Chief Magistrate’s Overview It is my pleasure to present the Magistrates Court of Queensland Annual Report for 2014-2015. Magistrates and court staff continue to work hard to deliver justice to the people of Queensland in an efficient and accessible way. My thanks go to all magistrates and court staff for their hard work over the past year. Court performance In the 2014-15 year, Magistrates have continued to manage a heavy workload. In particular, lodgements in the domestic violence jurisdiction increased by 1,481 applications (+5.86 per cent) from the previous year. Although criminal defendants increased marginally (+.26 per cent), charge lodgements increased by 8,350 (+2.11 per cent). Child Protection application lodgements also increased by 71 applications (+2.03 per cent). Appointments and Retirements During the reporting period there was one notable retirement being the former Chief Magistrate, Judge Tim Carmody as he then was. The Magistrates Court owes Judge Carmody a significant debt of gratitude for leading the Court so capably for a relatively short period of nine months. There was one other retirement, Magistrate Laurie Verra on the 11th of July 2014, after 15 years of service as a Magistrate. There were three magistrate appointments; Magistrate Peter Hasted, Magistrate Cathy Ann McLennan and Magistrate Jeffrey Clarke. Office of the State Coroner The Coroner’s office continues to perform well, again in an environment of increased workloads. I thank the Magistrates and all of the staff of the Coroner’s office for their significant contribution and in particular the State Coroner, Terry Ryan and Deputy State Coroner, John Lock for their leadership and support over the last twelve months. Acknowledgements I especially wish to thank all magistrates, judicial registrars and court staff for their dedicated and hard work during the past year. In particular I would like to thank the following: Deputy Chief Magistrate Leanne O’Shea and Deputy Chief Magistrate Terry Gardiner for their steadfast advice and endeavour which has been of great benefit to me in my new role; The regional coordinating magistrates and coordinating magistrates whose contribution has made the efficient running of a large and decentralised court possible; Paul Marschke, Executive Director, for his extensive knowledge and experience in managing the Magistrates Courts Service and his dependable support of the Magistracy; 4 Maryanne May, Principal Legal Officer, and Danielle Palmer, Legal Officer for their assistance to the Magistrates and myself throughout the year; and Kate Cranitch for managing the Office of the Chief Magistrate up until early in 2015 and since then Nicola Azgin, and all of the staff of the Office of the Chief Magistrate including my Executive Assistants, Rachel Monaghan and Joanne Vogel. Judge Orazio Rinaudo Chief Magistrate 5 Executive Director’s overview The Magistrates Courts Service (MCS) comprises a number of specialist units working together to support and meet the operational needs and performance of Queensland’s Magistrates Courts. In administering the Queensland Magistrates Courts offices, the MCS Directorate units include: Magistrates Courts Service Directorate Brisbane Magistrates Court Registry Operations Office of the State Coroner (OSC) Courts Innovation Programs (CIP) Judicial Support (Office of the Chief Magistrate) Each unit has specific responsibilities in supporting the 79 permanently staffed registry locations across Queensland, with 23 of these registries during 2014-15 also being Queensland Government Agency Program (QGAP) offices. Magistrates are permanently located in 32 of these locations and circuit to approximately 80 locations to conduct court, accompanied by court registry staff who undertake operational responsibilities. Highlights Queensland’s first two One-Stop Shop Service Outlet Pilot Customer Centres opened in January 2015. Residents of the Scenic Rim can now perform a majority of State Government transactions at the Beaudesert Customer Centre, and whilst DJAG continues to operate a separate courthouse in Beaudesert, registry staff are assisting in the coordination of volunteer Justice of the Peace services at the new Customer Centre. The Department of Justice and Attorney-General (DJAG) is lead agent of the Gatton Customer Centre, where a team of DJAG and Department of Transport and Main Roads (DTMR) staff are delivering services in a service outlet with an integrated courtroom, magistrate’s chamber and vulnerable witness facilities. The new Customer Centre offers Lockyer Valley residents the full suite of DTMR licensing and registration services, birth, death and marriage certificates, plant and animal permits, court registry services, fines and tax payments as well as federal government Medicare and Centrelink services. The Integrated Criminal Justice Videoconferencing Program continued through 2014-15 to expand the use of videoconferencing across the criminal justice system, to reduce the costs and risks of prisoner transports. Videoconferencing is now the primary method of appearance for court matters for defendants in correctional centres with around 70 per cent of such appearances now being by videoconferencing. The pilot of the early plead guilty online service was launched on 1 July 2014 for 16 courthouses in Southeast Queensland, for four minor offences. On 12 March 2015, this online service was rolled out across Queensland and expanded to include all non-indictable offences. Customer uptake of the early plead guilty online service was high during 2014-15, with approximately 36 6 per cent of guilty pleas in writing being submitted online, as opposed to being submitted via hard copy over the counter. Several advancements including the development of an online search and copy process in Brisbane Magistrates Court (with an online payment facility) means customers can request, pay for orders and receive fulfilment online;

    RESEARCH PAPER SERIES, 2015–16 17 SEPTEMBER 2015 2015 Queensland state election: an overview Dr Joy McCann and Simon Speldewinde Politics and Public Administration Section Executive summary • This paper provides an overview of the issues and outcomes for the January 2015 election for the Queensland Legislative Assembly. Where appropriate, it draws on the Library’s earlier publication on the 2012 Queensland state election.1 • The 2015 Queensland state election result surprised many observers with the dramatic shift in the fortunes of the two major parties. The Australian Labor Party (ALP), having lost government at the 2012 election and retaining just seven seats, emerged with 44 of the 89 seats with a swing of 10.8 per cent. The Liberal National Party (LNP), which had won a record majority of 78 of the 89 seats at the 2012 state election, experienced a swing of 8.3 per cent against it with its seats reduced to 42. Of the remaining seats, two were won by Katter’s Australian Party and one by Independent Peter Wellington. • The election outcome was initially unclear when it was revealed that a Palmer United Party candidate was ineligible as a result of being an undischarged bankrupt. Electoral Commission Queensland (ECQ) indicated that it would refer the Ferny Grove election result to the Court of Disputed Returns but subsequently decided not to proceed based on legal advice, paving the way for the ALP to form minority government with the support of an Independent. • Several key issues emerged during the election campaign including political financing, privatisation and asset sales, the impact of mining on the Great Barrier Reef and anti-association laws.

    PALASZCZUK’S SECOND YEAR AN OVERVIEW OF 2016 ANN SCOTT HOWARD GUILLE ROGER SCOTT with cartoons by SEAN LEAHY Foreword This publication1 is the fifth in a series of Queensland political chronicles published by the TJRyan Foundation since 2012. The first two focussed on Parliament.2 They were written after the Liberal National Party had won a landslide victory and the Australian Labor Party was left with a tiny minority, led by Annastacia Palaszczuk. The third, Queensland 2014: Political Battleground,3 published in January 2015, was completed shortly before the LNP lost office in January 2015. In it we used military metaphors and the language which typified the final year of the Newman Government. The fourth, Palaszczuk’s First Year: a Political Juggling Act,4 covered the first year of the ALP minority government. The book had a cartoon by Sean Leahy on its cover which used circus metaphors to portray 2015 as a year of political balancing acts. It focussed on a single year, starting with the accession to power of the Palaszczuk Government in mid-February 2015. Given the parochial focus of our books we draw on a limited range of sources. The TJRyan Foundation website provides a repository for online sources including our own Research Reports on a range of Queensland policy areas, and papers catalogued by policy topic, as well as Queensland political history.5 A number of these reports give the historical background to the current study, particularly the anthology of contributions The Newman Years: Rise, Decline and Fall.6 Electronic links have been provided to open online sources, notably the ABC News, Brisbane Times, The Guardian, and The Conversation.

    Opinion: Tim Carmody deserves the chance to prove his competence as Chief Justice ANTHONY MORRIS THE COURIER-MAIL AUGUST 04, 2014 12:00AM FEW political commentators try as hard as Tony Fitzgerald to present their own political views as non-partisan. Fitzgerald’s frequent press releases have for some time carried express disclaimers, that he has “never been a member or supporter of any political party” and doesn’t know “any member of any Parliament anywhere”. He has now abandoned this practice and with good reason. Were he the official leader of the Opposition, he could not have done a better hatchet-job on the Newman Government. Which is fine. In a democracy, all citizens are entitled to push the barrow for whichever side of politics they support. What sticks in my craw, however, is the gobsmacking hypocrisy from the once-celebrated corruption-fighter. Fitzgerald obsesses over the youthfulness of the state’s Attorney-General. He does not mention that, in his early 30s, Jarrod Bleijie is about the same age as Fitzgerald was when appointed the state’s (then) youngest-ever QC. Fitzgerald says that Chief Justice Carmody “had briefly been a Family Court judge”. In fact, Carmody’s five years on the Family Court is double Fitzgerald’s time as a Federal Court Judge before appointment as Court of Appeal president. Contempt for Carmody Fitzgerald describes as “startling” and “politically charged” Carmody’s recommendation to prosecute Goss government ministers who (as he concluded) acted illegally in deciding to shred the Heiner documents. Yet Fitzgerald himself recommended “startling” and “politically-charged” prosecutions of ministers in the Bjelke-Petersen government.

    JUDICIAL CONDUCT: CRAFTING A SYSTEM THAT ENHANCES INSTITUTIONAL INTEGRITY GABRIELLE APPLEBY* AND SUZANNE LE M IRE† Judges are human. It is their humanity that allows them to pass judgement on the complexities of fact and law in cases before them. However, their humanity also means they are subject to the usual gamut of human frailties. Problematic judicial conduct remains rare in Australia. However, failing to acknowledge and address it has the potential to damage the integrity of the courts and undermine the ability of individual judges to fulfil the judicial function. In this article we examine the requirements for a ‘good’ complaints system through a comparative analysis of systems operating in Australia and overseas. We proffer an alternative system for Australia, tailored to fit within our constitutional constraints whilst promoting the institutional integrity of the judiciary. Some disappear with nary a trace, while others go on to effect real and lasting change. Why some inquiries succeed and others fail largely depends on the political context and public mood at an inquiry’s calling, the breadth of that inquiry’s terms of reference, the comprehensiveness of its recommendations and the political will of governments to act on those recommendations. There’s little doubt, for example, that Australians today hope the recommendations of the Hayne Royal Commission into the Banking, Superannuation and Financial Services Industry, released in February this year, will not just curtail sharp practice, but force financial institutions to treat clients as people first and customers second. This July marked exactly thirty years since one of Australia’s most far- reaching reports was handed down. Officially titled the Commission of Inquiry into Possible Illegal Activities and Associated Police Misconduct, the Fitzgerald report brought lasting, monumental change to Queensland public life.

It is one of the great virtues of this country that we can usually take for granted the great principles upon which our State and Commonwealth governments stand. The separation of powers and the rule of law usually need not be discussed very much, except among lawyers, and that is a good thing for, when that is so, it means the system is working. ! Under our system of responsible, representative constitutional government, the judiciary is one arm of government together with the executive and the legislature. Its integrity, independence and continued existence is guaranteed by the Australian Constitution itself. That the judges are appointed by the Executive is a historical fact but it cannot alter the fundamental proposition that the Supreme Court cannot, must never, be the tool of the Executive or must not even be suspected of being so. ! That is why the choice of leader of the Supreme Court is so important. The Chief Justice of Queensland is the leader of one of the three branches of government: the branch which keeps a check upon the legislature and the executive, which may have to decide controversies between a citizen and the executive government. ! There can, in the nature of things, only be less than a handful of truly qualified candidates for the position of leader of one of the three arms of government. In living memory in Queensland there has not been such a controversy about the appointment of a new Chief Justice of Queensland as there has been recently.

    Facing up to Diversity? Transparency and the Reform of Commonwealth Judicial Appointments 2008–13 Elizabeth Handsley and Andrew Lynch† Abstract In this article, we describe and consider the impetus for the reforms to federal judicial appointments that were initiated by Attorney-General Robert McClelland in 2008 and applied during the life of the Labor Government until 2013. We then proceed to evaluate those reforms by reference to the central idea of transparency. Looking first at the role of the express criteria in identifying a candidate and then at the way in which particular appointments were publicly justified by the Attorney-General, we assess how adequately all the factors leading to an individual’s selection were acknowledged under the reformed process. This takes us to a fairly familiar controversy — the relationship between ‘merit’ (whether expressed as a one-word concept or through elaborate criteria) and diversity. Our discussion of this relationship draws on the experience of judicial appointments reform in the United Kingdom over the last decade. McClelland was candid about his interest in promoting diversity, but refrained from its direct inclusion in the design of the appointments model. Nevertheless, we argue that diversity considerations found a way into the appointments process. We suggest this was both inevitable and defensible. However, the failure to acknowledge the role of those considerations meant that the model did not ultimately deliver the degree of transparency that was proclaimed as its central rationale.
