EXHIBIT 3 FACTUAL BASIS FOR SEPARATE UNCHARGED CRIMES OF FORCE AND VIOLENCE ADMITTED BY DEFENDANT

INCIDENT 27: The 12/10/75 attempted murder of Officer William McGowen in Visalia, Tulare County

The Visalia Ransacker committed over 100 burglaries between April of 1974 and

December of 1975 in the City of Visalia. Following the murder of Claude Snelling, efforts to apprehend the ransacker increased and included a plan to trap him during a prowling incident based at locations where he might be expected to return. On the evening of December 10, 1975, in an area that had recent ransacker activity, the Visalia Police Department set up a perimeter and set out to wait and see if the ransacker would return. Detective William McGowen held a position in the garage of a residence where he believed the ransacker might make an appearance based on prowling incidents that had occurred at that residence in the recent past.

While positioned in the garage, Detective McGowen observed a subject walk down the side of the garage towards the rear of the residence. Detective McGowen described the subject as a white male adult, five-ten, with light-blond hair and a round babyface. Based on his observations, McGowen later assisted in the creation of a composite sketch that clearly resembled Joseph DeAngelo.

Detective McGowen approached DeAngelo from behind with a flashlight. When

DeAngelo turned, Detective McGowen observed that he was wearing a black ski cap that was rolled up. Detective McGowen had his firearm out and announced himself as a police officer, stating, "Police, what are you doing here?" DeAngelo began screaming, "Oh, my God. Don't

1 hurt me. Oh, my God. Don't hurt me." DeAngelo removed the ski cap and started running through the back yard of the residence towards the fence. Detective McGowen shot into the ground as a warning, but DeAngelo continued to run. Eventually DeAngelo stopped on the other side of a slate fence, and Detective McGowen illuminated his face. DeAngelo stated, "I give up.

See, see. I've got my hands up."

Detective McGowen observed DeAngelo's right hand and demanded DeAngelo raise his left hand that was out of view. Detective McGowen began to climb the fence to detain

DeAngelo. DeAngelo pulled a revolver from his left jacket pocket and shot at McGowen, hitting his flashlight. DeAngelo then ran off into the dark. Detective McGowen received several cuts to his face that required medical attention. (6/29/20 Reporter’s Transcript [hereinafter R.T.], pp. 34-

INCIDENT 28: The 6/18/76 rape and false imprisonment of Jane Doe #14 in Rancho Cordova, Sacramento County

On June 18th, 1976, Jane Doe Number 14 was sleeping in her bedroom at her Paseo

Drive residence in the City of Rancho Cordova, County of Sacramento. She lived with her father, who was retired from the military and on vacation out of state. At approximately 4:00 a.m. she awoke to a male figure standing in the doorway of her bedroom. The male was wearing a ski mask, a T-shirt and gloves, but was nude from the waist down and had an erection. The male was Joseph DeAngelo.

DeAngelo was armed with a knife. He jumped on the bed next to her and held the knife to her right temple. While speaking through clenched teeth, DeAngelo said, "If you move or make one sound, I'll stick this knife in you." DeAngelo told Jane Doe Number 14 he was going to rape her and ordered her to take off her nightgown. He looked around the room and in the

2 closet before returning to the bed, demanding that she roll onto her stomach. DeAngelo bound her hands tightly behind her back with a small rope. He again looked around the room and found a belt, which he also tied around her hands. He again ordered her to roll over and then vaginally raped her, while she lay on the bed and with her hands bound behind her back.

When he was done he wiped his penis clean with the bed sheet and asked her if she had any money. Each time DeAngelo spoke he used a low, guttural whisper through clenched teeth.

She told him there was some change in her bedroom and money in her purse. Before leaving the room DeAngelo tied her feet together with a bra and an electrical cord from her hair dryer and gagged her, while placing a slip in her mouth. Once DeAngelo left her room she could hear him rummaging through the house. Eventually everything became quiet. She was able to free herself from her bindings, walk to her father's bedroom and knock the phone onto the floor to get assistance from the operator. DeAngelo fled with $15 and two packs of cigarettes. (R.T., pp.

142-144.)

INCIDENTS 29 & 30: The 7/17/76 false imprisonment of Jane Doe #15 and rape and false imprisonment of Jane Doe #16 in Carmichael, Sacramento County During the early hours of July 17th, 1976, two teenage sisters, Jane Doe Number 15 and

Jane Doe Number 16, were home alone at their residence on Marlborough Way in the City of

Carmichael, in the County of Sacramento. Their parents were out of town for several days. The sisters were asleep in separate bedrooms when Jane Doe Number 15 was awakened by a male straddling her back. The male was Joseph DeAngelo. He told her, "If you make a move I'm going to stab this right through your neck." She then felt a poke to the back of her neck several times with what she believed was a knife. DeAngelo then struck her several times in the head before grabbing her arms and pulling them behind her back, binding her hands and legs with

3 string and gagging her with a pair of stockings. She was able to see the suspect had a knit mask covering his entire head. Before leaving the room DeAngelo said, "Don't you move or I'll kill you. I'm going to steal some stuff, and I'll be done in half an hour."

DeAngelo then went into the bedroom of Jane Doe Number 16. Once in the room,

DeAngelo placed his hand over her mouth. She screamed, and he said, "Shut up. I have a knife, and if you don't shut up, I'll kill you." He attempted to restrain her, but she ran out of the room.

He caught up to her and hit her in the back of the head, and she fell. Jane Doe Number 16 pretended to be unconscious while DeAngelo bound her hands behind her back, bound her legs, gagged her with a sock and dragged her back to her bedroom.

He then left her in the room and can be heard rummaging throughout the house, but eventually returned to Jane Doe Number 16, unbound her legs, straddled her back and forced her to use her hands to masturbate him. He placed some type of lotion on his penis prior to that time.

DeAngelo then came close to her ear and asked, "Have you ever fucked before?" She shook her head, no. DeAngelo then repeatedly vaginally raped her. In between the rapes he would rummage through the house and then return only to rape her again. When he was finished,

DeAngelo asked her where the money was in the house. Eventually the house was quiet, and she was able to loosen her bindings and call for assistance. DeAngelo took money and an opal ring from the residence. (R.T., pp. 145-146.)

INCIDENTS 31--33: The 8/29/76 residential burglary and attempted rapes of Jane Does #17, 18 and 19 in Rancho Cordova, Sacramento County

Jane Doe Number 17 lived with her husband and their two daughters, Jane Doe 18 and

19, at their residence on Malaga Way in the City of Rancho Cordova, in the County of

Sacramento. Her husband worked the night shift and was away from home most nights.

On August 29th, 1976, three o'clock in the morning, Jane Doe Number 17 and her two daughters were asleep when Jane Doe Number 18 was awoken by the sound of chimes that were hung near her bedroom window. It was a warm evening, and many of their windows had been left open.

When Jane Doe Number 18 looked toward the window, she saw a silhouette of a male trying to pry her window screen off. When she sat up, the male ducked down.

Jane Doe Number 18 ran to her mother's room and told her someone is trying to break into the house. The two of them went to her sister's room to wake her, but were unable to do so.

They looked in the back yard and then quickly went to the kitchen to use the phone. As the mother was dialing the phone, they could hear the curtain rod crash to the floor. Shortly thereafter they saw a male standing directly in front of them. The man was Joseph DeAngelo.

The first words he uttered were, "Freeze or I'll kill you all," and told her to hang up the phone.

He was holding a gun in one hand and a club in the other hand and was naked from the waist down.

As DeAngelo drew closer to them, Jane Doe Number 17 grabbed him by the wrist to turn the gun away from her family. His response was to strike her in the head several times with the club he was holding. After beating her into submission, he told them all he wanted was their money. When he asked if there was anyone else in the house, Jane Doe Number 18 said that her sister was asleep in her own bedroom. He then tried to tie the mom, Jane Doe Number 17's, hands behind her back, but she struggled with him. DeAngelo struck her several more times in the head with the club. She was able to break free and ran out the front door to a neighbor's house. DeAngelo, in turn, fled the residence. Jane Doe Number 17's head injuries required multiple stitches. Their residence was located just around the corner from Jane Doe Number 14, who was actually assaulted two months prior. (R.T., pp. 147-149.)

INCIDENTS 34 & 35: The 10/5/76 rape and false imprisonment of Jane Doe #20 and false imprisonment of John Doe #13 in Citrus Heights, Sacramento County

On the morning of October 5th, 1976, Jane Doe Number 20's husband left for work. Her three-year-old son, John Doe Number 13, came into her room and got into bed with her. Her husband had been gone only ten minutes when she heard a light switch off and footsteps in the hallway of her home located on Woodpark Way in the City of Citrus Heights, in the County of

Sacramento. When she looked up toward the bedroom door, she saw a masked male standing in the doorway. The masked male was Joseph DeAngelo.

DeAngelo told her, "Shut up. I want your money, and I won't ." Jane Doe

Number 20 hugged her son tightly and said, "Please don't hurt us. Take my money. Just leave us alone." DeAngelo told her he had a knife. When she continued to beg DeAngelo to take all their money and go, he responded by again telling her to shut up or he would use the knife on her.

DeAngelo tied her hands behind her back with shoestrings, bound her ankles and blindfolded her with a towel. He confirmed the fact that he did have a knife by sticking it on different parts of her body, including her neck. After tying her up, he began rummaging through the drawers and other rooms of the house.

When the suspect returned to the bedroom, Jane Doe Number 20 could hear fabric being ripped. DeAngelo used that torn fabric to bind the hands and feet of the little boy. He then moved Jane Doe Number 20's son off the bed, away from her. When she continued to beg for their safety, DeAngelo stuffed a washcloth in her mouth. He approached the side of the bed and told her, "Play with my penis," with her hands. DeAngelo untied her legs and used his fingers to digitally penetrate her vagina. He then vaginally raped her. During the rape, DeAngelo asked

6 her if it felt like the captain's and that she looked good at the club. Jane Doe Number 20's husband was a captain in the military and was assigned to a nearby base.

After the sexual assault she could hear DeAngelo walking around the house. When she could no longer hear him in the house, she was able to remove the blindfold and hop, still bound, to a neighbor's house for help. When asked to describe her assailant to law enforcement, Jane

Doe Number 20 reported that he had a small penis, a fact that was consistently reported by the majority of the sexual assault victims. (R.T., pp. 150-151.)

INCIDENT 36: The 10/9/76 rape and false imprisonment of Jane Doe #21 in Rancho Cordova, Sacramento County

On October 9th, 1976, Jane Doe Number 21 was asleep in her bedroom on El Segundo

Drive in Rancho Cordova, in the County of Sacramento, when she was awakened by a masked male. He put his hand over her mouth and poked her in the back with a sharp object. The man called her by name, told her not to scream or he would cut her. The man was Joseph DeAngelo.

DeAngelo had Jane Doe Number 21 turn over, tied her hands behind her back, gagged her and blindfolded her. He led her back to the patio outside, where he had her lie down on a rug. DeAngelo then tied the clothesline from Jane Doe Number 21's brother's bedroom door to a bathroom faucet in order to prevent him from opening his door. DeAngelo questioned her about where he could find the money. He went back inside, and she could hear him walking around the house and then in the back yard.

When he approached her it sounded as if he were masturbating. He told her, "Don't you dare scream," and he again poked her with the knife. DeAngelo then said, "You better let me do this," before straddling her back, putting his penis into her hands and forcing her to masturbate

7 him. DeAngelo then vaginally raped her several times, forcing her to change positions multiple times at his direction.

After the sexual assaults he dragged her close to one of the patio posts and tied her feet to the post. He removed two rings from her fingers and told her not to scream, as he lived close by.

Once she determined he was gone, she loosened her blindfold and hopped into the house. She was unable to call law enforcement. The phone lines had been cut. Jane Doe 21's residence had been burglarized in September of 1973, with the burglar taking a single earring and some other jewelry. (R.T., pp. 152-154.)

INCIDENT 37: The 10/18/76 rape and false imprisonment of Jane Doe #22 in Carmichael, Sacramento County

On October 18th, 1976, Jane Doe was in her house on Kipling Drive in the City of

Carmichael, County of Sacramento, with her two children. In preparation for a move to the Bay

Area, the house had recently been listed for sale, and the sign was still out front. Jane Doe

Number 22's husband had already started a new job in the Bay Area. In the early-morning hours she was awakened by her son, who told her someone was trying to get into the house through a kitchen window. She picked up the phone and tried to dial the operator, but the phone just rang.

She could hear someone running down the hallway toward the bedroom. The door opened, and a masked male with no pants grabbed the phone from her, jumped on the bed, put a knife to her throat. He told her to do exactly what he wanted or he would kill her.

After asking who else was in the residence, DeAngelo bound Jane Doe 22's hands and her son's hands behind their backs. He then blindfolded them with torn pieces of towel and bound their ankles. DeAngelo tied her son to the headboard and before leaving the room with

8 his mother said, "Don't make a noise. Every time you move a muscle it will take seconds off of your mother's life."

DeAngelo demanded money, and Jane Doe 22 told him there was money in her purse and an envelope with $250, which was a donation for the Cancer Fund. He took all of it. Jane Doe

22 was forced to the ground on her back. DeAngelo covered her face with a towel, stuffed a rag in her mouth and untied her feet, removed her underwear and vaginally raped her. He then rolled her over and forced her to masturbate him while her hands were tied behind her back. DeAngelo then forced her to orally copulate him and raped and sodomized her several more times. In between the rapes he would wander around the house, eat food, open drawers, only to return and rape her again.

She heard DeAngelo go into the garage. After several minutes she was able to untie her bindings and go to a neighbor's house for help. Before leaving, DeAngelo took four rings off of

Jane Doe Number 22’s fingers, including her wedding ring and band. (R.T., pp. 155-156.)

INCIDENT 38: The 11/10/76 kidnapping, rape and false imprisonment of Jane Doe #23 in Citrus Heights, Sacramento County

On November 10th, 1976, Jane Doe 23, who was a teenager at the time, was home alone watching television. Her parents had gone out for the evening. She was in the family room in their home on Greenleaf Drive in the City of Citrus Heights, County of Sacramento. At 7:30 p.m. she heard a loud noise, and her dog, who was sitting on her lap, began to shake and bark.

Moments later, a man entered the family room and grabbed her, told her to shut up or he would kill her. Her dog began to bark and the man kicked it viciously. The intruder was Joseph

DeAngelo.

He was wearing a leather-like welder's hood and told her he only wanted money, but then proceeded to tie her hands behind her back with black shoestrings. DeAngelo then forced her outside into the back yard. Once outside he bound her ankles with shoelaces and demanded money. She told him she didn't have any. The victim saw DeAngelo had a bike with him and there were numerous shoelaces that were draped over the handlebars of the bike.

DeAngelo returned to the house, turned off the television, put the screen back on the window and locked the rear door to the home. He then untied the bindings on her ankles and forced her to a nearby drainage ditch which ran along the back of the property. After walking a quarter of a mile in the ditch, DeAngelo forced her down on the bank and re-tied her ankles. He started ripping and cutting her jeans and removed them. He started moving his hands up and down her thighs and asking her questions about where she went to school.

Jane Doe 23 initially reported that she was forced to walk further away from her home, told to sit down and not move for 20 minutes. She said that DeAngelo had then walked off, leaving her just sitting on the edge of the drainage bank. She was able to untie her wrists and ankles and walked back towards the home. When she reached the neighbor's house, she called for help.

After Joseph DeAngelo was arrested, Sacramento County Sheriffs Detective Sergeant

Michelle Hendricks was asked to re-interview Jane Doe Number 23 to confirm her original statements to law enforcement from 1976. During the 2018 interview, Jane Doe 23 admitted that she had been vaginally raped on the bank of the drainage ditch by DeAngelo. At the time of the event she was young and too embarrassed and ashamed to talk about it. (R.T., pp. 157-159.)

INCIDENT 39: The 12/18/76 rape and false imprisonment of Jane Doe #24 in Fair Oaks, Sacramento County

On the evening of December 18th, 1976, Jane Doe Number 4 was home alone with a cold. Her parents had gone to a Christmas party and her sister was at a friend's house. The teenager decided to practice piano in their Ladera Way home in Fair Oaks, in the County of

Sacramento. As she played the piano she heard some strange noises, but didn't think anything of it. Moments later, she looked to her side and saw a man, who immediately held a knife to her throat and told her, "Make a move and I'll kill you." It was Joseph DeAngelo that held the knife to her throat.

DeAngelo asked when her parents would be returning so he would know how much time he had. She said she didn't know. DeAngelo told her to get up and said, "Get moving. If you say anything or flinch, I'll push the knife all the way in, and I will be gone in the dark of night."

DeAngelo then tied her hands behind her back with shoelaces that he had in his pocket and forced her outside into the back yard. Once in the back yard, DeAngelo forced her to take a seat on a picnic bench. He bound her legs, gagged and blindfolded her.

He walked back in and out of the house several times, and she could hear him opening cabinets and drawers. DeAngelo then asked her if she had ever fucked a man, and she replied no. DeAngelo took her hand and placed it on his penis. He forced her to masturbate him until he ejaculated. DeAngelo stood up, untied her leg bindings, pulled her jeans and underwear off. He cut her bra off with his knife and ripped her shirt off. He pushed her back on the picnic bench, binding her legs again. DeAngelo went back inside the house and returned several minutes later and forced her back inside the home to her parents' bedroom. He threw her onto the bed and

11 vaginally raped her. Afterwards he forced her outside again and then brought her into the family room, where he raped her another time.

DeAngelo went into the dining room and can be heard rummaging through a buffet cabinet. He returned to the family room, dragged her closer to the fireplace and raped her yet another time. Before climbing off of her DeAngelo said, "I've seen you at school before, and you sure look good." After ten minutes of silence, Jane Doe Number 24 was able to get to the phone and call a neighbor for help. Later her parents determined a lotion bottle, two gold rings, a necklace, a BB gun and a photo were missing from their home. (R.T., pp. 160-162.)

INCIDENT 40: The 1/18/77 rape and false imprisonment of Jane Doe #25 in Sacramento, Sacramento County

On January 18th, 1977, Jane Doe Number 25's husband was out of town on business. At the time, they lived on Glenville Circle, in the City and County of Sacramento. Jane Doe

Number 25 was five months pregnant at this time. As she was falling asleep that evening, she sensed someone was in the room. She opened her eyes and saw a man, Joseph DeAngelo, standing in her bedroom pointing a flashlight in her face.

When Jane Doe Number 25 asked who it was, DeAngelo told her, "Be quiet, and I won't hurt you." He told her to roll over, and she tried to explain to him, because she was pregnant, she couldn't roll onto her stomach. He then pushed her onto her stomach and tied her wrists and ankles. When she was on her stomach he put his knife to the right side of her neck and said, "All

I want is your money, just your money, and then I'll leave. If you don't tell me where it is, I'll slash you or just cut you up." She told him where he could find the money and he began rummaging through the house.

When DeAngelo returned to the bedroom, he blindfolded her. She could hear a popping noise and asked DeAngelo what the noise was. He told her to guess. She then realized he was masturbating. DeAngelo straddled her back and tried to place his penis in her hands, but was not able to do so due to her positioning. He rolled her over, untied her legs, told her to put her legs around his neck as if he were her husband. DeAngelo then vaginally raped her and ejaculated inside her.

DeAngelo left the room, continued to rummage through the home, broke a piggy bank and took loose change. He then returned to the bedroom, pulled her to the edge of the bed and forced her to orally copulate him. He pushed her back on the bed and raped her a second time.

When he was ready to leave he asked her for her car keys. She eventually heard the car start and leave. DeAngelo took coins, cash, a photograph of the victim and several pieces of jewelry from the home. (R.T., pp. 162-164.)

INCIDENT 41: The 1/24/77 rape and false imprisonment of Jane Doe #26 in Citrus Heights, Sacramento County

Jane Doe Number 26 lived alone in a single-story house on Primrose Avenue in the City of Citrus Heights, County of Sacramento. On the evening of January the 23rd, 1977, the victim entertained some friends for dinner. Soon after midnight everyone left the residence, leaving her home alone. After falling asleep she was awakened at about 1:30 a.m. on January the 24th, 1977, by Joseph DeAngelo, who grabbed her by the arms. As she struggled to free herself, Jane Doe

Number 26 felt something cold and sharp against her throat. The defendant told her, "Roll over on your stomach. Put your hands behind your back. All I want is your money." He threatened her with an eight-inch ice pick. She described her attacker as reeking from the smell of stale sweat.

DeAngelo tied her hands behind her back with a clear cord and then wrapped a scarf around her eyes. After asking where her purse was located, he left the room and ransacked the house. When DeAngelo returned a few minutes later, the victim heard a popping sound, which she believed to be the defendant masturbating. He asked her, "Do you know what I'm doing?"

When she told DeAngelo that he was playing with his penis, he demanded that she call it, quote, unquote, "a dick" instead, forcing her to use that word. He forced her to play with it while her hands were tied behind her back. The victim knew she was about to be raped.

Joseph DeAngelo then rolled the victim over onto her stomach and inserted his penis into her vagina. He asked her, "How long has it been since you've been fucked?" DeAngelo forced the victim into multiple positions as he raped her over and over again. He was unable to achieve an orgasm. He then left her and walked to the kitchen, where he made food and drank beer.

Over the next two hours he repeatedly returned to rape the victim in different positions. The last time he left the room the victim waited 15 minutes before crawling to the telephone to call police for help. (R.T., pp. 165-166.)

INCIDENTS 42 & 43: The 2/7/77 rape and false imprisonment of Jane Doe #27 and false imprisonment of Jane Doe #28 in Carmichael, Sacramento County

Jane Doe Number 27 lived with her husband and six-year-old daughter, Jane Doe

Number 28, in a single-story home on Heathcliff Drive in the City of Carmichael, County of

Sacramento. When her husband left for work at approximately 6:30 a.m. on February the 7th,

1977, Jane Doe Number 27 walked through the house to make sure all the doors were locked.

About ten minutes later she felt someone else's presence in the house. She turned around, and

Joseph DeAngelo was standing there with a gun pointed right at her. He was wearing a ski mask and said, "Don't scream or I'll shoot you. I just want your money." DeAngelo forced her to sit at

14 the kitchen table as he tied her hands behind her back with shoelaces that he brought with him.

The defendant used granny knots, the same type of knots left at the scene of the Maggiore murders. When DeAngelo led her into the bedroom, she knew she was about to be raped.

He forced her to lay face down on the bed while he tied her ankles, placing a pillow over her head. DeAngelo sat on top of her with his hand cupped over her mouth. He told her to shut up. She felt the gun and reached for it. As the two began struggling over the weapon,

DeAngelo began to hit the victim several times and told her to stop fighting or he would hurt her daughter, saying, "I'll go and cut her ear off and bring it back to you." Pressing his face against hers he said, "If you make one move, I'll kill you." He ran the cold sharp blade of his knife across her cheek, telling her to shut up or he would slice her face open. DeAngelo mostly talked through clenched teeth in a harsh whisper. He gagged and blindfolded her.

After removing the victim's pants, DeAngelo pressed the knife against her stomach and orally copulated her as he ran the blade across her abdomen and legs. He then vaginally raped her, but suddenly stopped after a few minutes. The victim was blindfolded, but she could sense that her six-year-old daughter was now in the room. DeAngelo forced the little girl into the bathroom, where he tied her up because she was crying. When the little girl continued to sob,

DeAngelo placed her onto the bed next to her mother.

DeAngelo left the room and could be heard ransacking through the house. After a few minutes, the victim worked the gag out of her mouth and asked her daughter if she was okay.

The little girl warned her mother to be quiet, because right at that moment DeAngelo pushed his weight down on the bed to let them know that he was there. They could hear his heavy breathing. When the little girl cried, the defendant held a knife to her throat and said, "Be quiet or else I'll cut you up."

After the last time DeAngelo left the room and some time had passed, the little girl said,

"Mommy, do you think he's gone?" Even though she'd lost all sensation in her hands, the victim was able to loosen the bindings. Together they rolled off the bed, opened the sliding glass door and began yelling for help. A neighbor came running. (R.T., pp. 167-169.)

INCIDENT 44: The 3/8/77 rape and false imprisonment of Jane Doe # 29 in Sacramento, Sacramento County

Jane Doe Number 29 lived alone on Thornwood Drive in the City and County of

Sacramento. The residence is a single-story house. On the evening of March 7th, 1977, the victim returned home from a friend's residence around 9:00 p.m. Before going to bed, she checked all the doors and windows and made sure they were locked. Around 4:00 a.m. on

March the 8th, 1977, the victim was awakened by a noise of someone running on carpet.

Moments later, Joseph DeAngelo rushed into her bedroom and immediately put a knife to her throat. Through clenched teeth he said, "You feel this butcher knife? If you scream or say anything or move, I'll kill you."

After he bound her wrists and ankles with shoelaces, DeAngelo blindfolded and gagged her. He ransacked through the house for some time before returning to the victim. When she heard him remove his pants, she knew what was going to happen next. DeAngelo straddled her back, placed his penis in her bound hands and told her to play with it. As he forced her to masturbate him, Jane Doe Number 29 said that his penis felt slimy. DeAngelo violently flipped the victim over onto her back and ripped off her nightgown. He untied her feet and said, "You had better fuck me good, or I will kill you." DeAngelo placed a pillow over her face, even though a blindfold already covered her eyes. He scraped and clawed at her breasts with his hands before vaginally raping her and forcing her to change positions multiple times.

When DeAngelo was done sexually assaulting the victim, he draped a blanket over her body and said, "If you don't do anything, I won't hurt you. I'll be gone." Before leaving he took a photo of the victim wearing a bikini and stole a ring, which was a family heirloom. After

DeAngelo left, the victim's hands were still bound by shoelaces and she made her way to the door.

On April the 6th, 2001, Jane Doe Number 29 received a phone call at her residence.

DeAngelo said, "Don't you remember? Don't you want to party again?" When she asked who the caller was, he hung up. (R.T., pp. 170-172.)

INCIDENT 45: The 3/18/77 rape and false imprisonment of Jane Doe #30 in Rancho Cordova, Sacramento County

Jane Doe Number 30 was 16 years old and lived on Benny Way in the City of Rancho

Cordova, County of Sacramento. This location was approximately a mile away from where

Brian and Katie Maggiore would be murdered less than a year later. On the afternoon of March the 18th, 1977, the Sacramento Sheriff's Department received several phone calls from an unknown caller who stated, "I'm the East Area Rapist. I have my next victim already stalked, and you can't catch me." Later that evening around 10:40 p.m., Jane Doe Number 30 came home from her shift at a local fast food restaurant. Her family was away for the evening. The porch light was supposed to be on, but it wasn't.

She sat down for dinner and called a friend who was supposed to spend the night. As soon as she dialed the last number on the phone, she heard a noise in the hallway. It was Joseph

DeAngelo, wearing a mask and carrying a hatchet. He ran straight to her. "Don't scream or I'll kill you," he threatened. Using shoelaces he brought with him, DeAngelo tied the victim's wrists and ankles with granny knots. Blindfolded with strips of cloth and gagged, she laid on the floor.

DeAngelo walked around the house and each time he walked by her he clicked scissors in her ears. During this time the phone kept ringing, which made him nervous, and so he moved her to the living room. He asked her, "Have you ever fucked before?" When she said no, Joseph

DeAngelo orally copulated the victim, then vaginally raped her as she cried out in pain. The victim's name tag on her uniform was clearly visible. While sexually assaulting her, DeAngelo often referred to her first name. He continued to sexually assault the victim and forced her to masturbate him.

She heard DeAngelo repeatedly walking around the back yard. The neighbor owned a large German Shepherd that stayed in their back yard. After DeAngelo's arrest in 2018, a former friend named Gary S. told law enforcement that DeAngelo was attacked by a German Shepherd one day when they, as teenagers, burglarized a house in Gold River. Angry at the dog,

DeAngelo set it on fire with an M-80 firecracker.

At one point during the night, the victim heard knocking at the front door and her friend yelling. Eventually, the friend and her father entered the house and freed the victim from the bindings, but DeAngelo got away. Detectives from the sheriff's department found two partially- consumed bottles of Diet Dr. Pepper on the side yard near the gate. The victim did not leave the soda there. When Joseph DeAngelo was arrested in 2018, detectives found numerous bottles of

Diet Dr. Pepper in his home. It was his drink of choice. (R.T., pp. 173-175.)

INCIDENTS 46 & 47: The 5/5/77 rape and false imprisonment of Jane Doe #31 and false imprisonment of John Doe #14 in Orangevale, Sacramento County

Jane Doe Number 31 visited her friend, John Doe Number 14, who lived on Winterbrook

Drive in the City of Orangevale, County of Sacramento. On the evening of May the 4th, 1977, friends had dinner together at the residence. Earlier in the evening, the victim felt as if someone

18 was watching when she took her dogs outside. Even the dogs acted strange. She thought nothing of it. At approximately 12:15 a.m. on May the 5th, 1977, John Doe Number 14 walked

Jane Doe Number 31 outside to her car. As they reached the driveway, Joseph DeAngelo approached them. Wearing a mask and pointing a gun at them, he said, "Get in the house."

Once inside, he forced them face down on the floor next to each other. DeAngelo threw shoestrings to Jane Doe Number 14 and forced her to tie her friend's wrists behind his back and his ankles together. After tying her up as well, DeAngelo stacked a cup and a saucer on each of their backs. He threatened the male, "If you move or make a sound with that dish, I'm going to blow your brains out. I'll kill her and let you hear it."

DeAngelo ransacked the house and repeatedly stated that all he wanted was money, but he wanted more. DeAngelo led the victim down the hallway to the master bedroom, where he forced her onto the floor. He unbuttoned her blouse, cut off her bra with a knife and began to sexually assault her, raping her and orally copulating her several times over the next several hours. He repeatedly went back to her and threatened her and raped her. She described

DeAngelo that evening as wearing a Navy-style jacket. Witnesses who saw DeAngelo flee from the scene of Brian and Katie's murder describe him as also wearing a brown Navy-style jacket.

INCIDENTS 48 & 49: The 10/29/77 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #32 and robbery and false imprisonment of John Doe #15 in Sacramento, Sacramento County

Jane Doe Number 32 lived with her husband, John Doe 15, on Woodson Avenue, in the

City and County of Sacramento. They recently moved into their new home, which was the only residence occupied on the street, since the others were still under construction. Just before 2:00

19 a.m. on October the 29th, 1977, the husband was awakened by someone tapping his foot with a hard object. Joseph DeAngelo stood at the foot of their bed. He threatened the husband, "Don't move or I'll blow your fucking brains out, fat boy," he told him.

DeAngelo ordered the victim to tie the husband's wrists behind his back with shoelaces he threw to her. DeAngelo noticed that the victim only tied one wrist and yelled, "Bitch, I'll blow your brains out if you try something like that again." Using granny knots, DeAngelo tied up the victim and ransacked the house.

He soon returned to Jane Doe Number 32 and forced her into the living room, and by doing so he unlawfully kidnapped her and carried her away with the intent to commit robbery, within the meaning of Penal Code Section 209. In doing so, he substantially increased the risk of harm to her above and beyond the crime of robbery itself.

After placing some dishes on the husband's back, DeAngelo stated, "If I hear the dishes rattle, I'll cut off her ear and bring it back to you." DeAngelo returned to the victim and straddled her back as he placed his penis in her bound hands, forcing her to masturbate him.

DeAngelo forced the victim to orally copulate him and then vaginally raped her. Over the next several hours, Joseph DeAngelo continued to sexually assault the victim, alternating between vaginal rape and forced sodomy, as the victim cried out in pain.

During this time, the victim felt a gun belt and a holster on the defendant's waist. Each time the defendant returned to the husband, who remained bound on his bed with dishes on his back, and each time the defendant shoved the gun in the husband's cheek and pushed the knife against his throat. At one point in between repeatedly sexually assaulting the victim, DeAngelo told her, "I'm going to go watch TV. Keep your mouth shut." Before leaving, Joseph DeAngelo

20 took the victim's wedding ring. The victims eventually freed themselves and were able to call the police. (R.T., pp. 178-179.)

INCIDENTS 50 & 51: The 11/10/77 rape, robbery and false imprisonment of Jane Doe #33 and the robbery and false imprisonment of Jane Doe #34 in Sacramento, Sacramento County

Jane Doe Number 33 was just 13 years old and in the 7th grade. She lived with her mother, Jane Doe Number 34, in a two-story condominium that backed up to the levee of the

American River on La Riviera Drive, in the City and County of Sacramento. If the curtains were open, you could see into the residence from the top of the levee.

At approximately 2:30 a.m. on November the 10th, 1977, the mother was awakened by a noise of the sliding glass door and saw a bright light in her face. It was Joseph DeAngelo, who then tied the victim's mother with her hands behind her back. When the mother complained that the bindings were too tight, he said, "You want me to cut off your fingers? Who else is in the house?" The mother stated that her young daughter slept in another room.

Before leaving the mother, DeAngelo placed two plates on her back. DeAngelo then walked into the 13-year-old's room and woke her up. DeAngelo put a knife to her ear and slid it down behind it and said, "You want me to cut off your ear?" The young girl said she didn't care.

A clearly-frustrated DeAngelo told her, "Do what I say or I'm going to stab you with a knife and slit your throat and watch you bleed to death."

Before leaving the girl's bedroom, DeAngelo bound her hands with shoelaces tied in granny knots and gagged her; however, she was able to loosen her bindings. DeAngelo became angry when he returned and noticed that she had freed her hands from the bindings. Eventually,

Joseph DeAngelo got onto the victim's bed, straddled her and placed his penis in her hands. He

21 ordered the young girl to masturbate him, but she refused to do so. She could smell the strong odor of the lotion on him. DeAngelo asked this 13-year-old victim, "Have you ever fucked before?" When she said that she did not know what that word meant, DeAngelo removed this child's underwear and told her to, "Bend your legs more or I'll kill you."

In the victim's own words, he was poking around with his penis and could not get his penis into her vagina, but then he forced it into her anus for a few moments. The defendant then re-tied her ankles before heading to the mother's room. He went to the mother's room and told her that he was going to go cook something, but he left the residence, taking cash and a gold necklace. (R.T., pp. 181-182.)

INCIDENT 52: The 12/2/77 residential burglary and attempted rape of Jane Doe #34 in Sacramento, Sacramento County

Jane Doe Number 34 lived in a single-story house with her husband and children on

Revelstok Drive, in the City and County of Sacramento. The victim went to bed around 11:30 p.m. on the evening of December the 2nd, 1977. The victim's young child slept in bed next to her because her husband was not home. Shortly after falling asleep the victim was immediately awakened by someone poking her and shining a flashlight in her face. It was Joseph DeAngelo standing there. The defendant told her, "Get up. Come with me or I'll hurt your little boy."

DeAngelo spoke in a harsh whisper through clenched teeth, like he was angry. James Huddle, the defendant's former brother-in-law, told law enforcement that the defendant would speak in harsh whisper through clenched teeth when he became angry.

The defendant forced his way into the victim's house through the family room window with the intent to commit robbery and rape. DeAngelo ordered the victim to her feet as he held long shoestrings in his hand. He ordered her into the living room where he forced her face down.

Using the same granny knots that were found at the Maggiore murder scene, he tied the victim's hands behind her back and her ankles. Joseph DeAngelo removed her underwear and possessed the intent to rape the victim, but he left when he heard a group of boys outside the residence talking loudly. DeAngelo frequently looked out the window to see what they were doing and seemed nervous. Before leaving, he stole the victim's ring. (R.T., pp. 183-184.)

INCIDENTS 53 & 54: The 1/28/78 rapes and false imprisonments of Jane Does #36 and #37 in Carmichael, Sacramento County

Jane Doe Number 36 was 15 years old, and Jane Doe Number 37 was 14 years old. They were sisters and lived at home with their parents on College View Way in the City of

Carmichael, County of Sacramento. On the evening of January 28th, 1978, the parents left the residence to attend the Sacramento Symphony. The two girls were home alone and watched television until about 10:00 p.m., when they both went to bed in their separate bedrooms.

Shortly after falling asleep the older sister heard some thumping noises and got out of bed to check outside her window. While looking out the window she heard someone whispering behind her, saying, "Give me all your money or I'll kill you." It was Joseph DeAngelo, and he was standing right behind her with a flashlight in one hand and a gun in the other. After taking her money the defendant forced the older sister to walk to her younger sister's room.

Once they were in the little sister's room, DeAngelo forced the girls to lay face down on the bed. After doing so he covered the older sister's head with a pillow, tied both wrists behind her back and told them, "I'm going to look around the house. If you move I'll kill you, cut your throat and slip away in the fog." Upon returning to the bedroom, Joseph DeAngelo removed their underwear and forced each of them to masturbate him with their hands tied behind their back. With both girls in the room together, Joseph DeAngelo took turns vaginally raping both of

23 them, telling them to relax and not to talk to each other. He repeatedly raped them before leaving the house.

The parents returned home later that night and found their daughters tied up. The bindings were so tight that the girls' father had to use a knife to cut them off. The defendant had used shoelaces to tie up both victims and took a picture of the younger sister with him. (R.T., pp.

185-186.)

INCIDENTS 55 & 56: The 9/6/77 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #38 and the robbery and false imprisonment of John Doe #16 in Stockton, San Joaquin County

On the evening of September 6th, 1977, Jane Doe Number 38 and her husband, John Doe

Number 16, were asleep in the master bedroom of their home on Portage Circle in the City of

Stockton, County of San Joaquin. Jane Doe 38 was awakened when Joseph DeAngelo opened the unlocked sliding glass door to their bedroom and blinded her with the beam from his flashlight. DeAngelo was wearing a mask and told her not to move. All he wanted was food and money.

DeAngelo asked who else was in the home. He was told that there were two children.

DeAngelo told the victims, "If you don't behave I'll cut off your kids' ears and bring them back to you." Deangelo then handed Jane Doe 38 shoelaces and told her to tie her husband's hands and feet. He then bound her hands and feet and tightened the bindings on her husband. DeAngelo placed two plates on John Doe Number 16's back and told him that if he heard dishes rattle, he would kill all of them. He also held a gun to John Doe's head several times.

DeAngelo closed all the curtains in the home before untying Jane Doe 38's feet and told her to get out of bed. He held a knife to her chin and forced her into the living room, face down

24 on the floor. He blindfolded her, untied her feet and removed her robe. He rolled her onto her back and said, "Fuck me like your old man." DeAngelo was masturbating before raping her the first time.

After rummaging through the house, DeAngelo returned and proceeded to rape her several more times in a variety of positions. He attempted to sodomize her on one occasion, but then stopped trying and returned to raping her again. After he was finished, DeAngelo placed her face down on the floor and covered her up. After a few minutes, she was able to get her feet untied and went into the master bedroom where her husband was still tied up. They used a knife to cut the shoelaces and called the police.

Jane Doe 38 reported that the suspect spoke in a low hoarse voice most of the time, but when he got excited his voice changed to a very high pitch. Officers observed that a blanket had been draped over the lamp in the room where Jane Doe Number 38 had been assaulted. During this incident, DeAngelo took silver dollars, money and jewelry, including their wedding bands and custom cufflinks. (R.T., pp. 192-194.)

INCIDENTS 57 & 58: The 3/18/78 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #39 and the robbery and false imprisonment of John Doe #17 in Stockton, San Joaquin County

In the early morning of March 13th, 1978, Jane Doe 39 and John Doe Number 17 were asleep in Ms. Doe's home on Meadow Avenue in the City of Stockton, County of San Joaquin.

They were awakened when a masked male was standing in their bedroom holding a gun in his right hand and a flashlight in his left. The man said, "All I want is your money and food so I can live a little longer." While holding the flashlight beam in their eyes, he waved the gun slightly

25 and said, "This is a .357 Magnum, you see, and I'll blow your heads off." The masked man was

Joseph DeAngelo.

He ordered both of them to roll onto their stomachs and then made Jane Doe Number 39 bind her boyfriend's hands with shoelaces that DeAngelo provided. DeAngelo then tied her hands behind her back, tightening the bindings on John Doe 17, and bound the feet of both victims. DeAngelo then went through the dresser and jewelry box in the dresser. He then went into another room and could be heard tearing up towels. DeAngelo returned to the bedroom and used the towels to blindfold John Doe Number 17. He then placed the barrel of his gun between

Jane Doe 39's shoulder blades and ordered her to get out of bed and not look at him. He forced her to walk into the living room with the gun still at her back and then forced her to lay face down on the living room floor. She was then blindfolded and her feet bound again. DeAngelo placed a plate and a bowl on John Doe Number 17's back and ordered him not to move or he would kill both of them.

DeAngelo came back to the living room and turned on the television set. He straddled

Jane Doe 39's back and forced his penis into her hands while ordering her to, "Make it feel good." He also rubbed his penis on her back before untying her feet. He rolled her over, sat on her chest and forced her to orally copulate him. DeAngelo then vaginally raped her. He then placed suntan lotion on her vagina and anus and sodomized her as she cried. When DeAngelo was finished, he got up and could be heard rummaging through the kitchen. DeAngelo returned to her, placed a plate and a bowl on her back and said, "One clink, one small noise, and he's dead."

Eventually Jane Doe was able to slide down the hall, knock the phone off the shelf and call the operator for help. DeAngelo took jewelry, a driver's license and money. Empty beer

26 cans were found outside on the patio that had not been there before he was in the home. (R.T., pp. 295-197.)

INCIDENTS 59 & 60: The 6/4/78 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #40 and the robbery and false imprisonment of John Doe #18 in Modesto, Stanislaus County

In the early-morning hours of June 4th, 1978, Jane Doe Number 40 and her husband,

John Doe Number 18, were asleep in their master bedroom of their home on Fuchsia Lane in the

City of Modesto, in the County of Stanislaus. Their four-year-old daughter was asleep in the home at the same time. At approximately 2:30 a.m. they were awakened by a knocking noise and a beam of light from a flashlight carried by a masked Joseph DeAngelo. He was carrying a gun in his right hand. DeAngelo stated he had a .357 and would blow their brains out.

Jane Doe Number 40 was told to tie her husband's hands and feet together. DeAngelo tossed shoestrings to her to use for bindings. DeAngelo then tied her hands and feet together, also with shoestrings. DeAngelo spoke in a low whisper and continued to threaten them and put a gun and knife to their heads. He stated all he wanted was food and money to put in his van.

He could be heard rummaging through their kitchen and opening their refrigerator. He then came back into the master bedroom and forced Jane Doe Number 40 to move to the floor next to the bed. He then placed dishes on the back of John Doe Number 18, instructing him not to move or he would kill him.

DeAngelo forced Jane Doe Number 40 to get up, move down the hall and lie face down on the living room floor. A towel had been stuffed under the lamp shade in the living room.

DeAngelo proceeded to straddle her back and forced her to fondle his penis. He then raped her

27 and forced her to change positions several times. When he was done, he placed a glass and a dish on her back and told her he better not hear any noise.

DeAngelo eventually left, and John Doe Number 18 was able to call 911 using his tongue to dial the number. DeAngelo took approximately $1500 in cash from the residence. (R.T., pp.

198-200.)

INCIDENT 61: The 6/7/78 rape and false imprisonment of Jane Doe #41 in Davis, Yolo County

On June 7th, 1978, Jane Doe Number 41, a UC Davis student, was asleep alone in her first-floor apartment located on Lake Forest Drive in the City of Davis, in the County of Yolo.

She was awakened by a male near her bed, who put his hand on her face and was poking her in the back with something sharp. He told her not to scream and said, "All I want is food and money." The man who said he was only there for food or money was Joseph DeAngelo.

Jane Doe Number 41, who was sleeping on her stomach, put her hands behind her back as instructed. He tied her hands together with twine and then tied her legs. He covered her with a sheet before going through her dresser and opening the drawers. DeAngelo stuffed a pair of panties into her mouth and held a sharp object near her left eye, repeatedly threatening her to shut up. Ultimately, he poked her in the left eye with a nail file, causing an injury to her eye.

DeAngelo then went into her walk-in closet and the bathroom, briefly turning on the lights in each area. He returned to Jane Doe, put towels around her head, including her mouth and eyes. She was able to get the towels to slip down and was able to get a look at the suspect.

She was able to see his pants, his shirt and the fact that his head was completely covered with some type of stocking cap.

When DeAngelo saw her looking at him, he hit her several times in the head and pressed the nail file into her neck. He took the covers off of her and saw that she had untied the bindings on her feet. That angered him further, so he struck her several more times in the head and removed her underwear. Jane Doe Number 41 was sobbing, attempting to scream, which only served to anger DeAngelo further. DeAngelo then straddled her back, put his penis into her hands and told her to grab his dick. He took some lotion from a bottle near the bed and put it on his penis. DeAngelo then raped her.

When he was finished, he covered her with a sheet and placed a towel over her head. She remained on the bed until it was quiet for a few minutes before going outside and screaming, until her upstairs neighbors heard her and came to assist. When they saw the state she was in, they called the police. DeAngelo took the victim's wallet. Twine and strips of material that were used to bind the victim did not come from her apartment. (R.T., pp. 205-206.)

INCIDENTS 62 & 63: The 6/23/78 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #42 and the robbery and false imprisonment of John Doe #19 in Modesto, Stanislaus County

On June 23rd, 1978, Jane Doe Number 42 and her husband, John Doe Number 19, were asleep in their home on Grand Prix Drive in the City of Modesto, in the County of Stanislaus.

Early in the morning, Jane Doe Number 42 heard her puppy growling and then she saw the silhouette of someone standing in the bedroom. The person turned on a flashlight and shined it in her eyes. The masked person holding the flashlight was Joseph DeAngelo.

The first words DeAngelo uttered were, "I have a gun. Don't make any sounds or I'll blow your fucking heads off." DeAngelo told both of them to roll over and tossed some shoelaces to

Jane Doe and told her to tie her husband's hands together. He said he only wanted food and

29 money, and if they kept their mouths shut, he would leave. DeAngelo bound Jane Doe Number

42's hands and feet. He then forced her to walk down the hall into the living room. He instructed her not to look at him, but she was able to see a large knife that he carried in his hand.

He forced her to lay on her stomach, proceeded to go through the kitchen and open the refrigerator.

DeAngelo went back to the bedroom and asked John Doe Number 19 where the money was located. He told him it would be in a purse on the kitchen table. DeAngelo then placed three items on the bed next to him and said, "I'll kill your fucking wife if I hear this, and it will be all your fault." DeAngelo returned to the living room and turned on the television. He placed two towels over Jane Doe's head, preventing her from seeing. She heard him go into the garage and he returned, straddling her back. He poked her with the tip of a knife on the side of her face and then placed his penis in her hands and told her to play with it. DeAngelo untied her feet, rolled her over and sexually assaulted her several times in different positions. When he was finished, DeAngelo bound her feet and left her in the living room.

He could be heard rummaging around the house, and after a period of time it was silent.

John Doe Number 19 was able to eventually hop down the hall, obtain a knife and cut their bindings loose. Shoelaces were located in the home that did not belong to the victims. The phone lines had been cut and DeAngelo took money, a revolver and both of their wedding rings.

INCIDENTS 64 & 65: The 6/24/78 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #43 and the robbery and false imprisonment of John Doe #20 in Davis, Yolo County

Jane Doe Number 43 lived with her husband, John Doe Number 20, and their two children on Rivendell Drive in the City of Davis, County of Yolo. Just after midnight on June the 24th, 1978, the couple went to bed. At approximately 3:00 a.m. they were awakened by a bright flashlight shining in their faces. It was Joseph DeAngelo standing in the doorway. They could only see his dark silhouette. He told them, "I have a .357 Magnum, and I'll kill everyone if you don't cooperate." After ordering them to roll over onto their stomachs, DeAngelo threw two pairs of shoelaces onto the bed, made the wife tie up the husband, and after tying up the wife,

DeAngelo shoved a gun up against her back and told her not to move.

As DeAngelo began ransacking the house, he encountered the couple's young son and locked him in the bathroom, placed a cup on the doorknob to alert him if the door opened. After returning to the victim, DeAngelo pushed something sharp into her upper back and said, "That kid better stay in the bathroom or I'm going to push this ice pick into your back." He continued to threaten to blow everyone's head off if they did not cooperate.

He ordered the victim off the bed and into the living room, where he placed her on the floor facedown. In doing so he kidnapped her with the intent to commit robbery, and he substantially increased the harm to her. While lying on the living room floor, the victim heard the lotion bottle open. The defendant made her masturbate him with her hands behind her back.

He vaginally raped her and forced her to orally copulate him. After terrorizing the victims, he stole their money and he left. (R.T., pp. 207-208.)

INCIDENT 66: The 7/6/78 rape and false imprisonment of Jane Doe #44 in Davis, Yolo County

Jane Doe Number 44 lived with her two young children on Amador Drive in the City of

Davis, County of Yolo. Around 3:00 a.m. on July 6th, 1978, Joseph DeAngelo came through her bedroom door and shined a flashlight in her face. He told her, "Don't move or I'll blow your fucking head off, and I'll kill your boys. You see this?" as he pointed to the handgun. DeAngelo ordered the victim to roll onto her stomach, after which he bound her wrists with shoelaces.

After he wiped lotion on his penis, he forced the victim to masturbate him with her hands bound behind his (sic) back, and then he vaginally raped her.

After sexually assaulting the victim, he ransacked the house, ate their food and stole their money. But he wasn't done. Joseph DeAngelo returned to the victim and forced her to orally copulate him before sodomizing her. He forced her into multiple positions as he sexually assaulted her. At one point during the night Joseph DeAngelo started saying, "I hate you. I hate you, Bonnie." Joseph DeAngelo was previously engaged to a woman named Bonnie, and she broke off the engagement with him because of his controlling nature. He showed up at her window and tried to kidnap her at gunpoint. (R.T., pp. 210-211.)

INCIDENT 67: The 11/4/78 rape and false imprisonment of Jane Doe #45 in San Jose, Santa Clara County

Jane Doe Number 45 lived on Havenwood Way in the City of San Jose, County of Santa

Clara, with her one-year-old baby. On the night of the incident, she was home alone with her baby around 3:45 a.m. on November the 4th of 1978. She felt pressure on top of her and opened her eyes to see a stranger pressing against her body in the dark. It was Joseph DeAngelo. He told her, "Don't make any sound. If you do I'm going to kill you. I have a knife." She felt a sharp

32 object against her face. After he forced the victim facedown, he tied her hands behind her back.

She could hear something being ripped and was subsequently gagged and blindfolded. The victim felt DeAngelo's gloves as he touched her body.

He vaginally raped her twice. After the assaults DeAngelo told her he was hungry, and he went to the kitchen, where he could be heard eating food. He used drapery cord to bind the victim, just like he used the drapery cord in Ventura County. (R.T., pp. 212-213.)

INCIDENTS 68 & 69: The 12/2/78 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #46 and the robbery and false imprisonment of John Doe #21 in San Jose, Santa Clara County

Jane Doe Number 46 lived with her husband, John Doe 21, on Kesey Lane in the City of

San Jose, County of Santa Clara. On February the 2nd, 1978, Joseph DeAngelo broke into their home and stood in their bedroom watching them sleep. Around 2:00 a.m. he woke up the wife by shining a flashlight in her face. She screamed several times, until her husband woke up.

When the husband threw the covers off, DeAngelo yelled out, "Just try to move, motherfucker.

Try to do it again, and I'll shoot you." DeAngelo threw the victim a handful of shoelaces and ordered her to tie up her husband, which she did. The defendant then tied up the victim's hands behind her back. Some of the bindings, the shoelaces, came from the victim's shoes; others

DeAngelo brought with him.

After ransacking the house DeAngelo came back into the bedroom and led Jane Doe

Number 46 to the front bedroom. In doing so he unlawfully kidnapped her with the intent to commit robbery and substantially increased the risk of harm to her. DeAngelo re-entered the bedroom and placed a jar on the husband's back and told him if he heard a noise he would shoot his wife. Upon returning to the wife DeAngelo forced her to masturbate him with her hands still

33 bound behind her back. DeAngelo then forced her to orally copulate him. He placed a knife to her throat and told her she better make it feel nice, or he would cut her throat. After a few moments, the defendant vaginally raped the victim as he held a gun up against her head and told her not to scream or he would blow out her brains.

After sexually assaulting the victim he started eating a box of crackers and drinking beer from the refrigerator. The victim thought the defendant had left the house, but then he called out and came back. Like several of the sexual assaults in Contra Costa and in the East Area Rapist series, the defendant used shoelaces as bindings, stole wedding bands from the victims, ate their food and drank their beer after he terrorized them. (R.T., pp. 213-215.)

INCIDENT 70: The 12/9/78 rape and false imprisonment of Jane Doe #47 in Danville, Contra Costa County

On or about December 9th of 1978, Jane Doe Number 47 was home alone. She lived in the City of Danville, in the County of Contra Costa. She'd gone to bed around 12:30 a.m. that morning, normally slept on her stomach. She was awoken out of her sleep by the touch of a male's hand on the nape of her neck. The male was Joseph DeAngelo. Still holding her head down, he also held a long blunt-tipped object perpendicular to her throat and said, quote, "Don't scream. Don't make a noise. I won't hurt you. All I want is money and food for my van." He continued, "Where's the money? Where's the money?"

He then told her to put her hands behind her back, which she did. He then pulled the covers off of her and told her to put her hands up high, high enough behind her back, which she did. He then tied her hands behind her back and pulled the bed covers over her head. He then pulled the bed covers up from the bottom, exposing her feet, and told her to cross them, which she did. He then tied her feet together and left the bedroom.

The victim could hear him in her kitchen opening and closing cupboards and opening and closing doors in the hallway. He then entered her room again and began opening and closing drawers. She saw what she thought was a light from a flashlight at this point, while still covered with the sheets. He continued rummaging through the house and at some point turned off the radio in the living room and the heater, both of which she had left on before she went to bed.

He then returned to her room once more, this time to her bedside. She heard something tearing. Two strips of cloth were then placed over her eyes. At that point what she heard next was the defendant masturbating at her bedside. He then walked into her bathroom and returned, continuing to masturbate. At this point she smelled what she believed was the odor of her lotion from her bathroom.

He then untied her legs, turned her over and pushed one of her legs up toward the headboard of the bed. He pulled her shirt up and using her name, said, "Do you like to fuck?" to which she said no. She also remembered him asking again, "Where's the money? Where's the money?" the latter of which she responded there was money in her purse, which was in the kitchen. He continued on at her bedside, "Do you like to raise dicks?" to which she replied no.

In return he said, quote, "Then how come you always raise mine every time I see you?" The victim didn't respond.

He then raised her shirt up and fondled her breasts. He went down toward the edge of the bed, raised her legs so that both knees were bent. He then penetrated her vagina without her consent with his penis, moving his penis from her vagina to her rectum, and back and forth again. He then re-tied her feet, covered her again with the bedding and left the room. He came back though, turned her on her right side, and moved her left leg up toward her upper body. He then inserted his penis into her vagina without her consent and raped her again. Once the act was

35 complete, he got up, rubbed his hands on a sheet, re-tied her feet and left the room. She then heard a screen door open and waited for the defendant to leave.

After waiting for a period of time, she began to try to untie herself. She was able to get to the kitchen to retrieve a knife to cut the ties and at that point she noticed that it was about 5:00 a.m. She went to a neighbor's house for help. She was taken later that morning to the emergency room at John Muir Hospital for a sexual assault examination.

After a search of her home it was discovered that money, approximately $25, and her driver's license were taken from her wallet. Additionally, five pieces of jewelry were missing, which had been taken from the jewelry box: A yellow gold ring with a jade stone, a yellow gold ring with an aquamarine stone, a yellow gold stick pin with an opal stone, a white gold pendant with an opal stone and two small diamonds with a gold chain and a yellow gold antique pendant with a pink stone with seed pearls and a yellow gold chain. The defendant had also taken a bottle of beer from her refrigerator, consumed it and left it in the rear of her yard.

A sexual assault evidence kit was collected from the victim. A vaginal sample was analyzed for DNA. The DNA profile from the sperm fraction of the vaginal swab generated a single male donor consistent with the single male donor from charged Count Twenty-five, Jane

Doe Number 12, and charged Count Number Twenty-six, Jane Doe Number 13, both of which are Contra Costa cases, in addition to Orange County, Ventura and Santa Barbara cases. In May of 2018 the California Department of Justice notified Contra Costa Sheriff's Department Crime

Laboratory of a DNA match to the defendant, Joseph DeAngelo. (R.T., pp. 75-79.)

INCIDENT 71: The 6/2/79 rape and false imprisonment of Jane Doe #48 in Walnut Creek, Contra Costa County

On June 2nd of 1979, in the City of Walnut Creek, in the County of Contra Costa, Jane

Doe Number 48 was babysitting for a family in a single-story residence. At approximately 8:30 p.m. she was sitting at the kitchen table and she heard either footsteps or a voice that caused her to look toward the hallway. She saw a male standing there with a white face mask on, holding a large leather sheathe, which she believed contained a knife. The man standing in the hallway was Joseph DeAngelo.

He'd said to her, quote, "Shut up. Don't make a noise." He immediately grabbed her and pushed her head down to a point where she would not look up at him. He then walked her from the kitchen to the master bedroom and laid her face down on the bed. He directed her to put her hands behind her back and to hold still as he bound her wrists and ankles with plastic ties. He then covered her eyes with a halter top, placed a towel around her mouth and gagged her with the towel.

As she lay face down on the bed, he began rummaging through the bedroom and told her to be still or he would kill her. She believed that there was a flashlight in his hand at this time.

He took her shoes and socks off. He untied the bindings around her ankles and got on top of her.

He then took his own pants off and began masturbating. He then either spread her legs or told her to spread them and attempted to penetrate her vagina with his penis. At this point he asked her, quote, "Have you ever fucked before?" He then got frustrated and stopped.

The defendant then got up and began rummaging through the room again. Still blindfolded, the victim felt something moist in her hands. The defendant moved to her left side of the bed and placed his penis in her hands and told her to stroke and play with his penis and to

37 masturbate him. He then reached under her shirt, ripped off her bra, pulled up her shirt and bit her breast four times, one of those times biting down extremely hard. He then penetrated her vagina with his penis without her consent and raped her. He continued to tell her not to make a sound, stroked the left side of her neck with a sheathe-like object which, again, she believed to be a large knife within that sheathe. He then told her not to move or he would cut her throat. He continued to rape her until he eventually stood up and bound her ankles once more.

He rummaged through the room for a short time and left through the sliding glass door at the rear of the residence. She eventually was able to work her ankles free, believing it to be around 11:15 or 11:30 p.m. at that time. She awoke one of the children she was babysitting and was eventually able to get someone to contact her parents and the Walnut Creek Police

Department. (R.T., pp. 80-82.)

INCIDENT 72: The 6/25/79 rape and false imprisonment of Jane Doe #49 in Walnut Creek, Contra Costa County

On June 25th of 1979, in the City of Walnut Creek, in the County of Contra Costa, the victim, Jane Doe Number 49, was home with her sister and father. She and her sister went to bed at around 9:30 or ten o'clock, p.m., and her father had gone to bed a little later, around 11:00, all in their own respective bedrooms. It was customary for everyone to sleep with their bedroom doors closed. The victim indicated that she did sleep with her window open that evening. She wore a full-length nightgown to bed and cotton underwear. At some point in the middle of the night a man jumped on her back. She was asleep in her bed. He put his hand over her mouth and said, "Don't say a word. I'm not going to kill you. All I'm looking for is money. All I want is money." She could feel the sharp point of a knife being put to the side of her neck.

He pulled her comforter back and told her to place her hands behind her back. She complied. She could feel her hands being tied tightly with some type of twine or rope. He then got off of her bed and covered her entire body, including her head, with the comforter. At some point during the sequence of events her feet were tied together as well.

At this point she turned to see the male, Joseph DeAngelo, the defendant, in her bedroom.

She observed his clothing and could see that he had a light-colored mask over his head. At that point she was left alone for a few minutes, as he rummaged through her bedroom. She was threatened again not to say a word. He then returned to her bed after about five minutes with a piece of cloth material and forced it into her mouth and then tied a bra under her head and also obtained a pair of underwear from her underwear drawer and tied those behind her head.

She was not blindfolded at this point. The defendant commanded her to keep her head down and not to look at him. He continued to say that he was looking for money, and at this point she saw what she believed to be a flashlight after seeing momentary flashes of light in her room. He then found a table lamp in the room and turned it on and continued to rummage around her room and said, calling her out by name, "Just do what I want, and I won't hurt you.”

She then heard what sounded like someone applying baby lotion or hand lotion either to their hands or some portion of their body. Defendant returned to her bed, straddled her body and placed his penis in her hands, which were still tied behind her back, and told her, quote, "You rub my cock, and you better make it good or I'll kill you." She did as she was told.

He then directed her to turn over on her back and she complied. He removed the ties from her feet and reached under her nightgown, pulling her underwear down, and asked her something to the effect of, “Had she fucked or done this before.” At this point her face was

39 covered by a shirt that the defendant had put over her face and gave her the following command:

I want you to spread your legs apart. She complied. He got on his knees and maneuvered her legs on each side of his body and then penetrated her vagina without her consent with his penis and raped her. He continued thrusting against her body and then eventually pulled his penis out.

He then re-tied her feet together, her hands still bound behind her, still gagged, face still covered with a shirt.

He then put his mouth close to her ear and said, quote, "I'll kill you while I'm looking, looking, looking for money, money, money." He then left her bedroom, closing the door behind him. She waited for about 15 minutes until she believed the defendant was gone and went to her father's room screaming on the way there, “I was raped.” The police arrived and she was ultimately taken to John Muir Hospital with her sister and mother for a sexual assault examination. (R.T., pp. 83-86.)

INCIDENTS 73 & 74: The 4/4/79 kidnapping for robbery, rape, robbery and false imprisonment of Jane Doe #50 and the robbery and false imprisonment of John Doe #22 in Fremont, Alameda County

On April 4th, 1979, Jane Doe Number 50 and her boyfriend, John Doe Number 22, were asleep in their home on Honda Way in the City of Freemont, in the County of Alameda. Just after midnight they were awakened and saw a male pointing a flashlight and handgun at them in their bedroom. He told them not to move or he would blow their heads off. The man in their bedroom holding the gun was Joseph DeAngelo.

The suspect threw shoelaces at John Doe's back and told Jane Doe Number 50 to tie his hands behind his back. DeAngelo then tied her hands and feet, as well as John Doe Number 22's feet. He told them that, "We're going into the other room so you guys won't be together."

DeAngelo forced Jane Doe Number 50 to walk into the front room and lay down on the floor.

He covered her with a blanket and blindfolded her. He then returned to John Doe Number 22 and placed dishes on his back, while instructing him not to move or he would blow their heads off.

DeAngelo then went back to Jane Doe Number 50 and told her that if she did what he wanted he would take food and money, and no one would get hurt. He also mentioned that he needed supplies for his van. Next, he turned on the television with no sound, removed the blanket and straddled her back and forced her to masturbate him. DeAngelo removed the bindings from her feet, rolled her over and raped her vaginally several times. After he finished he put a towel in her mouth.

DeAngelo could be heard rummaging through the home before leaving. Jane Doe

Number 50 was able to untie her bindings and untie her boyfriend's bindings and call for help.

DeAngelo took John Doe's office and house keys, along with money. (R.T., pp. 217-218.)
