Perivale Police Pound Walmgate Road Perivale Middlesex UB6 7LR D6 (V3 MAR 2017) NOTICE TO OWNER / RELEASE PROCEDURE (SEIZED VEHICLE) OPENING HOURS - THE POUND IS OPEN 7 DAYS A WEEK, 365 DAYS A YEAR, BETWEEN 11.30 -19.30 HOURS IMPORTANT: THERE ARE NO PARKING OR TOILET FACILITIES AT THE POUND. YOU MUST COMPLY WITH THE LOCAL AUTHORITY PARKING RESTRICTIONS IN WALMGATE ROAD. THE RELEASE OF VEHICLES SEIZED UNDER 165A THE ROAD TRAFFIC ACT 1988 IS GOVERNED BY THE ROAD TRAFFIC ACT 1988 (RETENTION AND DISPOSAL OF SEIZED MOTOR VEHICLES) REGULATIONS 2005 (AMENDED 2008). THE VEHICLE DETAILED ON THE ACCOMPANYING NOTICE LETTER HAS BEEN SEIZED, BECAUSE A POLICE OFFICER HAD REASONABLE GROUNDS TO SUSPECT THAT THE DRIVER DID NOT HAVE VALID INSURANCE OR WAS DRIVING OTHERWISE THAN IN ACCORDANCE WITH THEIR LICENCE. THE REGISTERED KEEPER OR OWNER OF THE VEHICLE IS REQUIRED TO CLAIM THE VEHICLE FROM PERIVALE POLICE POUND IN PERSON, PRODUCE THE REQUIRED DOCUMENTS AND PAY THE STATUTORY STORAGE AND REMOVAL CHARGES. THIS MUST BE DONE WITHIN 7 WORKING DAYS FROM THE DATE OF SEIZURE (OR THE DATE OF SERVICE OF THE NOTICE ON THE OWNER OR REGISTERED KEEPER, IF NOT THE DRIVER AT THE TIME OF SEIZURE.) FAILURE TO DO SO WILL RESULT IN THE VEHICLE, AND ANYTHING CONTAINED IN THE VEHICLE, BEING DISPOSED OF ON THE FIFTEENTH DAY AFTER THE DATE OF SEIZURE. PROOF OF IDENTITY AND OWNERSHIP: TO RECLAIM THE VEHICLE (OR TO REMOVE PROPERTY), THE REGISTERED KEEPER OR OWNER MUST ATTEND THE POUND WITH PROOF OF IDENTITY AND OWNERSHIP. PROOF OF IDENTITY: AN ORIGINAL AND VERIFIABLE PHOTOGRAPHIC IDENTITY DOCUMENT (I.D.). A UK DRIVING LICENCE, PASSPORT OR EU NATIONAL IDENTITY CARD, HOME OFFICE ISSUED ID DOCUMENT OR A FREEDOM PASS. A NON-UK DRIVING LICENCE CANNOT BE ACCEPTED AS PROOF OF IDENTITY. NON- VERIFIABLE ITEMS SUCH AS STUDENT OR EMPLOYER'S ID WILL NOT BE ACCEPTED. THE FOLLOWING LEGAL REQUIREMENTS TO RECLAIM A SEIZED VEHICLE ARE NOT NEGOTIABLE. THE BURDEN OF PROOF TO SATISFY THE REQUIREMENTS FOR THE RELEASE OF THE VEHICLE RESTS WITH THE OWNER AND/OR REGISTERED KEEPER AND NOT WITH THE POLICE. 1. PROOF OF OWNERSHIP OF THE VEHICLE Registered Keepers a). Full V5C registration document (logbook). We do not accept copies; and b). Photographic I.D.* and proof of name and address that matches the V5C. (N.B. If the Registered Keeper cannot produce a full V5C, we require (i) a second document showing proof of name and address that match the details on the register and (ii) if the registered keeper was not driving at the time of seizure, the driver should attend with photo ID* to confirm ownership) New Keepers a). A recognisable bill of sale or receipt from a verifiable source, but please note that the vehicle may not be released if there is no verifiable link to the last registered keeper; and b). A correctly completed, unaltered and current V5C/2 (New Keeper Supplement - valid for 13 months); and c). Photographic I.D.* and at least two documents showing proof of address that match the V5C/2. 2. A VALID DRIVING LICENCE A valid driving licence granting entitlement to drive the vehicle. We do not accept photocopies. Learner motorcyclists must also produce a CBT certificate. A provisional licence holder must have L-plates for the vehicle and be supervised by someone over the age of 21 who has held their licence for 3 years or more. An EU licence (non-UK) must be produced together with another form of verifiable photo I.D. A non-EU driving licence must be produced with together a passport containing evidence of immigration status. We may also require an official translation or an International Drivers Permit to confirm driving entitlements. 3. A VALID CERTIFICATE OF INSURANCE A valid certificate of insurance covering the release of the vehicle. We do not accept photocopies. We will only accept verifiable faxes or emails. The policy may be invalid if material information has not been disclosed to the insurer. If there is any doubt, we may require confirmation from the relevant insurance company or the Motor Insurance Bureau of the validity of the policy. WARNING: Before attending you must check with your insurer that they will cover you to reclaim a vehicle that has been seized by a government authority. 4. PAYMENT OF CHARGES The statutory removal and storage charges are set by the Home Office. (See table below) THE VEHICLE WILL NOT BE RELEASED UNLESS THESE CHARGES ARE PAID. Payment is accepted by cash or credit/debit card only (NOT American Express). The cardholder must be present. We cannot accept card payments by telephone. MOT - If your vehicle does not have a current MOT test pass, it can only be driven to an MOT testing station. You should produce evidence of a pre-booked MOT test appointment or else arrange recovery at your expense. COLLECTION BY A NOMINATED THIRD PARTY The owner or registered keeper of the vehicle may nominate a third party to collect it on their behalf, but only after they have attended the car pound and satisfied their legal requirements for proof of ownership or registered keeper status. The nominated third party, if attending separately after the registered keeper, will need to bring a letter of authority and proof of signature (e.g. a passport or driving licence) from the owner or registered keeper who previously attended. PRIOR TO ATTENDING, THE THIRD PARTY SHOULD CHECK THAT THE INSURANCE POLICY IS VALID TO RELEASE THE SEIZED VEHICLE, IF THEY DO NOT OWN IT OR HAVE AN INSURABLE INTEREST IN IT. RECOVERY: You will be required to arrange recovery at your own expense if: * The vehicle is deemed unsafe or not roadworthy, or if it has been issued with a PG9 prohibition notice. * The vehicle will not start. PLEASE NOTE: WE DO NOT ALLOW ANY REPAIRS TO BE CARRIED OUT ON SITE. THIS INCLUDES CHANGING WHEELS, WINDSCREEN REPAIRS AND JUMP STARTING, IF THE BATTERY IS FLAT. ONLY A PROFESSIONAL RECOVERY OPERATOR WILL BE PERMITTED ON SITE. THEY MUST MEET THE POUND REQUIREMENTS AND SIGN A DECLARATION FORM. COMPLAINTS - If you wish to complain about the seizure of the vehicle, submit your complaint in writing to: ILP Team, VRES, 8th Floor East Empress State Building, Empress Approach, Lillie Road, Earls Court, SW6 1TR. DO NOT ATTEND THE EARLS COURT OFFICE IN PERSON - YOU WILL NOT BE SEEN. All other correspondence should be sent to the police pound. If you wish to dispute the offence, please follow the instructions which will be sent to you in due course. Please note that the procedure for disputing the offence is separate from that for disputing the seizure of the vehicle. The vehicle must be reclaimed within the specified time period and the charges must be paid. If your complaint is about the conduct of the Police Officer or member of Police Staff who dealt with you, further information on how to make a complaint can be found at your local police station, www.met.police.uk or www.ipcc.gov.uk. Complaints in this regard can only be about the conduct of the Officer or member of Police Staff and not about the power of seizure itself, where lawfully used.
