In recent years, there has been a notable tendency towards increasing the visibility and usability of libri amicorum. It therefore appeared only fi tting that Prof. dr. Jules Stuyck’s Festschrift serve an audience as wide as his fi eld of expertise is encompassing. Indeed, Jules’ expertise is European as much as it is Belgian. It relates to consumer law as well as competition law. And it is both academic and practical in nature.

Th erefore at the occasion of his emeritus ceremony on 20 September 2013, not one liber, but two libri have been presented to Jules Stuyck. One dedicated to consumer law and another focusing on competition law. One taking a European point of view, the second rooted in Belgian law.1 Th e format of both libri is however similar. In honour of Jules’ renowned skills to switch from law in the books to law in action, we have asked his amici to build their academic contributions on landmark cases of European consumer law and Belgian competition law. Some of these cases have been pleaded by Jules – no surprises there. Many of them have been elucidated by his sharp-witted comments.

Th e libri thus tell the story of the coming of age of two legal domains that were scarcely developed when Jules started his career as an academic and a lawyer, yet that haven’t ceased to expand in depth and scope since. However, neither of the two libri amicorum has been conceived by the editors as an exercise in nostalgia. Th e contributions off er ample food for thought about the challenges awaiting consumer and competition law in the years to come.

Th e selected cases in this book on consumer law are without exception landmark decisions. Th e selection has further been determined by the particular interests of Jules’ friends. What the book doesn’t off er however, is an exhaustive overview of EU consumer law jurisprudence. It doesn’t aspire to be a textbook covering all aspects of consumer law. Rather, the authors have approached the cases – which generally have been commented upon quite extensively in legal doctrine already – from a novel and personal perspective, sometimes coloured by the contributor’s particular background and relation to Jules. We think that the result of the contributors’ eff orts reads as an expression of esteem, friendship and gratitude to prof. dr. Jules Stuyck. At the same time, we trust this book will be read and continue to be read by anyone interested in EU consumer law. And in the end, we hope that this liber amicorum may serve as a reminder of Jules’ contribution to the work in progress that is modern day consumer law.

x Intersentia A PERSONAL NOTE

I met Jules Stuyck for the fi rst time nearly thirty years ago at a conference in Brussels. Where else could it have been in 1983 or 1984? Th e European Union, at that time the European Economic Community, was in bad shape. Th e Single European Act had not yet been adopted, nor even the now famous White Paper on the Completion of the Internal Market. Th e European Commission had put consumer law on its agenda, via the fi rst programme in 1976 and the second in 1981, but was lacking the drive, power, support and legitimacy to push for the realisation of what would later become a coherent body of European consumer law directives. Jules, who had started his career with a PhD on ‘Aggressive Sales Methods’ in 1975, was presenting the fi ndings of a study undertaken for the European Commission on ‘Product Diff erentiation in Terms of Packaging, Presentation, Advertising, Trade Marks, etc. An assessment of the legal situation regarding pharmaceuticals and certain other consumer goods’ (Kluwer Law and Taxation Publishers, Deventer, 1982). I remember a young scholar – I was young myself at that time – who raised uncomfortable questions about the link between competition law and consumer law. He did not seem to be caught by the overall trend in the Member States and in the emerging consumer law community that pushing for consumer law is ‘a good thing’ per se. He claimed that the extension of consumer rights impacts on competition and competition law and that the relationship between the two fi elds deserves a holistic approach. Th is attitude, which never changed over the decades, is characteristic of Jules’ approach to law and legal research. I term it intellectual independence and resistance against mainstream ideologies. Th e reasons could be related to the two fi elds of research which kept Jules busy in his academic life – competition and consumer law. However, there is a third and maybe even deeper explanation: Jules loves cases. Th roughout his writings, we can easily trace his deep interest in the true world of litigation where diff ering interests clash and where black and white are diffi cult to discern. Studying the law in action works as a shield against ideologically loaded position taking, against twisting the law into the direction where it should go according to the ups and downs of policy trends.

Since the early 1980s we have regularly met, co-operated, organised conferences, published books and exchanged ideas in a nearly endless fl ow of meetings around the world. One of the major projects we started was the Casebook on Consumer Law within the Series of the Ius Commune. When Walter van Gerven

Intersentia xi A Personal Note approached me, asking whether I was ready to edit jointly with Jules the envisaged casebook on European consumer law, I felt honoured and confi rmed my participation immediately. Later, Jules and I decided to take Evelyne Terryn on board – I fear the publication might have taken much longer without her support and input. Th e Ius Commune project dovetails with Jules’ approach to law: using cases to building European law bottom-up. Th e realisation of the project, which started as early as 2005, intensifi ed our relationship. We had to organise meetings in Bamberg, Brussels or Florence to bring together the authors and to agree on a common framework. Here I benefi tted from Jules’ commitment to the ius commune project, from his skills and knowledge in broad fi elds far beyond consumer law, from his generosity as a host and from his friendship. Th e book for which I was asked to write this little note is meant to honour an outstanding scholar, a bright intellectual mind and a respectful warm-hearted personality. Cheers!

It should only happen to you. Your whole life, through short sentences, rapid steps and subtle wit, without stressing the point, you show others that you need to focus on the essentials. Not on titles and positions, not on routine management tasks, interference and tiredness, not on meetings and ceremonies, but on academic content and your fellow human beings in social relations. Despite staying true to this – never complain never explain – you still can’t avoid a grand celebration with Libri, and inevitably a laudatio.

Jules, or rather Julien Henri and, aft er his father, Victor. Connected to the Tienen area on his mother’s side and through his home, but also with a partially Antwerp bloodline, having moreover spent a large part of his youth in Germany due to his father’s military career. Anyone who hears his beautiful English would not suspect how naturally he speaks French and German, while his accentless Dutch outshines even the best Flemish news anchor. No one can roll their ‘r’s in as many languages as Jules.

As a young man, Stuyck returned from Germany earlier than the rest of his family to study law in Leuven. Having just turned 17, he lodged with his family in Tienen. Th at was in the mid-60s. His good voice won him a place in the Trio Egidius, which became a quartet. In that quartet there were two brothers who had a sister called Mieke. She wasn’t a member of the quartet, but still… At that time, Jules was already a big Beatles fan, and still is today.

As a student, Jules looked up to the young Vice-Rector Walter Van Gerven. Jules’ speed and precision proved to be just as legendary as those of his mentor. Already in 1972 he and Mieke got married and in 1975 he was awarded his PhD, under Van Gerven’s supervision. Th e three children, Kristof, Ansje and Bindu followed in due course.

Although a brilliant all-rounder, during his studies, Jules gave priority to véracité. So, in keeping with tradition, he had to cool his heels for a while as senior assistant and then supervisor, or ‘werkleider’, as they called it at the time. It was then, in 1981, that I got to know him as a very enjoyable, modest and witty colleague who was never at a loss for a joke from famous Dutch stand-up comedians such as Koot and Bie, or Freek. Always timely, but still always on the road. Jules used this ‘antichambre’ time to undertake additional studies in

Stockholm and at the Max Planck Institute, and to publish an impressive number of articles and books still at a very young age. Th e style of his early work remains highly distinctive: straight to the point, closely connected to the judiciary and the legislature, almost casuistic, using as few words as possible. His style already had a touch of Holland about it before he even went to teach there.

Jules’ thesis on aggressive sales methods dealt with consumer law and commercial market practices, and anyone who ploughs through his lengthy list of publications – I counted over 400 – will fi nd that he has always preferred this branch of the law. Th e best proof of this is the Ius Commune Case Book on Consumer Law (2010), the recently published third edition of the Treatise Commercial Market Practices (Handboek Handelspraktijken) in the series Beginselen van Belgisch privaat recht, and his decades-long editorship of the Revue du Droit de la Consommation/Tijdschrift voor Consumentenrecht (DCCR). He also still sits on dozens of other editorial and advisory boards, for Belgian and international journals on both consumer and European law.

Few explore an academic fi eld in such depth and breadth at the same time: fi rst of all, Jules branched out into cartel law, with a lively much appreciated review of case law (TPR 1981) and a monograph about product diff erentiation (1981). Later came, together with Bos and Wytinck, the English standard publication about the new Merger Control Regulation (1992), and together with Van Gerven and others, the Treatise on Cartel Law (Handboek Kartelrecht) (1996).

With hindsight, Jules’ career went into the highest gear in 1987, the year in which he was given tenure as full professor of economic and European law in Leuven and Nijmegen simultaneously. Two years later, he was also appointed to the . In the run-up to Jacques Delors’ internal market in 1992, when he occupied the chair bearing the same name at the University of Liège, Jules eagerly embraced the four European freedoms. Gradually, he came to be the Leuven specialist in substantive European law, from state aid to anti- dumping, from transfer of seat to golden shares, to GATS, patent law and the obligation to publish a prospectus. Many national and international research projects followed. European law touches on everything, and it takes a versatile generalist to cover the whole fi eld. He is therefore the fi rst occupant of the chair for the new compulsory course for a Master’s degree at Leuven – European social and economic law– the name being inspired by the joint Dutch/Flemish journal Sociaal Economische Wetgeving. Th e course was subsequently renamed Substantive Law of the European Union, but Jules continued to retain the chair.

His mastery of many languages, his business-like delivery, rapid discourse and dry wit make Jules a celebrated professor. He is twice Jean Monnet professor at the University of Bonn (1990–1995), and permanent visiting professor at the xiv Intersentia Laudatio

Universities of Paris-Panthéon (2008–2012) and Budapest (2000 to date). Recently, he also held the Francqui chair at Namur university. With his international outlook, it is no surprise that he developed the Generale Bank chair as from 1987, in cooperation with the economics faculty he knew from the inside as a lecturer, into an international chair in European Integration, not to mention leading the LL.M. programme at Leuven for ten years. He looked aft er the international students in a fatherly, empathic manner. Th e same gift s serve him well when supervising PhD students. Jules has a faithful following, with some of his pupils standing out. Th ey have become his close fellows and colleagues: Peter Wytinck, Béatrice Ponet, Gert Straetmans, Evelyne Terryn, Veerle Colaert and Tom Van Dyck. Under his leadership, the Institutes for Consumer Law and European Economic Law have grown into prominent research settings.

For a scholar of European law, there is no practice closer to academia than the Court of Justice. Jules became a formidable and erudite attorney before that Court, as well as before the Belgian courts. He is soon running the department of European and competition law at the leading Brussels fi rm Liederkerke as a partner. He is a highly sought-aft er adviser for European institutions and agencies. Anyone steeped in consumer law knows that it is like a modern contract law. So it’s not by coincidence that Jules became the fi rst Belgian member of the high-profi le expert group on European Contract Law. True greatness always shines through. So, there is no place for superlatives, they would just make Jules feel awkward. However, at the last research visitation of the Leuven law faculty, in all his modesty, he turned out to have grown into one of the most outstanding Leuven fellows in international circles.

Jules has always chosen his home location very cleverly, starting at the stylish house in Boutersem, then, once the children had left home, living in a house renovated by his son Kristof near Leuven station so that he could travel around Belgium and neighbouring countries by train. He worked incessantly on the train, and the only sport which he practiced was walking to and from the station as fast as possible. But he did this with true dedication, eff ortlessly keeping in trim.

Mieke, who taught languages for many years before fi nally moving on to craft ing with words and ceramics, not only worried, but also took care of everything. Jules did his bit, going along with the solutions off ered if he did not fi nd them himself. Jules is an excellent chef, cooking up delicious creations. He is even better at choosing and tasting the wine, for a convivial occasion, preferably with his family in a special place in the south of France treasured by father to son. I’ve seldom seen anyone who is such a natural at multitasking as Jules.

Mieke’s illness, lasting several years, was borne quietly but not secretively. No one will forget how Jules graced the funeral mass with his choir. Her death came far too early, but Mieke’s life, and Jules’ with her, could scarcely have been bettered. Jules’ vigour and wisdom, and his bond with his children and grandchildren were made even stronger by loss, as also happened when two of his fi ve sisters passed away far too young. Now more than ever, Jules is a traveller who seeks far horizons, in the excellent company of Luth, and with a broad culture, with a preference for India.

On behalf of the faculty and the department, I thank him for his invaluable friendship and unstinting dedication, and wish him the best possible journey that literally gives him the time – for he has always found the time. We dare to hope for his continued generous support and inspiration.
