    Indian entertainment and media outlook 2010 2 Indian entertainment and media outlook 2010 Message To our clients and friends both in and beyond the entertainment and media industry : Welcome to the 2010 edition of PricewaterhouseCoopers’ Indian Entertainment and Media (E&M) Outlook, covering the forecast period of 2010–2014. Our forecasts and analysis for this edition focus on eight major E&M industry segments and one emerging segment. Each segment details out the key trends observed and challenges faced apart from providing the prospects for the segment. In the industry overview section, we have highlighted the key theme observed during 2009 and what we perceive as future trends in the coming years. We have a chapter on the tax and regulatory impact on the various E&M segments and for the very first time we have included a chapter on how technology can be leveraged in the E&M industry. In 2009, the economy severely impacted the world, translating into steep declines in advertisement as well as consumer spending. India though impacted, did manage to show growth with increased consumer spending as well as innovative action on the part of the industry. Against this backdrop, across the world, except certain markets, speed of digital spending increased due to changing consumer behavior as well as technology available to deliver the same. In India, while the spend on digital media is likely to grow, it is unlikely that it will dominate in the forecast period. This is largely due to the relative unavailability as well as unaffordability of the broadband and mobile infrastructure.

    ABSTRACT A CASE STUDY OF CROSS-OWNERSHIP WAIVERS: FRAMING NEWSPAPER COVERAGE OF RUPERT MURDOCH’S REQUESTS TO KEEP THE NEW YORK POST by Rachel L. Seeman Media ownership is an important regulatory issue that is enforced by the Federal Communications Commission. The FCC, Congress, court and public interest groups share varying viewpoints concerning what the ownership limits should be and whether companies should be granted a waiver to be excused from the rules. News Corporation is one media firm that has a history of seeking these waivers, particularly for the New York Post and television stations in same community. This study conducted a qualitative framing analysis of news articles from the New York Times and the Wall Street Journal to determine if the viewpoints expressed by the editorial boards were reflected in reports on News Corp.’s attempt to receive cross-ownership waivers. The analysis uncovered ten frames the newspapers used to assist in reporting the events and found that 80% of these frames did parallel the positions the paper’s editorial boards took concerning ownership waivers. One of the options to improve the design involves personalizing media selection from the existing Electronic Service Guide. The opportunity to deliver personalization has been made easier by the rapid pace of convergence. The overall aim of the project is to explore how to realize personalized ESG based on shifting contexts in converged digital broadcast and 3G environments. This report covers a review of various aspects influencing ESG design, an analysis of the stakeholders involved in mobile TV, and the planning, implementation and analysis of a case study based on a broadcaster. On this basis, an ESG design is proposed and preliminary work has been done on a prototype.     A Supreme Court's Place in the Constitutional Order: Contrasting Recent Experiences in Canada and the United Kingdom Paul Daly" In 2014, the Supreme Court of Canada ruled in Reference re Supreme Court Act, ss 5 and 6 that its position at the apex of the judicialsystem was constitutionally entrenched. It did so by interpreting its own history and developing a narrative that emphasized both the critical importance of section 6 in protecting Quebec's distinct interests and legal tradition, and the Court's position as domestic rights protector. The author analyzes this narrativeand argues that the Court'sentrenchment within the Constitution Act, 1982 was not as inevitable 2015 CanLIIDocs 5258 as its reasoning suggests. The article then turns its attention to the newly established United Kingdom Supreme Court and its role pre-and post-adoption of the Human Rights Act 1998. The authorpulls out themes in the Court's recent judgments-which suggest a move awayfrom the European Convention for the Protection of Human Rights and Fundamental Freedoms and the Strasbourg Court and a desire to return to British common law traditions-andan emerging narrativethat resembles that of its Canadiancounterpart.
