The Federal Bureau of Investigation, U. S. D epartment of Justice, is

charged with the duty of inves tigating violations of the laws of the Unit ed

States and col l ecting evidence in cases in which the is or may be a party in interest.

The Bureau does not have investigative jurisdiction over violations of Counterfeiting, Narcotic, Customs, Immigration, or Postal Laws.

However, the Federal Bureau of Investigation will immediately institute

I desire at this time to invite the attention of law en force­ ment offici als to the increas ed use of air mai l faci li ties to exp edi te the receipt of informat ion des ired in any ca se.

The Bureau recently has adopt ed the practice of using air mail in answering fingerpr ints in which iden t ifications have been made on fingerprint ca rds forwarded from the more distant points, and particularly by officers west of the Mississippi River. The air mail is used in thes e ca ses ev en though the prints are not received by air ma i l. However, only "a rrest" prints are answered in this manner , i. e. , prints taken at the time of any arrest an d not in the ca se of "pr ison" pr ints , whi ch are taken when a person is received in a penal institution or transferred from one institution to another . The air mail postage on thes e records is paid by the Bureau and the practice outl ined has been adopted because of the Bu­ reau's desire to afford prompt servi ce in the case of ident ified "a rrest" fingerprint records submitted by interested officials.

I des ire also to point out at this time the fact that air mail receipts of fingerpr ints have incr eased tremendo us ly within recent mont hs and I would like to invite the attent ion of those department s whi ch are not now us ing the air mail to the possible des irabili ty of forwarding certain records of an em ergency nature to the Bureau in this manner . The transmittal of prints by the air mail expedi tes their arrival in Washing­ ton. Further , the us e of special delivery postage insures delivery by the Post Office Department at night, on Saturday afternoons, on Sundays, and on holi days . Air mail postage without speci al del ivery postage do es not gUa rantee del ivery after regul ar po stal service hours. It is noted in this co nnection that all fingerprints received in the Ident ification Division, regardless of their point of origin, are answered by the Identi­ fication Division in the same manner in which they ar e received, i. e. , prints recei ved by air ma il are ans wer ed by air mail and those rec eived by specja l del ivery ar e answered by speci al del ivery . The Bureau in each instance provi des for the return postage. It is felt that it would be des irable to forward any special matter s by speci al mail to the Bureau . Su ch action with the aid of the reply in like manner would insure the most ex pedi tious handling .

It is hoped that through this expans ion of the air mail servi ce, more ef fective attent ion can be given to records and requests for informa­ tion forwarded to the Bureau by law enforcem en t officials .

A wanted circular wa s received in the Federa l Bureau of Investi ­ gati on from the State Peni tenti ary at Boise, Idaho, on October 8, 19 34, con­ ta ining informati on tha t Wal ter Ma thi s wa s wa nted as an escape from tha t

insti tuti on . Thi s person had been recei ved at the Idaho Sta te Peniten tiary in Apr il, 1928 , to ser ve a li fe term for first degree murder. The wa nted circular issu ed by the Idaho authoriti es stated tha t he ha d effec ted hi s escape on Sep tember 30, 19 34. On the receipt of thi s information a wanted notice wa s posted in the fingerp ri nt files of the Bureau against the record of Mathi s. Moreover, a notice of hi s fugitive sta tu s wa s published in the December , 1934 issu e of the bu l leti n, "Fug itives Wanted by Police".

A fingerprint card wa s received in the Bureau on January 16 , 19 35, from the Sheriff's Office at Phoenix, Ari zona, whereon it appeared that Geo rge Wal ter Ma di son ha d been arrested by tha t off ice on January 10 , 19 35,

on a charge of investi gati on . In formati.on accompan ied thi s fingerprint card to the ef fect tha t when Ma di son's fingerprints wer e taken, after hi s arrest by that office, they were compared wi th finger impr essi ons appearing in the Fug i­ tive Bulletin . On thi s compari son, they were found to be identical wi th tho se of Wal ter Mathi s, the escaped life termer from the Idaho Penitenti ary.

When the fingerpri nts from the Sheriff's Office at Phoenix, Ari zo na, were searc hed agai nst the fi ngerprint files of the Bureau , the iden ti ­ fication ref erred to ab ov e wa s confi rmed and the Sheriff's Office at Pho enix, Ari zona , was, of course, notified of tIli s fact. Moreover, the authorities of the Ida ho Sta te Penitentiary were advised of the arrest of thi s person at Pho enix.

The above case is bu t one of many tha t have come to the atten ­ tion of the Bureau wherei n notices in the Fu g itive Bul letin have been instr u­ men tal in iden ti fyi ng perso ns un der arrest as being wanted. Iden ti fication Officers and la w en forcement ag en c ies thro ug hou t the country, in constan tl y increasing numbers, are making complete use of the data appearing in thi s bu lletin. The fi les of the Iden tification Division of the Federal Bureau of Inves ti gation refl ect tha t Cla ude S. Owen s was arrested by the Police

Department at Birmingha m, , on July 10 , 19 19 , on a charge of hi gh­ way robbery, and on October 1, 19 19, wa s sentenced to serve a term of life and one hundred years in three ca ses of robbery . A wanted ci rcular was received in the Iden ti fi cation Division fr om the State Convi ct Depart­ ment, Montgomery, Alabama, on , 19 33, containing informati on that Owens ha d effected hi s es cape from pr ison on , 19 33 . Accord­ ingly, a notice of the fugi tive status of thi s individual was posted in the fi ngerpr int fi les of this Bureau. Mo reover , a noti ce of the fa ct tha t thi s person wa s wanted by the Alabama authoriti es wa s published in the Ap ril, 19 33, issue of the bull eti n enti tl ed "Fugi tives Wanted by Police".

A fingerprint ca rd wa s recei ved in the Bureau from the Po lice Department at Kan sas Ci ty, Missouri, on Ja nuary 18 , 19 35, wher eon it appeared tha t Cl aude Stanston Owens, whose fi nger impressions appeared on thi s ca rd, ha d been arrested by tha t department on January 10 , 19 35, on a charge of investigati on. Thi s ca rd contained a notation tha t by means of a noti ce appearing in the Fugi ti ve Bulleti n thi s person ha d been fo un d to be iden ti cal wi th Claude S. Owens, the es caped life termer from Alabama. Thi s fingerprint ca rd wa s searched against the fi les of the Identification Division of the Federal Bureau of Investigati on and the iden ti fi cati on of thi s individua l wi th the fugi tive from Alabama was confi rmed . Subsequent info rmation ha s been received that Owen s wa s returned to the Alabama authorities on January 14, 1935.

The above ca se is an interes ti ng illustrati on of the results that may be obtained by systemati c us e of data appearing in the Fugi tive Bulle­ tin. In ca ses wher e law en forcement authorities have persons un der arres t on minor charges an d des ire to ascer ta in immedi ately whether or not such persons are wa nted the Fugi tive Bulletin is practi cally an indi spensable means of making such determinati ons. Th e figures are also presented in the form of daily averages . In view of the differenc e in the number of days in those two months , it is rec oÑmended that the dai ly averages be used in making com­ parisons of the amount of crime reported for those two months . The compilation discloses moderate increases in the da ily average number of offens es of murder and aggravated assault during February and slight increases in the figures for burglary, larceny, and auto theft . Rather substant ial decreases are shown for the re­ maining offense classes . It should be observed that for offenses of manslaughter by negligenc e and larceny, the figures are based on the reports from the number of cities indicated in the footnotes to the table.

CRIMINAL IDENTIFICATION WITH RKLATION TO PLASTIC SURGERY

The circumstances surrounding the final arrest of Dill inger raise the question of the possibi lity of hampering crimina identification by means of plastic sm"gery . It is worthwhile for pOlice officers and physicians to consider to what extent reconstructive surgery can alter the appearance, to learn the tell-tale marks such alterations leave and to attempt to devise measures to prevent the performance of surgery in order to frustrate the law. Each human being is suppl ied by nature , several months bœfore birth ,

with an elaborate identificat ion tag , absolutely individual to himself and impossible to duplicate , wh ich he carries throughout life and evon for some time after death . This is the system of epide rmic ridges that covers the en­ tire palmar surface of the hands and the soles of the feet . The character of these friction ridges is strongest on the balls of the fingers , where they form a strong pattern of loops , whorls and arches . The design is different , not only for each person but for each digit of the same person ; and the evidence of a single finger tip is sufficient to establish an absolute identi­ fication . The finger prints cannot be destroyed by linear scars or by any burns of less than third degree . It is not feasible to replace the skin on the fin­ ger tips with grafts from any other part of the tody as the skin on the palms and soles has a unique structure and the substitution would be too apparent . Besides , ten separate grafts would h3ve to be performed . It is true that a suspect "in a capital cass , with fingerp:ints the principal evidence against him , might subj ect himself to o. third degree burn on each Unger tlp. Such devices to prevent identification would be avo idŔd by taking the imprint of the who le palm instead of just the last pha lanx of each "digit . Whi le the friction ridges are the most absolute method of establ isbing identity, their evidence cannot be put to practical use unless the suspect is apprehended . Even after the identity of a criminal has been establ ished by fingerprints , the police must usually rely on sight recognition to make the arrest . The difficulties of sight recognition are many and varied . The same person may look different at various times or there may be strange and baf­ fling resemblances between totally unrelated people . The difficulties of sight recognition are intensified today by the fact that plastic surgery can permanently and painlessly alter most of the features of the face . Fortunate­ ly each change is accompanied by some scarring , no matter how cleverly con­ cealed ; and in suspicious cases detectives should be trained to look for those scars . The topography of the forehead can easi ly be changed by the insertion of a cartilaginous or dermo-fat graft beneath the skin , through an inconspicuous incision above the hairline . The thin scar and a palpable mass beneath the surface indicate that reconstructive surgery has been performed . Any type of nose can be strikingly changed by the endonasal route . The dimensions of the nose can be changed in all its diameters ; the bridge can be raised or flattened ; the contour of the nostrils can be al tered . When ex­ tensive changes are made there are corresponding alterations in the contour of the adj oining parts. However, a thorough search of the mucous membrane by 13 a

someone experienced in this type of work will reveal a l inear scar , flat or thickened . Removal of osteocartilaginous tissue results in callous formation over the bridge which can be felt through the skin . The presence of a bony or carti laginous graft, or of any implant , is also easily detected . Hypertrophic lips due to excessive devel opment of the red of the lip may be reduced by the excision of crescent shaped fragments from the mucous mem­ brane . The scar is plainly visible on the inside of the mouth . An under­ developed jaw can be enlarged by the insertion of a dermo-fat graft and a prognathic chin ca n be reduced by sawing off crescentic fragments of the jaw­ bone . In either case the scar is concealed in the fold beneath the chin . The ear , wh ich is one of the most important features of the face from the point of view of identification , can be changed in all its most character­ istic points . Its size can be altered symmetrically by excising fragments of skin and cartilage ; the lobes can be joi ned to or detached from the cheeks . Scars must be hunted for very painstakingly as they can be cleverly concealed in the numerous grooves and depressions of the auricle . "Face-lifting" makes identification more difficult by eradicating characteristic bags , folds and wrinkles and by imparting a fictitious air of youth ; but it can hardly be said to co nceal identity for it leaves the features un touched . Furthermore , the ha irline scar can always be traced . Scars , birthmarks , tattooing , etc. , once prominent features of the Bertillon system of identification, can now be al most co mpletely eradicated, and for the most part without conspicuous scarring . The deformity is excised and the surrounding skin undermined and stretched to cover the defect . There can be no doubt of the possibi lity of effectively disguising the appearance by means of plastic surgery and the police should cooperate with reputable plastic surgeons to prevent the use of this spec ialty for such pu r­ poses . In suspicious cases the surgeon should be on file with both local police and the Department of Justice. When a dangerous criminal is being hunted , particularly if he has a striking fac ial trait who se obl iteration would make sight recognition difficult, the descriptive circular issued by the police could be sent to plastic surgeons to put them on the ir guard .
