WHO SHOULD ATTEND: Our panel will discuss issues relevant to risk management, property operations and financial executives, general counsel and real estate stakeholders. THE PROGRAM: Risk Management and Insurance Strategies In the aftermath of Hurricane Katrina, large property owners throughout the country have realized how ill prepared they are. In examining the issues there is an overriding concern regarding the effec- tiveness of risk management strategies. Real estate executives, financial managers, risk managers and in house counsel have expressed the need for a current and focused discussion and analysis relating to the pur- chase of appropriate insurance coverages and the recoverability of damages once a natural disaster occurs. Keynote address by Professor Nicholas Coch, hurricane expert, will explain the potential damage a major hurricane will cause to the New York City area. Key Note Speaker Nicholas K. Coch, Ph.D., C.P.G., Queens College Nicholas K. Coch received his Ph.D.. in 1965 from Yale University with a specialization in sedimentology and coastal geology. In 1967, he joined the faculty at Queens College and the CUNY Doctoral Faculty in Earth and Environmental Sciences and is now a Professor of Geology in the School of Earth and Environmental Sciences at Queens College. He has co-authored two college geology textbooks (PHYSICAL GEOLOGY) and is the author of GEOHAZARDS (Prentice Hall). Dr. Coch is an expert on Northern Hurricanes and has been a consultant to the N.Y. City Emergency Management Organization and the N.Y.State Office of Emergency Manage- ment. He has presented hurricane seminars to emergency management and government officials in every county in southern New York as well as insurance, reinsurance and risk management groups nationwide. He was chosen as a Sigma Xi Distinguished Lecturer for 2004-2006, and is currently presenting lectures on his research at educational and research facilities in the U.S. and Canada. Program Moderator John E. Osborn, Esq., Partner, John E. Osborn PC ("Jack") has practiced law in New York City for over twenty-five years. His practice concentrates in litigation and consultation on environmental law, construction contract law and real estate mat- ters. He is an active participant in BOMA/NY and is the professional member representative to BOMA/NY’s Board of Directors. He also serves on the board of directors for the Greater New York Construction User Council (GNYCUC) and acts as the GNYCUC’s general counsel. The Panel Barry J. Fleishman, Esq., Partner, Dickstein Shapiro LLP Barry Fleishman joined Dickstein Shapiro LLP in 1996, and is a partner in the Firm's Insurance Coverage Practice. Mr. Fleishman's practice focuses on complex policyholder insurance coverage, electric power, and products liability. He represents major corporations seeking insurance cover- age with respect to liabilities and losses incurred as the result of property damage, defective or misused products, natural disasters, fires and explosions, directors' and officers' activities, and the events of 9/11. In addition to litigating insurance coverage cases, he provides general counsel on insurance-related matters. Representative companies for which Mr. Fleishman has provide na- tional insurance coverage counsel include A.M. Todd, Inc., AT&T, Archstone-Smith Operating Trust, Merck, and the Royal Bank of Canada. Daniel Lentz, Partner, Ernst & Young Mr. Lentz is a Partner in Ernst & Young's Fraud Investigations & Dispute Services practice for Virginia, Maryland and Washington, D. C. He is the national leader for the Dispute Services group, which includes the Insurance Claim Services practice. Dan has served in both auditing and advisory practices during his 22+ years with the firm. Mr. Lentz’s primary responsibilities are in the insurance claims, fraud and litigation services areas, where he has frequently served as a con- sulting and testifying expert. He is a member of the American Institute of Certified Public Ac- countants, the Maryland Association of Certified Public Accountants and the Association of Insol- vency Accountants. Mr. Lentz is also a Certified Fraud Examiner and a member of the Associa- tion of Certified Fraud Examiners. Damon Gersh, CR, President & CEO, Maxons Restoration Damon Gersh is the President and CEO of Maxons Restorations, Inc. -- New York’s premier dis- aster restoration and recovery specialists. Damon holds the regarded distinction of Certified Re- storer from the National Institute of Disaster Restoration and is a leading expert in the highly spe- cialized field of disaster recovery. Damon has been asked to address various aspects of disaster restoration on CNN, Inside Edition, WABC-TV, NY1 News, The New York Times, New York Post, New York Newsday, Crain’s New York Business, Claims Magazine, Real Estate New York. Damon has served as the President of the New York Chapter of the Entrepreneur’s Organization (EO) and is an active member of the BOMA and Young Insurance Professionals. Damon was selected as a winner of “Fast Company” Magazine’s first annual Fast 50 Award for Leadership, is an Inc. 500 award recipient and was awarded the prestigious Ernst & Young Entrepreneur of the Year Award in 2002 for leading his firm’s large-scale response to help restore lower Manhattan following 9/11. Brian Schley, Assistant Vice President, Risk Management, Archstone Smith Brian Schley is the Assistant Vice President of Risk Management for Archstone-Smith Trust. Archstone-Smith, an S&P 500 company, is a recognized leader in apartment investment and opera- tions. Mr. Schley has over 11 years of risk management and insurance related experience. He has the overall responsibility for the strategic risk management functions and corporate insurance pro- grams for the Archstone-Smith organization. These responsibilities include company risk identifi- cation and analysis, insurance procurement (including traditional and Wrap-Up programs), risk transfer alternatives (including the development/management of a captive), overall claims/ litigation management, and overseeing the surety bond program. Brian has been instrumental in overseeing, administering and resolving several class action styled litigation matters related to mold and ADA/FHA issues. He is well versed in negotiating insurance recoveries; and since join- ing Archstone-Smith, he has negotiated recoveries in excess of $75 million related to various mat- ters. Lynn K Neuner, Esq., Partner, Simpson Thacher & Bartlett Lynn K. Neuner is a member of Simpson Thacher’s Litigation Department. Her trial and litigation experience covers several areas such as insurance coverage, securities, Lanham Act and general corporate matters. She tried a centi-million dollar insurance coverage action on behalf of Travel- ers Casualty and Surety Company in August 2005 and a multi-million dollar personal injury case on behalf of New York City in January 2003. Ms. Neuner is a member of the Departmental Disci- plinary Committee for the First Judicial Department and a member of The Lawyers’ Committee of the Archdiocese of New York. She is also a member of the American Bar Association (where she is Co-Chair of the Program Subcommittee of the Insurance Coverage Litigation Committee), New York State Bar Association, and the Association of the Bar of the City of New York (where she was a member of the Federal Courts Committee). Michael Chang, Vice President, Chubb & Son, A Division of Federal Insurance Company In October of 2005, Michael was promoted to run the newly formed Chubb Specialty Insurance Worldwide Real Es- tate Practice. Since 2000, Michael has served in various management capacities in Chubb’s New York Brokerage Zone Financial Institution operation. In this role, Michael was responsible for the profit, retention, and growth of the Financial Institution Property and Casualty book of business, which equates to approximately 40% ($200,000,000) of Chubb’s Financial Institution Property and Casualty premium worldwide. He also oversaw a group of 38 staff mem- bers (inclusive of underwriters, underwriting associates, and customer service representatives) in three Chubb offices. Michael has a Bachelor of Science in Economics, which he received in May of 1995, from the University of Pennsyl- vania, Wharton Undergraduate Division. Thomas E. Kelly, Managing Director, Marsh USA, Inc. Thomas E. Kelly, Managing Director, is the US Builder Risk Practice Leader based in the New York Office of Marsh USA Inc. Tom is responsible for leading the national strategy for the Builders Risk product. Tom is also responsible for leading the teams that creates builders all risk property solutions for US domiciled clients projects around the world. Tom has extensive experience in property insurance programs for large and small construction projects in the real estate, energy, petrochemical, manufacturing and public transportation industries. His involvement in placing build- ers risk policies for projects ranging from a $2.5 billion power station in Indonesia, to a $250 million multi use real estate project in Washington, DC. Over the past 15 years, Tom has also successfully partnered builders risk insurers and reinsurers with contractors, residential and commercial developers and public entities in devising master rolling builders risk programs for multi-phase project developments. Mr. Kelly joined Marsh & McLennan in 1990. He is a graduate of the University of Pennsylvania with a BA in European History and has studied at the Wharton School of Finance. Mr. Steve Curlen, Loss Control Corporate Officer Chubb & Son, Inc. As Loss Control Corporate Officer with Chubb, Mr. Curlen is currently is the Worldwide Loss Control Manager of Chubb’s Specialty Real Estate Insurance Practice.
