A vote o'er-looked may work most grievous wrong: A single pebble save a tottering house.** On June 4, 1989, a young man stood in Tiananmen Square in Beijing and surveyed the array of tanks and troops deployed by the Chinese government to crush a student-led movement seeking democ- racy. "Our government is already done with," he remarked to an ** Aeschylus, Eumenides, inGREAT BOOKS OF THE WESTERN WORLD 88, lines 748-51 (R. Hutchins ed. 1952) 1990] CONSENT, LEGITIMACY AND ELECTIONS American journalist. "Nothing can show more clearly that it does not represent the people." 1 Events have proved the young man wrong on the first count: the Chinese government has survived essentially intact. But the truth of his second statement is more difficult to assess. When does a government truly represent its people? How can we tell? In the United States, these questions seem to have simple answers. In the first place, we choose our government by election, so we know who represents us. In the second place, we do not have to contend with tanks enforcing the government's idea of who represents whom. Yet, many Americans would probably be surprised to learn that one of the first congressional delegates from Virginia, Francis Preston, won the election of 1794 when his brother, a federal military officer, arrived at the polls with more than sixty troops who, under orders, threatened physical violence to anyone who voted for Preston's opponent.2 Or that an armed group seized the polls during an 1860 congressional election in Baltimore and drove off voters under a hail of bullets while the po- lice looked the other way.' Or that in an 1882 congressional election in South Carolina the total number of ballots cast exceeded by six thou- sand the number of people who had voted.' Or that bribed, forged and otherwise fraudulent ballots accounted for fully ten percent of all votes cast in the November, 1982 general election in Chicago.' Can we be so sure that the winners of any of these elections really represented the people? If not, what is the status of officials who win election by vio- lence or fraud, and of the government in which those officials serve? The advent of the modern, heavily-financed, media-dependent election campaign has raised even more difficult questions. Many peo- ple, for example, think a candidate can essentially "buy" an election by outspending his or her rival on mass media advertising. If so, on what basis do we distinguish a candidate who wins an election by outspend- ing his rival on advertising from one who bribes voters directly? In this Article, I shall address some of these questions in the con- text of the United States government by examining federal elections in light of the political theories underlying the Constitution. I shall argue that what is at stake in an election in this country is legitimacy, by which I mean rightful rule under a Lockean system of popular sover- eignty. As a result, election laws and procedures necessarily affect the legitimacy of an elected government by determining the extent to which election results accurately reflect the consent of the governed. Next, I shall argue that these factors suggest that the Constitution should be read to grant Congress broad power to enact election laws aimed at enhancing electoral accuracy, and that numerous judicial de- cisions striking down such laws on first amendment grounds rest on an incomplete analysis of the government interests at stake. More specifically, Part I of this Article argues that the Constitu- tion should be understood to embody a Lockean theory of popular sov- ereignty. Part II argues on the basis of this theory that election laws play a significant role both in implementing popular sovereignty and in mediating governmental legitimacy by enhancing electoral accuracy. Part III examines a group of what I call "Newtonian" election laws that attempt to prevent the most basic forms of election fraud, and the favorable treatment such laws have generally received from the Su- preme Court. Morgan published Inventing the People: The Rise of Popular Sovereignty in England and America.2 In that brilliant and wide-ranging book Morgan traces how, between the time of the English Civil War in the mid-seventeenth century and the adoption of the American Constitution in 1787, the idea of “popular sovereignty”—the right of the people to govern themselves— replaced the notion of “the divine right of kings” as the acknowledged source of political power.3 The central theme of Morgan’s work is that while popular sover- eignty is a “fiction” in the sense that the people of a nation cannot actually rule them- selves without creating a government,4 over the centuries our ancestors constantly labored to create a society and a government which gradually came closer to the realization of that principle—a closer approximation of the ideal of popular sover- eignty.5 At the end of Inventing the People, Morgan concludes: * C.

    Popular sovereignty 1 Popular sovereignty Popular sovereignty or the sovereignty of the people is the belief that the legitimacy of the state is created by the will or consent of its people, who are the source of all political power. It is closely associated to the social contract philosophers, among whom are Thomas Hobbes, John Locke and Jean-Jacques Rousseau. Popular sovereignty expresses a concept and does not necessarily reflect or describe a political reality.[1] It is often contrasted with the concept of parliamentary sovereignty, and with individual sovereignty. Benjamin Franklin expressed the concept when he wrote, "In free governments, the rulers are the servants and the people their superiors and sovereigns."[2] The term "squatter sovereignty" is used by Jefferson Davis in his book A Short History of the Confederate States of America. This probably derogatory term referred to the influx of new citizens in order to manipulate the ultimate sovereign votes. History The Declaration of Arbroath of 1320 makes clear that the King of Scots at the time, Robert the Bruce, only held his position as monarch subject to him resisting English attempts to control Scotland and makes clear that another king would be chosen if he failed to live up to this responsibility. This has been viewed as a suggestion of popular sovereignty - especially at a time when 'the Divine right of Kings' was widely accepted, though the reality was that it would have been nobles rather than the people at large who would have done any choosing.[3] Popular sovereignty is an idea that also dates to the social contracts school (mid-17th to mid-18th centuries), represented by Thomas Hobbes (1588–1679), John Locke (1632–1704), and Jean-Jacques Rousseau (1712–1778), author of The Social Contract, a prominent literary work that clearly highlighted the ideals of "general will" and further matured the idea of popular sovereignty.

S. MILL’S POLITICAL THOUGHT The year 2006 marked the two hundredth anniversary of John Stuart Mill’s birth. Although his philosophical reputation has varied greatly in the interven- ing years, it is now clear that Mill ranks among the most influential modern political thinkers. Yet despite his enduring influence, and perhaps also because of it, the breadth and complexity of Mill’s political thought is often under- appreciated. Although his writings remain a touchstone for debates over liberty and liberalism, many other important dimensions of his political philosophy have until recently been mostly ignored or neglected. This volume aims, first, to correct such neglect by illustrating the breadth and depth of Mill’s political writings. It does so by drawing togetheracollection of essays whose authors explore underappreciated elements of Mill’s political philosophy, including his democratic theory, his writings on international relations and military inter- ventions, and his treatments of socialism and despotism.     Tocqueville: Is He Relevant Today? Serge Audier The bicentennial of the birth of Alexis de Tocqueville (1805-1858) affords us an opportunity to rediscover one of the most complex works of his time, and also to contemplate how it can help us better understand present-day democracies. Is Tocqueville really relevant? Does his writing still offer fresh perspectives? If today Tocqueville is a “classic,” he wasn’t always so; his rediscovery, in the second half of the 20th century, put an end to a period of partial eclipse. Yet Tocqueville was one of the most well-known French specialists of “public rights.” The popular success of the first volume of Democracy in America, which appeared in 1835, can be attributed to his desire to introduce an uninformed audience to American society and institutions, and also to his political goals. Before Tocqueville, “doctrinarians” like Guizot, who had supported the Kingdom of France, defined democracy as a social and legal state, but not a political one. On the contrary, Tocqueville presents democracy as a society dominated not only by the equality of conditions, but also by the sovereignty of the people. In asserting that America presaged the future of Europe, Tocqueville encouraged his more conservative peers not to fear the democratic state. Americans had found adequate responses to the dangers of this new political and social state. But Tocqueville was far from contented with an idealistic picture, and as early as 1835 – and even more in 1840, in the second volume – he emphasized the new perils of this democratic society, which was haunted by a passion for equality and “well-being” which could destroy political freedom.
