The Mughrabi Quarter Digital Archive and the Virtual Illés Relief Initiative
Are you saying there’s an original sin? The Mughrabi True, there is. Deal with it. Quarter Digital – Meron Benvenisti (2013) Archive and the Few spaces are more emblematic of Jerusalem today than the Western Virtual Illés Relief Wall Plaza, yet few people – including Initiative Palestinian and Israeli residents of Jerusalem alike – are aware of the Maryvelma Smith O’Neil destruction of the old Mughrabi Quarter that literally laid the groundwork for its very creation. For the longue durée of almost eight centuries, the Mughrabi Quarter of Jerusalem had been home to Arabs from North Africa, Andalusia, and Palestine. However, within two days after the 1967 War (10–12 June 1967), the historic neighborhood, located in the city’s southeast corner near the western wall of the Noble Sanctuary (al-Haram al-Sharif), was completely wiped off the physical map by the State of Israel – in flagrant violation of Article 53 of the Fourth Geneva Convention, which stipulates: Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.1 Two decades prior to the Mughrabi Quarter demolition, Jerusalem’s designation as a “corpus separatum” had been intended to depoliticize the city through internationalization, under [ 52 ] Mughrabi Quarter & Illés Relief Initiative | Maryvelma Smith O’Neil Figure 1. During traditional wedding celebrations in al-Bireh and neighboring villages, it is still possible to hear this strange incantation celebrating the roaring whistle of the Jerusalem train approaching the southern approaches of Kafr ‘Aqab. كومي اركصي يا نجال بابريك الزيت [Come Najla do the dance of the oil jug [on your head زمر بابور البيرة الله يجيره ,The al-Bireh engine whistles, may God protect it وسمعنا زعيكه من كاع الواد We hear its cry from the bottom of the valley1 There are several variations to this song. Invariably they evoke separation from loved ones taking a train or a steamship – the Arabic word babur can mean locomotive, steamship, or engine – to distant lands. Another song goes: ازمر يا بابور ازمر Blow, engine, blow بعدك بأراضينا ,while still in our lands حاجة تزمر يا بابور ,Hold your whistle, engine تا نودع أهالينا .while we bid our kin farewell ازمر يا بابور ازمر Blow, engine, blow بعدك ع سوا عارة while you are still in ‘Ara حاجة تزمر يا بابور ,Hold your whistle, engine تا نودع أهل الحارة so we can bid our neighbors farewell.2 Is the whistle in al-Bireh wedding song from a train or a ship? Most old-timers have no recollection of a train passing by al-Bireh or its environs. Ships off the coast of Jaffa were too far from al-Bireh for their whistles to be audible. -

chapter 25 Waqf Endowments in the Old City of Jerusalem: Changing Status and Archival Sources Salim Tamari The Old City of Jerusalem is unique in its predominance of endowed, or waqf, properties (public and family-based). At the end of the twentieth century, waqf properties in all categories totaled 1,781 units, or 54 percent of all proper- ties in the Old City.1 In terms of area, these properties amounted to 348 dunams (1 dunam = 0.247 acres), or about 66 percent of the total area of the Old City. One quarter of those were family endowments (waqf dhirrī), equivalent to 567 units or 84 dunams. The revenue of these endowments was assigned to both private and charitable purposes, which will be explained below. The task of finding accurate sources for interpreting the scope and character of these properties has been a major challenge for the historian. Court records and land registry archives have been plagued with problems of accessibility, shift- ing registration procedures, and proper bureaucratic organization of registered properties. An additional problem was the layers of leasing and subleasing of waqf properties, some of which were never registered. Since 1967, another prob- lem has emerged: the abuse of archaic legal categories of endowments by the State of Israel and its propensity to sequester waqf property on behalf of the state and settler groups. In this chapter I will examine how new archival sources can help to shed light on the extent and nature of these family and public endowments. These archival sources include municipal tax registries for Old City properties, aerial photography and on-site architectural surveys. -
