Brings Challenging Obstacle Course Endurance Event to Summit County in Summer 2017 LOUISVILLE, Co. (Nov. 3, 2016) – Tough Mudder Inc., Human Movement, Inc. (HMM) and Copper Mountain together announced today that the best-in-class obstacle endurance events, Tough Mudder and Tough Mudder Half Colorado, will take place at Copper Mountain in July 2017 after being in Snowmass for three years. “We are thrilled to bring Tough Mudder and Tough Mudder Half to Copper Mountain for the first time in 2017, and we are excited to host thousands of new and returning Mudders,” said Courtney Jordan, Event Director for Tough Mudder, Inc. “We look forward to working closely with the Copper Mountain venue, Human Movement as well as the local community & stakeholders to produce a successful event and provide a positive economic impact on the region.” Over the weekend of July 15 and 16, Tough Mudder, Inc. will host two events: Tough Mudder and Tough Mudder Half. • Tough Mudder: The premier 10-12 obstacle course challenge designed to test physical and mental strength, stamina and teamwork. Tough Mudder will pack in 20-25 signature obstacles, such as King of the Swingers, Arctic Enema, the infamous Electroshock Therapy and a handful of new-for-2017 obstacles. • Tough Mudder Half: Designed to require less training and facilitate teamwork, Tough Mudder Half packs in all the thrills of Tough Mudder into half the distance. The event is a 5-mile course that does not include more daunting obstacles on the full course, such as those with ice or electricity. It features about 12-15 signature obstacles, such as Everest, The Block Ness Monster Mud Mile, and that test teamwork, grit and strength. The events are not races, but challenges in which participants focus on teamwork and camaraderie rather than speed or podium winners. The events are untimed, and finishers receive a customer performance tee-shirt from event sponsor Merrell, as well as an ice cold beer and finisher headband. “We are thrilled to welcome Tough Mudder to Copper Mountain,” said Gary Rodgers, president and general manager at Copper Mountain Resort. “Tough Mudder’s emphasis on teamwork and camaraderie is a great match for Copper’s own values, and our high alpine terrain combined with Tough Mudder’s world-class obstacles is sure to create an unforgettable experience. Christopher Noe and Joseph Weber Over the seven years since its founding in 2010, Spartan Race grew to be the world’s most popular obstacle course race provider. In 2012 and 2016, the company raised a total of $15 million through two separate private equity investments.1 In 2017, however, Spartan Founder and CEO Joe De Sena was contemplating the possibility of an initial public offering. One question that he had was what impact, if any, the new accounting standard on revenue recognition would have on Spartan’s financial statements.2 Well aware of the importance of demonstrating robust prospects for revenue growth to investors, De Sena scheduled a meeting with Spartan’s Director of Financial Planning Andy Boudreau and Controller Zac Biesiada to discuss the matter further. Obstacle Course Racing Industry Unlike other extreme fitness activities such as marathons or triathlons, obstacle course racing (OCR) requires participants to navigate a series of obstacles such as rope climbs, log carries, monkey bars, mud crawls, and fire jumps. Experiencing a boom in popularity beginning around 2010, OCR has been called the fastest growing sport in history. Keiper, Sarah Young, Gil Fried, and Todd Seidler This article applies legal theory, case law, and suggested risk management strategies to obstacle events and racing. The history, popularity, and exponential growth of the obstacle racing industry are explored. Trends in the obstacle racing industry are also examined and legal implications that may follow the trends are discussed. Case law, in a variety of scenarios, is used to explain and apply assumption of risk and duty of care to obstacle racing events. Finally, suggested risk management strategies for race organizers are recommended. Course design, medical staffing, waivers, and proper staff training are all discussed. Imagine spending your Saturday morning running up a muddy incline being sprayed from both sides with high-pressure fire hoses, then plunging into opaque, frigid water brimming with ice to slog your way 25–30 feet, and, finally, running through a trench of blazing kerosene-soaked straw with 4-foot high flames! This is a description of just a few of the obstacles that can be found in obstacle racing or challenge events currently sweeping the nation.
