Adjourn ADMINISTRATION/FINANCE/HR Carry forward Action List – CURRENT Date/Source Action Item/Request Status Sept 16, 2013 Temperance Colony Tax Title Property Disposal • Tax Title property, Pcl A NE/21/38/4/W3 was transferred to the Municipality under the Council resolution to dispose of Tax Title property, Tax Enforcement Act in 2008. File left inactive, property not disposed of. Pcl A NE/21/38/4/W3 • Marksview Farms, Dick Friesen claims interest in property due to farming the land in conjunction with of the adjacent land for over 50+ years. Interest registered on title. • R.M. applied to ISC for Lapse of Interest of Marksview Farms interest. • Court of Queen’s Bench, April 24th May 8th set for hearing regarding lapse and removal of interest held by Marksview Farms from title. • June 16, 2014 Administration received the court’s decision that the R.M. was successful in arguing that the miscellaneous interest registered by Marksview Farms was not appropriate and that they were given 30 days to amend its interest to allege that it is a tenant and to remove all reference to any other interest in the land. • June 19, 2014 the R.M. received notification from ISC that Marksview Farms had revised their interest type to that of a “Lease – less than 10 years.” • July 14, 2014 Committee advised Administration to contact at least two real estate agents specializing in rural property sales and obtain appraisals of the property and information regarding the potential sale of the property. • July 21, 2014 Administration reported to Council that two real estate agents were contacted and obtained appraisals for the property. • July 21, 2014 Council approved hiring Don Dyck, Real Estate Agent with Remax North Country, to sell the R.M. tax title and that all purchase bids be submitted in closed tender. • Tenders closed, results brought to the October 20, 2014 Council Meeting. • October 20, 2014 - Declined tender received and are awaiting results of the Court of Queen’s Bench Application for review. • November 25, 2014 - Administration was advised by the RM’s legal representative that the Courts have again ruled in favour of the RM of Corman Park and dismissed the application made by Marksview Farms. RM’s legal representatives will proceed to have the pending litigation removed from the title of the said property and await further direction. continued…. Effective March 31, 2015 the property will now be relisted for sale with purchase bids being submitted in close tender. • June 15, 2015 – Council passed the motion: “That Administration bring back a report outlining a proposed plan for enhancement of the tax title property, known as Parcel A. NE 21-38-4-W3, prior to re-listing it for sale.” • July 20, 2015 – Council passed the motion “That the R.M. proceed with the enhancement of the tax title property, Parcel A, NE 21-38-4-W3, with the survey of the property at a cost of $1,700.00 and the installation of a fence around the parcel at a cost of $1,000.00 for a total cost of $2,700.00 be APPROVED and that the property be rezoned from AG to AR1 following the survey.” • July 21, 2015 – Survey in progress. • September, 2015 – Survey of the property is complete with property corners being marked. Administration to bring forward rezoning from AG to AR1 of the said parcel. • Oct 5, 2015 – Rezoning from AG to AR1 was read a first time. • Nov 2, 2015 – Rezoning from AG to AR1 was read a 2nd and 3rd time. Awaiting rezoning approval of the Minister of Government Relations. • Jan 6, 2016 – Ministry of Government Relations rezoning approval received. To proceed with parcel enhancement and marketing in the spring. • Jan 25, 2016 – Council received correspondence from the Sonnenschein Law Office, legal counsel for Marksview Farms Ltd, proposing to the R.M. an exchange of land for the R.M. tax title property. Council responded to the proposal with conditions that would includea legal review and the execution of an agreement by Council. Response letter to follow pending the approval of the Jan 25th minutes on Feb 8th. • Feb 16, 2016 – Administration received a letter from Sonnenschein Law Office, acknowledging receipt of the R.M. letter responding to Marksview Farms proposal. Page 2 of 6 Printed Date: June 8, 2016 ADMINISTRATION/FINANCE/HR Carry forward Action List – CURRENT Date/Source Action Item/Request Status Tax Title Property Disposal (cont’d) • Mar 21, 2016 – Administration presented Council with a letter of response from Council resolution to dispose of Tax Title property, Sonnenschein Law Office reporting that they had would contact their client and Pcl A NE/21/38/4/W3 advised them to contact the R.M. to make arrangements for matter to proceed. • Apr 18, 2016 – Council passed the following motion: “That the proposal as presented in the April 6, 2016 letter from Sonnenschein Law Office, on behalf of their client, Marksview Farms be received as information and that written agreement be made ensuring that all the tax title costs and all costs to be incurred will be recovered from the proceeds of the sale of new lands prior to split of the proceeds by the two parties.” • May 6, 2016 - Administration forwarded a letter to Sonnenschein Law Office regarding Council’s proposal. Mar 16, 2015 PFRA Community Pasture Transfers • Councillor Rooke brought forward a request to include a contribution to the pending lawsuit regarding the PFRA Community Pasture lands. • March 16, 2015 – Council passed a motion to investigate participating in the Community Pastures lawsuit and that information be brought back for Council review. April 20, 2015 – Council was presented an historical review of the PFRA pasture transfers and resolved to defer any further action until a legal opinion is received and that this item remain on the action list. • Sept 14, 2015 – Committee presentation includes SARM’s update from the Ministry of Agriculture on the PFRA transitions and included the Federal Community Pasture Transition Schedule and Policy and the Agricultural Crown Land Sale to Lessee Policy. • Dec 7, 2015 – No legal opinion received to date. • Apr 18, 2016 – Council passed a motion “that correspondence be sent to the RM of Dundurn requesting a copy of the legal opinion regarding the PFRA Community Pastures Transitions and upon receipt of the legal opinion, Council determine their support regarding legal action.” • Apr 18, 2016 – Update received from SARM regarding their involvement with the PFRA transition. Administration completed the SARM feedback survey. • May, 2016 – Legal opinion received with an information item to follow at the June 20th Council meeting. Council passed the following motion: “that the residents of Merrill comes back to Council with a plan prior to December 31, 2015 to be reviewed by the R.M. to eradicate Leafy Spurge in the Hamlet of Merrill Hills and that the residents continue mowing within the Hamlet of Merrill Hills in the interim.” • Sept 21, 2015 – Councillor Rooke brought forward concerns regarding spraying of leafy spurge within 500m of the Organized Hamlet of Merrill Hills and Council passed the following motion: “That Administration consult with a government agency regarding safety aspects of spraying for leafy spurge with herbicides within the Hamlet of Merrill Hills and to clarify if it is the obligation of the R.M. to control or eradicate the noxious weed.” • Nov 7, 2015 – Administration has several attempts to confirm and have clarification of the information provided by Robert Martin, Regulatory Information Officer.

    Backgrounder Saskatchewan’s 2018‒19 federal Gas Tax Fund allocations The Government of Canada has delivered the first of two more than $30.9 million federal Gas Tax Fund (GTF) instalments to Saskatchewan for the 2018-19 fiscal year. The funding will flow through the provincial government to the following 749 communities on a per capita basis. In total, the GTF will provide Saskatchewan with over $61.9 million this fiscal year for local infrastructure projects. By the end of 2018-19, more than $665.8 million will have been provided to Saskatchewan through the federal Gas Tax Fund since the program was launched in 2005. An update on the RSC property and clubhouse Over the last year the land slumping at Last Mountain Lake has been a real cause for concern in the Resort Village of Saskatchewan Beach. In fact, at a Council meeting September 22, 2104, the village passed a resolution to declare a local emergency. Since then, the village has ceased using its community hall and extended the declaration of the local emergency – it is still in effect at time of publication. As you are probably well aware, the property rented by RSC was not spared. Evidence of the slumping land is plainly identifiable to even the untrained eye upon arriving at the RSC property. Examples include: ! The approach from the main drive to the clubhouse features ‘camel humps’ whereas it was more level in 2014 ! There are large cracks in the soil at the south east side of the property ! Trees on the east and west sides of the clubhouse have cracked trunks – they have split from the ground up as the root systems are pulled apart ! The lower deck had moved approx.
