FOOD ACT 1983 FOOD (AMENDMENT) (NO. 2) REGULATIONS 2014
IN exercise of the powers conferred by section 34 of the Food Act 1983 [Act 281], the Minister makes the following regulations:
Citation and commencement
(1) These regulations may be cited as the Food (Amendment) Regulations 2014.
(2) These Regulations come into operation on ______
Amendment of regulation 11
1. Regulation 11 of the principal Regulations is amended:
(a) by substituting for subregulation 1(g) the following:
(g) where the food contains food additive, a statement as to the presence in that food of such food additive, (i) state the functional class of the relevant food additive, followed by the name and the INS number in brackets, (ii) where the food additive other than flavouring substance does not have INS number, only the functional class and the name shall be declared; or; (iii) where the food additive is a flavouring substance, only the functional class shall be declared; (g)(a) for the purpose of subregulation (1)(g), where the food contains food additive of animal origin, the origin shall be specified the common name of such animal in brackets, immediately following the INS number, (g)(b) notwithstanding anything in these Regulations, where the food contains more than one food additive or of more than one food additive functional class, a single statement is sufficient, (g)(c) for the purpose of subregulation (1)(g), where the food contains food additive of animal origin, the origin shall be specified by the common name of such animal in brackets, immediately after the functional class, name or INS number, (g)(d) where the food contains aspartame or neotame, in not less than 10 point lettering, the words “PHENYLKETONURICS: CONTAINS PHENYLALANINE”, or (g)(e) where the food is added with sugar alcohol, in not less than 10 point lettering, the words “EXCESSIVE USE CAN HAVE LAXATIVE EFFECT”. (g)(f) where the food is added with polydextrose at 25g/100g or more, in not

less than 10 point lettering, the words "Sensitive individuals may experience a laxative effect from the excessive consumption of food containing polydextrose". (g)(g) where the food is added with sulphite or sulphur dioxide, is more than 10 mg/kg, the words “contains sulphur dioxide”. (b) by substituting for subregulation (3) the following;
(3) For the purposes of paragraphs (1)(e), where the ingredients of the food, are derived from animal, the common name of such animal shall also be stated on the label of that food:
Provided that shall not be necessary to indicate the name of the animal from which the ingredient is derived if it can be inferred from the appropriate designation of such ingredient.
Amendment of regulation 19
2. Regulation 19 of the principal Regulations is amended by substituting for the regulation the following regulation;
(1) In these Regulations, “food additive” means any safe substance that is not normally consumed as a food by itself or used as a typical ingredient of the food, and intentionally introduced into or on a food in order to affect the food's keeping quality, texture, consistency, appearance, odour, taste, alkalinity, or acidity, or to serve any other technological purpose in the manufacture, processing, preparation, treatment, packing, packaging, transport, holding or storage of the food, and that results or may be reasonably expected to result directly or indirectly in the substance or any of its by products becoming a component of, or otherwise affecting the characteristic of the food but shall not include added nutrient, incidental constituent or salt. (2) For the purpose of these regulations, food additives includes acidity regulator, anticaking agent, antifoaming agent, antioxidant, bleaching agent, bulking agent, carbonating agent, carrier, colour, colour retention agent, emulsifier, emulsifying salt, firming agent, flavouring, flavour enhancer, flour treatment agent, foaming agent, gelling agent, glazing agent, humectant, packaging gas, preservative, propellant, raising agent, sequestrant, stabilizer, sweetener and thickener, as defined under Table I of the Sixth B Schedule.
(3) No person shall import, manufacture, advertise for sale or sell or introduce into or on any food, any food additive other than a permitted food additive: (a) any food additive other than a permitted food additive; (b) any food additive that is prohibited by these Regulations as prescribed in Table II of the Sixth B Schedule;and

(c) any permitted food additive which does not comply with the standard for certain permitted food additive prescribed in Table III of the Sixth B Schedule. Provided that where no standard is prescribed, the purity of the permitted food additive shall conform to the specifications as recommended by the Joint Food and Agriculture Organisation of the United Nations and World Health Organisation (FAO/WHO) Expert Committee on Food Additives (JECFA). (4) Notwithstanding subregulation (3), the addition of food additive to food is prohibited except where – (a) the addition is permitted by these Regulations as prescribed in Table IV of the Sixth B Schedule; or (b) the addition is permitted under the Codex Alimentarius; or (c) the addition is permitted through a written approval by the Director. (5) For the purpose of subregulation (4), a reference in these Regulations to addition or use of "other food" in the composition of food for which a standard is prescribed in these Regulations shall not be construed as permission for the use of food additives. (6) The proportion of the addition of food additive to food shall not exceed the maximum proportion, if any, prescribed under these Regulations. Where no maximum proportion is prescribed, the food additive shall be used in accordance with good manufacturing practice. (7) Where the use of more than one of such preservatives and antioxidants is permitted by these Regulations, the amount of each shall be such that when expressed as a percentage of the amount permitted singly, the sum of the several percentages does not exceed one hundred (8) No person shall introduce into or on a food any food additive in such a manner as to conceal any damage to, or any inferiority in the quality of that food. (9) Notwithstanding anything in these Regulations, a food additive may be present in any food as a result of carry-over from a raw material or ingredient used to produce the food, provided that - (a) the additive is permitted by these Regulations to be in any ingredient used in the manufacture of the food; (b) the proportion of the additive in any such ingredient does not exceed the maximum proportion if any, permitted by these Regulations for that ingredient; (c) the total proportion of the additive in the final

product does not exceed the maximum proportion, if any, permitted by these Regulations for that product; (d) the food into which the additive is carried over does not contain the additive in a greater quantity than would be the case if the food were made under proper technological conditions and in accordance with good manufacturing practice; and (e) the additive carried over is present in the food at a level that is significantly less than that normally required for the additive to achieve an efficient technological function in its own right. (10) For the purpose of subregulation 11(1)(g), INS refers to a harmonized naming system for food additives developed by Codex Alimentarius and published in Codex Class Names and the International Numbering System for Food Additives, CAC/GL 36. (11) There shall be written in label on a package of food additive imported, manufactured, advertised for sale or sold as food additive – (a) the words "(state the chemical name of the food additive and the INS number) as permitted (state the functional class of food additive)"; provided that in the case of colouring substance or flavouring substance it shall be sufficient to state the common name or appropriate designation of the food additive in place of the chemical name; and (b) a statement giving direction for its use; and (c) the words ‘For Food Use’ or a statement substantially similar thereto, in a prominent position on the label. Amendment of regulation 20
3. Regulation 20 of the principal Regulations is amended by deleting the regulation.

4. Regulation 20A of the principal Regulations is amended by deleting the regulation.
New regulation 20B
5. Regulations 20B of the principal Regulations is amended by inserting after regulation 20A the following regulation:
(1) For the purpose of these regulations-
(a) ‘sweetener’ refers to a food additive other than a

monosaccharide or disaccharide sugar which imparts a sweet taste to a food.
(b) ‘sweetener preparation’ refers to a product in tablet, granular, powder or liquid form prepared by admixing one or more permitted sweetener in a base with or without other food and includes table-top sweetener.
(2) Sweetener preparation may contain any of the following substances as the base-
(a) Acacia (gum arabic) (b) Agar (c) Alginic acid and its sodium, potassium and ammonium salts, calcium alginate and propylene glycol alginate (d) Carrageenan (e) Citric acid (f) Dextrin (g) Dextrose (h) Ethyl alcohol (i) Glucono-delta-lactose (j) Glycerol (k) Guar gum (l) Karaya gum (m) Hydroxypropylmethylcellulose (n) Lactose (o) L-leucine (p) Locust bean gum (q) Mannitol (r) Methylcellulose (s) Mono-, di-, and polysaccharides (t) Pectin (u) Potassium acid tartrate (v) Propylene glycol (w) Sodium bicarbonate (x) Sodium carboxymethylcellulose (y) Sodium citrate (z) Sodium phosphate (aa) Sorbitol (bb) Tartaric acid (cc) Tragacanth gum (dd) Water (ee) Xanthan gum
(3) A liquid sweetener preparation of may contain sulphur dioxide, benzoic acid or sorbic acid in proportion not exceeding a total of 2,000 mg/kg whether present singly or in any combination as permitted preservative.

(4) Except as otherwise provided, a sweetener preparation may contain the following food additive –
(a) polyethylene glycol in a proportion not exceeding 10000 mg/kg (in tablet form only) (b) ethyl maltol (c) magnesium stearate (d) maltol (e) microcrystalline cellulose (f) polyvinylpyrrolidone (g) silicon dioxide (h) stearic acid (i) tricalcium phosphate (in granular and powdered form only)
(5) There shall be written in the label of a package containing sweetener preparation for each of the sweetener - (a) in not less than 10 point lettering, the name of the sweetener; provided in the case if it contains artificial sweetener, in not less than 10 point lettering, the words “CONTAINS ARTIFICIAL SWEETENER" (b) a statement of concentration- (i) in the case of tablets, as milligrams per tablet; (ii) in the case of liquids, as percentage weight in volume; and (iii) in the case of granules or powder, as milligrams per serving contained in a sachet or similar package. (c) a statement indicating the equivalence of the sweetener both in sweetness and energy; (d) where the sweetener preparation contain aspartame a statement in the form “PHENYLKETONURICS: CONTAINS PHENYLALANINE”; and (e) where the sweetener preparation contains sugar alcohol either singly or in combination, a statement in the form "EXCESSIVE USE CAN HAVE LAXATIVE EFFECT”. Amendment of regulation 21
6. Regulation 21 of the principal Regulations is amended by deleting the regulation.
New regulation 21A
7. The principal Regulations are amended by inserting after Regulation 21 the
6 following regulation:
(1) For the purposes of these regulation- (a) "colour" means a food additive, which adds or restores colour in a food and includes colour preparation. (b) "colour preparation" means a product prepared by admixing one or more permitted colour with permitted diluents; and (c) "diluent" means any component of colour preparation that is not itself a colour and has been intentionally mixed therein to facilitate the use of the mixture in colouring foods. (2) Colour preparation shall contain not less than 4 per cent of permitted colour. Liquid form of colour preparation may contain benzoic acid as permitted preservative in a proportion not exceeding 1,500 mg/kg and calcium phosphate as permitted acidity regulator in proportion not exceeding 4,000 mg/kg. (3) Colour preparation may contain any of the following diluents- (a) anhydrous sodium sulphate, sodium chloride, sucrose, dextrose, cornflour or starch to be used in the powdered form; or (b) water, ethyl alcohol, edible oil, sugar syrup, sorbitol, glycerine or propylene glycol to be used in the liquid form. (4) Every package containing colour imported, manufactured or advertised for sale, or sold or intended to be used for colouring food shall, in addition to the requirements of regulation 19(11), be labelled with- (a) where the colour is a synthetic dye which has colour index number or colour preparation containing synthetic dye, the colour index number of the synthetic dye; and (b) in the case of colour preparation, the common name, and the total percentage proportion, of the colour present in the preparation. (5) Nothing in this regulation shall prohibit the sale of fish, meat, cheese, egg, vegetable, fruit, or nut that bear markings which have been applied for the purpose of identification or grading to the food in its raw or original form, or on a portion of the food normally eaten, if such markings- (a) are composed of permitted colour, with or without

other permitted food additives or harmless diluents; (b) contrast strongly with their background; (c) do not cover a substantial area of the original surface to which they were applied; and (d) have not penetrated the underlying part of the food to any noticeable degree. Amendment of regulation 22
8. Regulation 22 of the principal Regulations is amended in subregulation (7) by substituting the following regulation:
(7) Preparation of permitted flavouring substances may contain the following food additive –
(a) Sulphur dioxide in a proportion not exceeding 800 mg/kg, benzoic acid in a proportion not exceeding 350 mg/kg or sorbic acid in a proportion not exceeding 800 mg/kg and in whether present singly or in any combination as permitted preservative;
(b) Propyl, octyl or dodecyl gallate or any mixture thereof in a proportion not exceeding 100 mg/kg, butylated hydroxy-anisole (BHA) in a proportion not exceeding 200mg/kg, butylated hydroxyl- toulene (BHT) in a proportion not exceeding 200mg/kg, any mixture of BHA and BHT in a proportion not exceeding 200mg/kg or isopropyl citrate, monoisopropyl citrate in a proportion not exceeding 100mg/kg or tocopherol and in whether present singly or in any combination as permitted antioxidant;
(c) Karaya gum;
(d) Silicon dioxide, amorphous; and
(e) Propylene glycol
