In the Year One Thousand Nine Hundred and Thirty-Nine.

An Act providing for construction of facilities for THE CONVENIENT TRANSFER OF PASSENGERS IN KEN- MORE SQUARE, BOSTON, AS A PART OF THE EXTENSION OF THE BOYLSTON STREET SUBWAY. Be it enacted by the Senate and House of Repre- sentatives in General Court assembled, and by the authority of the same, as follows: 1 Section 1. The transit department of the city 2 of Boston, hereinafter called the transit department, 3 may, after the agreement hereinafter provided for 4 is made, construct as a part of the extension of the 5 Boylston street subway in the city of Boston, con- -6 structed under the authority of chapter three hun- -7 dred and forty-one of the acts of nineteen hundred i 8 and twenty-five, as amended by chapter three hun- -9 dred and ninety-four of the acts of nineteen hundred 10 and thirty, a busway, platform and shelter in the 11 reservation in Commonwealth avenue near its junc- -12 tion with Beacon street in Kenmore square, Boston, 2 HOUSE No. 2083. 13 with a stairway or stairways connecting said platform 14 with the of said subway and for said 15 purpose shall have all the powers and authority con- -16 ferred by said chapter three hundred and forty-one 17 as amended.

1 Section 2. Such busway, platform, shelter and 2 stairways shall not be constructed until a plan alter- -3 ing the plan for the alterations and extensions of the 4 Boylston street subway authorized by said chapter 5 three hundred and forty-one so as to provide for such 6 busway, platform, shelter and stairways shall have 7 been approved by the department of public utilities 8 as provided in said chapter three hundred and forty- -9 one as amended and an agreement shall have been 10 made between the transit department and the Boston 11 Elevated E,ailway Company, hereinafter called the 12 company, consenting to such alteration and agreeing 13 to the amount to be added to the net cost of the 14 alterations and extensions authorized by said chapter 15 three hundred and forty-one as amended upon which 16 the rental under the existing contract for use of the 17 alterations and extensions authorized by said chap- -18 ter three hundred and forty-one as amended is based. 19 The transit department in behalf of the city of Boston 20 and the company are hereby authorized to make such 21 agreement. The treasurer of the city of Boston may 22 issue and sell bonds as provided in said chapter three 23 hundred and forty-one as amended to meet all costs 24 incident to carrying out the provisions of this act.

1 Section 3. This act shall take effect upon its 2 acceptance both by vote of the city council of the 3 city of Boston, approved by the mayor, and by the 1939.] HOUSE — No. 2083. 3

4 Company by vote of its 5 board of directors, and upon the filing of certificates 6 of such acceptances with the state secretary; provided, 7 that such acceptances, approval and filing occur 8 during the current year.
