Under Section 272 (a) of the Financial Services Act 2013 (FSA), exemptions granted under the BAFIA are deemed to have been granted under the corresponding provision of the Financial Services Act 2013 and shall remain in full force and effect until amended or revoked. This article examines the transition of the insolvency laws in Malaysia from a liquidation culture under the CA 1965 to a corporate rescue culture under the CA 2016. It also reviews the necessary changes to the pro-creditor laws, which are preserved under the CA 2016 in order to accommodate the pro-debtor laws with the introduction of the corporate rescue mecha- nisms, which came into force on March 1, 2018. Through comparative and critical analysis of similar laws in the United Kingdom and Singapore, this article argues that while the corporate rescue mechanisms are regarded as pro-debtor however the review reveals that the position of secured creditors are impeding its appli- cation and reforms ought to be considered.

Malahan, berlawanan dengan propagandanya yang sangat menggebu, RRC pada dasarnya merupakan pihak yang berpartisipasi dalam konfrontasi dengan secara pasif. Gejala ini disebabkan oleh fakta bahwa pada waktu konfrontasi berlangsung Partai Komunis Malaya yang didukung Cina tengah menerapkan kebijakan yang lebih lunak terhadap pemerintah Malaysia. Tambahan lagi, RRC mungkin sekali lebih peduli terhadap nasib golongan etnik Cina di Malaysia daripada mendukung partai komunis lokal. Abstract This paper argues that contrary to the traditionally accepted opinion, the People’s Republic of China (PRC) participated in the Indonesian campaign to crush Malaysia half-heartedly. In fact, despite its strong propaganda broadcast in supporting Indonesia, the PRC was actually a passive participant in the campaign. This is due to the fact that at that time the Chinese supported Malayan Communist Party, which was pursuing a more conciliatory policy toward the Malaysian government. Furthermore, China was probably more concerned with the well-being of ethnic Chinese Malaysia than supporting the local communist party.
