychology program which, i. is offered at an institution that is, A. a Canadian institution that is legally authorized to grant the degree, B. an institution in the United States of America that is accredited, 1. by an accrediting body recognized by the United States Secretary of Education as a reliable authority concerning the quality of education or training offered by institutions of higher learning, or 2. by another accrediting body approved by Council, or C. an institution that is based in a country other than Canada or the United States of America that is considered to be equivalent to an institution described in sub-subparagraph A,

1. by a foreign credential evaluation service that is a member of the National Association of Credential Evaluation Services, or 2. by another foreign credential evaluation service approved by Council, ii. requires as a prerequisite for admission to the program that the applicant have taken a minimum of 576 hours of undergraduate instruction in psychology, and iii. includes, A. at least 36 hours of instruction in each of the areas of, 1. psychological assessment, 2. psychological intervention, 3. professional ethics and standards for psychology, 4. research design, methodology and statistics, 5. biological bases of behaviour, 6. social bases of behaviour, 7. cognitive-affective bases of behaviour, and 8. psychology of the individual, B. a supervised psychology practicum or psychology internship, and C. at least one academic year of full-time resident graduate study and training or the equivalent in part-time resident graduate study and training. 2. Following the awarding of the degree described in paragraph 1, the applicant must have performed at least 6,000 hours of practice of the profession over at least four years while under the supervision of a member holding either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice. 3. The applicant must have performed, while being a member holding a certificate of registration for a psychological associate authorizing supervised practice, at least 1,500 hours of practice of the profession while under the supervision of a member who meets the requirements in subsection 23 (2). 4. The applicant must have passed the Examination for Professional Practice in Psychology administered by the Association of State and Provincial Psychology Boards or one or more other examinations of knowledge or competence set or approved by the Council or by a body that is approved by the Council for that purpose. 5. The applicant must have passed the oral examination set or approved by the Council. 6. The applicant must have passed the Jurisprudence and Ethics Examination set or approved by Council. 7. The applicant must have completed all further professional training or experience that in the opinion of a panel of the Registration Committee is required to ensure the competence of the applicant for autonomous practice as a psychological associate in his or her intended area of practice. (2) An institution shall only be considered as meeting the requirements of sub-subparagraph 1 i C of subsection (1) where the degree has been evaluated by the foreign credential evaluation service referred to in that sub-subparagraph as being equivalent in level to a master’s degree offered at a university in Canada. (3) Where an applicant has a master’s degree from a psychology program that meets the requirements in subparagraphs 1 i and ii of subsection (1), but that does not meet the requirements set out in subparagraph 1 iii of that subsection, the applicant shall be considered to have met the requirements in subparagraph 1 iii of that subsection if, (a) the program is considered by a panel of the Registration Committee to be substantially similar, but not equivalent, to a program that meets the requirements; and (b) the applicant successfully completes the additional education or training, if any, that is specified by a panel of the Registration Committee. (4) It is sufficient compliance with subparagraph 1 iii of subsection (1) if the hours of instruction described in sub-sub- subparagraphs A 5 to 8 of that subparagraph are taken, in whole or in part, at an undergraduate level beyond that of a first-year course. (5) Where, at the time of application, an applicant is registered or licensed to practise in a jurisdiction outside of Canada, he or she does not have to meet the requirements in paragraphs 1, 2, 3, 4, 5 and 7 of subsection (1) if the following requirements are met:

1. The applicant must be registered as a psychological associate in good standing in a jurisdiction, i. with which the College has a reciprocity agreement as of the date of the applicant’s application, or ii. that is considered by a panel of the Registration Committee to have registration requirements equivalent to those of the College for the issuance of a certificate of registration for a psychological associate authorizing autonomous practice. 2. The applicant must have attended an interview conducted by a panel of interviewers appointed by the Registrar and been assessed by that panel as being competent to practise in the area of the profession that he or she intends to practise in. 3. Where the applicant is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychological associate authorizing autonomous practice at any time during the 24-month period preceding his or her application, the applicant must meet any further requirement to undertake, obtain or undergo any additional training, experience, examinations or assessments that, in the opinion of a panel of the Registration Committee, is required to ensure the competence of the applicant for autonomous practice as a psychological associate in his or her intended area of practice. (6) Where an applicant is a member in good standing holding an Academic certificate of registration, the Registrar shall issue that member a certificate of registration for a psychological associate authorizing autonomous practice if the member, (a) was, at the time of being issued his or her Academic certificate of registration, a member holding a certificate of registration for a psychological associate authorizing autonomous practice; (b) applies in writing to the Registrar for a certificate of registration for a psychological associate authorizing autonomous practice not less than 60 days before the applicant proposes to begin practising as member holding a certificate of registration for a psychological associate authorizing autonomous practice; and (c) has satisfied the conditions, if any, imposed by a panel of the Registration Committee which in the opinion of the panel are required to ensure current competence in the proposed practice areas. (7) Where an applicant is a member in good standing holding an Inactive certificate of registration, the Registrar shall issue that member a certificate of registration for a psychological associate authorizing autonomous practice if the member, (a) was, at the time of being issued his or her Inactive certificate of registration, a member holding a certificate of registration for a psychological associate authorizing autonomous practice; (b) applies in writing to the Registrar for a certificate of registration for a psychological associate authorizing autonomous practice not less than 60 days before the applicant proposes to start practising as a member holding a certificate of registration for a psychological associate authorizing autonomous practice; and (c) has satisfied the conditions, if any, imposed by a panel of the Registration Committee which in the opinion of the panel are required to ensure current competence in the proposed practice areas. (8) Where an applicant is a member in good standing holding a Retired certificate of registration, the Registrar shall issue that member a certificate of registration for a psychological associate authorizing autonomous practice if the member, (a) was, at the time of being issued his or her Retired certificate of registration, a member holding a certificate of registration for a psychological associate authorizing autonomous practice; (b) applies in writing to the Registrar for a certificate of registration for a psychological associate authorizing autonomous practice no more than 24 months after the member was issued a Retired certificate of registration and not less than 60 days before the applicant proposes to start practising as a member holding a certificate of registration for a psychological associate authorizing autonomous practice; and (c) has satisfied the conditions imposed by a panel of the Registration Committee which in the opinion of the panel are required to ensure current competence in the proposed practice areas. Labour mobility 17. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration for a psychological associate authorizing autonomous practice, the applicant is deemed to have met the requirements set out in paragraphs 1, 2, 3, 4, 5 and 7 of subsection 16 (1). (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychological associate in every jurisdiction where the applicant holds an out-of- province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of

(4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 18. It is a term, condition and limitation of every certificate of registration for a psychological associate authorizing autonomous practice that the member shall practise the profession only within, (a) practice areas of the profession that are authorized for that member by the Registrar or a panel of the Registration Committee; or (b) other practice areas where the member’s practice is performed under the supervision of a member who is authorized by the Registrar or a panel of the Registration Committee to practise in the relevant practice areas and who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice.

Certificates of Registration for a Psychological Associate Authorizing Interim Autonomous Practice Certificates of registration for a psychological associate authorizing interim autonomous practice 19. To qualify for a certificate of registration for a psychological associate authorizing interim autonomous practice, it is a non-exemptible requirement that the applicant be registered as a psychological associate in good standing in a jurisdiction, (a) with which the College has a written reciprocity agreement as of the date of the applicant’s application; or (b) that is considered by a panel of the Registration Committee to have requirements equivalent to those of the College for a certificate of registration for a psychological associate authorizing autonomous practice. Labour mobility 20. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration for a psychological associate authorizing interim autonomous practice, the applicant is deemed to have met the requirements set out in section 19 of this Regulation. (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychological associate in every jurisdiction where the applicant holds an out-of- province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychological associate authorizing interim autonomous practice at any time in the two years immediately before the date of the applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee. (4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 21. It is a term, condition and limitation of every certificate of registration for a psychological associate authorizing interim autonomous practice that the member shall practise the profession only within, (a) practice areas of the profession that are authorized for that member by the Registrar or a panel of the Registration Committee; or (b) other practice areas where the member’s practice is performed under the supervision of a member who is authorized by the Registrar or by a panel of the Registration Committee to practise in the relevant practice areas and who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice.

Expiry 22. A certificate of registration for a psychological associate authorizing interim autonomous practice expires 12 months after the date on which it was issued.

Certificates of Registration for a Psychological Associate Authorizing Supervised Practice Certificates of registration for a psychological associate authorizing supervised practice 23. (1) To qualify for a certificate of registration for a psychological associate authorizing supervised practice, an applicant must comply with one of the following non-exemptible registration requirements: 1. Meeting the requirements in paragraphs 1 and 2 of subsection 16 (1). 2. Having provided to the College a signed undertaking from two supervisors in which the supervisors undertake to train the proposed member and supervise and evaluate the proposed member’s practice and to provide reports in the form and manner as specified by the Registrar or a panel of the Registration Committee. (2) A signed undertaking shall not be considered as satisfying the requirement in paragraph 2 of subsection (1) unless each proposed supervisor who signed the undertaking met all of the following requirements: 1. He or she must be a member holding either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice. 2. His or her certificate of registration must not be subject to any term, condition or limitation that was imposed as a result of a disciplinary proceeding or a fitness to practise proceeding. 3. He or she must not be the subject of any ongoing disciplinary or fitness to practise proceeding. 4. He or she must be authorized by the Registrar or a panel of the Registration Committee to practise in the same practice areas and with the same client groups as those of the individual who is to be under his or her supervision. Labour mobility 24. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration for a psychological associate authorizing supervised practice, the applicant is deemed to have met the requirements set out in paragraph 1 of subsection 23 (1) of this Regulation. (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychologist in every jurisdiction where the applicant holds an out-of-province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration for a psychological associate authorizing supervised practice at any time in the two years immediately before the date of the applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee. (4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 25. It is a term, condition and limitation of every certificate of registration for a psychological associate authorizing supervised practice that the member shall practise the profession only under the supervision of a supervisor who is approved for that purpose by the Registrar or a panel of the Registration Committee. Expiry 26. A certificate of registration for a psychological associate authorizing supervised practice expires on the date set out on the certificate which date shall be no earlier than 12 months after the date the certificate of registration was issued and no more than 24 months after the date the certificate of registration was issued.

Academic Class of Certificates of Registration Academic class of certificates of registration 27. To qualify for an Academic certificate of registration, an applicant must comply with the following non-exemptible registration requirements: 1. The applicant must occupy a full-time or regular academic position on the faculty of an Ontario university.

2. The applicant must be a member in good standing who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice and, i. whose certificate of registration is not subject to any term, condition or limitation that was imposed as a result of a disciplinary proceeding or a fitness to practise proceeding, ii. who is not in default of any obligation to the College, including payment of the annual membership fee, and iii. who is not the subject of any ongoing disciplinary or fitness to practise proceeding. Labour mobility 28. (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for an Academic certificate of registration, the applicant is deemed to have met the requirements set out in paragraph 2 of section 27 of this Regulation. (2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychologist in every jurisdiction where the applicant holds an out-of-province certificate. (3) If an applicant to whom subsection (1) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by an Academic certificate of registration at any time in the two years immediately before the date of the applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee. (4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 2 of section 3 if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph. (5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code. Terms, conditions and limitations 29. It is a term, condition and limitation of every Academic certificate of registration that the member not provide intervention, assessment or consultation services to individual clients, groups of clients, or organizations and not supervise persons in providing those services.

Inactive Class of Certificates of Registration Inactive class of certificates of registration 30. To qualify for an Inactive certificate of registration, an applicant must comply with the following non-exemptible registration requirements: 1. The applicant must submit his or her application to the Registrar not less than 60 days before the applicant intends to cease practising the profession. 2. The applicant must be a member in good standing who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice and, i. whose certificate of registration is not subject to any term, condition or limitation that was imposed as a result of a disciplinary proceeding or a fitness to practise proceeding, ii. who is not in default of any obligation to the College, including payment of the annual membership fee, and iii. who is not the subject of any ongoing disciplinary or fitness to practise proceeding. Terms, conditions and limitations 31. It is a term, condition and limitation of every Inactive certificate of registration that the member shall not practise the profession.

Retired Class of Certificates of Registration Retired class of certificates of registration 32. To qualify for a Retired certificate of registration, an applicant must comply with the following non-exemptible registration requirements: 1. The applicant must submit his or her application to the Registrar not less than 60 days before the applicant intends to cease practising the profession.

2. The applicant must be a member in good standing who holds either a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice and, i. whose certificate of registration is not subject to any term, condition or limitation that was imposed as a result of a disciplinary proceeding or a fitness to practise proceeding, ii. who is not in default of any obligation to the College, including payment of the annual membership fee, and iii. who is not the subject of any ongoing disciplinary or fitness to practise proceeding. Terms, conditions and limitations 33. It is a term, condition and limitation of every Retired certificate of registration that the member shall not practise the profession.

Expiry, Reinstatement, etc. Expiry on issuance of new certificate 34. A person’s certificate of registration expires immediately if the Registrar issues another certificate of registration to the person. Reinstatement 35. If the Registrar suspends a member’s certificate of registration pursuant to section 24 of the Health Professions Procedural Code for failure to pay a fee, the Registrar may lift the suspension within two years from the date of suspension on the payment of, (a) the fee the member failed to pay; and (b) all applicable fees and penalties required under the by-laws.

Transition Transition 36. (1) Every certificate of registration that was in existence immediately before April 7, 2015 is continued asthe equivalent certificate of registration with the same status under this Regulation until such time as it otherwise ceases to be effective and, for greater certainty, (a) every certificate of registration subject to a limitation of academic status is continued as an Academic certificate of registration; (b) every certificate of registration subject to a limitation of inactive status is continued as an Inactive certificateof registration; and (c) every certificate of registration subject to a limitation of retired status is continued as a Retired certificate of registration. (2) Where an application for a certificate of registration had been made but not finally dealt with before April 7, 2015, the application shall be dealt with in accordance with this Regulation.

Revocation and Commencement Revocation 37. Ontario Regulation 533/98 is revoked.

Quiconque peut demander la délivrance d’un certificat d’inscription en présentant une demande à cet effet au registrateur et en y joignant les droits d’inscription qu’exigent les règlements administratifs. Exigences : délivrance d’un certificat d’inscription 3. La délivrance d’un certificat d’inscription est subordonnée aux exigences suivantes en matière d’inscription : 1. L’auteur de la demande fournit le détail des renseignements suivants le concernant : i. Toute déclaration de culpabilité pour une infraction criminelle ou une infraction se rapportant à la réglementation de l’exercice de la profession. ii. Toute constatation de faute professionnelle, d’incompétence ou d’incapacité faite en Ontario et se rapportant à une autre profession de la santé ou faite dans un autre territoire et se rapportant à la profession ou à une autre profession de la santé. iii. Toute instance pour cause de faute professionnelle, d’incompétence ou d’incapacité en cours en Ontario et se rapportant à une autre profession de la santé ou en cours dans un autre territoire et se rapportant à la profession ou à une autre profession de la santé. 2. L’auteur de la demande est capable de parler et d’écrire le français ou l’anglais avec une aisance raisonnable. 3. L’auteur de la demande est citoyen canadien ou résident permanent du Canada ou est autorisé, en vertu de la Loi sur l’immigration et la protection des réfugiés (Canada), à exercer la profession. Conditions et restrictions : tout certificat 4. Tout certificat d’inscription est assorti de la condition selon laquelle le membre fournit à l’Ordre le détail des faits suivants le concernant qui se produisent ou qui surviennent après son inscription : 1. Toute déclaration de culpabilité pour une infraction quelconque. 2. Toute constatation de faute professionnelle, d’incompétence ou d’incapacité faite en Ontario et se rapportant à une autre profession de la santé ou faite dans un autre territoire et se rapportant à la profession ou à une autre profession de la santé. 3. Toute instance pour cause de faute professionnelle, d’incompétence ou d’incapacité en cours en Ontario et se rapportant à une autre profession de la santé ou en cours dans un autre territoire et se rapportant à la profession ou à une autre profession de la santé. 4. Toute constatation de négligence ou faute professionnelle faite dans quelque territoire que ce soit.

5. Toute instance dans quelque territoire que ce soit et dans le cadre de laquelle il est allégué que le membre a commis une négligence ou faute professionnelle se rapportant à l’exercice d’une profession de la santé.

Certificats d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie Certificats d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie 5. (1) Sous réserve des paragraphes (2) à (6), l’auteur d’une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie ne peut se soustraire aux exigences suivantes en matière d’inscription : 1. Détenir un doctorat décerné, selon le cas : i. au terme d’un programme en psychologie agréé par la Société canadienne de psychologie ou par un autre organisme d’agrément approuvé par le conseil à cette fin, ii. au terme d’un programme en psychologie qu’un sous-comité du comité d’inscription juge équivalent à un programme visé à la sous-disposition i, iii. au terme d’un programme en psychologie offert par un établissement d’enseignement à l’extérieur du Canada ou des États-Unis d’Amérique qu’un sous-comité du comité d’inscription juge essentiellement semblable à un programme visé à la sous-disposition i. 2. Avoir exercé la profession sous supervision au niveau postdoctoral pendant au moins 1 500 heures, approuvées par le registrateur ou un sous-comité du comité d’inscription et effectuées pendant que, d’une part, il était un membre titulaire d’un certificat d’inscription à titre de psychologue autorisant l’exercice de la psychologie sous supervision et que, d’autre part, cette supervision était exercée par un membre satisfaisant aux exigences du paragraphe 12 (3). 3. Avoir réussi l’examen de pratique professionnelle en psychologie administré par l’Association of State and Provincial Psychology Boards ou un ou plusieurs autres examens des connaissances ou de la compétence établis ou approuvés par le conseil ou par un organisme approuvé par le conseil à cette fin. 4. Avoir réussi l’examen oral établi ou approuvé par le conseil. 5. Avoir réussi l’examen sur la jurisprudence et la déontologie établi ou approuvé par le conseil. 6. Avoir terminé tous les cours de formation professionnelle supplémentaires ou acquis toute l’expérience supplémentaire qui, de l’avis d’un sous-comité du comité d’inscription, sont nécessaires en vue de s’assurer qu’il possède les compétences pour exercer la profession de psychologue de façon autonome dans le domaine dans lequel il entend l’exercer. (2) L’auteur d’une demande qui détient un doctorat décerné au terme d’un programme en psychologie visé à la sous- disposition 1 iii du paragraphe (1) ne doit être considéré comme ayant satisfait aux exigences de la disposition 1 du paragraphe (1) que s’il a réussi les évaluations ou les cours de formation supplémentaires ou acquis l’expérience supervisée supplémentaire, le cas échéant, qui, de l’avis d’un sous-comité du comité d’inscription, sont nécessaires en vue de s’assurer qu’il possède des compétences équivalentes à celles de l’auteur d’une demande détenant un doctorat décerné au terme d’un programme visé à la sous-disposition 1 i du paragraphe (1). (3) L’auteur d’une demande qui, au moment de présenter sa demande, est inscrit ou autorisé à exercer la profession dans un territoire à l’extérieur du Canada n’est pas tenu de satisfaire aux exigences des dispositions 1, 2, 3, 4 et 6 du paragraphe (1) s’il satisfait aux exigences suivantes : 1. Être inscrit à titre de psychologue en règle dans un territoire, selon le cas : i. avec lequel l’Ordre maintient une entente de réciprocité à la date de la présentation de sa demande, ii. considéré par un sous-comité du comité d’inscription comme ayant des exigences en matière d’inscription équivalentes à celles de l’Ordre en ce qui concerne la délivrance de certificats d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie. 2. Avoir participé à une entrevue réalisée par un sous-comité d’examinateurs nommés par le registrateur et avoir été considéré par ce sous-comité comme possédant les compétences pour exercer la profession de psychologue dans le domaine dans lequel il entend l’exercer. 3. Satisfaire, si l’auteur de la demande est incapable de convaincre le registrateur ou un sous-comité du comité d’inscription qu’il a exercé, à un moment donné au cours de la période de 24 mois précédant la date de sa demande, la profession de psychologue dans la mesure où le permettrait un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, aux exigences supplémentaires en matière de formation, d’expérience, d’examens ou d’évaluations qui, de l’avis d’un tel sous-comité, sont nécessaires pour s’assurer qu’il possède les compétences pour exercer la profession de psychologue de façon autonome dans le domaine dans lequel il entend l’exercer.

(4) Si l’auteur d’une demande est un membre en règle titulaire d’un certificat d’inscription autorisant l’exercice de la psychologie en milieu universitaire, le registrateur lui délivre un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie s’il satisfait aux exigences suivantes : a) avoir été, au moment de la délivrance de son certificat d’inscription autorisant l’exercice de la psychologie en milieu universitaire, un membre titulaire d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie; b) présenter au registrateur, par écrit, une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie au moins 60 jours avant la date à laquelle il se propose de commencer à exercer la profession de psychologue à titre de membre titulaire d’un tel certificat; c) remplir les conditions qu’impose un sous-comité du comité d’inscription qui, de l’avis de ce sous-comité, sont nécessaires pour s’assurer qu’il possède des compétences à jour pour exercer la profession de psychologue dans les domaines dans lesquels il se propose de l’exercer. (5) Si l’auteur d’une demande est un membre en règle titulaire d’un certificat d’inscription à titre de membre inactif, le registrateur lui délivre un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie s’il satisfait aux exigences suivantes : a) avoir été, au moment de la délivrance de son certificat d’inscription à titre de membre inactif, un membre titulaire d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie; b) présenter au registrateur, par écrit, une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie au moins 60 jours avant la date à laquelle il se propose de commencer à exercer la profession de psychologue à titre de membre titulaire d’un tel certificat; c) remplir les conditions qu’impose un sous-comité du comité d’inscription qui, de l’avis de ce sous-comité, sont nécessaires pour s’assurer qu’il possède des compétences à jour pour exercer la profession de psychologue dans les domaines dans lesquels il se propose de l’exercer. (6) Si l’auteur d’une demande est un membre en règle titulaire d’un certificat d’inscription à titre de membre à la retraite, le registrateur lui délivre un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie s’il satisfait aux exigences suivantes : a) avoir été, au moment de la délivrance de son certificat d’inscription à titre de membre à la retraite, un membre titulaire d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie; b) présenter au registrateur, par écrit, une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie au plus tard 24 mois après la délivrance de son certificat d’inscription à titre de membre à la retraite et au moins 60 jours avant la date à laquelle il se propose de commencer à exercer la profession de psychologue à titre de membre titulaire d’un tel certificat; c) remplir les conditions qu’impose un sous-comité du comité d’inscription qui, de l’avis de ce sous-comité, sont nécessaires pour s’assurer qu’il possède des compétences à jour pour exercer la profession de psychologue dans les domaines dans lesquels il se propose de l’exercer. Mobilité de la main-d’oeuvre 6. (1) L’auteur d’une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie visé par l’article 22.18 du Code des professions de la santé est réputé avoir satisfait aux exigences des dispositions 1, 2, 3, 4 et 6 du paragraphe 5 (1) du présent règlement. (2) L’auteur d’une demande visé au paragraphe (1) ne peut se soustraire à l’exigence en matière d’inscription voulant qu’il fournisse un ou plusieurs certificats ou une ou plusieurs lettres, ou encore une autre preuve que le registrateur ou un sous- comité du comité d’inscription juge satisfaisante, qui confirment qu’il est un psychologue en règle dans chaque territoire dont il détient un certificat extraprovincial. (4) L’auteur d’une demande visé au paragraphe (1) est réputé avoir satisfait à l’exigence de la disposition 2 de l’article 3 si les exigences en matière de délivrance du certificat extraprovincial comprenaient des exigences relatives aux compétences linguistiques équivalentes aux exigences que prévoit cette disposition. (5) Malgré le paragraphe (1), l’auteur d’une demande n’est pas réputé avoir satisfait à une exigence si celle-ci est mentionnée au paragraphe 22.18 (3) du Code des professions de la santé.

L’auteur d’une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome temporaire de la psychologie ne peut se soustraire à l’exigence voulant qu’il soit inscrit à titre de psychologue en règle dans un territoire, selon le cas : a) avec lequel l’Ordre maintient une entente de réciprocité écrite à la date de la présentation de sa demande; b) considéré par un sous-comité du comité d’inscription comme ayant des exigences en matière d’inscription équivalentes à celles de l’Ordre en ce qui concerne la délivrance de certificats d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie. Mobilité de la main-d’oeuvre 9. (1) L’auteur d’une demande de certificat d’inscription à titre de psychologue autorisant l’exercice autonome temporaire de la psychologie visé par l’article 22.18 du Code des professions de la santé est réputé avoir satisfait aux exigences de l’article 8 du présent règlement. (2) L’auteur d’une demande visé au paragraphe (1) ne peut se soustraire à l’exigence en matière d’inscription voulant qu’il fournisse un ou plusieurs certificats ou une ou plusieurs lettres, ou encore une autre preuve que le registrateur ou un sous- comité du comité d’inscription juge satisfaisante, qui confirment qu’il est un psychologue en règle dans chaque territoire dont il détient un certificat extraprovincial. (3) Si l’auteur d’une demande auquel le paragraphe (1) s’applique est incapable de convaincre le registrateur ou un sous- comité du comité d’inscription qu’il a exercé, à un moment donné au cours des deux années précédant la date de sa demande, la profession de psychologue dans la mesure où le permettrait un certificat d’inscription à titre de psychologue autorisant l’exercice autonome temporaire de la psychologie, il doit satisfaire aux exigences significatives supplémentaires en matière de formation, d’expérience, d’examens ou d’évaluations que peut préciser un tel sous-comité. (1) L’auteur d’une demande de certificat d’inscription à titre de psychologue autorisant l’exercice de la psychologie sous supervision ne peut se soustraire aux exigences suivantes en matière d’inscription : 1. Détenir un doctorat décerné, selon le cas : i. au terme d’un programme en psychologie agréé par la Société canadienne de psychologie ou par un autre organisme d’agrément approuvé par le conseil à cette fin, ii. au terme d’un programme en psychologie qu’un sous-comité du comité d’inscription juge équivalent à un programme visé à la sous-disposition i, iii. au terme d’un programme en psychologie offert par un établissement d’enseignement à l’extérieur du Canada ou des États-Unis d’Amérique qu’un sous-comité du comité d’inscription juge essentiellement semblable à un programme visé à la sous-disposition i. 2. Fournir à l’Ordre un engagement signé par deux superviseurs portant qu’ils s’engagent, d’une part, à former le futur membre et à superviser et à évaluer son exercice de la profession et, d’autre part, à fournir des rapports sous la forme et de la manière que précise le registrateur ou un sous-comité du comité d’inscription. (2) L’auteur d’une demande qui détient un doctorat décerné au terme d’un programme en psychologie visé à la sous- disposition 1 iii du paragraphe (1) ne doit être considéré comme ayant satisfait aux exigences de la disposition 1 du paragraphe (1) que s’il a réussi les évaluations ou les cours de formation supplémentaires ou acquis l’expérience supervisée supplémentaire, le cas échéant, qui, de l’avis d’un sous-comité du comité d’inscription, sont nécessaires en vue de s’assurer qu’il possède des compétences équivalentes à celles de l’auteur d’une demande détenant un doctorat décerné au terme d’un programme visé à la sous-disposition 1 i du paragraphe (1). (3) L’engagement signé ne doit être considéré comme satisfaisant à l’exigence de la disposition 2 du paragraphe (1) que si chaque superviseur proposé qui l’a signé satisfait à toutes les exigences suivantes : 1. Être membre titulaire soit d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie. 2. Détenir un certificat d’inscription non assorti de conditions ou de restrictions imposées à la suite d’une instance portant sur la discipline ou l’aptitude professionnelle. 3. Ne pas faire l’objet d’une instance en cours portant sur la discipline ou l’aptitude professionnelle. 4. Être autorisé par le registrateur ou un sous-comité du comité d’inscription à exercer dans les mêmes domaines de la profession et avec les mêmes groupes de clients que ceux du particulier qu’il doit superviser. Mobilité de la main-d’oeuvre 13. (1) L’auteur d’une demande de certificat d’inscription à titre de psychologue autorisant l’exercice de la psychologie sous supervision visé par l’article 22.18 du Code des professions de la santé est réputé avoir satisfait aux exigences de la disposition 1 du paragraphe 12 (1) du présent règlement. (2) L’auteur d’une demande visé au paragraphe (1) ne peut se soustraire à l’exigence en matière d’inscription voulant qu’il fournisse un ou plusieurs certificats ou une ou plusieurs lettres, ou encore une autre preuve que le registrateur ou un sous- comité du comité d’inscription juge satisfaisante, qui confirment qu’il est un psychologue en règle dans chaque territoire dont il détient un certificat extraprovincial. (3) Si l’auteur d’une demande auquel le paragraphe (1) s’applique est incapable de convaincre le registrateur ou un sous- comité du comité d’inscription qu’il a exercé, à un moment donné au cours des deux années précédant la date de sa demande, la profession de psychologue dans la mesure où le permettrait un certificat d’inscription à titre de psychologue autorisant l’exercice de la psychologie sous supervision, il doit satisfaire aux exigences significatives supplémentaires en matière de formation, d’expérience, d’examens ou d’évaluations que peut préciser un tel sous-comité. Le certificat d’inscription à titre de psychologue autorisant l’exercice de la psychologie sous supervision est assorti de la condition et restriction selon laquelle le membre ne peut exercer la profession que sous la supervision d’un superviseur approuvé à cette fin par le registrateur ou un sous-comité du comité d’inscription. Expiration 15. Le certificat d’inscription à titre de psychologue autorisant l’exercice de la psychologie sous supervision expire à la date qui y est indiquée, laquelle doit se situer au plus tôt 12 mois après la date de délivrance du certificat et au plus tard 24 mois après la date de sa délivrance.

Certificats d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie Certificats d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie 16. (1) Sous réserve des paragraphes (2) à (8), l’auteur d’une demande de certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie ne peut se soustraire aux exigences suivantes en matière d’inscription : 1. Détenir une maîtrise décernée au terme d’un programme en psychologie qui répond aux critères suivants : i. il est offert dans un établissement qui est : A. soit un établissement canadien légalement autorisé à décerner ce grade, B. soit un établissement situé aux États-Unis d’Amérique qui est agréé : 1. soit par un organisme d’agrément reconnu par le ministre de l’Éducation des États-Unis comme étant une autorité fiable en ce qui concerne la qualité de l’enseignement ou de la formation dispensée par des établissements d’enseignement supérieur, 2. soit par un autre organisme d’agrément approuvé par le conseil, C. soit un établissement situé dans un autre pays que le Canada ou les États-Unis d’Amérique et qui est jugé équivalent à un établissement visé à la sous-sous-disposition A : 1. soit par un service d’évaluation des titres de compétence étrangers membre de la National Association of Credential Evaluation Services, 2. soit par un autre service d’évaluation des titres de compétence étrangers approuvé par le conseil, ii. il exige, comme condition d’admission, que l’auteur de la demande ait suivi un minimum de 576 heures d’enseignement en psychologie au premier cycle, iii. il comprend les volets suivants : A. au moins 36 heures d’enseignement dans chacun des domaines suivants : 1. évaluation psychologique, 2. intervention psychologique, 3. normes professionnelles et de déontologie en matière de psychologie, 4. conception et méthodologie de la recherche, et statistiques, 5. fondements biologiques du comportement, 6. fondements sociaux du comportement, 7. fondements cognitifs et affectifs du comportement, 8. psychologie de l’individu, B. un stage supervisé en psychologie, C. au moins une année d’études et de formation à temps plein aux cycles supérieurs à titre de résident ou des études et des cours de formation à temps partiel équivalents à titre de résident. 2. Après obtention du grade visé à la disposition 1, avoir exercé la profession pendant au moins 6 000 heures réparties sur au moins quatre ans alors qu’il était sous la supervision d’un membre titulaire soit d’un certificat d’inscription à titre

de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie. 3. Alors qu’il était membre titulaire d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision, avoir exercé la profession pendant au moins 1 500 heures sous la supervision d’un membre qui satisfait aux exigences du paragraphe 23 (2). 4. Avoir réussi l’examen de pratique professionnelle en psychologie administré par l’Association of State and Provincial Psychology Boards ou un ou plusieurs autres examens des connaissances ou de la compétence établis ou approuvés par le conseil ou par un organisme approuvé par le conseil à cette fin. 5. Avoir réussi l’examen oral établi ou approuvé par le conseil. 6. Avoir réussi l’examen sur la jurisprudence et la déontologie établi ou approuvé par le conseil. 7. Avoir terminé tous les cours de formation professionnelle supplémentaires ou acquis toute l’expérience supplémentaire qui, de l’avis d’un sous-comité du comité d’inscription, sont nécessaires en vue de s’assurer qu’il possède les compétences pour exercer la profession d’associé en psychologie de façon autonome dans le domaine dans lequel il entend l’exercer. (2) Un établissement ne doit être considéré comme ayant respecté les exigences de la sous-sous-disposition 1 i C du paragraphe (1) que si le service d’évaluation des titres de compétence étrangers visé à cette sous-sous-disposition a jugé que le niveau de ce grade était équivalent à celui de la maîtrise offerte par une université au Canada. (3) L’auteur d’une demande qui détient une maîtrise décernée au terme d’un programme en psychologie satisfaisant aux exigences des sous-dispositions 1 i et ii du paragraphe (1) mais non aux exigences de la sous-disposition 1 iii de ce paragraphe est considéré comme ayant satisfait aux exigences de cette sous-disposition si les conditions suivantes sont réunies : a) un sous-comité du comité d’inscription considère le programme comme étant essentiellement semblable, mais non équivalent, à un programme qui satisfait à ces exigences; b) l’auteur de la demande réussit les études ou les cours de formation supplémentaires que précise un sous-comité du comité d’inscription. (4) Il suffit pour se conformer à la sous-disposition 1 iii du paragraphe (1) que tout ou partie des heures d’enseignement visées aux sous-sous-sous-dispositions A 5 à 8 de cette sous-disposition soient suivies au niveau du premier cycle, après un cours de première année. (5) L’auteur d’une demande qui, au moment de présenter sa demande, est inscrit ou autorisé à exercer la profession dans un territoire à l’extérieur du Canada n’est pas tenu de satisfaire aux exigences des dispositions 1, 2, 3, 4, 5 et 7 du paragraphe (1) s’il satisfait aux exigences suivantes : 1. Être inscrit à titre d’associé en psychologie en règle dans un territoire, selon le cas : i. avec lequel l’Ordre maintient une entente de réciprocité à la date de la présentation de sa demande, ii. considéré par un sous-comité du comité d’inscription comme ayant des exigences en matière d’inscription équivalentes à celles de l’Ordre en ce qui concerne la délivrance de certificats d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie. 2. Avoir participé à une entrevue réalisée par un sous-comité d’examinateurs nommés par le registrateur et avoir été considéré par ce sous-comité comme possédant les compétences pour exercer la profession de psychologue dans le domaine dans lequel il entend l’exercer. 3. Satisfaire, si l’auteur de la demande est incapable de convaincre le registrateur ou un sous-comité du comité d’inscription qu’il a exercé, à un moment donné au cours de la période de 24 mois précédant la date de sa demande, la profession de psychologue dans la mesure où le permettrait un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie, aux exigences supplémentaires en matière de formation, d’expérience, d’examens ou d’évaluations qui, de l’avis d’un tel sous-comité, sont nécessaires pour s’assurer qu’il possède les compétences pour exercer la profession à titre d’associé en psychologie de façon autonome dans le domaine dans lequel il entend l’exercer. (6) Si l’auteur d’une demande est un membre en règle titulaire d’un certificat d’inscription autorisant l’exercice de la psychologie en milieu universitaire, le registrateur lui délivre un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie s’il satisfait aux exigences suivantes : a) avoir été, au moment de la délivrance de son certificat d’inscription autorisant l’exercice de la psychologie en milieu universitaire, un membre titulaire d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie;

b) présenter au registrateur, par écrit, une demande de certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie au moins 60 jours avant la date à laquelle il se propose de commencer à exercer la profession de psychologue à titre de membre titulaire d’un tel certificat; c) remplir les conditions qu’impose un sous-comité du comité d’inscription qui, de l’avis de ce sous-comité, sont nécessaires pour s’assurer qu’il possède des compétences à jour pour exercer la profession de psychologue dans les domaines dans lesquels il se propose de l’exercer. (7) Si l’auteur d’une demande est un membre en règle titulaire d’un certificat d’inscription à titre de membre inactif, le registrateur lui délivre un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie s’il satisfait aux exigences suivantes : a) avoir été, au moment de la délivrance de son certificat d’inscription à titre de membre inactif, un membre titulaire d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie; b) présenter au registrateur, par écrit, une demande de certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie au moins 60 jours avant la date à laquelle il se propose de commencer à exercer la profession de psychologue à titre de membre titulaire d’un tel certificat; c) remplir les conditions qu’impose un sous-comité du comité d’inscription qui, de l’avis de ce sous-comité, sont nécessaires pour s’assurer qu’il possède des compétences à jour pour exercer la profession de psychologue dans les domaines dans lesquels il se propose de l’exercer. (8) Si l’auteur d’une demande est un membre en règle titulaire d’un certificat d’inscription à titre de membre à la retraite, le registrateur lui délivre un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie s’il satisfait aux exigences suivantes : a) avoir été, au moment de la délivrance de son certificat d’inscription à titre de membre à la retraite, un membre titulaire d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie; b) présenter au registrateur, par écrit, une demande de certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie au plus tard 24 mois après la délivrance de son certificat d’inscription à titre de membre à la retraite et au moins 60 jours avant la date à laquelle il se propose de commencer à exercer la profession de psychologue à titre de membre titulaire d’un tel certificat; c) remplir les conditions qu’impose un sous-comité du comité d’inscription qui, de l’avis de ce sous-comité, sont nécessaires pour s’assurer qu’il possède des compétences à jour pour exercer la profession de psychologue dans les domaines dans lesquels il se propose de l’exercer. (2) L’auteur d’une demande visé au paragraphe (1) ne peut se soustraire à l’exigence en matière d’inscription voulant qu’il fournisse un ou plusieurs certificats ou une ou plusieurs lettres, ou encore une autre preuve que le registrateur ou un sous- comité du comité d’inscription juge satisfaisante, qui confirment qu’il est un associé en psychologie en règle dans chaque territoire dont il détient un certificat extraprovincial. (3) Si l’auteur d’une demande auquel le paragraphe (1) s’applique est incapable de convaincre le registrateur ou un sous- comité du comité d’inscription qu’il a exercé, à un moment donné au cours des deux années précédant la date de sa demande, la profession de psychologue dans la mesure où le permettrait un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie, il doit satisfaire aux exigences significatives supplémentaires en matière de formation, d’expérience, d’examens ou d’évaluations que peut préciser un tel sous-comité. Le certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome temporaire de la psychologie est assorti de la condition et restriction selon laquelle le membre ne peut exercer la profession que dans les domaines suivants, selon le cas : a) les domaines d’exercice de la profession dans lesquels le registrateur ou un sous-comité du comité d’inscription l’autorise à exercer; b) les autres domaines d’exercice de la profession dans lesquels le membre exerce sous la supervision d’un membre autorisé par le registrateur ou un sous-comité du comité d’inscription à exercer dans ces domaines et titulaire soit d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie. Expiration 22. Le certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome temporaire de la psychologie expire 12 mois après la date de sa délivrance.

Certificats d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision Certificats d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision 23. (1) L’auteur d’une demande de certificat d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision ne peut se soustraire à l’une ou l’autre des exigences suivantes en matière d’inscription : 1. Satisfaire aux exigences des dispositions 1 et 2 du paragraphe 16 (1).

2. Fournir à l’Ordre un engagement signé par deux superviseurs portant qu’ils s’engagent, d’une part, à former le futur membre et à superviser et à évaluer son exercice de la profession et, d’autre part, à fournir des rapports sous la forme et de la manière que précise le registrateur ou un sous-comité du comité d’inscription. (2) L’engagement signé ne doit être considéré comme satisfaisant à l’exigence de la disposition 2 du paragraphe (1) que si chaque superviseur proposé qui l’a signé satisfait à toutes les exigences suivantes : 1. Être membre titulaire soit d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie. 2. Détenir un certificat d’inscription non assorti de conditions ou de restrictions imposées à la suite d’une instance portant sur la discipline ou l’aptitude professionnelle. 3. Ne pas faire l’objet d’une instance en cours portant sur la discipline ou l’aptitude professionnelle. 4. Être autorisé par le registrateur ou un sous-comité du comité d’inscription à exercer dans les mêmes domaines de la profession et avec les mêmes groupes de clients que ceux du particulier qu’il doit superviser. Mobilité de la main-d’oeuvre 24. (1) L’auteur d’une demande de certificat d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision visé par l’article 22.18 du Code des professions de la santé est réputé avoir satisfait aux exigences de la disposition 1 du paragraphe 23 (1) du présent règlement. (2) L’auteur d’une demande visé au paragraphe (1) ne peut se soustraire à l’exigence en matière d’inscription voulant qu’il fournisse un ou plusieurs certificats ou une ou plusieurs lettres, ou encore une autre preuve que le registrateur ou un sous- comité du comité d’inscription juge satisfaisante, qui confirment qu’il est un psychologue en règle dans chaque territoire dont il détient un certificat extraprovincial. (3) Si l’auteur d’une demande auquel le paragraphe (1) s’applique est incapable de convaincre le registrateur ou un sous- comité du comité d’inscription qu’il a exercé, à un moment donné au cours des deux années précédant la date de sa demande, la profession de psychologue dans la mesure où le permettrait un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision, il doit satisfaire aux exigences significatives supplémentaires en matière de formation, d’expérience, d’examens ou d’évaluations que peut préciser un tel sous-comité. Expiration 26. Le certificat d’inscription à titre d’associé en psychologie autorisant l’exercice de la psychologie sous supervision expire à la date qui y est indiquée, laquelle doit tomber au plus tôt 12 mois après la date de la délivrance du certificat et au plus tard 24 mois après cette date.

Certificats d’inscription autorisant l’exercice de la psychologie en milieu universitaire Certificats d’inscription autorisant l’exercice de la psychologie en milieu universitaire 27. L’auteur d’une demande de certificat d’inscription autorisant l’exercice de la psychologie en milieu universitaire ne peut se soustraire aux exigences suivantes en matière d’inscription : 1. Occuper un poste d’enseignement à temps plein ou régulier au sein du corps professoral d’une université ontarienne. 2. Être un membre en règle titulaire soit d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie et satisfaire aux exigences suivantes : i. détenir un certificat d’inscription non assorti de conditions ou de restrictions imposées à la suite d’une instance portant sur la discipline ou l’aptitude professionnelle, ii. ne pas manquer à aucune de ses obligations envers l’Ordre, notamment en ce qui concerne le versement de sa cotisation annuelle,

(2) L’auteur d’une demande visé au paragraphe (1) ne peut se soustraire à l’exigence en matière d’inscription voulant qu’il fournisse un ou plusieurs certificats ou une ou plusieurs lettres, ou encore une autre preuve que le registrateur ou un sous- comité du comité d’inscription juge satisfaisante, qui confirment qu’il est un psychologue en règle dans chaque territoire dont il détient un certificat extraprovincial. Certificats d’inscription à titre de membre inactif Certificats d’inscription à titre de membre inactif 30. L’auteur d’une demande de certificat d’inscription à titre de membre inactif ne peut se soustraire aux exigences suivantes en matière d’inscription : 1. Présenter sa demande au registrateur au moins 60 jours avant la date à laquelle il entend cesser d’exercer la profession. 2. Être un membre en règle titulaire soit d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie et satisfaire aux exigences suivantes : i. détenir un certificat d’inscription non assorti de conditions ou de restrictions imposées à la suite d’une instance portant sur la discipline ou l’aptitude professionnelle, ii. ne pas manquer à aucune de ses obligations envers l’Ordre, notamment en ce qui concerne le versement de sa cotisation annuelle, iii. ne pas faire l’objet d’une instance en cours portant sur la discipline ou l’aptitude professionnelle. Conditions et restrictions 31. Le certificat d’inscription à titre de membre inactif est assorti de la condition et restriction selon laquelle le membre ne peut exercer la profession.

Certificats d’inscription à titre de membre à la retraite Certificats d’inscription à titre de membre à la retraite 32. L’auteur d’une demande de certificat d’inscription à titre de membre à la retraite ne peut se soustraire aux exigences suivantes en matière d’inscription : 1. Présenter sa demande au registrateur au moins 60 jours avant la date à laquelle il entend cesser d’exercer la profession. 2. Être un membre en règle titulaire soit d’un certificat d’inscription à titre de psychologue autorisant l’exercice autonome de la psychologie, soit d’un certificat d’inscription à titre d’associé en psychologie autorisant l’exercice autonome de la psychologie et satisfaire aux exigences suivantes : i. détenir un certificat d’inscription non assorti de conditions ou de restrictions imposées à la suite d’une instance portant sur la discipline ou l’aptitude professionnelle,

Conditions et restrictions 33. Le certificat d’inscription à titre de membre à la retraite est assorti de la condition et restriction selon laquelle le membre ne peut exercer la profession.

Expiration et remise en vigueur Expiration suite à la délivrance d’un nouveau certificat 34. Le certificat d’inscription d’une personne expire dès que le registrateur lui délivre un autre certificat d’inscription. Remise en vigueur 35. S’il suspend le certificat d’inscription d’un membre conformément à l’article 24 du Code des professions de la santé pour cause de non-acquittement des droits ou des cotisations, le registrateur peut annuler la suspension dans les deux ans de la date de celle-ci après acquittement : a) d’une part, des droits que le membre n’a pas payés; b) d’autre part, des droits et pénalités applicables qu’exigent les règlements administratifs.

Dispositions transitoires Dispositions transitoires 36. (1) Tout certificat d’inscription qui existait immédiatement avant le 7 avril 2015 est prorogé en tant que certificat d’inscription équivalent ayant le même statut en vertu du présent règlement jusqu’à ce qu’il cesse d’être en vigueur d’une autre façon. Il est également entendu que : a) tout certificat d’inscription assorti d’une restriction concernant le statut professoral est prorogé en tant que certificat d’inscription autorisant l’exercice de la psychologie en milieu universitaire; b) tout certificat d’inscription assorti d’une restriction concernant le statut de membre inactif est prorogé en tant que certificat d’inscription à titre de membre inactif; c) tout certificat d’inscription assorti d’une restriction concernant le statut de membre à la retraite est prorogé en tant que certificat d’inscription à titre de membre à la retraite. (2) La demande de certificat d’inscription présentée, mais non définitivement réglée avant le 7 avril 2015, est traitée conformément au présent règlement.

Abrogation et entrée en vigueur Abrogation 37. Le Règlement de l’Ontario 533/98 est abrogé.

Amending O. Reg. 231/08 (TRANSIT PROJECTS AND METROLINX UNDERTAKINGS)

1. (1) Subsection 1 (1) of Ontario Regulation 231/08 is amended by adding the following definition: “power supply infrastructure” means transmission lines and transmission stations described in subsection (3); (2) Section 1 of the Regulation is amended by adding the following subsections: (3) For the purposes of this Regulation, power supply infrastructure consists of the following transmission lines and transmission stations if they are for the purposes of the electrification of a commuter rail corridor and are not associated with a generation facility mentioned in paragraph 1, 2, 3, 4, 5, 6 or 7 of subsection 4 (1) of Ontario Regulation 116/01 (Electricity Projects) made under the Act: 1. A transmission line that, i. can operate at nominal voltage of 115 kV and is greater than 2 kilometres in length, or ii. can operate at nominal voltage of greater than 115 kV and less than 500 kV and is greater than 2 kilometres and less than 50 kilometres in length. 2. A transmission station that can operate at nominal voltage of equal to or greater than 115kV and less than or equal to 500 kV. (4) For the purposes of subsection (3), if a transmission station has more than one voltage level, the station’s nominal operating voltage is its highest voltage level. 2. The Regulation is amended by adding the following section:

Designation Designation 1.1 (1) Subject to subsections (2) and (3), the planning, designing, establishing, constructing, operating, changing or retiring of power supply infrastructure in relation to the electrification of a new or existing commuter rail corridor is defined as a major commercial enterprise or activity and is designated as an undertaking to which the Act applies. (2) A change to a transmission line and the subsequent operation and retirement of the changed or expanded line is defined and designated under subsection (1) only if, (a) the work involved in changing the line requires replacement of poles or towers and/or changes in the right-of-way for existing transmission lines that are capable of operating at a nominal voltage equal to or greater than 115 kV and less than or equal to 500 kV; and (b) the changed line would operate at a nominal voltage of equal to or greater than 115 kV and less than or equal to 500 kV. (3) A change to a transmission station and the subsequent operation and retirement of the changed or expanded station is defined and designated under subsection (1) only if, (a) the change requires the acquisition of property; and (b) the changed station is capable of operating at a nominal voltage of equal to or greater than 115 kV and less than or equal to 500 kV. (4) For the purposes of subsection (3), if a transmission station has more than one voltage level, the station’s nominal operating voltage is its highest voltage level. 3. Section 2 of the Regulation is amended by adding the following subsections: (7) Subsection (8) applies if, before the day section 1.1 came into force,

(a) the proponent of a transit project described in subsection 1.1 (1) submitted an environmental assessment or proposed terms of reference in respect of the project to the Ministry; or (b) the proponent of a transit project described in subsection 1.1 (1) gave a notice to the public in accordance with an approved class environmental assessment. (8) In the circumstances described in subsection (7), subsection (1) does not apply to the transit project unless, not later than December 31, 2015, the Director of the Environmental Approvals Branch and the appropriate regional director of the Ministry have received written notice from the proponent stating that the proponent will comply with the transit project assessment process. (9) The validity of anything done before section 1.1 came into force is not affected if, after receipt of the notices referred to in subsection (8), the transit project assessment process is terminated under subsection 6 (3) or clause 13 (4) (b) or 15 (20) (b). (10) If a proponent of a transit project that belongs to a class of transit projects described in Schedule 1 proposes to carry out a transit project with one or more other proponents of a transit project that belongs to a class of transit projects described in Schedule 1, the proponents may proceed with the transit project assessment process jointly. 4. Paragraph 7 of subsection 2 (1) of Schedule 1 to the Regulation is revoked. 5. Schedule 1 to the Regulation is amended by adding the following section: Transit projects for purposes of electrification 2.1 Subsection 2 (1) of this Regulation applies to a transit project that is carried out by any proponent or any of its successors or assigns if the transit project includes any one or more of the following in relation to the electrification of a new or existing commuter rail corridor: 1. The electrification of rail equipment propulsion. May include planning, designing, establishing, constructing, operating, changing or retiring an associated power distribution system. 2. The planning, designing, establishing, constructing, operating, changing or retiring of power supply infrastructure. Commencement 6. This Regulation comes into force on the later of July 1, 2015 and the day it is filed.

Amending Reg. 628 of R.R.O. 1990 (VEHICLE PERMITS)

1. (1) Subsection 16.1 (1) of Regulation 628 of the Revised Regulations of Ontario, 1990 is amended by striking out “Subject to subsections (2) and (3)” at the beginning of the portion before paragraph 1 and substituting “Subject to subsections (2), (3) and (4)”. (2) Subsection 16.1 (1) of the Regulation is amended by adding the following paragraph: 3. New vehicles that are owned by their manufacturer and that, upon being completed, are driven away from the place at which their manufacture was completed. (3) Section 16.1 of the Regulation is amended by adding the following subsection: (4) The exemption in paragraph 3 of subsection (1) applies only while the following conditions are satisfied: 1. The vehicle is in transit between the place at which its manufacture was completed and the yard at which it is to be kept prior to shipping. 2. The distance between the place at which the vehicle’s manufacture was completed and the yard at which it is to be kept prior to shipping is not more than eight kilometres. 3. The driver of the vehicle is the holder of a valid driver’s licence for that class of vehicle. 4. The vehicle is insured under a contract of automobile insurance in accordance with section 2 of the Compulsory Automobile Insurance Act. Commencement 2. This Regulation comes into force on the later of July 1, 2015 and the day this Regulation is filed.

(3) L’article 16.1 du Règlement est modifié par adjonction du paragraphe suivant : (4) L’exemption prévue à la disposition 3 du paragraphe (1) ne s’applique que si les conditions suivantes sont réunies : 1. Le véhicule est transporté entre le lieu où sa fabrication a pris fin et la cour où il sera entreposé avant son expédition. 2. La Gazette de l’Ontario paraît chaque samedi, et les annonces à y insérer doivent parvenir à ses bureaux le jeudi à 15h au plus tard, soit au moins neuf jours avant la parution du numéro dans lequel elles figureront. Pour les semaines incluant le lundi de Pâques, le 1 novembre et les congés statutaires, accordez une journée de surplus. Tarifs publicitaires et soumission de format :

1) Envoyer les annonces dans le format Word.doc par courriel à [email protected] 2) Le tarif publicitaire pour la première insertion envoyée électroniquement est de 75,00$ par espace-colonne jusqu’à un ¼ de page. 3) Pour chaque insertion supplémentaire commandée en même temps que l’insertion initiale, le tarif est 40,00$ 4) Les clients peuvent confirmer la publication d’une annonce en visitant le site web de La Gazette de l’Ontario www.ontario.ca/gazette ou en visionnant une copie imprimée à une bibliothèque locale.

Abonnement :

Le tarif d’abonnement annuel est de 126,50$ + T.V.H. pour 52 ou 53 numéros hebdomadaires débutant le premier samedi du mois de janvier (payable à l’avance) L’inscription d’un nouvel abonnement au courant de l’année sera calculée de façon proportionnelle pour la première année. Un nouvel abonné peut commander des copies d’éditions précédentes de la Gazette au coût d’une copie individuelle si l’inventaire le permet.

Le remboursement pour l’annulation d’abonnement sera calculé de façon proportionnelle à partir de 50% ou moins selon la date. Pour obtenir de l’information sur l’abonnement ou les commandes s.v.p. téléphonez le (416) 326-5306 durant les heures de bureau.

Copies individuelles :

Des copies individuelles de la Gazette peuvent être commandées en direct en ligne au site www.serviceontario.ca/publications ou en téléphonant 1-800-668-9938.

The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. For the Christmas/New Year holiday schedule please contact the Gazette at (416) 326-5310 or by email at [email protected]

Advertising rates and submission formats:

1) Please submit all notices in a Word.doc format to: [email protected] 2) For a first insertion electronically submitted the basic rate is $75 up to ¼ page. 3) For subsequent insertions of the same notice ordered at the same time the rate is $40 each. 4) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at:www.ontario.ca /gazette or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + H.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.

Refunds for cancelled subscriptions will be pro-rated from 50% or less depending upon date. For subscription information/orders please call (416) 326-5306 during normal business hours.
