The report contains three volumes in one document. Volume I is concerned with heritage rates and the methods used to estimate the rates; Volume II describes the methods and results of a current fish consumption survey; Volume III is a technical appendix to Volume II. A foreword to Volumes I-III has been authored by the Shoshone-Bannock Tribes and EPA. The Shoshone-Bannock Tribes have also authored a second foreword to Volumes I-III and the ‘Background’ section of Volume I. -

Statement of Alonzo Coby, Chairman of the Fort Hall Business Council for the Shoshone-Bannock Tribes Hearing on S. 2802 Blackfoot River Land Settlement Act of 2009 Senate Committee on Indian Affairs April 29, 2010 I. Introduction Good afternoon Chairman Dorgan, Vice-Chairman Barrasso, Senator Crapo, and other Members of the Committee. My name is Alonzo Coby, and I am the Chairman of the Fort Hall Business Council, which is the governing body of the Shoshone-Bannock Tribes located on the Fort Hall Reservation in southeast Idaho. I am honored to be here today to provide our views on S. 2802, an Act to settle land ownership issues on the Blackfoot River in southeastern Idaho. We particularly appreciate that Senator Crapo, our Senator from Idaho, introduced this bill with Senator Risch. On the House side, Representative Mike Simpson along with Representative Walt Minnick introduced H.R. 4613, the companion bill to S. 2802. Our delegation understands the importance of resolving these historic land title issues in southeast Idaho that have created challenges for the Tribes and non-Indian landowners. We greatly appreciate Mr. Marion Walker, a landowner affected by the legislation, being able to come and offer his support. This legislation is supported by all the affected non-Indian landowners. For over five years, these issues have been in litigation before a water master in Idaho. We have been working with the Tribal landowners, non-Indian landowners, the Bureau of Indian Affairs, the Bingham County Commissioners, and the state of Idaho to amicably address and resolve these long-standing land matters. -

RESERVATION OF RIGHTS A number of governments and agencies participated in the development of this Kootenai Subbasin Plan, Part I (Assessment Volume), Part II (Inventory Volume), and Part III (Management Plan Volume), its appendices, and electronically linked references and information (hereafter Plan). The primary purpose of the Plan is to help direct Northwest Power and Conservation Council funding of projects that respond to impacts from the development and operation of the Columbia River hydropower system. Nothing in this Plan, or the participation in its development, is intended to, and shall not be interpreted to, compromise, influence, or preclude any government or agency from carrying out any past, present, or future duty or responsibility which it bears or may bear under any authority. Nothing in this Plan or the participation in its development constitutes a waiver or release of any rights, including the right to election of other remedies, or is intended to compromise, influence, or preclude any government or agency from developing and prosecuting any damage claim for those natural resource impacts identified in the Plan which are not directly and exclusively resulting from, or related to, the development and operation of the Columbia River hydropower system. Braatne3, Assistant Professor, University of Idaho; Rohan Benjankar1, Research Associate, University of Idaho. 1Center for Ecohydraulics Research, Boise, ID 2Rocky Mountain Research Station, Boise, ID 3College of Natural Resources, Moscow, ID Abstract The regulated hydrograph of the Kootenai River between Libby Dam and Kootenay Lake has altered the natural flow regime, resulting in a significant decrease in maximum flows (60% net reduction in median 1-day annual maximum, and 77%-84% net reductions in median monthly flows for the historic peak flow months of May and June, respectively). Other key hydrologic characteristics have also been affected, such as the timing of annual extremes, and the frequency and duration of flow pulses. Moreover, Libby Dam has impeded downstream delivery of sediment from the upper 23,300 km2 of a 50,000 km2 watershed. Since completion of the facility in 1974, observed impacts to downstream channel bed and bars in semi-confined and confined reaches of the Kootenai River have included coarsening of the active channel bed, homogenization of the channel bed, disappearance of relatively fine-grained beach bars, and invasion of bar surfaces by perennial vegetative species. These impacts have led to reduced aquatic habitat heterogeneity and reduced abundance of candidate recruitment sites for riparian tree species such as black cottonwood (Populus trichocarpa) and native willows (Salix spp.). Limited quantitative documentation of the pre-regulation substrate composition exists. -

Appendix D American Indian Background Information INTRODUCTION This appendix provides background information about the American Indian tribes with off-reservation interests and rights in the lands now administered by the Boise, Payette, and Sawtooth National Forests. Basis for Legal Status Treaty with Nez Perce Tribe, June 11, 1855; Nez Perc Treaty, June 9, 1863: Treaty with Nez Perce Tribe, August 13, 1868; Agreement with Nez Perce, May 1, 1893; . Data Construction and Sample Selection Additional measures of bison-reliance: Our anthropological measure of bison reliance is generated from anthropological accounts of bison-reliance taken from Waldman (2009). We construct a scale from 0 to 1 in 0.1 increments that range from “no contact with the bison” to “calories being almost completely based on bison products all year.” The coding of this variable is given in Tables A1. For those nations that were not included in Waldman (2009), we find additional sources to inform our coding. Please refer to Tables A3, A4, A5, and A6 for the list of sources additional sources used. For tribal names in our data sources that are too broad for reasonable classification of this measure, we use our original measures of bison-reliance. In all data sets, this represents a relatively small fraction of communities, and the correlation between the anthropological measure and the geographical measure is roughly 0.8.
