Minutes of the Livingston Parish Council Livingston, Louisiana November 8, 2018 The Livingston Parish Council met in regular session duly called, advertised, and convened at its regular meeting place, the Parish Council Chambers, Governmental Building, 20355 Government Boulevard, Livingston, Louisiana, on Thursday, November 8, 2018, at the hour of six (6:00) o’clock p.m. with the following Livingston Parish Council members present: Jeff Ard John Wascom Tracy Girlinghouse Garry “Frog” Talbert R.C. “Bubba” Harris Tab Lobell Maurice “Scooter” Keen Shane Mack Also present: Layton Ricks, Parish President Jennifer Meyers, Parish Finance Director Christopher Moody, Parish Legal Counsel Absent: Jeff Averett ------------------------------------------------- The chair asked the public to please mute or turn off their cell phones. ------------------------------------------------- The chair announced that Public Input would be accepted from any member of the audience wishing to address an agenda item. ------------------------------------------------ The chair addressed agenda item 7, “Public Hearing and Adoption of L.P. Ordinance No. 18- 24, “Authorization of …. GOMESA bonds”. The chair declared that the Public Hearing for L.P. Ordinance No. 18-24 was open and called upon Jim Ryan, of Government Consultants and also the Parish of Livingston’s Financial Advisor. Mr. Ryan read the ordinance by title. The chair asked for public input from the audience. Having none, he inquired if there was any input from the Councilmembers. Having no input from the Councilmembers the chair closed the public hearing. LPR NO. 18-328 The following ordinance which was previously introduced in written form required for adoption at a regular meeting of the Livingston Parish Council on October 25, 2018, a summary thereof having been published in the Official Journal together with a notice of public hearing which was held in accordance with said public notice, was brought up for final passage on November 8, 2018 on Motion of Garry “Frog” Talbert and seconded by R.C. “Bubba” Harris: L.P. ORDINANCE NO. 18-24 An ordinance authorizing the Parish of Livingston, State of Louisiana to proceed with a not to exceed $9,000,000 financing through the Louisiana Local Government Environmental Facilities and Community Development Authority; authorizing and ratifying the Parish’s request of the Louisiana Local Government Environmental Facilities and Community Development Authority to issue its revenue bonds; authorizing the borrowing by the Parish of the proceeds from the sale thereof to finance qualified GOMESA projects and providing for the repayment of and security therefor; approving and ratifying within certain parameters the terms of the sale of the bonds; authorizing the form and execution of the Loan and Assignment Agreement; authorizing the form of and execution of an agreement for the purchase of the bonds and ancillary financing documents; and otherwise providing with respect thereto. Upon being submitted to a vote, the vote thereon was as follows: YEAS: MR. WASCOM, MR. HARRIS, MR. LOBELL, MR. ARD, MR. MACK, MR. GIRLINGHOUSE, MR. KEEN, MR. TALBERT NAYS: NONE ABSENT: MR. AVERETT ABSTAIN: NONE And the ordinance was declared adopted as amended on the 8th day of November 2018. (The above and foregoing ordinance, upon final approval by the President, or the Council in case of veto by the President, shall be published in full in the Official Journal by the Clerk of the Council within fifteen (15) days of its adoption and shall be recorded in full in the Livingston Parish Council Ordinance Book No. 4). ----------------------------------------------------- The chair addressed agenda item 8, “Presentations”. He instructed that he wished to recognize Ms. Layni LeBlanc, a graduate of Walker High School who had received the distinguished honor of being Louisiana’s first female to serve as the National FFA (Future Farmers of America) Secretary. The chair read of Ms. LeBlanc’s accomplishments and requested that she join him in the front. He presented her with a certificate of achievement. He then requested that the Parish President and the Councilmembers come and join them and then allowed time for a photo opportunity. ----------------------------------------------- The chair addressed the addendum to the agenda and called upon Mr. Mark Harrell, Director of the Livingston Parish Office of Homeland Security and Emergency Preparedness. Mr. Harrell advised that his office had some mitigation projects coming in, very slowly. Two (2) had been received that week that he wished to move forward on before the end of the year. He explained the differences between the two (2) proposed properties to be acquired pursuant to the Flood Mitigation Assistance Program. He defined loss structure, repetitive loss structures and severe repetitive loss structures, putting each in a different category. He added that severe repetitive loss structures receive one hundred percent (100%) acquisition. Mr. Harrell asked if the chair would like him to read the proposed ordinance by title. The chair agreed. Mr. Harrell read the proposed ordinance by title into the record. The Council clerk advised that the date of the Public Hearing would be resolved at the end of the meeting upon the determination of agenda item 16, “Adopt resolution to (re)schedule the November 22, 2018 regular meeting of the Council due to the Thanksgiving holidays– Jeff Ard”. The following ordinance was introduced in proper written form and read by title, to wit: L.P. ORDINANCE NO. 18-26 AN ORDINANCE TO ACQUIRE IMMOVABLE PROPERTY FOR THE PARISH OF LIVINGSTON PURSUANT TO THE FLOOD MITIGATION ASSISTANCE PROGRAM PROJECT NUMBER FMA-PJ-06-LA-2017-024- LIVINGSTON PARISH. 1. Homeowner: Address: 14660 Highway 16 French Settlement, LA 70733 Appraised Value: $400,000.00 Amount Offered: $400,000.00 Legal Description: Lot #1 in Section 11, T9S, R4E, SED LPR NO. 18-329 MOTION was offered by Tracy Girlinghouse and duly seconded by John Wascom to publish the ordinance by title in the Official Journal in accordance with the legal mandates and set a Public Hearing for Thursday, December 6, 2018 at the hour of six o'clock (6:00) p.m. at the Parish Council Chambers in the Governmental Building located at 20355 Government Boulevard, Livingston, Louisiana, at which time comments will be received on the proposed ordinance prior to a Council vote. Upon being submitted to a vote, the vote thereon was as follows: YEAS: MR. WASCOM, MR. HARRIS, MR. LOBELL, MR. ARD, MR. MACK, MR. GIRLINGHOUSE, MR. KEEN, MR. TALBERT NAYS: NONE ABSENT: MR. AVERETT ABSTAIN: NONE Thereupon the chair declared that the Motion had carried and was adopted. ------------------------------------------- Mr. Harrell asked if the Council clerk would like to read the proposed ordinance by title into the record to which she abided. The Council clerk advised that the date of the Public Hearing would be resolved at the end of the meeting upon the determination of agenda item 16, “Adopt resolution to (re)schedule the November 22, 2018 regular meeting of the Council due to the Thanksgiving holidays– Jeff Ard”. The following ordinance was introduced in proper written form and read by title, to wit: L.P. ORDINANCE NO. 18-27 AN ORDINANCE TO ACQUIRE IMMOVABLE PROPERTY FOR THE PARISH OF LIVINGSTON PURSUANT TO THE FLOOD MITIGATION ASSISTANCE PROGRAM PROJECT NUMBER FMA-PJ-06-LA-2017-024- LIVINGSTON PARISH. 1. Homeowner: Address: 30362 Dawson Lane Hammond, LA 70403 Appraised Value: $182,600.00 Amount Offered: $164,340.00 Legal Description: Lot 1, Whispering Willow LPR NO. 18-330 MOTION was offered by R.C. “Bubba” Harris and duly seconded by Tracy Girlinghouse to publish the ordinance by title in the Official Journal in accordance with the legal mandates and set a Public Hearing for Thursday, December 6, 2018 at the hour of six o'clock (6:00) p.m. at the Parish Council Chambers in the Governmental Building located at 20355 Government Boulevard, Livingston, Louisiana, at which time comments will be received on the proposed ordinance prior to a Council vote. Upon being submitted to a vote, the vote thereon was as follows: YEAS: MR. WASCOM, MR. HARRIS, MR. LOBELL, MR. ARD, MR. MACK, MR. GIRLINGHOUSE, MR. KEEN, MR. TALBERT NAYS: NONE ABSENT: MR. AVERETT ABSTAIN: NONE Thereupon the chair declared that the Motion had carried and was adopted. ------------------------------------------- The chair questioned if Councilman Garry Talbert would like to address his items on the agenda at that time. He advised that he would, and the chair called upon Mr. Mark Harrell once again. Mr. Harrell advised that the Parish was seeking a two hundred and fifty thousand-dollar ($250,000.00) mosquito abatement grant with stipulations and requirements that the Parish must meet. He requested that the two (2) Councilmembers that wished to have mosquito abatement in their district move their proposed election to an earlier date. Mr. Harrell indicated that he had spoken with the State of Louisiana, and it had been determined that there were only four (4) parishes that would be considered for the grant funds in the coming year. He explained why the election was necessary and requested that the Councilmembers vote favorably to provide two- ninths (2/9ths) of the remaining funding from the previous mosquito abatement program. Mr. Harrell read agenda item 17, “Adopt resolution to allocate two-ninth (2/9) of the funds from the Livingston Parish Mosquito Abatement District to Mosquito Abatement District Two and Three” and stated that this was the first thing that he was proposing to the Councilmembers to approve. The chair called for a motion to Mr. Harrell’s proposed resolution. Councilman Maurice “Scooter” Keen offered the motion and Councilman Tracy Girlinghouse made the second to that motion. The chair requested Public Input from the audience members. Having none, he invited input from the Councilmembers. Councilman Shane Mack requested to speak and said that he wished to qualify how he was going to vote, giving explanation to the constituents of his district.
