An exciting opportunity has arisen for someone with the right level of vision, drive and leadership to join Council and oversee the delivery of a successful and well-established municipal harbour.

Tor Bay Harbour is situated on the stunning south coast of and sits within the jewel that is the English Riviera. Not only is Torbay a major holiday destination as one of the UK’s premier coastal resorts, but we also have a UNESCO Global Geopark. The Tor Bay Harbour area occupies 16 square miles of open sea and has 22 miles of extraordinary coastline. It includes three enclosed harbours and provides a sheltered anchorage for shipping which has been widely used during the pandemic drawing visitors just to see the cruise ships at anchor. The Bay is also a venue for a wide range of maritime events, including various national and international championships.

The right candidate will be responsible for the overall management, direction and leadership of the Harbour Authority and will need to use their expansive maritime and leadership knowledge to influence and shape the services provided. As a senior officer within the local authority, you will manage and lead the statutory harbour function of Tor Bay Harbour, as required by Torbay Council. The Harbour Authority manages the enclosed harbours of , and , who within their own right host fishing, leisure and small commercial vessels, including seasonal passenger craft. Brixham is a significant fishing port, and the Bay provides a safe anchorage for shipping, as well as attracting cruise ships with passengers landed by tender in Torquay. Quays, piers and breakwaters can be found located around all three enclosed harbours, together with a range of assets that make up the relevant land-based harbour estates.

The service also includes all aspects of beach management and has an exceptional team who maintain the current Blue Flag status that some of our beaches are proud to display.

Torbay Council is looking for someone who has experience of management in ports and harbours at a senior level, knowledge of legislation relevant to ports and harbours, an appropriate marine related qualification, along with the ability to lead, motivate and develop staff at all levels. There is also the requirement that you have the ability to act as a stand-by pilot, although this is desirable and not essential.

1. Key purpose of job

1.1. To be the key decision maker, accountable for the leadership, direction, development and delivery of the Tor Bay Harbour Authority function and Beach Services, providing strategic leadership to facilitate the best outcomes for the Council. 1.2. To hold the role of Tor Bay Harbour Master to ensure that the service meets legislative requirements and all statutory functions. 1.3. Responsibility for managing the staff across the service delegating responsibility and authority as appropriate to managers and authority staff working within Torbay’s enclosed harbours, beaches and along the coastline, consistent with the requirements of the service. 1.4. To directly manage and oversee the statutory obligations and operations of Tor Bay Harbour, including the enclosed harbours of Brixham, Torquay and Paignton, the Council’s beaches and coastline, together with the relevant land-based harbour estate and all associated facilities and assets, as required by the Council. 1.5. To set out the requirements of the service by developing and ensuring implementation of business and service plans and regular review all relevant policy, practice and procedures including contract specifications and conditions, service level agreements and performance management standards for the provision of a safe and effective operation for Tor Bay Harbour and Beach Services. 1.6. To develop and deliver a robust transformational roadmap that will ensure the sustainable provision of an effective, efficient, compliant and economic service, meeting current and future financial targets and objectives. 1.7. To work closely with the Council’s key partners and stakeholders to achieve planned outcomes on both a long and short-term basis internally and community wide.

2. Anticipated outcomes of post

2.1. The safe, efficient, effective and smooth running of the Tor Bay Harbour Authority function and Beach Services. 2.2. That, as a minimum these services areas meet national and local performance targets, the Council’s corporate objectives and deliver high quality outcomes for Torbay and its visitors/residents. 2.3. High levels of health and safety are maintained on the Council’s beaches, coastline and within the Tor Bay Harbour estate. 2.4. Maintain compliance with the Port Marine Safety Code through the effective use of formal safety management systems. 2.5. The agreed targets for the provision and quality of the service are met using performance measures, customer feedback and regulatory inspections. 2.6. Budgets are managed effectively, efficiencies are identified, captured, and reported and resources are utilised effectively. 2.7. The service areas provide an effective operational and strategic response to emergencies, including a planned response to oil spills and the associated pollution. 2.8. Efficient service delivery is provided within the community and appropriate and timely technical and professional advice is provided across the specialisms relevant to the Harbour Authority function, Beach Services, and to other Directorates within the Council, including Council Members. 2.9. A high level of legal compliance with Harbour Acts, relevant Byelaws and regulations including adherence to a robust Health and Safety management system, in respect of Tor Bay Harbour and the Council’s Beach Services. 2.10. Procurement processes are undertaken effectively and in line with the Council’s financial regulations and appropriate statutory requirements. 2.11. A one team, one goal ethos is achieved through, effective communication and inter- departmental cross-working ensuring that the various harbour locations and beach related services effectively support each other and are co-ordinated to assist the delivery of other relevant service areas. 3. List key duties and accountabilities of the post

3.1. Responsible for following appropriate guidelines and procedures in respect of safeguarding and the welfare of children within Tor Bay Harbour and on the Council’s beaches and coastline. 3.2. To lead, manage and provide effective communication across the Tor Bay Harbour Authority function and Beach Services, ensuring integration and co-ordination of specialist disciplines, determining priorities, utilising resources efficiently to ensure

smooth and effective customer focussed delivery of services and facilitating, and fostering effective relationships that support a team ethos.

3.3. Working with the Director of Place to continually develop and shape the service to deliver transformational projects and innovative service solutions. Taking the strategic lead in identifying, developing and delivering service changes in line with Council and government policy developing proposals and efficiencies that improve performance and maximise income including exploring alternative methods of service delivery and potential benefits of increased partnership/joint working with other organisations and Local Authorities. 3.4. To be accountable for the revenue budget for Tor Bay Harbour Authority function and Beach Services, ensuring that systems of budgetary accountancy and financial control are properly understood across the service and used and developed in line with the Council’s financial regulations and procedures. 3.5. To lead and direct the Tor Bay Harbour service, undertaking negotiations with relevant bodies, supporting the Council’s Harbour Committee, and liaising as appropriate with all harbour user groups and attending Committee or Harbour Users meetings to ensure effective communication and consultation on harbour issues, throughout the Bay. 3.6. Assisting the Council in the promotion of Maritime Events within Tor Bay, on the beaches and along the coastline and in compiling and programming of such events, ensuring adequate berthing arrangements and supervision of quayside activities with event organisers. Attending liaison meetings with the relevant organisations as and when required. 3.7. To maintain efficient harbour, beach and coastline control using consistent overall management with an appropriate level of enforcement to ensure the Harbour Acts, Byelaws and Regulations are observed including taking witness statements, conducting interviews under caution and attending Court. The main Acts and Regulations are as follows: • Harbours Act 1964 • Merchant Shipping Act 1995 • Tor Bay Harbour Act 1970 (as amended in 1983) • Harbours, Docks and Piers Clauses Act 1847 • Dangerous Goods in Harbour Areas Regulations 2016 • Pilotage Act 1987 3.8. To research, draft and oversee delivery of organisational policy and respond to legislative changes by developing, implementing, and reviewing new policies, procedures and practices, within the service areas. Thereby being responsible to the Harbour Committee and the Director of Place for the efficient and effective management of the services. 3.9. Ensuring the effective operation and maintenance of all navigational lights, marks and beacons. Complying with all requirements laid down by Trinity House as well as enabling proper control over the navigation and safe berthing of all vessels utilising the waters and facilities of Tor Bay and its enclosed harbours.

3.10. Attending the harbour outside of normal working hours as and when required. Working in conjunction with the management team to ensure 24 hour on-call cover, throughout the year, to meet the Council’s responsibility as a competent Harbour Authority. 3.11. If necessary, undertaking the examination of commercial pleasure boatmen pursuant to the issue of a boatman’s licence. Monitoring the seasonal operation of commercial pleasure craft and angling boats, together with their kiosk or board site booking operation. Issuing appropriate pleasure craft licences. 3.12. Responsible for ensuring effective complaint management within the service and providing or ensuring the provision of an adequate response to any complaints in accordance with policy and published procedures. 3.13. To advise the Director of Place of major and strategic service specific issues that are likely to affect the policy framework and performance of the service by writing reports, attending briefings and Council meetings as required. 3.14. Responsible for providing such support as may be required in response to Major Emergencies and business recovery. To include the requirement to attend Tor Bay, the enclosed harbours, the beaches and coastline outside of set working hours as and when required to deal with any matter requiring special attention e.g., oil pollution, hazardous substances, vessels adrift, bad weather, fire or other emergency, etc. 3.15. Actively engage with other Service Managers and team members within the Place Directorate and Council to ensure a collaborative and seamless integration of service provision to both internal and external customers. 3.16. Monitor and ensure key performance and risk management of projects to maximise the delivery and outcomes of the services areas and align to the Business Plan supporting and developing strategies to address any issues. 3.17. Responsible for the preparation of procurement bids with the overall responsibility for the contracts, tendering and commercial evaluation of services and facilities across the service. 3.18. To ensure that the Council meets its obligations under the Pilotage Act 1987 in the provision of a proper and safe pilotage service. May be required to undertake piloting duties on a relief basis. (if suitably qualified) 3.19. Responsible for the compliance with all Health and Safety Regulations within Tor Bay Harbour, on the beaches and coastline, including liaising with the Council’s corporate Health and Safety function. Ensuring that standards are maintained or improved, risk assessments undertaken and staff trained to ensure that an effective Health and Safety culture is fostered and maintained. 4. Budgetary/Financial Responsibilities of the post

4.1. Budget holder for the Tor Bay Harbour Authority budget and the Beach Services budget. 4.2. Responsible for setting, allocating and monitoring budgets within budgetary constraints across all relevant service areas, as set by the Harbour Committee and/or Council.

4.3. Beach Services - Gross £655k, net £26k and Tor Bay Harbour – Gross £3.5M, net £nil 4.4. The harbour budget will be the post holder’s prime budget supported by the Business & Administration Manager, responsibility for the Beach Services budget will be supported by the Marine Leisure & Beach Services Manager. 5. Supervision/Line Management Responsibilities of the post

5.1. To undertake the line management and supervision of the following posts :- Assistant Harbour Master – Brixham Business & Administration Manager Marine Leisure & Beach Services Manager 5.2. To ensure the regular supervision of each team member using identified mechanisms. 5.3. To assertively and continually challenge teams and managers to improve performance. 5.4. To establish annual objectives and ensure that these are cascaded to team members, monitoring their performance through the Council’s appraisal process. 5.5. Assuming direct overall accountability for the management of the Tor Bay Harbour Authority function and Beach Services staff including allocating work and determining priorities, monitoring performance, identifying training needs, staff appointments and related matters including discipline and flexible utilisation of staff to meet workload requirements.

6. Working environment and conditions of the post

6.1. The normal working environment and conditions will be office based, however the postholder will also be required to work on the harbour estate, quays & piers, as well as occasionally afloat. Sometimes the postholder will be required to work in inclement weather conditions. 6.2. Responding to emergency situations may on occasion require call out to any harbour, beach, or coastal location, for example emergency incidents during bad weather. 6.3. It may be necessary on occasion to undertake piloting duties, on a relief basis, requiring the post holder to climb pilot ladders and work on ships at sea.
