Freamon Abstract There is now a worldwide consensus on the firm existence of a human right to freedom from slavery. This consensus gives rise to what was thought to be an irrefutable argument that the right to be free from slavery is a jurisprudential universal, with no competent legal system or govern- ment able to deny its existence or permit derogation from its tenets. This argument is now being tested by the ideologies, policies, and actions of Muslim insurgencies in Iraq, Syria, and Nige- ria, each claiming that the enslavement of non-believing combatants and war captives and slave trading in such persons is permitted under Islamic law. This Article considers the implications of these claims for the future of Islamic law and for its relationship with the world’s legal systems, particularly international humanitarian law. It posits that the claims of these insurgencies, while glaringly out of step with modern views of chattel slavery, should be taken seriously and actually have a great deal of support in Islamic legal history. It argues that, despite the long presence of slavery and slave-trading in Islamic legal and imperial history, there is now a firm jurisprudential basis for declaring that slavery in Islam can and should be abolished, even under a government bound by the Shar??ah. It asserts that Muslims and scholars of Islam must engage the Islamic State and Boko Haram in dialogue on this point. It argues that the moral questions raised by the continued specter of slavery in Islamic legal culture are profound and fundamentally more signifi- cant than any other questions facing the Muslim community at this time. The Article closes with a pessimistic assessment of the future of Islamic law in its relationship with international human- itarian law and in its ability to improve the lives of its subjects, should Muslims and scholars of Islam fail to achieve a community-wide understanding on the need for de jure abolition. These facts give rise to what was thought to be an irrefutable argument that the right to be free from slavery, like the right to be free from genocide, torture, racial discrimination and piracy, is a jurisprudential universal, with no competent legal system or government able to deny its existence or permit derogation from its tenets.1 To the great surprise and grim consternation of many contemporary scholars, observers and commentators, particularly those who seek a place for the Sharīʿah among the world’s legal systems, this argument is being tested by the ideologies, policies, and actions of Muslim insurgencies in Iraq and Syria and in Nigeria, each claiming that the enslavement of non- believing combatants and war captives and slave trading in such persons is permitted under Islamic law. This Article considers the implications of these claims for the future of Islamic law and for Islamic law’s relationship with the world’s international and domestic legal systems, particularly the emerging system of international humanitarian law. It posits that the claims of the Muslim insurgencies in Iraq, Syria, and Nigeria should, from a jurisprudential perspective, be taken seriously and that such claims, while glaringly out of step with modern views of chattel slavery, actually have a great deal of support in Islamic legal history. It argues that, nonetheless, there is now a firm Islamic jurisprudential and legal basis for declaring that slavery in Islam can and should be abolished, even under a government bound by the Sharīʿah. It asserts that Muslims and scholars of Islam around the world must engage the partisans, jurists, and ideologues of these insurgencies in dialogue on this point, questioning both their view of the historical facts supporting their claims and their understanding of the role of Islamic law in contemporary Muslim communities. The Article closes with a pessimistic assessment of the future of Islamic law in its relationship with international humanitarian law and in its ability to improve the 1. Source: CIA World FactBook (Last Updated August 2020) INTRODUCTION While Turkey remains a nominally secular republic, political Islam has been ascendant in the country since the military coup of 1980. The consolidation of power by Recep Tayyip Erdogan’s Justice and Development Party in the past 15 years, however, has led to the gradual weakening of secularism and the promotion of political Islam in Turkish public life. Political Islam has become increasingly visible at the grassroots level, as pious Turks enjoy growing representation in the political process. In parallel, the mounting authoritarian tendencies of the Turkish government have stifled political opposition. The transformation of Turkey from a parliamentary to a presidential system of government in a 2017 referendum has ensured, for the time being, that Erdogan’s political agenda faces no serious domestic challenges. That said, following the fallout with the Gülen Movement with whose support Erdoğan came to power, he has been forced into an uneasy alliance with domestic ultra-nationalists. This has not diminished Erdoğan’s Islamism, however, but rather injected it with greater doses of Turkish nationalism. Turkey’s foreign policy has been transformed accordingly. Following the 2011 Arab Spring uprisings, Turkey actively intervened to secure the victory of political Islam across the Middle East and North Africa, lending support especially to the Muslim Brotherhood and affiliated organizations.

    Contemporary Slavery 2 and Its Definition in Law Jean Allain Had Olaudah Equiano, Abraham Lincoln, or William Wilberforce been able to look into the future to the twenty-first century, what they may have been most struck by was not how far we had come in ending slav- ery and suppressing human exploitation but, rather, that we had yet to agree on what in fact the term “slavery” means. This is a rather intrigu- ing puzzle, as a consensus has existed for more than eighty-five years among states as to the legal definition of slavery. Yet, this definition has failed to take hold among the general public or to “speak” to those in- stitutions interested in the ending of slavery. At first blush, this is not so hard to understand since the definition, drafted in the mid-1920s by legal experts, is rather opaque and seems to hark back to a bygone era. The definition found in the 1926 Slavery Convention reads: “Slavery is the status or condition of a person over whom any or all of the powers attaching to the right of ownership is exercised.”1 At first sight, the definition really does not convey much to the reader, but for the fact that it appears to require that a person own another. As the ownership of one person by another has been legislated out of existence – again – it appears that this definition would have no traction in the contemporary world. Yet, this is not so since the legal definition of slavery established in 1926 has been confirmed twice: first, by being included in substance in the 1956 Supplementary Convention Contemporary Slavery

Article 12 of the Convention establishes the right of the child to express views and to have those views respected and properly taken into consideration. Introduction It is widely accepted that capitalism is characterized by “free” wage labor. But what is “free wage labor”? According to Marx a “free” laborer is “free in the double sense, that as a free man he can dispose of his labour power as his own commodity, and that on the other hand he has no other commodity for sale” – thus obliging the laborer to sell this labor power to an employer, who possesses the means of production. Yet, instances of “unfree labor” – where the worker cannot even “dispose of his labor power as his own commodity1” – abound under capitalism. The question posed by this paper is why. What factors can account for the existence of unfree labor? What role does it play in an economy? Why does it exist in certain forms? In terms of the broadest answers to the question of why unfree labor exists under capitalism, there appear to be various potential hypotheses. ¾ Unfree labor may be theorized as a “pre-capitalist” form of labor that has lingered on, a “vestige” of a formerly dominant mode of production. Similarly, it may be viewed as a “non-capitalist” form of labor that can come into existence under capitalism, but can never become the central form of labor. ¾ An alternate explanation of the relationship between unfree labor and capitalism is that it is part of a process of primary accumulation.

The Ys tended to separate themselves from the Peshmerge (the Kurdish military), which likely resulted in their being left vulnerable to this brutal attack. (For interviews with some Yazidis, here via BBC). Who are theologically the Yazidis ? For repeat readers, they will know I support the (somewhat) controversial thesis of Christian scholar Margaret Barker (known as Royal Temple Theology). Barker’s first work is titled The Older Testament. A brilliant way to describe her point of view–namely that the Judaism that comes across in the Hebrew Bible we currently have has been massively (re)edited, more than most scholars will admit, by the Deuteronomic/Rabbinic schools of Judaism. The Older Testament (as opposed to the “Old Testament” of the Deutro. school) included the belief in two g/Gods. The first was the High God (El, Elyon) who had “sons” (angelic beings). Each angel, known as an angel of the nation, was chosen for a specific people. As above so below. i.e. When their was war on earth between two peoples, their angels were fighting in heaven. Hence all the Psalms rousing YHWH (Israel’s Angel/god) to fight. The second G/god then is YHWH for Israel.

Sheikh Adi, a Sufi, and His colleagues, a ragtag fraternity of Buddhists, Christians, Hindus and Jews wrote a detailed explanation of This Angelic Being and His Pillars of Faith called the Kitab al Jilwa, “The Book We Wrote.” The people Sheikh Adi taught about Tawsi Melek, called themselves Yazidi, the descendants of Angels, or “The Defenders of the Place”. Who attacked them? Other Christians, Muslims, and Jews without restraint. Weary of war, dogma, displacement, and the shear ridiculousness of it all, Sheikh Adi led a revolution through Tawsi Melek. What did Tawsi Melek say about His religious contemporaries and reasons for their Crusades? “All the books of those who are without decency are altered by them; and they have declined from them, although they were written by their prophets and the apostles. That there are interpolations is seen in the fact that each sect endeavors to prove that the others are wrong and to destroy their books.” Sheikh Adi and the Yazidi wanted none of it.
