Confirmation of Assessment Rolls This is an Order pursuant to clause 12(1)(p) of The Assessment Management Agency Act confirming the 2007 assessment roll for each municipality listed in Schedule 1, as at the date of each municipality’s 2007 assessment return. The Cities Act [section 43] ______

ALTERATION OF BOUNDARIES — BETWEEN THE city OF HUMBOLDT AND THE RURAL MUNICIPALITY OF HUMBOLDT NO. 370 ______

1 Pursuant to section 43 of The Cities Act, the Council of the City of Humboldt has submitted an application to alter its boundaries to the Minister of Municipal Affairs. 2 Upon consideration of the application, the Minister is of the opinion that the municipalities affected will be viable entities following the alteration of boundaries. Therefore, the undersigned hereby orders, pursuant to section 43 of The Cities Act, that: (a) the boundaries of the City of Humboldt and the Rural Municipality of Humboldt No. 370 be altered by withdrawing from the Rural Municipality of Humboldt No. 370 and adding to the City of Humboldt the territory described in Schedule A; (b) Schedule B is conclusively deemed to be the legal description of the boundary of the City of Humboldt; and (c) the alteration shall take effect on and from the date of this Order. Dated at the City of Regina, in the Province of Saskatchewan, the 28th day of January, 2009.

SCHEDULE A The boundaries of the City of Humboldt are altered by adding to the city and withdrawing from the Rural Municipality of Humboldt No. 370 territory lying within: Township 37, Range 22, West of the Second Meridian and described as:

(1) the north‑west quarter of Section 18; and Township 37, Range 23, West of the Second Meridian and described as: (1) the east half of Section 25 EXCEPTING that portion of the south‑east quarter of Section 25 lying between the northern limit of the road right‑of‑way shown on Plan No. 61H07723 and a parallel line drawn 110.642 metres north thereof. ______

SCHEDULE b The boundaries of the City of Humboldt shall comprise the territory in the Province of Saskatchewan lying within: Township 37, Range 22, West of the Second Meridian and described as: (1) the north‑west quarter of Section 18; (2) Sections 19 and 20; (3) that portion of the north‑west quarter of Section 21 lying north of the southern limit of the Canadian National Railways right‑of‑way shown on Plan No. G1295; (4) the south‑west quarter of Section 28; and (5) Sections 29 and 30; 236 THE SASKATCHEWAN GAZETTE, FEBRUARY 13, 2009

Township 37, Range 23, West of the Second Meridian and described as: (1) that portion of the north‑east quarter of Section 24 lying north of the northern limit of the Canadian National Railways right‑of‑way shown on Plan No. G1295, EXCEPTING Parcel C shown on Plan No. 65H08137; and (2) The east half of Section 25. Unless otherwise specified, the Sections and portions of Sections described in the above schedules include the adjoining south and west road allowances, intersections thereof and widenings thereto by plan of survey. For description purposes, the land acquired by plan of survey for widening to an adjoining road allowance is deemed to be part of the road allowance. The said plans of survey are of record with Information Services Corporation of Saskatchewan. ______

The Municipalities Act [sections 53, 56, 57, 59, 61, 62 and 63] ______

ALTERATION OF BOUNDARIES — BETWEEN THE TOWN OF SHELLBROOK AND THE RURAL MUNICIPALITY OF SHELLBROOK NO. 493 ______

1 Pursuant to sections 53, 56, 57, 59, and 61 of The Municipalities Act, the Council of the Town of Shellbrook has submitted an application to alter its boundaries to the Minister of Municipal Affairs. 2 Upon consideration of the application, the Minister is of the opinion that the municipalities affected will be viable entities following the alteration of boundaries. Therefore, the undersigned hereby orders, pursuant to sections 61, 62, and 63 of The Municipalities Act, that: (a) the boundaries of the Rural Municipality of Shellbrook No. 493 and the Town of Shellbrook be altered by withdrawing from the rural municipality and adding to the town the territory described in Schedule A; (b) Schedule B is conclusively deemed to be the legal description of the boundary of the Town of Shellbrook; and (c) the alteration shall take effect on and from the date of this Order. Dated at the City of Regina, in the Province of Saskatchewan, the 16th day of January, 2009.

The Saskatchewan chicken Marketing Plan, 1978 — Registered Producer ORDER 39/08. The Chicken Farmers of Saskatchewan, pursuant to the provisions of The Saskatchewan Chicken Marketing Plan, 1978, and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 In addition to section 2 – Interpretation, (o) “registered producer” the following shall further identify the definition of a registered producer: (a) any person who is licensed with the board and produces more than 999 chickens in a calendar year; (b) a “person” shall include an individual, corporation, co‑operative, trust and any other entity designated as a person under The Interpretation Act or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue of this person, and operating as a single economic unit. 2 Notwithstanding 1(b), the Board may, in its discretion, designate more than one registered producer to the definition of person. 3 All registered producers shall produce their base quota in a production unit owned by the registered producer. The board may give special allowance to registered producers to produce in production units owned by other registered producers through a lease agreement, however this would be considered a short term allowance and not extend for more than 12 months. If an allowance is given the Board may require further information at its discretion. 4 Registered producers shall own or lease the land on which their production unit is situated. The Board may request verification of land ownership or a copy of the existing land lease agreement with legal land locations. 5 No registered producer shall hold more than one license from the Board. Registered producers with multiple licenses will be required to amalgamate their licenses into one. 6 Notwithstanding any provision of any order or regulation, no individual shall be allowed to cast more than one vote during a board election or special election. Order No. 39/08 is made pursuant to clauses 2(o), 11(a) and section 30 of The Saskatchewan Chicken Marketing Plan, 1978, and shall be effective on, from and after the 6th day of November, 2008. BASE QUOTA LIMITS ORDER 40/08. The Chicken Farmers of Saskatchewan, pursuant to the provision of The Saskatchewan Chicken Marketing Plan, 1978, and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 No person, either directly or indirectly in any manner whatsoever including without limiting the generality of the fore going through an interest in a corporation, partnership, co‑operative or in any other manner including by agreement through a trust, through his or her spouse, siblings, parents or issue hold more than 6% of the total base quota allocated by the Board, unless such trust, spouse, siblings, parent or issue constitutes a separate economic unit. 2 (a) “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act or the Income Tax Act (Canada); (b) “interest” as used herein shall be determined by deeming a person to have full ownership of any corporation, partnership or co‑operative such person has ownership in, or any other contractual or other relationship such person is involved with. 3 No more than 8.0% of all base quota allocated by the Board may be produced at one production facility and premises. 4 For the purpose of sections 1 and 2, the amount of base quota shall be determined as follows: (a) the holding of base quota for a person is the sum of: (i) the base quota held by that person; and (ii) the full quota of any corporation, partnership, co‑operative or any other entity which a person has ownership interest in; and (iii) any base quota in which the person has an ownership interest as a lessee of quota; and 258 THE SASKATCHEWAN GAZETTE, FEBRUARY 13, 2009

(b) the holdings of a corporation, partnership, co‑operative or any other entity is the sum of: (i) the base quota held by that corporation, partnership, unincorporated organization or group of individuals; (ii) the full quota of any corporation, partnership, co‑operative or any other entity which a person has ownership interest in; and (iii) any base quota in which the corporation, partnership, co‑operative or any other entity has an ownership interest as a lessee of quota. 5 The Board shall not allocate, reallocate or approve the lease of any base quota, if, as a result of that allocation, reallocation or lease any person would hold quota in excess of that allowed pursuant to sections 5 to 9. Base Quota Reduction 6 Subject to section 9 of the Act, the Board may reduce, suspend, or cancel a base quota if the registered producer to whom it was allocated or the person to whom is has been leased: (a) has failed to observe, perform or carry out the provisions of the Act, these regulations or an order of the Board; or (b) is not utilizing or has voluntarily given up all or part of that producers base quota or portion leased; or (c) has not received the approval of the Board for any change of ownership interest in that producer if a base quota has been allocated or leased in the name of a company; or (d) has had his or her license cancelled or suspended. 7 Base quota that has been cancelled pursuant to section 7 shall be returned for auction in accordance with procedures described in an order of the Board. 8 No producer shall be compensated for any quota cancelled pursuant to section 7. 9 Quota that is allocated to a producer shall relate to and be attached to a particular production unit that is situated in Saskatchewan on a legally defined parcel of land registered at the Land Titles Office. 10 No producer or producers shall have more than one production unit on one legally defined parcel of land owned or leased or otherwise controlled by that producer or producers, without the written permission of the Board unless demonstrated to be a co-op or grouped production approved by the board. 11 Order No. 34/06 is hereby wholly revoked. Order No.40/08 is made pursuant to clause 14(w) and section 31 of The Saskatchewan Chicken Marketing Plan, 1978, and shall be effective on, from and after the 6th day of November, 2008. BASE QUOTA Leasing ORDER 41/08. The Chicken Farmers of Saskatchewan, pursuant to the provisions of The Saskatchewan Chicken Marketing Plan, 1978, and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 The Board may allow a registered producer to lease their base quota as provided herein to: (a) another registered producer who holds a license. 2 No subleasing of quota shall be permitted. 3 The board may allow a registered producer to lease up to a maximum allowable amount of 25% of such producers base quota. Compliance of this board order will be required by September 1, 2009 subject to the following exceptions by Board approval: (a) an “Act of God” that requires a registered producer’s production unit to be out of operation for a period of time. (b) a start up period of no longer than 5 production cycles to allow for new registered producers to build or acquire production units acceptable for production. 4 An application to lease must be made on the basis of kilograms of quota to be produced in a given production period. 5 An application to lease quota must: (a) be made in writing to the Board by the registered producer; and (b) be endorsed by the proposed lessee; and (c) include any other information that the Board requires; and (d) be in the Chicken Farmers of Saskatchewan office four (4) weeks prior to the lessees’ chick placement date. 6 If an authorization to lease is granted by the Board, the Board may make the authorization subject to those terms or conditions that the Board considers appropriate in the circumstances. 7 The registered producer and lessee are: (a) jointly responsible for reducing the marketing of chicken in accordance with these regulations; (b) jointly and severally liable for: (i) all service charges assessed pursuant to these regulations; (ii) all levies assessed pursuant to these regulations; and (iii) any judgement obtained in respect of service charges or levies assessed pursuant to this regulation. 8 If a lease is terminated and any reduction in the marketing of chicken imposed pursuant to these regulations are not completed, the remaining reductions in the marketing of chicken are the responsibility of: (a) the registered producer who leased the quota to the lessee; or (b) the lessee. 9 The Board shall not allow a lease of quota from a registered producer to a lessee if: (a) the registered producer has outstanding service charges or levies payable to the Board; (b) the proposed lessee would exceed the base quota limit established by these regulations. 10 Order No. 37/07 – Base Quota Leasing, of the Chicken Farmers of Saskatchewan is hereby wholly revoked. COMMUNAL GROUP PRODUCTION ALLOWANCE QUOTA ORDER 42/08. The Chicken Farmers of Saskatchewan, pursuant to the provisions of The Saskatchewan Chicken Marketing Plan, 1978, and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 A communal group may apply for an allocation of communal group production quota by filing a completed application form provided by the Board. A “communal group” shall be defined as persons living in a communal situation for such reasons as faith, lifestyle, or other valid reason and whose resources and income are shared in some manner other than by partnership or joint venture. 2 The Board may grant communal group production quota to an applicant if: (a) the communal group is not a registered producer with the Board; and (b) the communal group resides on adjacent to the same parcel of land on which the production facilities are located at which the chicken is produced. 3 Chicken produced under a communal group production quota must only be: (a) used by the communal group for personal use; and/or (b) marketed to consumers from: (i) the land referred to in clause 2(b); (ii) land that is adjacent to the land referred to in clause 2(b); or (iii) a stall at a farmers’ market. 4 An applicant for a communal group production quota must pay to the Board a service charge of $350 at the time of making the application for the quota, and thereafter the holder of the communal group production quota must pay to the Board an annual service charge of $350 by January 31 of each year. 5 If the annual service charge is not paid by January 31 in the year it is due, the Board may cancel the communal group production quota. 6 A communal group production quota holder must, report to the Board in writing the number of chicks so acquired within 2 weeks after the chicks are delivered to the holder. A copy of the invoice will be required. 7 A communal group production quota may not be sold, transferred, reallocated, leased or divided. 8 If the holder of a communal group production quota is granted an allocation or reallocation of an authorized quota, the communal group production quota is cancelled on that allocation or reallocation of the authorized quota. 9 A communal group production quota may be reduced or cancelled, either permanently or for such period as the Board considers appropriate, if a communal group quota holder: (a) produces in excess of 5000 chickens in any calendar year; (b) fails to comply with clause 3(b) when marketing any chicken; or (c) fails to report the information required by subsection 6. 10 Before the Board proceeds to amend this section, the Board must: (a) give written notice by ordinary mail to the communal group production quota holders of the proposed amendments; (b) hold a public meeting at which communal group production quota holders may make representations to the Board about the proposed amendments; and (c) prior to amending this section, consider the representations made. ANNEX 1 Proposed Business Plan for Communal Group Production (in conjunction with CFS Board Order 42/08) Description of Businesses Communal groups, including Hutterite Colonies, have been involved in the production of boiler chicken for many years. The intent of their business in the future is to raise and market roasting chicken in rural Saskatchewan to a niche market that has been established in its surrounding area. Background The Saskatchewan broiler industry has evolved substantially since the inception of the existing marketing board. Through the changing times, a majority of consumers have demanded smaller cuts of chicken, resulting in producers growing smaller birds. The wholesale market for larger, ‘roaster’ chickens has diminished to the point that Saskatchewan producers no longer grow this large sized bird. Although majority of the Saskatchewan consumer base enjoys smaller sized chicken, some individuals prefer a larger roasting bird. These birds are available in small quantities in the frozen section of some grocery stores but the availability of fresh roasters is limited. Marketing Production These communal groups will source their chicks from the Saskatchewan hatcheries and will be verifiable via established records. A large portion of communal groups raise their birds seasonally (usually 3 flocks a year) and have the chickens ready for sale, at the same time each year. Customers know that during these seasonal time periods these roaster chickens will be ready. A major portion of customers will have standing orders for a given number of roaster chickens to purchase. Some customs will be picked up via word of mouth and others at local events (including farmers markets). The size of the product that will be produced will be a heavier bird, 6.5 pounds and up. This product is a preferable size that customers have indicated that they will pay a premium for. Customers Most customers prefer to pick up chickens the same day they are butchered. For those that want them delivered, a time and place is scheduled and a refrigerated vehicle is used for deliveries. The customer base will be made up of 90% of repeat customers and will include homeowners, retired farming families and larger families who require larger portions of chicken meat. Plan Going Forward Some communal groups have raised and sold roasters chickens to an established customer base. This brand name has attracted existing and new customers with confidence in the product they will purchase. 262 THE SASKATCHEWAN GAZETTE, FEBRUARY 13, 2009

Communal group production facilities like Hutterite Colonies will able to supply this specialized, niche, market. Through CFS Board Order 42/08 these groups would be able to place on their farms up to 5,000 roaster chickens. This total amount would include production for their own communal use and to market to neighbours and local farmers markets. This method of direct marketing would be regulated through the board order and a set fee would be established by the CFS board. ______

The Commercial Egg Marketing Plan Regulations — START CLEAN-STAY CLEAN ™ ORDER 42/08. WHEREAS the purpose and objective of the Saskatchewan Egg Producers includes matters set out in section 4 of the Plan; AND WHEREAS the Board has the power to do those things set out in section 26 of the Plan; AND WHEREAS the Board has determined that it is in the best interests of the egg industry in Saskatchewan to adopt the Start Clean‑Stay Clean ™ program (SCSC) for the purposes of safety, health, and competitiveness in the industry; AND WHEREAS the Board has provided past and ongoing notice and advice to the producers regarding the SCSC program in Saskatchewan; THE SASKATCHEWAN EGG PRODUCERS Board, pursuant to the provisions of The Commercial Egg Marketing Plan Regulations and The Agri-Food Act, 2004 hereby determines and orders as follows: 1 All licensed egg producers must meaningfully participate in and maintain continuous participation in the Start Clean-Stay Clean ™ program. 2 All licensed egg production facilities must be rated at 90% under the Start Clean-Stay Clean™ program on their 2009 evaluation. 3 Any production facility failing to achieve a 90% score on their 2009 evaluation shall have 30 days from the date of that evaluation to develop and deliver to the office of the Saskatchewan Egg Producers a written plan that will be fully implemented within 6 months from the date of the evaluation that will raise their score to the required standard of 90%. 4 If the written plan is not fully implemented within the time period set out in Section 3, the producer will be penalized 20 cents per dozen on each dozen eggs marketed and:

1 (a) /2 of the penalty will be repaid to the producer within 30 days of the date that the Saskatchewan Egg Producers’ office is advised in writing that the score of 90% has been reached; and 1 (b) /2 of the penalty will be repaid within 30 days of the date that the Saskatchewan Egg Producers’ office is advised in writing that the production facility is Start Clean-Stay Clean ™ certified. 5 If the producer/production facility has not achieved the 90% score by December 31, 2010, the Board may suspend the producer’s licence, in accordance with The Agri-Food Act, 2004 and The Commercial Egg Marketing Plan Regulations. 6 All production facilities must achieve full Start Clean-Stay Clean ™ certification by December 31, 2010. 7 Any production facility failing to achieve certification by December 31, 2010, shall have until June 30, 2010 to achieve certification, after which they will be penalized 5 cents per dozen on their egg price, which will be refunded to them within 30 days of the date that the Saskatchewan Egg Producers’ office is advised in writing that certification has been achieved. WHEREAS the purpose and objective of the Saskatchewan Egg Producers includes matters set out in section 4 of the Plan; AND WHEREAS the Board has the power to do those things set out in section 26 of the Plan; AND WHEREAS the Board has determined that it is in the best interests of the egg industry in Saskatchewan to adopt Animal Care standards for the purposes of animal health, productivity, and competitiveness in the industry; AND WHEREAS the Board has provided past and ongoing notice and advice to the producers regarding the Animal Care program in Saskatchewan; THE SASKATCHEWAN EGG PRODUCERS Board, pursuant to the provisions of The Commercial Egg Marketing Plan Regulations and The Agri-Food Act, 2004 hereby determines and orders as follows: 1 No additional birds shall be placed in, housed in, or transferred to any production facility unless the production facility meets, and continues to meet the requirement of 67 square inches per bird for white birds and 75 square inches per bird for brown birds. 2 Any new construction of barns or any placement or replacement of cages shall be done to meet the 67"/75"requirements as set out in section 1. 3 Production facilities that have had cages installed after December 31, 2003: (a) that have a cage density below 64" square per bird must meet the 67"/75" requirements by December 31, 2010; (b) that have a cage density at or above 64" square per bird but below 67" square per bird must meet the 67"/75" requirements by December 31, 2012. 4 Production facilities that had cages installed before December 31, 2003 must meet the cage density requirement of 64 square inches per bird and 70 square inches per bird by December 31, 2012. 5 House averaging, as defined by the policy of the Saskatchewan Egg Producers Board, will be allowed until December 31, 2012. House averaging is calculated by: (a) multiplying the dimensions of the cage together to reach the square inch dimensions of the cage; then (b) dividing the square inches per cage by the square inches required per bird, to calculate the number of birds allowed per cage; then (c) multiplying that number (including decimals) by the number of cages. 6 Once a producer invests to ensure that their production facility meets the 67"/75" requirements, they will be grandfathered under any new provincial Animal Care programs adopted by the Board for 15 years from the date they achieved the 67"/75". 264 THE SASKATCHEWAN GAZETTE, FEBRUARY 13, 2009
