276 Road Traffic and Vehicles No. 84. 1979 No. 84 ROAD TRAFFIC AND VEmCLES Urban Clearways () Order () 1979 Made. 21st March 1979 Coming into operation 30th April 1979 The Department of the Environment in exercise of the powers conferred on it by section 19 of the Road Traffic Act (Northern Ireland) 1970(a) and of all other powers enabling it in that behalf hereby makes the following Order:- Citation, commencement and interpretation 1.-(1) This order may be cited as the Urban Clearways (Belfast) Order (Northern Ireland) 1979 and shall come into operation on 30th April 1979. (2) In this order:- "clearway" means a road or length of road specified in column 1 of Schedule 1; "lay-by" means any area of carriageway intended for the waiting of vehicles and bounded partly by a longitudinal broken white line and partly by the outer edge of that carriageway on the same side of the road as that on which the line is placed. (3) For the purpose of this order a vehicle shall be deemed to wait for more than two minutes on a clearway if any point on the road. is below the vehicle or its load (if any) throughout a period exceeding two minutes. whether or not the vehicle is moved during the period. Revocation 2. The bye-laws in respect of urban clearways specified in Schedule 2 are hereby revoked. Control of waiting on clearways 3. Save as provided in articles 4, 5, 6 and 7, no person shall cause or permit any vehicle to wait:- (a) on a clearway during the hours and on the days· specified in columns 2 and 3 respectively; (b) wholly or partly on a footWay forming part of a clearway at any time; (c) on a verge between a footway and a carriageway which are part of a clearway at any time; (d) on a central reservation of a dual carriageway which is a clearway at any time. 4. Nothing in article 3(a) shall render it unlawful to cause or permit any vehicle to wait on a clearway for so long as may be n,ecessary to enable a person to board or alight from the vehicle or to load thereon or unload there­ from his personal luggage.

(a) 1970 c. 2 (N.J.) as substituted by S.l. 1978/1051 (N.J. 21) No. 84 Road Traffic and Vehicles 277 Provided that, except where the said person is a disabled person, no vehicle may wait longer than two minutes. Exemptions '5. Nothing in article 3 shall apply to any of the following vehicles, that is to say:- (a) veb,icles being used for fire brigade, ambulance or police purposes; (b) vehicles being used in the' service of a district council in pursuance of statutory powers or duties. 6.-(1)' Nothing in article 3 shall render it unlawful to cause or permit any vehicle to wait on a clearway:- (a) if the vehicle is on actual use on the clearway for the purpose of delivering or collecting postal packets as defined in section 87 of the Post Office Act 1953(b); (b) while the vehicle, if it cannot conveniently be used for such purpose in any road not being a c1earway, is being used in copnection with any building operation or demolition in or adjacent to the clearway, the removal of any· obstruction to traffic it1 the clearway, the maintenance, improvement or reconstruction of theclearway, or the laying, erection, alteration or repair fu. or adjacent to the clearway of any sewer or drain or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line as defined in section 2 of the Telegraph Act 1878(c); or (c) while any gate or other barrier at the entrance to premises to which the vehicle requires a<;:cess or from which it has emerged is being . opened or closed, if it is not reasonably practicable for the vehicle to wait otherwise than on the clearway while such gate or barrier is being opened or closed. (2) Nothing in article 3(a) shall render it unlawful to cause or permit any vehicle to wait where the person in control of the vehicle is required by law to stop, or is obliged to do so in order to avoid an accident, or is prevented from proceeding by circumstances outside his control. (3) Nothing in article 3 shall apply to anything done upon the direction or with the permission of a constable or a traffic warden. 7. Nothing in article 3 shall render it unlawful to cause or permit any vehicle to wait in a lay-by.

Th~ restrictions imp!:>sed by this order shall be in addition to and not in derogation of any restriCtion or requirement imposed by the Road Traffic Act (Northern Ireland) 1970 or by any regulations made thereunder or by any other enactmep,t.
