INTRODUCTION What is and what is not the unauthorized practice of law has long been difficult, if not impossible, to define.' Unauthorized practice of law committees and courts have frequently grappled with the issue. Specifi- cally, are corporate in-house counsel participating in the unauthorized practice of law when they are assigned to work in a jurisdiction where they are not licensed? This issue has never been fully resolved. The American Bar Association has sidestepped the issue, although it has had a number of opportunities to address it. The ABA Code of Pro- fessional Responsibility and the ABA Model Rules of Professional Con- duct provide little guidance. They simply state that "[a] lawyer shall not practice law in a jurisdiction where doing so violates the regulation of the legal profession in that juisdiction."2 In the absence of guidance from the ABA, states confronting the question have reached very differ- ent conclusions. -

CLIENT CHOICE, CONTRACTUAL RESTRAINTS, AND THE MARKET FOR LEGAL SERVICES* Robert W. Hillman** I. INTRODUCTION The freedom of clients to discharge their lawyers at any time, with or without cause, greatly facilitates competition among lawyers. 1 An era of lawyer mobility that has destabilized law firms and rewarded lawyers able to command the loyalty of their clients rests on the simple and largely unquestioned premise that clients should be free to discharge their lawyers, with or without cause and even, under most circumstances, in contravention of contract. 2 This Article explores the norm of client choice and its impact on the market for legal services. It discusses the historical foundations of the norm, the policy reasons for and against the freedom accorded to clients to change their lawyers at any time, and ways in which the exercise of client choice is limited by application of other principles of law and ethics. For a comparative perspective, it also looks to standards of medical ethics to see the relative roles of consumer choice over service providers in the two professions. II. LEGAL SERVICES AND CLIENT CHOICE A. The Foundations of Client Choice At the core of client choice is the premise that an individual has a right to legal counsel and that “choice” necessarily suggests alternatives from which to choose. Legally Speaking: Group ride liability, part 1 Bob Mionske August 30, 2018 News What happens if one of the cyclists hits a pedestrian or a car or takes down a paceline on a group ride? Bike clubs have long organized of all sorts of group rides for club members as well as the public. These rides provide a great introduction to the world of cycling. Because they attract an array of different cyclists, the level of etiquette and experience varies immensely among the participants. To your left, you could be looking at a retired professional. But to your right, you’ll find a super-strong newbie who also struggles with proper riding lines and basic bike handling — which is, of course, critical in a fast-moving peloton. You start to wonder: What happens if one of the cyclists hits a pedestrian or a car or takes down a paceline? These are classic group ride liability scenarios. And, they all boil down to these two issues: 1. Who is responsible and who is legally liable? The club and its organizers? The individuals involved? Or the sponsors of the ride? 2. If liability attaches to the group ride, who pays for the property damages and injuries that happen to someone? These are sophisticated legal issues, and the answers will depend on a range of legal factors and vary from state to state. Consequently, we will address these questions in a two-part series. This column addresses the first issue — when can a group ride be held liable if someone gets hurt or property is destroyed? Injuries Involving Off-Road Cycling
o RIGINAL RESEARCH_______________________________ Injuries Involving Off-road Cycling Frederick P. Rivara, MD, MPH; Diane C. Thompson, MS; Robert S. Thompson, MD; and Viviana Rebolledo Seattle, Washington BACKGROUND. Data on injuries due to off-road bicycling are scarce, but do indicate that injuries in this sport are frequent. We examined the pattern of injuries to off-road riders as part of a larger study of bicycle injuries and helmet use. METHODS. We undertook a prospective study of bicycle-related injuries identified at seven emergency depart ments in Seattle, Washington, between March 1992 and August 1994. Hospitalized patients and medical examin ers’ cases were included. Detailed questionnaires and abstraction of all medical records provided information on crash and rider characteristics and injury type and severity. RESULTS. A total of 3390 injured riders participated, representing an 88% response rate. Of all injured cyclists, 127 (3.7%) were injured riding “off road.” Seventy-three percent of off-road cyclists were 20 to 39 years of age, and 86.6% were male. Helmet use was 80.3% for off-road cyclists as compared with 49.5% for other cyclists. The number of head and face injuries for the off-road cyclists was only 40% of the number incurred by other cyclists. Four percent of off-road cyclists had severe injuries (Injury Severity Score >8), and 6.3% were hospital ized, compared with 6.8% and 9.4%, respectively, of other cyclists. CONCLUSIONS. The majority of off-road bicycling injuries are minor. Off-road cyclists are less likely to have head and face injuries than other cyclists and are more likely to wear helmets.
