Glossary

Chittagong Hill : Chittagong Hill Tracts Regional Council is a statutory apex body Tracts Regional of the Chittagong hill tracts and consist of a chairman, fourteen Council tribal members; seven non-tribal members; chairmen of the three hill district councils (ex-officio).

Circle : Chittagong Hill Tracts are sub-divided into three units based on ethnic domain. Each unit is called circle.

Circle Chief : Circle Chief is an administrative head of a circle responsible for the administration of “tribal” justice and customary laws of the hill people, for revenue administration.

District : Administration unit headed by district commissioner comprising a number of .

Hill District Council : Hill District Council is a statutory body and consist of a chairman, twenty tribal members, and ten non-tribal members.

Headman : Headman is the mouza chief and responsible for the administration of “tribal” justice and customary laws of the hill people, for revenue administration within a Mouza.

Karbari : Karbari is the local level leadership in the Chakma justice system. Karbari assists the headmen in the judicial process.

Mouza : Mouza is composed of several villages. Mouza is officially called as Revenue Village.

Para : Administrative unit (sub-division of union).

Union : Union is an administrative unit and a subdivision of .

Union Parishad : Local government institution at union level. Union parishad consists of an elected members and chairman, and is the oldest government institution in Bangladesh.

Upazila : Upazila is an administrative unit and a sub-division of district (zila).

Upazila Parishad : Local government institution at upazila level. The upazila parishad consists of an elected chairman, two vice-chairmen (one male and one female), and ex-officio members of chairmen of union parishads.

EXECUTIVE SUMMARY

1. The Government of Bangladesh (GoB) has obtained a loan from Asian Development Bank (ADB) for financing Second Chittagong Hill Tracts Rural Development Project. Total cost of the project is $70.80 million, out of which $55.00 million is financing by ADB, $14.40 million by GoB financing and $1.40 million by the local beneficiaries. The project has been started since January 2012. Though it is expected that it will be accomplished by 30th June 2019 but considering the field difficulties it is decided to extend the completion of the project period up to 30th June 2020.

2. The Project’s impact is to increase rural household incomes in subproject areas in Chittagong Hill Tracts and its outcome is increased income-generating opportunities for people in subproject areas. The Project comprises five main outputs - (i) institutional development and capacity building, (ii) upgraded 166 km of rural roads, (iii) development of community infrastructure in 600 villages, (iv) sustainable micro agribusiness development in 9 upazilas, and (v) efficient project management operationalized. Ministry of Chittagong Hill Tracts Affairs is the executing agency, the Chittagong Hill Tracts Regional Council is the lead implementing agency, and the Local Government Engineering Department is the implementing agency for the rural road component.

3. In compliance with the loan covenant, this semistral environmental report has been prepared. This report describes the status of implementation and compliance of the Environmental Management Plan (EMP) to satisfy the environmental safeguard requirements of ADB and GoB as well as to fulfil the requirements mentioned in the loan document. This report also describes the environmental mitigation related any corrective and preventative actions with respect to each subproject for the period from January to June 2019.

4. The SQMC consultant has visited all the packages of contracts for the upgrading works of roads under rural road component and 32 completed and ongoing development works of community infrastructure subprojects. This report comprise of post monitoring of CI component in most cases and regular monitoring of rural road and micro agree business development

component. The major environmental concerns for the improvement of rural road and community infrastructure subprojects are – congestion of natural water flow channel due to unstable and improper management of excavated soil along with improper removal of diversion road, threat of hill slide due to steep cut of hill, soil erosion and sedimentation, slope instability, topsoil disturbance, disturbance of vegetation, degradation of surface water, soil induced dust pollution. Besides these, occupational health and safety issues are also very concern factor in all form of work. The slope maintain during cutting of hill is not maintained. The contractors are not very aware regarding the environmental issues. Protection of vegetation, direct loss of trees are considered by the contractors sometimes.

5. The environmental mitigation measures during the pre-construction stage of all sub projects was satisfactory. Checking of environmental mitigating infrastructure design in all rural road improvement subprojects and CI components have been done effectively during design and pre- construction stage. In all subprojects, environmental issues have been identified and EMPs have been prepared as a part of feasibility study report; and incorporated in bidding documents and contracts.

6. Contractor’s obligations in respect of implementation of EMP is partially satisfied with a lot of dissatisfaction. It might be happen that the contractor are not aware or capable to handle the environmental issues. Majority of contractors did not provide personal protective equipment - like face masks, hand gloves, helmets, high visibility clothing etc. to their workers; and first aid box with medicines was not available most of the worksites.

7. Primarily, about 91 hill spot has been identified for hill slide mitigation measures along the road side in which (Kawkhali 18, Kaptai 12, Baghaichori 03) has 33 spots , Bandarban (Sadar 12, Naikhongchari 23, Alikadam 08, Lama 14) has 57 spots and Khagrachori (Guimara 01) has 1 spot. Finally 67 spot has been finalized where mitigation measures is needed. It is found that natural water canal i.g. chara is getting congested by the huge soil dumping in some places of Lama and Alikadam Upazila. It is also found that due to inappropriate remove of diversion road of bridge construction, congestion of natural flow is being critical. Construction debris found on road which is a very risky factor for passenger as well as road longevity. Loose soil found on

bridge junction which create mud consequently risky factor for people and vehicle. Still no remarkable progress found regarding the soil compaction on road side.

8. Tree plantation is one of the major task in this reporting period. Though it is planned for completion the plantation activity by June but it is not possible due to adequate rainfall. It is now assumed that by July all tree plantation will be accomplished.

9. A corrective action plan and some recommendations have been suggested in this report. It is expected that LGED district offices and DPMOs will implement the corrective action plan and recommended monitoring adjustment measures; and will be able to demonstrate a substantial improvement, which will be focused in the next report.

Chapter 1 Introduction

1.1 Project Background:

10. The Government of Bangladesh (GoB) has obtained a loan from Asian Development Bank (ADB) for financing Second Chittagong Hill Tracts Rural Development Project. 11. Poverty alleviation is the significant activities of RD&I sector. The project aims at reducing incidence of absolute poverty among the rural CHT people through undertaking community infrastructure, rural access development activities, & expanding income through micro agri- business development in the CHT Region. The CHT region lags behind in every aspect compared to other parts of the country. The project has link with ADB assisted recently completed Chittagong Hill Tracts Rural Development Project (CHTRDP). Also the UNDP’s Promotion of Development and Confidence Building in CHT region (referred to as CHT. Development Facility (CHTDF), DANIDA’s Hygiene Promotion, Sanitation & Water Supply (HYSAWA) and other agencies like as the United Children Fund (UNICEF) assisted Integrated Community Development Project (ICDP) are also working in the region on rural & social development and community empowerment.

1.2 Project Objectives:

12. The Project’s impact is to increase rural household incomes in subproject areas in Chittagong Hill Tracts (CHT) and its outcome is increased income-generating opportunities for men and women in subproject areas. The main objectives of the project are as follows:

(i) To contribute to a reduction in the incidence of poverty among the rural population of the CHT region and provide suitable implementation arrangements to underpin the CHT Accord and strengthen key institutions to help meet their mandated role.

(ii) To increase employment and income generating opportunities for the population through community participatory subproject development.

(iii) To promote and increase of small agri-business opportunities through stimulating agriculture production & facilitating marketing of high value environmentally friendly crops in the Chittagong Hill Tracts region.

(iv) To increase economic opportunities for rural poor, especially women, vulnerable groups and IP communities through community infrastructure development activities &construction of feeder roads including appurtenant structures.

(v) To improve watershed conditions, especially soil erosion and water conservation that will underpin the investments made in water and land improvements; and

(vi) To support institutional strengthening of MOCHTA, CHTRC and HDC to plan implement and monitor sustainable rural development in the three of Chittagong Hill Tracts i.e. Rangamati, Khagrachari and Bandarban).

1.3 Project Output:

13. The Project comprises five main outputs -

(i) Institutional Development and Capacity Building, comprising capacity building and training of executing agency, implementing agencies and relevant NGOs in the areas of indigenous peoples and safeguards issues, village mapping, and project management and organizational enhancement;

(ii) Rural Roads comprising improvement of 105 kilometres union roads and 61 kilometres upazila roads, construction of 3,884 meters bridges and culverts; and the extension of 3 functional buildings for LGED’s district office;

(iii) Community Infrastructure, comprising construction of 92 kilometres village access roads between and within villages and 100 market sheds, improving small-scale irrigation and water supply in up to 600 villages and participatory watershed management interventions in 6 sample watersheds;

(iv) Micro Agribusiness Development, comprising capacity building in relation to identification and exploitation of potential high-yield commodities, establishment of common interest groups to market commodities and improving cultivation of high-yield commodities in 9 upazilas; and

(v) Project Management, comprising establishment and operation of the PMO, the DPMOs and the PD (Roads) Office, provision of technical and implementation expertise from project implementation consultants, and establishment and operation of a safeguards and quality monitoring cell within the PMO.

1.4 Context of the Environmental Monitoring Report:

14. ADB affirms that environmental and social sustainability is a cornerstone of economic growth and poverty reduction in Asia and the Pacific. ADB’s Strategy 2020 therefore emphasizes assisting DMCs to pursue environmentally sustainable and inclusive economic growth. In addition, ADB is committed to ensuring the social and environmental sustainability of the projects it supports. ADB adheres to the objectives of the safeguards and their delivery. ADB assumes the responsibility for conducting due diligence and for reviewing, monitoring, and supervising projects throughout the ADB’s project cycle in conformity with the principles and requirements embodied in the SPS. The SPS of ADB is comprised of three following key areas:

i. Environmental safeguards,

ii. Involuntary resettlement safeguards,

iii. Indigenous Peoples safeguards.

The main objective of Environmental Safeguard is to ensure the environmental soundness and sustainability of projects and to support the integration of environmental considerations into the project decision-making process.

15. According ADB’s Safeguard Policy Statement it is clearly mentioned that, the borrower/client will monitor and measure the progress of implementation of the EMP. The extent of monitoring activities will be commensurate with the project’s risks and impacts. In addition to recording information to track performance, the borrower/client will undertake inspections to verify compliance with the EMP and progress toward the expected outcomes. For projects likely to have significant adverse environmental impacts, the borrower/client will retain qualified and experienced external experts or qualified NGOs to verify its monitoring information. The borrower/client will document monitoring results, identify the necessary corrective actions, and reflect them in a corrective action plan. The borrower/client will implement these corrective actions and follow up on these actions to ensure their effectiveness.

16. The borrower/client will prepare periodic monitoring reports that describe progress with implementation of the EMP and compliance issues and corrective actions, if any. The borrower/client will submit at least semiannual monitoring reports during construction for projects likely to have significant adverse environmental impacts, and quarterly monitoring reports for highly complex and sensitive projects. For projects likely to have significant adverse environmental impacts during operation, reporting will continue at the minimum on an annual basis. Such periodic reports will be posted in a location accessible to the public. Project budgets will reflect the costs of monitoring and reporting requirements.

17. In compliance with the loan covenant, semestral environmental monitoring report is essential. This report describes the status of implementation and compliance of the EMP to satisfy the environmental safeguard requirements of ADB and GoB as well as to fulfil the requirements mentioned in the loan document. This report also describes the environmental mitigation related any corrective and preventative actions with respect to each subproject for the period from Jan to June 2019.

1.5 Methodology:

18. Several type of tools are considered to prepared this semi-annual environmental monitoring report. Field visit with direct observation is the key means to gather information. Several field visit has been made to understand the situation of implementation activities through the lens of environmental safeguard. Beyond the direct field observation, random performance checks, reviewing records and document, meeting minutes, field book and consultation with relevant stakeholders such as affected persons, beneficiaries, Para Development Committee (PDC), local union parishad representative. Focus group discussion with woman group and tea stall consultation were very effective means to get the information. Project Implementation Consultant (PIC), Project Management Office (PMO) and Local Government Engineering Department (LGED) at different levels are also consulted. The following environmental issues have been considered to develop this environmental monitoring report.

 Soil impacts (loss of top soil, soil quality, etc.)  Impact upon landscape and topography;  Dust, air and water pollutions;  Drainage congestions at bridge/culvert/ diversions and other locations;  Removal of trees/vegetation;  Disruption of watersheds and catchments;  Disruption of fish/wildlife habitats;  Loss of land, household and commercial structures;  Impacts upon community and occupational health;  Risks of worker and road accidents;  Disruption of existing infrastructure (water supply, sanitation, power lines, telephone lines, etc.)

19. As a part of the project management support, consultant of the safeguards and quality monitoring cell (SQMC) provides inputs on intermittent basis to monitor compliances with environmental safeguards to ensure that the project is implemented with due concern for environmental safeguards according to the ADB’s Safeguard Policy Statement 2009, specifically to ensure that these issues are adequately addressed to the requirements of ADB.

1.6 Physical Progress of Project Activities:

20. The most construction work is under the rural roads (RR) component and LGED is the implementer of this component. Three functional building in three hill districts have been completed. LGED has been spilt the total road construction work into 62 packages for effective implementation and management. Among the packages, 20 is under Rangamati district (31.22 km road and 615.50 m bridge), 33 in (37.74 km road and 1210.05 m bridge) and 9 in Khagrachari district (16.74 km road and 337.25 m bridge). Among the 9 packages of Khagrachari district 5 package is done completely, 3 packages have above 95% progress and only one project having the progress of 50% which is under process for rapid completion. The average progress is 83%. In Rangamati, 72% is average progress and 86% average progress is also happened in Bandarban. Out of 9 package in , only one package is under 50% progress. In Bandarban, 220 m bridge on is still very low progress in real ground. Out of 7 packages in Baghaichari Upazila, the progress of 3 packages is only less than 40 % progress. (please see Appendix 1 for detail progress report).

21. Under the community infrastructure (CI) component, all subprojects have been accomplished successfully. (Please see Appendix 2 for detail progress report)

22. In Micro Agree-business Development component, formation of 900 farmer group and 90 agree business group has been established where progress is 100%. The progress of vegetable farming is 100%, Medicinal plant 100%, Fisheries 100%, Orchard fruit garden 100% and orchard nursery is 100%.

1.7 Scope of the Monitoring Report:

23. The scope of this report is to assess the status of implementation and compliance of the EMPs of each subprojects of improvement of rural roads (upazila and union connecting roads) and development of community infrastructures, where the construction works have been started and completed, to satisfy the environmental safeguard requirements of ADB and GoB as well as to

fulfil the requirements mentioned in the loan document. This report also the environmental mitigation related any corrective and preventative actions with respect to each subproject for the period from January to June 2019 and onward.

1.8 Change in Project Scope:

24. Cost of rural roads improvement including construction of ancillary structures under rural road component, and market sheds under CI component have been increased substantially. Therefore, the target of upgrading 105 km of union and 61 km of upazila (sub-district) roads, construction of 3,884 meters ancillary structures, and 100 market sheds will not be achieved within the available budgetary allocation. So, the Project implementing authorities have proposed to re- fixation project scope as upgrading 54.50 km of union roads, 30.50 km of upazila roads, construction of 2300m ancillary structures, and 24 market sheds.

1.9 Monitoring Requirement:

25. The project falls under “B” category according to ADB Safeguard Policy Statement, 2009 and “Orange B” category in accordance with the Bangladesh Environment Conservation Act 1995 and Environment Conservation Rules 1997. All rural road subprojects require an IEE; but many community infrastructure development subprojects have minimal impacts, where a desk review is adequate. IEE as a part of the subproject feasibility report for each subproject, commensurate with the degree of environmental impacts has been prepared by the implementing agencies including EMP and included in all contracts let. These are consistent with GoB and ADB requirements.

26. Monitoring parameters vary depending upon nature of the project. CHTRDP-II is a rural development project comprising improvement of rural road subprojects from earthen surfacing to brick pavement surfacing and existing damaged brick pavement surfacing to bituminous surfacing, construction of small bridges and culverts, stairs on hill slope, installation of tube/ring wells, supply of small power pumps and power tillers for improved agriculture in the hilly rural area. In each of the subproject feasibility report on rural road improvement and community infrastructure development, an EMP has been included, where mitigation measures have been commensurate

with the degree of environmental impacts. Environmental monitoring requirements required for this project is presented in Table 1 as follows:

2.1 Quantitative and Qualitative Monitoring Data:

27. The extent of the environmental impacts is determined in qualitative term by field visits and visual inspection. On the other hand, the extent impact of environmental pollution related to surface water, ground water, air quality, noise, and soils is determined in quantitative terms by sampling a range of related parameters as well as visual inspection by field visits.

2.2 Environmental Safeguard Issues of Rural Road Components:

28. During the reporting period I have visited all the packages of rural road component, 32 packages of community infrastructure component and 24sites of micro agriculture business development component. Some of the packages of rural road component have completed and ready for tree plantation. Other packages are comprised of box cutting, earthen road surfacing to brick pavement surfacing and existing damaged brick pavement surfacing to bituminous surfacing, construction of bridges and culverts. Contract wise field visit observations on the environmental safeguard issues rural road component are presented in Appendix 4 and their summary is given in Table 2 as follows:

2.3 Environmental Safeguard Issues of Community Infrastructure (CI) and Micro Agribusiness Development (MAD) Component:

29. All CI component has been completed according to plan. 30. Quantitative monitoring data of surface water, noise (shrillness of sound) and soils (fertility of soil) related to environmental pollution for upgrading of rural roads and construction of bridges are equipment based and requires money. Till now the implementing agency (LGED) did not make any provision to monitor these parameters. The monitoring of ground water quality under community infrastructure component has been conducted and its quantitative data of arsenic (As), iron (Fe), manganese (Mn), chlorides (Cl), acidity (pH), and total dissolved solids (TDS) are were included in previous report (EMR: Jan-June, 2017). The field observation and practice of water supply along with maintenance of different technology particularly GFS and dug well have a potential threat of faecal contamination hence need to water quality test.

2.4 Monitoring Parameter:

31. For effective monitoring, environmental parameters have been identified as indicators which are qualitatively and quantitatively measured and compared over a period of time in order to assess the compliance to EMP. The parameters, which are identified as performance indicators, are (a) compliance with environmental management and monitoring plan; (b) compliance to national environment conservation rules; (c) monitoring of ambient surface water quality, ground water, noise levels (shrillness of sound), and soil (fertility of soils) and comparison with baseline environmental quality and national standards. As rural development project has no significant impact on air quality, monitoring of this parameter is dropped.

32. Parameter of shrillness of sound is dBA; parameters for fertility of soils are silt, clay, organic carbon, total nitrogen, exchangeable magnesium, exchangeable sodium, exchangeable calcium, exchangeable potassium, cation exchange capacity, phosphorus, and soil pH have been identified; and parameters for surface water such as dissolved oxygen, acidity, biological oxygen demand, and suspended solids have also been identified for upgrading of rural roads and construction of

bridges under rural road component. These parameters are not monitor due to lack of money as mentioned in para 30 above.

2.5 Monitoring Results and Compliance Status:

33. The implementation status of the environmental mitigation measures during the pre- construction stage of all sub projects was satisfactory. Checking of environmental mitigating infrastructure design in all rural road improvement subprojects has been done effectively during design and pre-construction stage in association with Survey Design and Supervision (SDS) consultants, and Deputy Team Leader of PIC. In this stage, Executive Engineers of the respective LGED district have checked the present subprojects environmental settings and identified the problems that might be occurred during construction and selected mitigation measures with implementation procedures in consultation with the community.

34. Similarly, checking of environmental mitigating infrastructure design in all community infrastructure subprojects has been done during design and pre-construction stage by the Deputy Team Leader of the PIC. In this stage, Deputy Project Directors of the respective DPMOs have checked the present subprojects environmental settings and identified the problems that might be occurred during construction and selected mitigation measures with implementation procedures in consultation with PDC of the respective para/village and community.

35. In all rural road subproject, probable occupational health and safety issues in relation to development of the subprojects were considered and incorporated into the contract documents; but the extent of the impacts of environmental pollution monitoring related to surface water, noise, and soil were not considered by the implementing agency (LGED).

36. In community infrastructure component, environmental issues have been identified and EMPs have been prepared as a part of feasibility study report; and EMPs were incorporated in the bidding documents and contracts.

37. 38. The major activities under the community infrastructure component are construction of irrigation canal, installation of deep tube well, installation of shallow tube well, production well for irrigation, dug well, distribution of power tiller and power pump and installation of gravity flow system. From the perspective of post monitoring view, it is found that most of the stair case covered with soil which have a treat of slipping. 2.7 Compliance Status of ADB Safeguard Policy Statement:

40. The project falls under “B” category according to ADB Safeguard Policy Statement 2009 and hence an IEE is sufficient to meet the environmental requirements. IEE reports for six sample subprojects were prepared by the project preparatory consultants. An EARF also prepared by the ADB’s PPTA team. The CHTRDP-II has adopted the EARF. IEE reports including EMP for other subprojects, which were implement, or are being implemented, were prepared as part of the subproject feasibility report based on this EARF and ADB Safeguard Policy Statement 2009.

2.9 Institutional Arrangement for Implementing EMP:

42. Ministry of Chittagong Hill Tracts Affairs is the executing agency. The Chittagong Hill Tracts Regional Council (CHTRC) is the lead implementing agency, where a PMO headed by a Project Director has been established. The PMO is supported by three DPMOs headed by Deputy Project Director at each district and a team of PIC. Respective project DPMO is implementing CI components through PDC/CDC. LGED is the implementing agency for the rural road component headed by another Project Director. The responsibilities of each agencies during the various phases of the project are shown in table 8 as below:

LGED, PIC and SQMC consultants monitor these activities. Similarly, DPMO implements and monitors EMP under CI component. LGED and DPMO send monthly monitoring report to PD, PMO. After compiling these report PMO prepares semistral report with the assistance of PIC/SQMC consultant and sends this report to ADB, MoCHTA and DoE. 44. A comprehensive grievance redress mechanism has been established for the project under the land acquisition and resettlement framework. The same mechanism is applied for grievances arising due to environmental impacts, with the Project Director deputing a relevant community, project team member or NGO representative to join the process depending on the nature of the grievance.

Chapter 3 Tree Plantation

3.1 Background:

45. As a suggestive measures from EMP, tree plantation was a very important event. It was decided that after completion of component B (Rural Road) tree plantation will be in placed following the policy 1 for 10. Social Mobilization NGO are the front line key players to implement this activities with the direct supervisor of DPMO. It is planed to accomplish the tree plantation by June 2019 but which is not done in mentioned period. The tree plantation guideline has been revised by the PMO where projected for plantation of 25,000 sapling in both side of road. Local species is selected for plantation. During this reporting period (by 30th June, 2019), though no plantation is made due to scarcity of rainfall but the PMO ensure us to make it happen when the seasonal rainfall start and subsequently will be accomplished by July 2019. The following table 9 of road packages are selected for tree plantation.

3.2 Institutional Framework of Tree Plantation:

46. The office of the Deputy Project Director (DPD), established in each of the hill districts is responsible to supervise, guide and monitor the Tree plantation implementation activities at the district level. The DPD will report to the PMO and Hill District Council (HDC) on all aspects of the project. Besides, he is also responsible for liaison and coordination at Upazila and Union Parishad level and will supervise the activities of the NGO contracted for social mobilization of the communities.

The MAD and SM-NGOs will play a vital role in the implementation of the tree plantation. Their key responsibilities are as follows:  Mobilize the affected person/ adjacent communities/ traditional leaders/ UP representatives etc. of along the improved roads.  Responsible for formation of a Tree Plantation Maintenance Committee (TPMC) as well as a procurement evaluation Committee (PEC).  They will update and guidance to TPMC ( Tree Plantation Maintenance Committee) about monitoring, supervision on tree plantation implementation process.

The (TPMC) represents their respective para’s affected person/ adjacent communities/ traditional leaders/ UP representatives etc. of along the improved roads. The Tree Plantation Maintenance Committee (TPMC) is located at Para level will be constituted with 9-11 person. The responsibilities of TPMC are as follows:

 Responsible for coordination and management of implementation of tree plantation in their respective area.  The TPMC will be responsible for Care and Maintenance of the saplings after completion of the tree plantation and  They will be responsible for sustainable O&M

3.3 Species Selection:

47. The common species of saplings are primarily selected for plantation which are Neem (Azadarachta indica), Mahogany (Swietenia mahagoni), Shishu (Dalbergia sissoo), Shirish (Albizia lebbek), Jam (Syzygium jambolana), Babla (Acacia 12rabica), Arjun (Terminalia arjuna), Jarul (Lagerstroemia flosreginae), Tentul (Tamarindus indica). Also Aam (Mango indica) and Jack Fruit (Artocarpus heterophylus). The saplings will be from above approved list of man-height size(five feet plus). After consultation with the department of forest, department of agriculture and local expert the species will be finalized.

3.4 Ownership of Planted Trees:

48. The representative of local government (UP Member/Chairman) should sign a MoU regarding ownership of the planted trees for all the affected persons in his area. The following parties will obtain shares (of the monetary value) of the planted trees at the time of sale. At consensus, parties may cut and sell trees after 10 years from the time of planting where Local government (Union Parisad) and Owner(s) of affected persons will get the share 45% and 55% respectively.

3.5 Action Plan:

49. It is decided to accomplish the tree plantation by June 2019 in all completed road. The following table 10 show the detail plan for tree plantation.

3.6 Plant Nursing:

50. The TPMC will, with the assistance of the NGO, DPMO & PIC, prepare an Operation and Maintenance (O&M) plan for monitor, nursing and care of the saplings. After plantation, watering, care of soil, weeding, vacancy filling/failed plants re-placement, prop replacement, pruning etc. will be done by the TPMC under close supervision of SM-NGOs and Union Parishad. The concerned issue for tree plantation and nursing to look after the tree. After June 2019 MAD and SM NGO’s contract will be finished. So it is now the question who will take care of the community people for nursing the tree which is not mentioned in the revised guideline of tree plantation.

Chapter 4 Result and Corrective Action Plan

4.1 Result:

51. The project is in the stage of third time extension which will be up to June 2020. Out of major 3 components MAD (Micro Agribusiness Development) and CI (Community Infrastructure) have been accomplished successfully. The only component which is not complete yet is the rural road component. Due to local context in terms of connectivity, political and resources availability it is happened. The major environmental impact found in the improvement of rural road construction. The previous EMR have dealt with different environmental issues. In this report I have focused on very specific issues but have a very large environmental and social impact. More over these, it is also important to notice that at the ending stage of project it is very difficult to find new environmental impact rather monitoring of previous suggestive measures.

52. Congestion of natural flow system is a very crucial issues for this reporting period. This particular issues is resulted from rural road construction. This is happen for both construction of road where massive amount of earth excavation is placed and obviously at the place of bridge or culvert construction. It is found that most of the site of bridge/culvert construction diversion roads are not properly removed. It is also a matter of bad practice that in some places no removal of diversion road which create water logging in one side and water shortage in downstream. As a result, habitats of both side of the the diversion road (which is acting as embankment) are at danger. Moreover the stagnant water is using for bathing and regular household activities through it is contaminated through nearby soak pit and other polluting agent. In this regard, it is strongly suggested that respective contractor will properly remove the diversion road and its associated materials. It is also suggested to remove or the soil mass from the pathway of natural flow resulted from soil excavation during road construction.

53. Construction debris on road is an important issue to mention here. It is found that after construction of road and bridge the debris and soil mass is not removed properly which make the road risky for passengers and vehicles. Again, during the dry season it make a huge amount of dust which is bad for health particularly for breathing problem. Moreover these, small piece of brick chips is very risky for motorcycle which are found in every bridge construction point. It is suggested to remove all the construction debris from the road to make the way risk free for people and vehicles,

54. Land slide threat for inappropriate slope cutting during road construction is very important issue highlighted in this report. The soil type of this region is very critical. It make

difference in very short distance even a couple of meters distance. Soil texture and soil profile also differ from its small depth. It is very difficult to find out uniform soil in long depth and distance. The most of the soil is mixture of silt, fine sand and clay along with loamy. Considering along with the soil condition, intensity of rainfall, physical communication, available materials and cost effectiveness, it is decided that one single solution is not enough to mitigate the hill slide threat. As a result 3 step measures have been suggested which are RCC retaining wall supported by RCC pile, providing geotex over the slope of the hill with appropriate nailing and bio engineering on the slope. The propose measures will not directly protect the hill slide during heavy rainfall rather it will safe the loss of live and keep the road communication live. To reduce the disturbance to hill, pile supported RCC retaining wall is suggested. Geotex will absorb the shocks of direct raindrop and protect the top soil. Local verities plants will primarily conserve the soil which will be planted by making hole on geotex wrapping. After settle down of soil it is suggested to plan local varieties of trees for long term protection of hill slide. Most of the location it is suggested for both retaining wall and geotex soil nailing with plantation. The height of retaining wall is depend on the height of hill. The length of the retaining wall is calculated in field considering the most vulnerability along with associated risks. The following table shows the required length of the proposed retaining wall. The maximum height of RCC retaining wall is considered two categories which is 5 meter and 3 meter. This table is also covered with the required area for geotex wrapping with soil nailing.

55. Tree plantation is now a burning issue for this reporting period. Though it is planed to accomplish the tree plantation by June 2019 but not possible due to lack of adequate rainfall. It is now planned to accomplish by July 2019. The tree plantation guideline has been revised by the PMO where projected for plantation of 25,000 sapling in both side of road. Local species is selected for plantation.

56. Dust pollution from soil during construction of road is not found during this reporting period as it is rainy season and most of the road construction is over. The important issue to notify is soil mass is found on road particularly in junction of bridge/culvert which create mud on road and subsequently it has created problem for people and vehicle. It is also projected that after rainy season, this soil mass will transfer to dry dust and make problem for others and children. The contractors should remove all the soil mass from the road immediately. 57. Soil erosion and sedimentation is very critically review in this report. Most of the excavated soil from road improvement are dumped besides the road without any compaction. As

a result it has a massive potential to erosion during rainfall and sediment over the agricultural land and forest along with congestion of natural flow.

58. Air pollution from bituminous activity of road construction is another environmental concern considering the climate change perspective. It is also found in some places that wood is using as fuel to burn the bitumen which is not a good practice at all. Though it is not very massive in this project but have some impact as carbon dioxide emission occur. The cumulative impact is aggravated if use of wood as fuel. The contractor should take care of it and it is suggested to not use of wood as fuel during road construction.

Chapter 5 Conclusion and Recommendations

5.1 Conclusion:

60. The implementation status of the environmental mitigation measures during the pre- construction stage of all sub projects was satisfactory. Checking of environmental mitigating infrastructure design in all rural road improvement subprojects and CI components has been done effectively during design and pre-construction stage. In all subprojects, environmental issues have been identified and EMPs have been prepared as a part of feasibility study report; and incorporated in bidding documents and contracts.

61. This report comprise of post monitoring of CI component in most cases and regular monitoring of rural road and micro agree business development component. The major environmental concern are associated with rural road component. The major environment impact are found are , congestion of natural water flow, construction debris on road. land slide treat, erosion of lose soil, loss or disturbance of top soil, , pollution of surface water and dust pollution. Besides these, occupational health and safety issues are also very concern factor. The slope maintain during cutting of hill is not maintained. The contractors are not very aware regarding the environmental issues. Protection of vegetation, direct loss of trees are considered by the contractors carefully.

62. Primarily, about 91 hill spot has been identified for hill slide mitigation measures along the road side in which Rangamati (Kawkhali 18, Kaptai 12, Baghaichori 03) has 33 spots , Bandarban (Sadar 12, Naikhongchari 23, Alikadam 08, Lama 14) has 57 spots and Khagrachori (Guimara 01) has 1 spot. Finally 67 spot has been finalized where mitigation measues is needed. It is found that natural water canal i.g. chara is getting congested by the huge soil dumping in some places of Lama and Alikadam Upazila. It is also found that due to inappropriate remove of diversion road of bridge construction, congestion of natural flow is being critical.

63. It is found some water point close the latrine pit which did not maintain the safe distance of Bangladesh standard i.g. 30 feet. Though it was suggested to test feacal coliform of all water (tube well, Gravity flow system) source but not maintained.

64. The store room constructed for medicinal plan is very good initiative but there is no sanitation facilities in this premises which lead to further environmental and physical problem of entrepreneur. The drainage facilities of market shade is not found appropriate which may lead to create mud in front of shed.

65. Most of the contractors were not provided personal protective equipment - like face masks, hand gloves, helmets, high visibility clothing etc. to their workers; and first aid box with medicines was not available at worksites.

66. Filled loose earth was observed along the side slopes. This loose earth is vulnerable for soil erosion, which leads to deposition of sedimentation over the adjacent agricultural lands. Side slopes road of the road embankments were not compacted. Moreover, at some sections steep batter slopes were observed.

5.2 Recommendation:

67. It is found from direct observation from field that suggestive environmental mitigation measures are not followed or partially followed by the contractors. In some cases, they were not aware regarding the safeguard policy or issues of ADB. On the other hand implanter i.e. LGED’s concerned person like Upazila engineer, sub-assistant engineer are not very comfort regarding the environmental safeguard issues of this project. From my observation I would like to put some recommendation which could assist to ensure the environmental safeguard compliance of ADB for this project.

I. Capacity building the field level staff of LGED and contractors (Not the signatory contractors rather than who are in field) regarding the environmental safeguard issues through training. II. Respective environmental officer should have strong stake to clearing the bill of contractor otherwise it is not possible to make the project complied with the policy and guideline. III. Full time Engagement of a person to look after the implication of suggestive mitigation measures day by day in field. IV. Contractors should ensure to provide personal protective equipment - like face masks, hand gloves, helmets, high visibility clothing etc. to their workers; and first aid box with medicines should be available at worksites. V. Immediate action to implement the hill slide mitigation measures in identified specific sites. VI. Contractor should take special attention that natural water canal never be congested and erosion of lose soil which can make a layer on top soil. VII. It would be best fitted if the environment specialist is engaged since finalization of road alignment and other construction project. VIII. It would be great initiative if inclusion of EMP in BoQ is possible from the very beginning of further project design.

Appendix 3: Site Specific Environmental safeguard Issues of rural Road Component particularly for Land Slide

Issue Observed: It seems to me that the slope mentioned in BoQ is not sufficient to protect the land slides considering the rainfall amount and intensity along with the type of soil. Moreover, due to not maintain the recommended slope the threat of land slide is increased as it is very steep.

Proposed Mitigation Measures: The soil type of this region is very critical. It make difference in very short distance even a couple of meters distance. Soil texture and soil profile also differ from its small depth. It is very difficult to find out uniform soil in long depth and distance. The most of the soil is mixture of silt, fine sand and clay along with loamy. Considering along with the soil condition, intensity of rainfall, physical communication, available materials and cost effectiveness, it is decided that one single solution is not enough to mitigate the hill slide threat. As a result 3 step measures have been suggested which are RCC retaining wall supported by RCC pile, providing geotex over the slope of the hill with appropriate nailing and bio engineering on the slope. The propose measures will not directly protect the hill slide during heavy rainfall rather it will safe the loss of live and keep the road communication live. To reduce the disturbance to hill, pile supported RCC retaining wall is suggested. Geotex will absorb the shocks of direct raindrop and protect the top soil. After settle down of soil it is suggested to plan local varieties of trees for long term protection of hill slide. Most of the location it is suggested for both retaining wall and geotex soil nailing with plantation. The height of retaining wall is depend on the height of hill. The length of the retaining wall is calculated in field considering the most vulnerability along with associated risks. The following table shows the required length of the proposed retaining wall. The maximum height of RCC retaining wall is considered two categories which is 5 meter and 3 meter. This table is also covered with the required area for geotex wrapping with soil nailing.
