NHS Litigation Authority 4 Report and Accounts 2014/15 Welcome There have been a number of senior management and Board changes in the year. Catherine Dixon, our former Chief Executive, left us at the end of November 2014 to take up a new role as the Chief Executive of the Law Welcome Society. We are grateful to Catherine for the changes she initiated in her time with us. After an extensive selection process we appointed Helen Vernon as our new Chief Executive on 1 December. Helen was previously our Director of Claims and the fact that we were able to make an internal appointment, despite the quality of external candidates is a testament to the quality of people in the NHS LA. Professor Rory Shaw’s term as a Non-Executive Operations Director ended on 31 March 2015 and we are very grateful for his support over eight years. On 1 April we were delighted to appoint Professor Keith Edmonds to our Board. Keith is a Consultant Gynaecologist and his experience will be invaluable to us in the years ahead. On 30 April 2015 Nina Wrightson, our Vice Chair and Senior Independent Director, stood down from Strategic and Director’s Report Strategic and Director’s the Board after eight years’ service to the NHS LA. Our thanks go to Nina for her past contributions. The next year will undoubtedly be challenging for the NHS LA as we seek to respond to the many challenges that already face us and the further changes that are likely to come. Further details are set out in the pages that follow. However we have good leadership, good people and a focus on what we need to do, so I am confident that the organisation will be capable of meeting these Report and Accounts challenges. Working closely with DHSC, NHS Supply Chain, the MHRA and colleagues from the devolved administrations, given the impact on other parts of the UK, NHS England and NHS Improvement is co-ordinating the NHS’ response in England, on a national basis. The supply position remains constrained and is forecasted to become even more constrained over the coming weeks. While it is anticipated that the position will improve from the middle of September, overall supply is likely to remain challenging for a significant period. We have previously sent information in relation to this issue and will continue to provide updates as the supply situation develops. The tubes impacted by this shortage are: 1. 5mls Yellow top – SST 2 – clotted sample (e.g. U&E, LFTs etc) 2. Purple top – EDTA (e.g. FBC, HbA1c) Alternative products are being sought to alleviate these constraints; and all labs that will be switching to these supplies have received samples for testing and validation. However, it will take time for these products to be imported and delivered in volume to services.

    To whom it may concern NHS England and NHS Improvement Skipton House| 80 London Road London SE1 6LH 1 April 2020 COVID-19: Indemnity provisions for independent sector employees working in the NHS and NHS employees working in independent sector facilities during the COVID-19 incident response NHS England and NHS Improvement, in collaboration with the Independent Healthcare Providers Network (IHPN), have reached a national agreement with independent sector (IS) healthcare providers to secure virtually all available inpatient capacity* and supporting resources in every area in England to form part of our response to COVID-19. This covers all of the facilities with inpatient and/or day case beds and the existing staff working for those providers. The arrangements that NHS England and NHS Improvement has entered into with the operators of independent sector hospitals across England to assist with the Covid-19 crisis became effective from 23 March 2020 and will continue for at least 14 weeks. Under the Heads of Terms already agreed, everyone involved in the delivery of NHS services under those arrangements, whether they are employed by one of the hospital operators or by an NHS Trust or Foundation Trust, is covered by: indemnity arrangements in respect of clinical negligence under schemes operated by NHS Resolution; and insurance arranged by the hospital operator, and/or indemnity arrangements under schemes operated by NHS Resolution, in respect of employer’s liability. The further detail of how these arrangements will operate will be written into the nationally agreed final terms of the contracts between NHS England and NHS Improvement and the independent sector providers which are party to the agreement.

As you will be aware, established systems and processes already exist for responding to serious supply disruption events for medical products (as set out in Annex A), and in all cases you should continue to use these “business as usual” channels to respond to and resolve issues where possible. To enhance this capability at a national level, these processes will be coordinated through the NSDR, set up by DHSC. NSDR systems and operations will monitor the supply situation at a national level and coordinate actions to address any supply disruption incidents should these occur. Annex A identifies what actions staff should take locally in the event of them experiencing supply disruptions to products and services. Escalation to NSDR should be made via organisational procurement leads (or equivalent). Guidelines on when to escalate to the NSDR and contact details have been shared with NHS Heads of Procurement.
