RULE S OF HE RA LDRY

To prove a right to Coat- o f- Arms in England or in any of the Colonies outside the United Kingdom of a Great Brit in , it is necessary to show without break male descent from some person to whom Arms

( a) have been granted by patent ; ( b) have been confirmed at one or other of the Visitations ; ( c) have been officially recorded or registered

My grandfather, GROSS SCRUGGS of Kentucky , was a remarkable man in many ways ; he was deter su es mined , commanding, impatient of criticism or gg ff tion , yet gentle and a ectionate with those whom he

loved . I him As remember , he was very proud and aristo cratic and delighted in relating to me incidents and

traditions connected with his family .

It was he who sowed the first seed , that later ripened into a desire to collect and preserve such data as could be obtained concerning the SCRUGGES in m A erica . I have spent much time and labor in a conscientious effort to gather from the many parts of our and the many more histories dealing with its

people, times and boundary lines , such facts as I hope may prove interesting and acceptable to those now

HISTORY

In the yea r 160 9 the Virginia Company of Lo ndon occupied a territorial grant covering two hundred miles north and two hundred miles south of Old Point Com

fort and west to the Pacific .

The settlement , after passing through a series of c e vi issitudes , ultimately b came prosperous , owing to the influx of immigrants from the Mother Country e men generally of the patrician stamp, who obtain d a Crown Grants of large est tes , and thus became pro

genitors of families representing what has been termed , “ ” d o in mo ern times , True Virginia St ck . 1 6 In 3 4 , the territory held by the Virginia Colony — was divided into nine shires or counties James City ,

Charles City , Elizabeth City , Warwick, Accomac ,

Nansemond , Isle of Wight , Henrico and York . In 1654 a county was formed from York called New in Kent . Goochland and Cumberland Counties were

1 82-8 cluded in Henrico until 7 4 , when they became

independent counties . The first English Settlement in America was made n 1 8 i Carolina, on Roanoke Island , in 5 5 , by Sir Walter

. Raleigh , but was abandoned the following year In

1 663 George II . granted Carolina, which had previously i o been attached to Virg nia , to L rd Clarendon and e others , and a large immigration from Virginia s ttled 1 2 in the northern part of the Province . In 7 9 the King purchased the Colony of Carolina and it was divided

into two Provinces with separate governments .

Georgia was first included in the charter of the 1 2 r Carolinas , but in 73 George II . granted a sepa ate charter to General James Oglethorpe and others , and nd 1 it was settled a colonized by the British in 73 3 . This charter covered the entire territory westward to the “ ” a Mississippi River , and was c lled in compli i s ment to the K ng. For a long time the early colonist were harassed by their Indian neighbors and former subdu possessors , the Creeks , but finally succeeded in 1 2 u ing them . In 75 the charter was s rrendered , pro rietar o p y government ab lished , as it proved unfavor able, and Georgia became a Royal Colony , securing privileges similar to those of the other Colonies . was originally included within the limits of North Carolina , from which Colony the inhabitants F n came and first settled at ort Lo don . These immigrations occ urred principally from 1 756 1 6 1 to 7 , when an Indian War broke out and armed forces were sent from the sister Colonies of Virginia and Carolina to aid the new settlers , and the Indians 1 8 were defeated . In 7 9 North Carolina proposed to cede the territory to the United States and by its act “ 2 1 0 of May 5 , 79 , Congress constituted it The Terri tory of the United States South of the Ohio ( see Uni versal Atlas, by George F . BEDFORD COU NTY was formed in 1 753 out of Lunenburg and was named for the fourth Duke of

Bedford . It comprised what is known as Bedford , e Campb ll and a part of Franklin Counties . Campbell County was cut from Bedford County a 1 8 1 in 1 8 on the southe st in 7 , and subsequently, 7 4 , the County of Franklin was cut on the south side . The town of “ SCRUGGS ” was originally in Bed ford County , and was named in honor of that branch u of the Scr ggs family that settled there . After the a division of Bedford and Fr nklin Counties , however , SCRUGGS ” became situated in the northern part of

Franklin County , two miles from the present Bedford “ ” County line . The town of SCRUGGS in Cole ff County , Missouri , is situated near Je erson City , the

Thomas Scruggs came to America with Endicott “ ” in the Abigail , sailing from Weymouth , England ,

t 6 1 628 16 . ember , , where he settled and died in 54 He often represented the town of Salem as Deputy in the General Court ; was one of the Judges of the o local court , and was always rec gnized among the n 1 6 6 rulers of the town . In Ja uary , 3 , he received a grant of three hundred acres of land on the south west limits of its territory (near Marblehead ) , in the immediate neighborhood of the seashore, in full view of the spacious bay , its promontories , islands and nav i i n o . gat . The month following this grant Mr Scruggs relinquished the land in order to further a project which the leading people of Salem had at heart , a

s s ff de ire to establi h a College on this tract . The e ort failed . In an address at the Essex Institute celebra “ 8 8 : tion ( about 1 9 ) Pres . Robert Rantoul said Har vard College came near being placed on Scruggs land in n Salem , whe it would have been named Scruggs ” College . From the little recorded of Thomas Scruggs it is evident he was a valuable and intelligent citizen , and the event that brought his career as a public man to a close proves that his min d was enlightened liberal and independent ; that he was in advance of the times in n which he lived . When the bitter and viole t perse cution of the celebrated Anne Hutchinson on account

of her Antinomian sentiments took place, Mr . Scruggs

17 S C R U G G S G E N E A L O G Y disapproved and denounced it ; he gave his whole in fluence earnestly and openly against such attempts to suppress freedom of inquiry an d the rights of s con cience , in consequence he was with five other lead ing men , proscribed , disarmed and deprived of his 16 a public functions . County, Kentucky, with his five grown children , and settled them there with the exception of his

son Gross, who returned to Virginia) . LAND PATENTS

From an early date the immigration of a person to t l Virginia, gave a itle to fifty acres of and . The immi ration t g was proved by oath before a coun y court , e which issued a certificate of the fact . On the pres nta tion of this certificate to the Secretary of the Colony w e an order for a survey was granted , hich was follow d by the granting of a Patent . All Patents were signed by the Governor, as representative of the Crown , and “ ” in this way were the Grants from the Crown . The fifty acres rights were known as Head ” rights and of course in the case of slaves and in dentu red t to servants , their gran s belonged their r and Masters, but were always transfe able, often passed through several hands before land was located in virtue of them . Though not always the case it may be accepted as a general rule that the first appearance of a person as a “ Patentee ” or Headright” gives the approximate date of his arrival in Virginia . settled in Laurens District . She had a brother

John Hastings , who became one of the wealthy

men of Pennsylvania . The bricks of which the Dial home in South

Carolina was built , were brought from England

and are in use at the present day by descendants .

The room occupied by Isabella Hastings , the wife “ " H r of enry Arthu Dial , was kept intact for many years after her death and has been visited by mem

ing port they became acquainted , and were mar ried shortly after the arrival of the boat at

Charleston . They settled at Four Hole Swamp , ‘ St . Mathew s Parish, near Bonneau , Berkley Dis trict Wathin , where they are both buried . Jean was considered a very beautiful woman of her

day , and it was doubtless that same beauty that

first attracted the gallant Joseph Dunklin . He was on 16 1 In uiror C0 1 appointed January , 777 , q and ’ lector of St . Matthew s Parish , including Orange

burg Township, for the purpose of raising and

no finer soldier ever carried a musket . I saw him

on the march from Chattanooga to Knoxville with his feet wrapped in rags ( when the brigade could be trailed by the bloody tracks in the snow) as there were only twelve pairs of shoes in the whole

brigade , but he never complained , and when we

met some Yankee prisoners going to the rear, he ‘ smiled and said , Hello , Yanks , how do you like the sunny South ?’ We have a reunion of Hood ’ s

Texas Brigade each year, and we speak of the

gallant companions gone before , and the name of Sergeant Dunklin is always mentioned as a syno n m d y of faithful evotion to duty , when the hour of

trial came . William Wathin Dunklin was educated and took

three medical degrees , one from the Medical Col

lege of Galveston , Texas , one from the College the of New Orleans , Louisiana, and third from

Bellevue Hospital , New York City . He was a

physician of note, a member of the firm of W . A .

Dunklin and Company of Galveston , Texas , and

owned land extensively throughout the State . In

the latter years of his life he engaged in planting,

in addition to his profession , and with his brother , t Francis Marion Dunklin , bough from his father “ the old home place, Spring Hill , near the town
