Existing Condition 8:

At times when there is a discharge to the Ohau Canal, a monitoring programme shall be undertaken as follows: a. Samples of canal water shall be taken on two occasions each year, once during November and once during May. b. Samples shall be taken on both occasions at the following sites in the Ohau Canal: i. at 100 metres upstream of the discharge point, and ii. at a point immediately above the confluence of the Ohau and Pukaki Canals iii. at 50 metres upstream of the water supply abstraction points for the power station.

Insert iv at a point on the Pukaki canal 50m upstream of the confluence of the Ohau and Pukaki canals.

Providing an additional sample point on the Pukaki Canal above the confluence clarifies the results which are measured at (iii) above Ohau A powerstation to which either the Ohau Canal, the Pukaki Canal or both may be contributing. The water source at Ohau A is determined by canal operation.

It can be solely Ohau canal water, Ohau and Pukaki Canal water, or only Pukaki Canal water.

This additional sample point eliminates any influence water quality in the Pukaki Canal may be contributing to the overall monitoring or the consent.

MCAS has been monitoring this site for several years on a voluntary basis.

Existing Condition 9 At times when there is a discharge to the Ohau B Canal, a monitoring programme shall be undertaken as follows: a. Samples of canal water shall be taken at three monthly intervals. b. Samples shall be taken on each occasion at the following sites in the Ohau B Canal: (i) at 100 metres upstream of the discharge point on the true right bank, (ii) at the State Highway Bridge 20 metres from the true left bank, (iii) at the State Highway Bridge 20 metres from the true right bank, (iv) at 50 metres upstream of the water supply abstraction points for the Ohau B power station. c. Analyses of all samples taken shall be carried out for the following parameters by a laboratory accredited to ISO Guide 25 for those analyses. a. suspended solids b. ammonia nitrogen c. five day biochemical oxygen demand d. nitrate nitrogen e. nitrite nitrogen f. total Kjeldahl nitrogen g. total phosphorus h. total mercury d. Results of the above analyses shall be provided to the Canterbury Regional Council within 10 working days of completion of the analyses

A description of Good Farm Management Practice ii. The proposed farm development plan and a review process at the end of each stage of development. iii. Explanation: Since the granting of the consent, MCAS and High Country Salmon (The Aquaculture Industry Working Group) have prepared an Aquaculture Environmental Plan.

This has been lodged with Ecan for approval and each existing farm site would have its own AEP.

The AEP and the AEP Template establish the parameters for processes described in i ii and iii.

The addition of a prior commencement wording makes it clear when an AEP should be obtained rather than a set date. The set date was not appropriate in the original consent as there was no farm in the Tailrace for which the plan could be applied to and if development did not occur within the original development plan, the date became obsolete.

The items relating to fish monitoring, surveys, Geosmin and collection of inputs remain relevant to the Tailrace farm.

Renumber condition 23 to 25

Existing Condition 24:

Farm practice shall be in accordance with the FEMP at all times and the FEMP shall be updated as necessary to reflect any changes in the farming operation over time. A copy of the FEMP shall be provided to the Canterbury Regional Council, Attention: RMA Monitoring and Compliance Manager on request.

Existing condition 25:

Nutrient Discharge Allowance a. A Nutrient Discharge Allowance (NDA) shall be set for each site (in accordance with the sites in condition 1) which is equivalent to the uneaten food and faeces at each site, and in accordance with the total discharge rate specified in condition 2) and 3). b. The NDA shall not be exceeded. However, if the NDA is exceeded, the consent holder shall undertake actions within one month to bring its calculated discharge within the NDA.

Nutrient Management:

A nutrient cap for Discharge into Haldon Arm of Lake Benmore has been established in the Land and Water Regional Plan (LWRP).

An Aquaculture Mass Balance Model (AMBM) as approved by Ecan shall be applied to each site to establish the nutrient loss.

The Cap shall not be exceeded. However, if the Cap is exceeded, the consent holder shall undertake actions within one month to bring the calculated discharged within the CAP.

Explanation: Since the consent was granted Ecan has established an Aquaculture nitrogen cap for the Haldon Arm of Lake Benmore. The above wording recognizes this.

Ecan and the Aquaculture Group are developing the Mass Balance equation to determine the N and P loss.

The Mass Balance equation will establish if the N cap on Lake Benmore is likely to be, or has been, exceeded.

Existing condition 26:

The Consent holder shall prepare once a year prior 31 March each year, from 31 March 2017, a. A nutrient budget, to a formula agreed by the Canterbury Regional. b. A report of the previous year’s farm nutrient discharge using the formula agreed by the Canterbury Regional Council. c. A copy of the nutrient budget and reports prepared in accordance with Condition 23 shall be given to the Canterbury Regional Council, attention: Regional Manager RM Monitoring and Compliance within one month of their completion .

The macrophyte monitoring plan shall include, at a minimum; i. The species/organisms (“identified species”) that will be monitored ii. The sampling method undertaken to measure growth and spatial coverage of these species iii. The locations that will be sampled iv. The frequency with which monitoring will be undertaken including sampling prior to farm stocking v. An agreed trigger level at which the expert report referred to in condition 31 will be commissioned

If the monitoring undertaken in accordance with conditions (27) and (29) shows trigger levels are met or exceeded, the consent holder shall commission a report. At a minimum, the report shall: a. be prepared by an expert review panel consisting of two qualified and experienced independent scientists. One of the scientists shall be nominated by the Canterbury Regional Council, and the other shall be appointed by the consent holder; and b. include the experts’ conclusion on whether the exceedance(s) were as a result of natural influences, one off events, or in whole or part by the discharge of contaminants authorised by this consent; and c. include an assessment as to whether the exceedance measured by the monitoring is likely to continue; and d. include recommendations as to how the effect of the discharge of contaminants authorised under this consents may be reduced; and e. include a timeframe for implementing the recommendations prepared in accordance with 31(d); and f. be provided to the Canterbury Regional Council, Attention: Regional Manager RMA Monitoring and Compliance, by 30 August following the monitoring

Explanation: This condition related to the operation of the Tailrace Farm as there is no “screening” mechanism preventing materials from the farm entering the lake. However, for the below the weir farm, or any of the upstream canal farms, the weed screens on the intakes to the Power Stations prevent any debris which might be detrimental to recreationalists from entering Lake Benmore.

If no farming takes place in the Tailrace, no material will be discharged into Lake Benmore.
