The District Municipality of Muskoka District Council Meeting 12(2017) Minutes The Council of The District Municipality of Muskoka met in the Council Chamber, District Administration Building at 7:00 p.m. on Monday, October 16, 2017. Present: District Chair J. Klinck and all other members of Council except P. Donaldson, R. Lacroix Officials Present: M. Duben, Chief Administrative Officer; J. Ross, Communications Officer Call to Order Chair Klinck called the meeting to order at 7:00 p.m. Acknowledgement of Supplementary Agenda Chair Klinck noted that there were no additional agenda items. Declaration of Pecuniary Interests None were declared. Oral Presentations (Deputations/Delegations) a) Janice Skot, President and Chief Executive Officer Royal Victoria Hospital Moved by S. Cairns and seconded by L. Braid P141/2017 THAT the request by Janice Skot for leave to make a delegation/deputation with respect to the Royal Victoria Hospital Foundation be granted. Carried. Ms. Skot highlighted the RVH digital presentation thanking Council for its continued financial support of the Simcoe Muskoka Regional Cancer Centre. She also commended Councillor Braid on the Township’s fundraising efforts with proceeds going to RVH through the Mayor’s golf tournament this year and the powerful brochure that the Township had produced to promote the tournament. The consultants confirmed that they did not have the time to formulate their own data to support what constituted a seasonal resident due to time constraints adding that the gold standard in determining population is the Canadian Census. In the consultants’ opinion, the Municipal Act and Municipal Elections Act informed their recommendation to utilize the voters’ list for calculating seasonal population. Several Councillors disagreed with this concept as the voters’ list does not account for all men, women and children, just the residence owner or tenant and spouse. The consultants further added that the estimate of the seasonal population produced through the Second Home Study may not be accurate or valid enough to be used for the purposes of determining representation on District Council; and therefore, they did not recommend any model using the Second Home Study population figures without further study. Some Councillors voiced concerns with the proposed reduction to two Councillors representing the smaller Townships (Georgian Bay and Lake of Bays) as this would force Councillors to do even more work than is currently undertaken by three Councillors; which is currently one less than the other Muskoka municipalities (at four each). Cooper and seconded by A. Edwards P143/2017 THAT the request by Meredith Cartwright for leave to make a delegation/deputation with respect to the Council Composition Review be granted. Carried. Ms. Cartwright advised that the Water Alliance Muskoka is a not-for-profit organization that advocates for the environment and particularly flood management as the province is looking to offload environmental duties to municipalities. She felt that the charter values and human rights are diminished in Muskoka through the District’s continued attempt to define “second home residency” in ways that are arbitrary, unreasonable and intrusive and that the Second Home Study is an example of this. She felt that all home owners, rent paying tenants and members of their households should all be considered residents of Muskoka and votes should count equally; and that by not calling a resident, a resident, diminishes their democratic rights. In closing, Ms. Cartwright suggested that major policy decisions such as the current review of the Muskoka Official Plan be deferred until the council composition review is completed. Council took a brief recess at 8:51 p.m. and reconvened at 9:00 p.m. Councillor Cooper left the meeting during the recess. Committee Reports a) Engineering & Public Works – PW-9-2017 – September 20, 2017 i) Review of Minutes for Correctness Councillor Harding advised that some Councillors that were in attendance at the meeting were not noted within the minutes. The Clerk advised that the minutes would reflect the correction. ii) Committee Report Councillor Harding highlighted the minutes of the September 20, 2017 meeting of the Engineering & Public Works Committee. Moved by P. Harding and seconded by P. Kelly P144/2017 THAT all recommendations contained in the minutes of the Engineering & Public Works Committee meeting PW-9-2017 held on September 20, 2017 be adopted. Carried. b) Community Services – CS-9-2017 – September 20, 2017 i) Review of Minutes for Correctness No errors or omissions. ii) Committee Report Councillor Terziano highlighted the minutes of the September 20, 2017 meeting of the Community Services Committee. Moved by K. Terziano and seconded by D. Smith P145/2017 THAT all recommendations contained in the minutes of the Community Services Committee meeting CS-9- 2017 held on September 20, 2017 be adopted. Carried. c) Planning & Economic Development – PED-11-2017 – September 13, 2017 These public meeting minutes are provided for information. d) Planning & Economic Development – PED-12-2017 – September 21, 2017 i) Review of Minutes for Correctness No errors or omissions. ii) Committee Report Councillor Edwards highlighted the minutes of the September 21, 2017 meeting of the Planning & Economic Development Committee. Moved by A. Edwards and seconded by D. Furniss P146/2017 THAT the recommendation contained in the minutes of the Planning & Economic Development Committee meeting PED-12-2017 held on September 21, 2017 be adopted. Carried. e) Corporate & Emergency Services – CES-10-2017 – September 18, 2017 i) Review of Minutes for Correctness No errors or omissions. ii) Committee Report Councillor Aitchison highlighted the minutes of the September 18, 2017 meeting of the Corporate & Emergency Services Committee. Moved by S. Aitchison and seconded by S. Baker P147/2017 THAT all recommendations contained in the minutes of the Corporate & Emergency Services Committee meeting CES-10-2017 held on September 18, 2017 be adopted. Carried. f) Council Composition Review – CCR-1-2017 – September 21, 2017 i) Review of Minutes for Correctness No errors or omissions. ii) Committee Report Councillor Young highlighted the minutes of the September 21, 2017 meeting of the Council Composition Review Committee. There were no recommendations from the CCR-1-2017 meeting for Council’s consideration. g) Council Composition Review – CCR-2-2017 – October 5, 2017 i) Review of Minutes for Correctness No errors or omissions. ii) Committee Report Councillor Young highlighted the minutes of the October 5, 2017 meeting of the Council Composition Review Committee. There were no recommendations from the CCR-2-2017 meeting for Council’s consideration. Correspondence/Written Submissions – All correspondence listed is a matter of public record.
