Fiqh al-Aqalliyyāt (Jurisprudence for Minorities) and the Problems of Contemporary Muslim Minorities of Britain from the Perspective of Islamic Jurisprudence This thesis is submitted in partial fulfilment of the requirements for the award of the degree of Doctor of Philosophy of the University of Portsmouth & Markfield Institute of Higher Education M.M.M. Rafeek 2012 Abstract This study seeks to explore some of the main problems contemporary British Muslims encounter from the perspective of Islamic jurisprudence. In so doing, it mainly aims to shed light on the extent Muslims in Britain face problems and what impact they might have on their religious identity as well as relationship, belonging, and contribution to the wider society. In so doing, the study will strive to examine whether existing fiqh (Isalmic jurisprudence) literature is adequate to guide contemporary fiqh scholars to deal with such issues effectively and how some contemporary answers to such issues are inappropriate. If that is the case, what would be the way forward jurists should take to find appropriate solutions? Hence, this study will use qualitative methodology to investigate such issues and questions and it will lead the study to emphasise the necessity to find answers to such problems and a mechanism to handle them, which this study would seek to suggest as a jurisprudential approach called fiqh al-aqalliyyāt al-Muslimah (Islamic Jurisprudence for Muslim Minorities) based on values, principles, universalities, and higher objectives of Islamic law: maqāsid al-Sharī‘ah (Purposes of Islamic Sharī‘ah) presented by revisiting textual sources of Islamic law as well as lived examples of early generations of Islam. -

The 21st Century New Muslim Generation Converts in Britain and Germany Submitted by Caroline Neumueller to the University of Exeter as a thesis for the degree of Doctor of Philosophy in Arab and Islamic Studies October 2012 1 2 Abstract The dissertation focuses on the conversion experiences and individual processes of twenty-four native British Muslim converts and fifty-two native German Muslim converts, based on personal interviews and completed questionnaires between 2008 and 2010. It analyses the occurring similarities and differences among British and German Muslim converts, and puts them into relation to basic Islamic requirements of the individual, and in the context of their respective social settings. Accordingly, the primary focus is placed on the changing behavioural norms in the individual process of religious conversion concerning family and mixed-gender relations and the converts’ attitudes towards particularly often sensitive and controversial topics. My empirical research on this phenomenon was guided by many research questions, such as: What has provoked the participants to convert to Islam, and what impact and influence does their conversion have on their (former and primarily) non-Muslim environment? Do Muslim converts tend to distance themselves from their former lifestyles and change their social behavioural patterns, and are the objectives and purposes that they see themselves having in the given society directed to them being: bridge-builders or isolators? The topic of conversion to Islam, particularly within Western non-Muslim societies is a growing research phenomenon. At the same time, there has only been little contribution to the literature that deals with comparative analyses of Muslim converts in different countries. -

Conference, Symposium, and Panel Reports The AMSS (UK) Fifth Annual Conference: Fiqh Today: Muslims as Minorities Traditional fiqh is facing a new challenge: formulating a suitable fiqh for minority Muslim communities. In this spirit, the Association of Muslim Social Scientists (AMSS [UK]) in conjunction with the International Institute of Islamic Thought, The Muslim College, and Q-News Media, convened its fifth annual conference, “Fiqh Today: Muslims as Minorities,” at the University of Westminster (London) during February 21-22, 2004. Anas Al-Shaikh-Ali, AMSS (UK) Executive Committee Chair, set out the vision in his opening remarks: A genuine fiqh for minority Muslims requires a collective engagement between social scientists and Shari`ah scholars “in the wider public arena.” He challenged participants to work for a “comprehensive methodology of minority fiqh” drawing on the past, but not being afraid to be innovative. Keynote speaker Mustafa Ceric, Grand Mufti of Bosnia-Herzegovina, maintained that while he did not believe in a minority fiqh per se, he readi- ly accepted the position that Muslims living as political minorities often are better able to fulfill their religious obligations than Muslims elsewhere. He posited a vision of Muslims in Europe that recognized their unique historic position and contribution to Europe, which he sees as a place of interaction rather than of confrontation. After discussing the interdependence of cultures and the need for balance and tolerance, he considered present diagnoses of the intellectual pathologies of Muslim and European societies and concluded by challenging Muslim minorities to see themselves as driving Islam’s civi- lizational wheel. He also called on Europe to institutionalize Islam and for Muslims in Europe to come together within a universal worldview. -

Summary Almost all religions reflect on the creation of the universe, or universes, in different forms and with varying degrees of clarity or detail. Common across most religions is an agreement that “creation” is an act of God and should be treated as such. This rapid literature review collates evidence on the role of faith and belief in environmental engagement and action in MENA region. The review draws on academic and grey literature and finds an expanding evidence base on the relationship between Islam, Islamic thought and climate change. It also identifies emerging examples of green approaches to pilgrimage and the ‘greening’ of places of worship. -

Yogyakarta 55281 Abstract The compatibility between Islamic law and international law has been a long lasting source of both academic discussion and social friction. This includes the Islamic laws on conduct of war (IsHL), especially in context of the Middle East conflicts. This article explores how there are two extreme opinions: ‘Islamophobes’ and apologists –both of them being dishonest. It will be shown that there are multi-level possibilities of relations between IsHL and International Humanitarian Law including possible incompatibilities, and that an ijma is a good room for reconciliation. Keywords: Islamic law, International Humanitarian Law, jihad. Intisari Kompatibilitas hukum Islam dan hukum internasional telah lama menjadi sumber debat akademis dan friksi social. Termasuk diantaranya adalah hukum Islam terkait pelaksanaan perang, terutama di tengah konflik Timur Tengah seperti sekarang. Artikel ini mengamati dua pendapat ekstrim: ‘Islamofobik’ dan ‘apologist’ –keduanya tidak jujur. Akan ditunjukan ada berbagai tingkat kemunginan hubungan antara hukum perang Islam dan Hukum Humaniter Internasional, termasuk diantaranya adalah kemungkinan pertentangan, lalu bagaimana dibutuhkan sebuah ijma untuk
