„JETIX“ Aktenzeichen: KEK 503 Beschluss in Der Rundfu Zulassungsantrag der Jetix Europe GmbH für das Fernsehspartenprogramm „JETIX“ Aktenzeichen: KEK 503 Beschluss In der Rundfunkangelegenheit der Jetix Europe GmbH, vertreten durch die Geschäftsführer Jürgen Hinz, Stefan Kas- tenmüller, Dene Stratton und Paul D. Taylor, Infanteriestraße 19/6, 80797 München, – Antragstellerin – w e g e n Zulassung zur bundesweiten Veranstaltung des Fernsehspartenprogramms „JETIX“ hat die Kommission zur Ermittlung der Konzentration im Medienbereich (KEK) auf Vorlagen der Bayerischen Landeszentrale für neue Medien (BLM) vom 02.06.2008 in der Sitzung am 19.08.2008 unter Mitwirkung ihrer Mitglieder Prof. Dr. Sjurts (Vorsitzende), Prof. Dr. Huber, Dr. Lübbert und Prof. Dr. Mailänder entschieden: Der von der Jetix Europe GmbH mit Schreiben vom 21.05.2008 bei der Bayeri- schen Landeszentrale für neue Medien (BLM) beantragten Zulassung zur Veran- staltung des bundesweit verbreiteten Fernsehspartenprogramms JETIX stehen Gründe der Sicherung der Meinungsvielfalt im Fernsehen nicht entgegen. 2 Begründung I Sachverhalt 1 Zulassungsantrag Die Antragstellerin hat mit Schreiben vom 21.05.2008 bei der BLM die Verlänge- rung der zum 30.09.2008 auslaufenden Zulassung für das Fernsehspartenpro- gramm JETIX um weitere acht Jahre beantragt. Die BLM hat der KEK den Antrag mit Schreiben vom 02.06.2008 zur medienkonzentrationsrechtlichen Prüfung vorge- legt. 2 Programmstruktur und -verbreitung 2.1 JETIX ist ein deutschsprachiges, digitales Spartenprogramm für Kinder mit dem Schwerpunkt auf Unterhaltung. Gesendet werden täglich von 06:00 bis 19:45 Uhr Action-, Humor- und Abenteuerformate. Die Zielgruppe sind Kinder im Alter zwi- schen 6 und 14 Jahren. 2.2 JETIX wird als Pay-TV-Angebot verschlüsselt und digital über die Programmplatt- form der Premiere Fernsehen GmbH & Co. KG („Premiere“) verbreitet. 2.3 Plattformvertrag mit Premiere XXX … 3 Antragstellerin und Beteiligte 3.1 Gegenstand der Antragstellerin ist nach deren Gesellschaftsvertrag, der nach An- gaben der Antragstellerin bis auf die Umfirmierung in Jetix Europe GmbH in der Fassung des Gesellschaftsvertrages der Fox Kids GmbH inhaltlich unverändert wei- terbesteht, die Produktion, das Betreiben und die Verwertung von Fernseh- und On- line-Kanälen sowie von Internet-Einrichtungen, Programmierungen und gewerbli- cher Rechtsschutz an Charakteren, die Durchführung von Geschäften der Vergnü- gungsindustrie jeder Art und der Kinder- und Familienunterhaltung durch sämtliche Medien, Ankauf, kommerzielle Verwertung und Veräußerung von geistigem und/oder gewerblichem Eigentum und damit verbundenen Rechten sowie das 3 Betreiben, die Führung oder Finanzierung von bzw. Beteiligung an anderen Unter- nehmen jeglicher Art (vgl. bereits Beschluss i. S. Fox Kids, Az.: KEK 076, I 4.1). 3.2 Tochterunternehmen der Jetix Europe GmbH veranstalten europaweit unter dem Markennamen JETIX entsprechende Kinderprogramme im Pay-TV, so in Großbri- tannien (vermarktet von BSkyB), den Niederlanden, Frankreich (im Rahmen des Canal-Satellite-Pakets), den skandinavischen Ländern, Polen, Spanien und in Ost- europa, und erreichen damit nach Angaben der Antragstellerin über 51 Mio. Haus- halte. 3.3 Die Antragstellerin ist eine Tochtergesellschaft der Jetix Europe Channels B.V. („Je- tix Europe“), Hilversum, Niederlande. Diese steht mittelbar über die Jetix Europe Properties S.à.r.l., Luxemburg, im Alleinbesitz der an der Amsterdamer Börse no- tierten Jetix Europe N.V., Hilversum, Niederlande. Über unmittelbare und mittelbare Beteiligungen hält die BVS Entertainment, Inc., Burbank, USA, 75,1 % der Anteile an der Jetix Europe N.V. Die übrigen Gesellschaftsanteile der Jetix Europe N.V. be- finden sich in Streubesitz. Alleingesellschafter der BVS Entertainment, Inc. ist über die ABC Worldwide Family, Inc., Los Angeles, USA, die Walt Disney Company. 3.4 Die Walt Disney Company („Walt Disney“) ist eine Publikumsgesellschaft mit breit gestreutem Aktienbesitz. Größter Einzelaktionär ist Apple-Gründer Steve Jobs mit einem Gesellschaftsanteil von rund 6 %. Der ehemalige Disney-CEO Eisner gilt mit etwa 1,7 % der Gesellschaftsanteile als zweitgrößter privater Anteilseigner. Dane- ben wird die Familie Disney als Einzelaktionär mit Anteilen um 5 % angegeben. Größere Einzelaktionäre sind daneben die Geschwister Sid Richardson, Lee Mars- hall und Perry Richardson Bass, die zusammen ungefähr 4 % der Anteile halten. Weitere Anteile werden von Investmentgesellschaften gehalten. Der Rest befindet sich in Streubesitz (vgl. Beschluss i. S. Disney Channel, Az.: KEK 420, I 3). Walt Disney ist neben JETIX an weiteren in Deutschland verbreitenden Fernseh- veranstaltern beteiligt. Über die Tochtergesellschaft Disney Enterprises, Inc. hält Walt Disney sämtliche Anteile an der The Walt Disney Company (Germany) GmbH, welche die Programme Disney Channel, Playhouse Disney und Toon Disney veranstaltet. Über die mittelbar 100%ige Tochtergesellschaft ABC Cable and International Broadcast Worldwide Holdings, Inc. ist Walt Disney mit 50 % am Kommanditkapital der Tele-München Fernseh GmbH & Co. Medienbeteiligung KG beteiligt, die wie- 4 derum zu 31,5 % an der RTL 2 Fernsehen GmbH & Co. KG beteiligt ist, der Ver- anstalterin des Programms RTL II . Über die Tochtergesellschaft BVI Television Investments, Inc. hält Walt Disney 50 % der Gesellschaftsanteile der RTL Disney Fernsehen GmbH & Co. KG, die das Programm Super RTL veranstaltet. Über die 100%ige Tochtergesellschaft Disney/ABC International Television, Inc. hält Walt Disney 37,5 % der Anteile an der A&E Television Networks (AETN), Delawa- re/USA, die wiederum über ihre Tochter AETN Germany Holding LL.C., New York/ USA, sämtliche Anteile an der The History Channel (Germany) Beteiligungs GmbH, Grünwald, hält. Diese ist mit 50 % der Anteile an der The History Channel (Germa- ny) GmbH & Co. KG *: zurzeit noch nicht auf Sendung Z: Zwischengesellschaften ausgeklammert 5 II Verfahren Die Vollständigkeitserklärung der Antragstellerin liegt vor. Einem Vertreter der BLM wurde Gelegenheit zur Stellungnahme gegeben. III Medienkonzentrationsrechtliche Beurteilung 1 Bestätigungsvorbehalt der KEK Nach § 20 Abs. 1 Satz 1 RStV bedürfen private Rundfunkveranstalter einer Zulas- sung. Fragestellungen der Sicherung der Meinungsvielfalt werden von der KEK nach Vorlage durch die zuständige Landesmedienanstalt gemäß § 37 Abs. 1 Satz 1 RStV beurteilt. 2 Zurechnung von Programmen 2.1 Der Antragstellerin ist das von ihr veranstaltete Programm JETIX gemäß § 28 Abs. 1 Satz 1, 1. Alt. RStV zuzurechnen. Das Programm ist über die unter Punkt I 3.3 aufgeführten Zwischengesellschaften auch Walt Disney zuzurechnen, § 28 Abs. 1 Satz 1, 2. Alt. RStV, Satz 2 i. V. m. §§ 15, 16 Abs. 1 AktG. 2.2 Zudem werden Walt Disney die Programme Disney Channel, Playhouse Disney , Toon Disney, Super RTL, The History Channel und The Biography Channel sowie das noch nicht auf Sendung befindliche Programm Crime & Investigation Network zugerechnet (vgl. Beschluss i. S. Disney Channel, Az.: KEK 420, III 2, zu- letzt Beschluss i. S. RTL II, Az.: KEK 451, III 2.4). Walt Disney wird aufgrund der gemeinsamen Beherrschung der Tele-München Fernseh GmbH & Co. Medienbetei- ligung KG durch ihr Tochterunternehmen ABC Cable and International Broadcast Worldwide Holdings, Inc. zusammen mit der Tele-München Fernseh-GmbH & Co. Produktionsgesellschaft auch das Programm RTL II zugerechnet, § 28 Abs. 1 Satz 2 und 4 RStV i. V. m. § 17 Abs. 1 AktG (vgl. bereits Beschluss i. S. RTL II, Az.: KEK 151, III 2.1.3). Die der Walt Disney zuzurechnenden Programme werden umgekehrt auch wieder sämtlichen Veranstaltern zugerechnet, arg. e §§ 28 Abs. 1 Satz 3, 29 Satz 2 RStV. 6 2.3 Keine Zurechnung zu Premiere XXX … Bei dieser Vertragsgestaltung ergeben sich keine Anhaltspunkte dafür, dass wesentliche Programmentscheidungen der Veranstalterin von der Zustimmung von Premiere abhängig wären. Folglich kommt eine Zurechnung des Programms JETIX gemäß § 28 Abs. 2 Satz 2 Nr. 2 RStV nicht in Betracht. 3 Vorherrschende Meinungsmacht 3.1 Zuschaueranteile 3.1.1 Mit Schreiben vom 12.08.2008 teilte die Veranstalterin für den Referenzzeitraum (Mai 2007 bis April 2008) für das Programm JETIX einen durchschnittlichen Zu- schaueranteil bei Zuschauern ab drei Jahren in Höhe von XXX … mit. JETIX wird über die Programmplattformen von Premiere und Premiere Star verbrei- tet. Bei dem mitgeteilten Zuschaueranteil für JETIX kann es sich nur um den soge- nannten internen Marktanteil aus der Premiere-Marktforschung handeln, der sich jedoch zu den Daten der

It contains 196 boxes of interviews, correspondence, original manuscripts, photos and comics from the 1920s to today. This was an amazing opportunity to obtain primary resources. !2 RESEARCH My most important primary resource was the phone interview I conducted with Stan Lee himself, now 92 years old. It was a rare opportunity that few people have had, and quite an honor! I use clips of Lee’s answers in my documentary.

(It does not include any children’s output on other commercial generalist non-terrestrial channels, such as GMTV,ABC1, Sky One.) • This output analysis examines the genre range within children’s programming and looks at how this range has changed since 2003. It is based on the BARB Children’s genre classification only and uses the BARB subgenres of Children’s Drama, Factual, Cartoons, Light entertainment/quizzes, Pre-school and Miscellaneous. • It is important to note that the BARB genre classifications have some drawbacks: – All programme output that is targeted at children is not classified as Children’s within BARB. Some shows targeted at younger viewers, either within children’s slots on the PSB main channels or on the dedicated children’s channels are not classified as Children’s. For example, Disney Channel’s That’s so raven is classified in BARB as ‘Entertainment Situation Comedy US’. This output analysis is not based on the total output of each specific children’s channel, e.g.

This study addresses this literature gap by analyzing depictions of religion in holiday specials aired in 2018 from three top preschool networks: Disney Junior, Nick Jr., and PBS Kids. Using qualitative content analysis, this study reveals that preschool holiday specials are shifting away from more in-depth portrayals of diverse religions toward commercialized, generalized, and secularized portrayals of Christmas. Although Chanukah and other non-Christmas religious holiday specials are, on average, older and less common than Christmas specials, they portray non-Christmas traditions in greater religious depth than the more recent and numerous Christmas specials portray Christmas.
