    Commentary Unprotected: Condoms, Bareback Porn, and the First Amendment Bailey J. Langnert ABSTRACT In November 2012, Los Angeles County voters passed Measure B, or the Safer Sex in the Adult Film Industry Act. Measure B mandated condom use by all porn performers in adult films produced within county borders and created a complex regulatory process for adult film producers that included permitting, mandatory public health trainings, and warrantless administrative searches. Shortly after its passage, Vivid Entertainment filed a lawsuit to enjoin the enforcement of Measure B, arguing that the Measure violated their First Amendment right to portray condomless sex in porn. In December 2014, the Ninth Circuit upheld the district court's decision upholding the constitutionality of Measure B. Notably, the mainstream discourse surrounding the Measure B campaign, as well as the legal arguments put forth in the lawsuit, focused exclusively on straight pornography while purporting to represent all porn. As a result, an entire genre of condomless pornography went unrepresented in the discussion: bareback porn, which portrays intentional unprotected anal sex between men. Excluding bareback porn from the lawsuit represented a missed opportunityfor Vivid in its challenge of Measure B. The Tisch family, worth an estimated 4 billion dollars, has major interests in hotels, an insurance company, Bulova, movie theatres, and Loliards, the nation's fourth largest tobacco company (Kent, Newport, True cigarettes). Brother Andrew Tisch has served as a Vice-President for the UJA-Federation, and as a member of the United Jewish Appeal national youth leadership cabinet, the American Jewish Committee, and the American Israel Political Action Committee, among other Jewish organizations. By September of 1986 Tisch's company owned 25% of the stock of CBS and he became the company's president. And Tisch -- now the most powerful man at CBS -- had strong feelings about television, Jews, and Israel. The CBS news department began to live in fear of being compromised by their boss -- overtly, or, more likely, by intimidation towards self-censorship -- concerning these issues. "There have been rumors in New York for years," says J. J. Goldberg, "that Tisch took over CBS in 1986 at least partly out of a desire to do something about media bias against Israel." [GOLDBERG, p. 297] The powerful President of a major American television network dare not publicize his own active bias in favor of another country, of course. That would look bad, going against the grain of the democratic traditions, free speech, and a presumed "fair" mass media.

    The 2008 Federal Obscenity Conviction of Paul Little and What It Reveals About Obscenity Law and Prosecutions Robert D. Richards* and Clay Calvert** ABSTRACT This Article provides an inside perspective on the 2008 obscenity trial and conviction of veteran adult movie producer Paul Little, who is known in the adult industry as Max Hardcore. Little was sentenced by a federal judge to nearly four years in prison after a twelve-person jury in Tampa, Florida found him guilty of multiple counts of selling and distributing obscene content via the U.S. Mail and Internet. The Article centers around comments and remarks drawn from four exclusive interviews conducted in person by the authors with: (1) Jeffrey Douglas, the California-based attorney who represented and defended Paul Little in United States v. Little; (2) H. Louis Sirkin, the Ohio-based attorney who represented and defended the corporate entities controlled by Paul Little in United States v. Producers of pornography typically respond to attempts to regulate pornography as infringements upon free speech. At the same time, large corporations involved in the production and sale of pornography rely on copyright law's complex regulatory framework to protect their pornographic content from copying and unauthorized distribution. Web 2.0 also facilitates the production and distribution of pornography by individuals. These user-generatorsproduce their own pornography, often looking to monetize their productions themselves via advertising revenues and subscription models. Much like their corporate counterparts, these user-generatorsmay increasingly rely on copyright law to protect their creationsin the future.
