INVITATION TO SUBMIT PROPOSAL Pursuant to this request for proposals (this “RFP”) Brooklyn Bridge Park Corporation (“BBP”) is seeking proposals for the provision of GENERAL CONSTRUCTION (GC) SERVICES for Empire Fulton Ferry (EFF) Marine Rail Replacement as part of the Brooklyn Bridge Park Project. BBP has engaged the services of Gardiner & Theobald Inc. (“G&T”) to administer the RFP process. All inquiries and correspondence during the RFP process are to be addressed to G&T, and on no account shall parties submitting proposals (“Proposers”) contact BBP directly, except for submission of final proposal pursuant to clause 2.2.9. The project and project site are defined in the RFP Summary section below (Part I, Section 2), along with such other information as the anticipated dates for the execution of a contract with the winning Proposer, if one is selected pursuant to this RFP, and the anticipated contract term. The scope of services to be performed is outlined in the General Requirements section (Part II, Section 1). All undefined capitalized terms set forth in this RFP shall have the same definitions as set forth in Appendix A to Part III of the draft contract (the “Contract Draft”) annexed to this RFP as Exhibit 1. Subject to the availability of funds and the responses to this RFP, BBP will select a winning Proposer, hereafter referred to as “General Contractor” or “GC”, to provide the Services. The GC shall be experienced in all aspects of the Services. The GC will commence the Services upon a written Notice to Proceed from BBP or upon execution of the Contract by the GC and BBP substantially in the form of the Contract Draft. The Contract Draft is an initial draft subject to further review and revision by BBP prior to execution. BBP shall not be bound to the terms of any aspect of the Contract Draft, and the final acceptance of any successful proposal shall be subject to, and contingent upon, the negotiation between the parties of a Contract in form and substance acceptable to BBP. Nevertheless, you should review the Contract Draft included as Exhibit 1 herein and be familiar with all of the terms and conditions set forth therein prior to submitting your proposal. 2. RFP SUMMARY 2.1 In General. This summary of terms, deadlines and requirements specific to this RFP is set forth for your immediate reference and convenience only. It does not set forth all of the requirements of this RFP, but should be read in conjunction with the General Requirements (Part II) and the Specific Requirements (Part III) of this RFP. You should review and become familiar with all parts of this RFP prior to submitting your proposal. 2 BROOKLYN BRIDGE PARK REQUEST FOR PROPOSALS FOR THE PROVISION OF GENERAL CONSTRUCTION SERVICES FOR EMPIRE FULTON FERRY MARINE RAIL REPLACEMENT 2.2 Specific Terms, Deadlines and Requirements. 2.2.1 Project Information: 2.2.1.1 The Project: Empire Fulton Ferry (EFF) Marine Rail Replacement. 2.2.1.2 The Project Site: Empire Fulton Ferry (EFF) Park, Brooklyn Bridge Park, Brooklyn, NY 2.2.1.3 Type of Services: General Construction as more specifically described in Part II General Requirements and detailed within the Contract Draft attached as Exhibit 1. 2.2.2 Project Team: 2.2.2.1 The project team retained to date is: Owner’s Representative: Gardiner & Theobald, Inc. (G&T) Lead Consultant: Michael Van Valkenburgh Associates, Inc. New Yorkers and visitors can take advantage of this new service starting summer 2017. In the last 30 years ferries have made a comeback in our waterways and become a fixture on the East River. It’s easy for New Yorkers to see them as novel but ferryboats provided the earliest connections to and from Manhattan. In 1814, Robert Fulton introduced steam-powered vessels in New York Harbor, enabling expansion and settlement across the East River. Then, as now, the city sought a way to link emerging neighborhoods to vital job centers. The answer was a robust Brooklyn and Queens ferry system, supplied by private operators. The last 150 years have seen several attempts to preserve, supplant, and revive this network of citywide ferry routes. Citywide Ferry by Hornblower is a culmination of these efforts and development processes that have shaped the New York waterfront. In the early 1800s, influential Brooklyn businessmen vied for profitable routes to Lower Manhattan. As ridership grew, these small operators sold their rights to the Brooklyn Union Ferry Company. In the 1850s, the Union Ferry Company controlled 7 routes from Fulton Ferry to Hamilton Avenue, with 40,000,000 annual passengers, and Brooklyn was home to the largest ferry company in the world.
