Program Description Tech companies are revolutionizing the economy by creating marketplaces that connect individuals who “share” their services with consumers who want those services. This “sharing economy” is changing the way Americans rent housing (Airbnb), commute (Lyft, Uber), and contract for personal services (Thumbtack, Taskrabbit). For every billion-dollar unicorn, there are hundreds more startups hoping to become the “next big thing,” and APAs play a prominent role in this tech boom. As sharing economy companies disrupt traditional businesses, however, they face increasing regulatory and litigation challenges. Should on-demand workers be classified as independent contractors or employees? Should older regulations (e.g., rental laws, taxi ordinances) be applied to new technologies? What consumer and privacy protections can users expect with individuals offering their own services? Join us for a lively panel discussion with in-house counsel and law firm attorneys from the tech sector. 2. Panelists Albert Giang Shareholder, Caldwell Leslie & Proctor, PC Albert Giang is a Shareholder at the litigation boutique Caldwell Leslie & Proctor. His practice focuses on technology companies and startups, from advising clients on cutting-edge regulatory issues to defending them in class actions and complex commercial disputes. Short-Term Rentals and L.A.’s Lost Housing Roy Samaan | 24 August 2015 In March 2015, the Los Angeles Alliance for a New Economy (LAANE) released Airbnb, Rising Rent, and the Housing Crisis in Los Angeles. That report, based on data gathered in October 2014, found that Airbnb listings were dominated by commercial operations and were exacerbating the lack of affordable rental units in L.A.’s already tight housing market.1 The goal of this reassessment is to determine how the size and scope of the short-term rental (STR) industry has changed over the last nine months. This policy brief examines listing information from a broad range of STR operators alongside new Airbnb data. Combining these data sources allows for an examination of how Airbnb’s internal composition has changed over the last nine months and allows for the creation of a more refined snapshot of the Los Angeles STR industry.2 Estimated scope of short-term rental industry has more than doubled The short-term rental industry is more than twice Table 1: Total Unique Listings and Market Share for Los Angeles STR Operators as big as previously estimated, with a combined Share of L.A.’s STR Company Unique Listings 23,268 units spread across 19 different platforms. Analýza sdílené ekonomiky a digitální platforem Sekce pro evropské záležitosti Úřadu vlády ČR Analytický materiál 06/2017 Východiska a shrnutí Tento analytický materiál je představen jako základ pro věcnou debatu o přijetí návrhu konkrétního regulačního zakotvení v oblasti sdílené ekonomiky. Samotný materiál se zabývá tím, jak a zda vůbec sdílenou ekonomiku efektivně regulovat a nastiňuje možnosti horizontální (tedy nastavením principů platným pro všechny podniky), tak vertikální (tj. sektorově, konkrétně dle věcné definice aktivit sdílené ekonomiky) úpravy. Sdílená ekonomika je komplexní fenomén, který se dotýká široké škály oblastí a má dopady jak na právní, tak i ekonomické prostředí. Obšírnost této problematiky neumožňuje jednoduchý způsob ukotvení skrze jeden právní princip.1 Sdílená ekonomika je v mnoha ohledech živelným fenoménem, který vznikl, roste a vyvíjí se navzdory současnému právnímu řádu a regulatornímu prostředí. Nejen Česká republika, ale i ostatní členské státy Evropské unie řeší to, jak se k tomuto novému konceptu z právního, ale i obecného hlediska postavit. V teoretické rovině představuje sdílená ekonomika možnost, jak dále maximalizovat využití ladem ležících statků. Stejně tak dobře však může při neodpovídajícím právním zakotvení a nemožnosti efektivně vymáhat již stanovená pravidla poskytovat prostor pro rozvoj šedé ekonomiky či regulatorní arbitráže. S ohledem na tyto skutečnosti je proto nutné důsledně rozlišovat jednotlivé aktéry sdílené ekonomiky, jejich (nejen právní) postavení a rovněž různorodost služeb v rámci sdílené ekonomiky poskytovaných, užívaných a zprostředkovaných. V rámci sdílené ekonomiky se projevuje principiální rozdíl anglosaského a kontinentálního práva. V tzv. common law legislativní rámec flexibilně na nové jevy reaguje skrze judikaturu. Operujeme-li v kontinentálním právu, ocitáme se ve velice složité situaci a jsme konfrontováni se subjekty, které v našem pojetí právo porušují.
