This approval will expire August 10, 2016. The proposed work, as approved, consists of removing one-over-one, double hung wood windows from the third through eighth floors of the Fifth Avenue and 36th Street elevations and installing one-over-one double hung aluminum windows finished in light gray; the restoration and/or replacement of the wooden window brickmolds; and the removal and replacement of mechanical louvers installed within the upper sash of existing window openings at the West elevation single-bay addition; as described in an Exterior Finishes Investigation report dated February 16, 2010, prepared by Super Structures Engineers and Architects, and shown in existing condition photographs, historic photographs, and drawings labeled T-1, A-1, A-2, A-3, A-4, A-5, and SK-1, dated October 1, 2009, prepared by Arthur Kahane, R.A., submitted as components of the application and presented to the Commissions. In reviewing this proposal, the Commission noted that 390 Fifth Avenue, known as the Gorham Building, is a Florentine Renaissance style building designed by Stanford White of Mckim, Mead and White and built in 1904-06. With regard to the proposal, the Commission found that the existing historic windows are in a deteriorated condition that warrants their removal; that the configuration, operation, details and dimensions of the proposed aluminum replacement sash will match the historic wood sash; that given the scale of the building and the simple configuration and details of the windows, the change from painted wood sash to an aluminum sash with a baked enamel finish, will not be discernable from the street; that the light gray finish of the windows will match the historic window paint color, and is consistent with historic paint colors for buildings of this age and style and is based on an analysis of paints historically used in this building; that the existing wooden brick molds will be retained or replaced in kind where deteriorated beyond repair, and painted to match the sash, thereby maintaining the appearance of the historic frames; and that the proposed louvers at the West elevation single-bay addition will replace existing mechanical louvers, will be installed within the upper sash of existing window openings, and set flush with the façade and painted to match the surrounding fenestration, thereby not calling undue attention to themselves. Based on these findings, the Commission determined the proposed work to be appropriate to the building and voted to approve this application. However, in voting to grant the approval, the Commission stipulated that two signed and sealed copies of the final Department of Buildings filing drawings be submitted to the staff of the Commission for review and approval. Subsequently, on October 6, 2010 the Landmarks Preservation Commission received final drawings labeled T-1, A-1, A-2, A-3, A-4, and A-5, dated September 16, 2010, prepared by Arthur Kahane, R.A. Staff reviewed the drawings and found that the work approved by the Commission has been maintained. Based on the above findings, the drawings are marked approved, and Certificate of Appropriateness 11-3210 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
