  • The State of Sex: Tourism, Sex and Sin in the New American Heartland
    THE STATE OF SEX The State of Sex is a study of Nevada’s legal brothels that situates the nation’s only legal brothel industry in the political economy of con- temporary tourism. Nevada is part of the “new American heartland,” as its pastimes, people, and politics have become more central to the nation. The rise of a service and leisure economy over the past 60 years has propelled sexuality into the heart of contemporary markets. Yet, neoliberal laws in the United States promote business but limit sexual commerce. How have Nevada’s legal brothels survived, while the rest of the country criminalizes prostitution? How do the brothels operate? Who works in them? This book brings social theory on globalizing econ- omies, politics, leisure consumption, and emotional labor in interactive service work together with research on contemporary prostitution and sexual commerce. The authors employ an innovative, multi-method sociological approach, combining historical analysis of how the brothels came to be with over a decade’s worth of ethnographic research on the current state of the industry. There is no pro-sex-trafficking position any more than there is a public pro-slavery position for labor these days. The only issue is defining these terms so nothing anyone wants to defend is covered. It is hard to find overt defenders of inequality either, even as its legal definition is also largely shaped by existing practices the powerful want to keep. Prostitution is not like this. Some people are for it; they affirmatively support it. Many more regard it as politically correct to tolerate and oppose doing anything effective about it. Most assume that, if not exactly desirable, prostitution is necessary or inevitable and harmless. These views of prostitu- tion lie beneath and surround any debate on sex trafficking, whether prosti- tution is distinguished from trafficking or seen as indistinguishable from it, whether seen as a form of sexual freedom or understood as its ultimate de- nial. The debate on the underlying reality, and its relation to inequality, intensifies whenever doing anything effective about either prostitution or trafficking is considered.

Most often, the end destination of sex trafficking is the commercial sex industry, primarily prostitution, which is marked by widespread exploitation and violence, is linked to organized crime and perpetuates gender inequality. Around the world, survivors’ experiences illustrate that sex trafficking and commercial sexual exploitation is a human rights violation that predominantly impacts women and girls. Their voices are a powerful tool to put a human face to this crime, dispel myths and encourage action; the stories they share are part of a bigger platform for change. Survivors know not only of the experiences they have lived, but have insight as to which strategies and solutions are most effective to combat the harms associated with the sex trade.

INTRODUCTION Throughout history many people have viewed sodomy and prostitution as moral evils, because sex has often been linked to sin and, therefore, to immorality and guilt.1 For example, in ancient Hebrew, a sodomite was known as a qadhesh, a male temple prostitute who was associated with heathen deities and impure forms of worship.2 The female version of qad- hesh, qedheshah, is translated directly as prostitute.3 This archaic view of labeling prostitution and sodomy as impure has been challenged over time, and both topics are still a source of great controversy.

From 5th Century BCE, to ancient Greece, to modern day Amsterdam and Nevada, prostitution is a way of life for both the prostitutes as well as their customers. The debate regarding legalized prostitution is rife with arguments on both sides that speak of the pros and cons of a legalized or decriminalized stance toward prostitution. Scholars argue either from a morality standpoint buttressed with statistics on the quality of life the prostitutes experience, or scholars suggest that the prostitute’s body is her own and she may do with it as she pleases. The economic impact of legalized prostitution is substantial and this impact cannot be refuted from either moralists or feminists who disagree with the profession as a whole. Nevada is one such example of a locale where the legalized prostitution industry brings in substantial income to the county coffers.

PROSTITUTION: FEMINISM AND SOCIAL JUSTICE • Sex work activists, sex positive feminists, and radical feminists have long been engaged in a debate over naming, costs, and policies regarding sex work/prostitution. Although all sexual exchange could be thought of in terms of a continuum of exploitation and empowerment (Katsulis 2009), debates over “what to call it” (sex work or prostitution) are hotly contested and reveal tensions about the role of women in fostering gender equity. For more on the complexities of this debate, including the so-called “Sex Wars” of the 1980’s, and its relationship to feminist theory more generally, see Siegel (2007). • Sex work activists emphasize the need to treat sex work as a legitimate form of work, and favor legal reforms including de-criminalization or regulation, improved working conditions, sexual citizenship, and sovereignty (Kempadoo & Doezema 1998; Nagle 1997; O'Connell Davidson 1999). • Radical feminists and (some) human rights activists argue that prostitution is a form of sexual slavery, highlight the victimization and exploitation of the prostitute at the hands of more powerful others, and emphasize the dangers of legalization (see, for example, Barry 1996; Jeffreys 1997; Whisnant and Stark 2005). • The sex work vs. prostitution debate parallels the division between those who frame the movement of sex workers across borders as either human trafficking/slavery or labor migration. Understanding the extent of human trafficking and sexual slavery is necessary to fight exploitation; however, the protection, support, and sexual agency of migrant sex workers must also be considered.

    learning from Mistakes: Decriminalizing Prostitution in the United States Katheryn E. Marcum Prostitution: Problem or Profession? Prostitution is, according to cliché, the world’s oldest profession. It is also an activ- ity greatly disputed by many, all over the world. Nearly every country has devel- oped some way to address the issue. In the United States of America, prostitution is against the law in forty-nine of fifty states and heavily regulated in the other. The fact of the matter is that prostitution must exist because there is demand for it, and as long as that demand persists, so will the activity. Prostitution occurs across the globe between people of all genders, sexualities, ages and religions, and many other countries have decided that to fight against prostitution is futile. These countries have chosen to better distribute their resources in ways that pro- tect all citizens. The United States should consider the successes and failures of all possible approaches to prostitution in comparison to the disrespectful, limiting, expensive and crime-ridden systems of criminalization and legalization currently in place. According to Merriam-Webster’s Online Dictionary, prostitution can be defined as “the act or practice of engaging in promiscuous sexual relations espe- cially for money;” (promiscuous meaning “not restricted to one sexual partner”) (Merriam-Webster Online 2010). This definition is, technically, correct. Prostitution is the exchange of sexual activities for a favor, usually in the form of monetary compensation, and may also be referred to as commercial sex (Law 2000, 525). Based on this definition, it is important to recognize that any sexual activity for which an individual receives monetary compensation is considered prostitution, including activities typically associated with other parts of the sex industry.
