Women in Criminal Trials in the Julio-Claudian Era by Tracy Lynn Deline B.A., University of Saskatchewan, 1994 M.A., University of Saskatchewan, 2001 A THESIS SUBMITTED IN PARTIAL FULFILLMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY in THE FACULTY OF GRADUATE STUDIES (Classics) THE UNIVERSITY OF BRITISH COLUMBIA (Vancouver) September 2009 © Tracy Lynn Deline, 2009 Abstract This study focuses on the intersection of three general areas: elite Roman women, criminal law, and Julio-Claudian politics. Chapter one provides background material on the literary and legal source material used in this study and considers the cases of Augustus’ daughter and granddaughter as a backdrop to the legal and political thinking that follows. The remainder of the dissertation is divided according to women’s roles in criminal trials. Chapter two, encompassing the largest body of evidence, addresses the role of women as defendants, and this chapter is split into three thematic parts that concentrate on charges of adultery, treason, and other crimes. A recurring question is whether the defendants were indicted for reasons specific to them or the indictments were meant to injure their male family members politically. Analysis of these cases reveals that most of the accused women suffered harm without the damage being shared by their male family members. Chapter three considers that a handful of powerful women also filled the role of prosecutor, a role technically denied to them under the law. Resourceful and powerful imperial women like Messalina and Agrippina found ways to use criminal accusations to remove political enemies. Chapter four investigates women in the role of witnesses in criminal trials. -

Michael Jaffee Patterson Independent Project 2/1/13 Pompey, the Great Husband Abstract: Pompey the Great’s traditional narrative of one-dimensionally striving for power ignores the possibility of the affairs of his private life influencing the actions of his political career. This paper gives emphasis to Pompey’s familial relationships as a motivating factor beyond raw ambition to establish a non-teleological history to explain the events of his life. Most notably, Pompey’s opposition to the special command of the Lex Gabinia emphasizes the incompatibility for success in both the public and private life and Pompey’s preference for the later. Pompey’s disposition for devotion and care permeates the boundary between the public and private to reveal that the happenings of his life outside the forum defined his actions within. 1 “Pompey was free from almost every fault, unless it be considered one of the greatest faults for a man to chafe at seeing anyone his equal in dignity in a free state, the mistress of the world, where he should justly regard all citizens as his equals,” (Velleius Historiae Romanae 2.29.4). The annals of history have not been kind to Pompey. Characterized by the unbridled ambition attributed as his impetus for pursuing the civil war, Pompey is one of history’s most one-dimensional characters. This teleological explanation of Pompey’s history oversimplifies the entirety of his life as solely motivated by a desire to dominate the Roman state. However, a closer examination of the events surrounding the passage of the Lex Gabinia contradicts this traditional portrayal. -

Is Plutarch right when he implies that she was dishonest and ill-treated her daughter? What was the nature of Roman marriage and family life? Was the Cicero family life ever ‘happy’, judged by modern standards? Can the resources of modern sociology apply, and will such application lead to an alternative interpretation of the known facts? INTRODUCTION Cicero’s private life as evidenced in his correspondence cannot be separated from his political life: at times each part seems to work as a sort of counter-irritant to troubles in the other half. While his marriage was still intact, it sometimes seemed to be all that saved the beleaguered consular’s sanity. His divorce of Terentia, his wife of over thirty years, and subsequent marriage to his young ward Publilia in late 47 or early 46 B.C. (at a time when Cicero’s political career seemed at an impasse) has never been satisfactorily accounted for. Cicero divorced this second wife soon after his daughter Tullia’s death in 45, ‘because she seemed pleased about it’ (Plut. Cic. 41.8).1 This divorce, too, seems odd, at the very least. The purpose of this paper is threefold. First it will review the usually cited evidence for the disintegration of the marriage of Cicero and Terentia, starting with Plutarch, with a view to reinterpretation of aspects that appear to have been misconstrued by the ancient biographer and followed by moderns. -

The fact that the Romans repeatedly emphasized the importance of virtus goes to show the fundamental significance of this concept for their so ciety. Originally the conception of virtus was quite narrow consisting in the readiness of the agrarian and militant community to wage war and to endure hard toil. -

Latin 300: Tacitus, Agricola Spring, 2002 Gillison Course objectives: The text for this semester is Tacitus’ Agricola, a work which combines biography, ethnography, and political critique in a particularly “Tacitean” manner. Central to our discussions will be the concept of “rhetorical history” as the Romans knew and composed it, and you will learn to compare and contrast Roman historiography and it’s modern relative. We will translate the monograph and investigate in the process various elements of Roman history, historiography, and historical research. We will read Cicero’s recommendations about the writing of history and you will learn to discuss Tacitus’ relationship to those recommendations. We will look into numismatics epigraphy and you will learn to discuss their uses in the modern historian’s hands. We will place Tacitus’ works in historical context.. Each student will make an oral presentation to the class and will write an essay focused on Tacitus’ mode of historiography. -

TOPIC 35: SIXTH COMMANDMENT OF THE DECALOGUE 1. Male and female he created them… God’s call to men and women to “be fruitful and multiply” should be understood from the perspective of our creation “in the image and likeness” of God (cf. Catechism 2331, 2334). This entails that human procreation, in the wider context of our sexuality, cannot be “something simply biological, but concerns the innermost being of the human person as such” (Catechism 2361), and so is essentially distinct from animal life. God is love (1 Jn 4:8), and his love is fruitful. He wants human beings to share in this fecundity, by linking the procreation of each new person with a specific act of love between a man and a woman.1 Therefore “sex is not a shameful thing; it is a divine gift, ordained to life, to love, to fruitfulness.”2 Since a human being is an individual consisting of a body and a soul, the loving procreative act calls for the participation of all dimensions of the human person—body, feelings, spirit.3 Original sin broke the harmony within each person and with other men and women. This rupture had a special repercussion on the capacity to live our sexuality in accord with human reason. It obscured the inseparable bond between the affective and procreative dimensions of the conjugal act, and made it more difficult for the will to exercise control over the affective and bodily forces of sexuality. In these circumstances, the struggle for purification and growth in maturity that our sexuality requires does not imply any rejection or negative consideration of this gift that men and women have received from God. -

This paper offers a case study that questions this position's validity: an examination of Sallust's Epistula Mithridatis (Hist. 4.69M) and Pompeius Trogus' speech of Mithridates (Justin 38.4-7). I argue that Sallust offers a more powerful attack on Roman foreign policy than does Trogus, whom many scholars have deemed "anti-Roman," and conclude that Roman historiansare capable of using -
