I, Justin McLean, declare as follows:

1. I am a Managing Principal of Analysis Group, Inc., a consulting firm specializing in

microeconomic, financial and accounting analysis. I assisted in the preparation of the

previously submitted Expert Report of Dr. Saha dated April 19, 2004, Expert Rebuttal

Report of Dr. Saha dated June 11, 2004, (collectively, the “Saha Reports”) and

Opposition to Defendants’ Motion for Remittitur Under 59(e) (“2005 Remittitur”)

executed by Dr. Saha on July 6, 2005.1 I am thus very familiar with the methodology

used by Dr. Saha in calculating the damages set forth in the Saha Reports, as well as the

methodology used to calculate the 2005 Remittitur. I also provided deposition testimony

on May 14, 2005 regarding data, programming, and damages calculation issues related to

the Saha Reports.

2. On June 29, 2011; July 28, 2011; August 4, 2011; and June 19, 2012, I filed Declarations

that identified the specific damages claimed in the Saha Reports and presented at trial for

certain self-funded customers. In this Declaration, I have been asked by Counsel for the

Plaintiffs to identify the specific damages claimed in the Saha Reports and presented at

trial for the self-funded customers as set forth in Exhibits 1 through 3. The specific self-

funded customers for whom I have been asked to calculate damages include some self-

funded customers contained in my previous Declarations as well as certain additional

self-funded customers.

3. The data used in my Declarations for these remittitur calculations is the same Plaintiffs’

claims data used in the Saha Reports and 2005 Remittitur. This data, which includes

information on group numbers, prescriptions, expenditures, copayments, dispensing fees,

coinsurance, deductibles and sales tax has remained resident on Analysis Group computer

servers since its production by Counsel and use under Dr. Saha’s direction in the Saha

Reports and 2005 Remittitur. Additionally, my testimony of May 14, 2005 addressed, in

part, the computer program embodying the Saha Reports methodology.

4. The damages methodology applied in the Saha Reports presented aggregate damages

figures based on data provided by Plaintiffs for reimbursement claims. These claims

were associated with various group numbers that included premium accounts as well as

self-funded accounts for BCBS Massachusetts, BCBS Minnesota, and HCSC (BCBS

Texas).2 Here, I have been asked to analyze the damages for selected self-funded

customers. This customer-based damages calculation is consistent with the methodology

contained in the Saha Reports and identical to the methodology contained in the 2005

Remittitur.

5. I have been provided the customer names and associated group numbers on which to

perform these calculations by Counsel. Accordingly, I have re-calculated the Saha

Report damages figures presented at trial on a customer-by-customer basis for the self-

funded customers listed on these exhibits. I present the results of these calculations for

the specified self-funded customers for BCBS Massachusetts in Exhibit 1, for BCBS

Minnesota in Exhibit 2, and for HCSC (BCBS Texas) in Exhibit 3.

Justin McLean, a Managing Principal at Analysis Group in the Washington office, specializes in applying finance and economics to problems in complex business litigation. He has served as an expert witness, and has provided assistance in many phases of litigation, including development, presentation and review of pretrial discovery; preparation of testimony; and critique of analyses of opposing experts. Mr. McLean’s recent case work has included business valuation, intellectual property and general damages analyses, and evaluation of fiduciary duties and investment management.

Mr. McLean received an M.S. in Industrial Administration (concentrating in Finance, Accounting and Entrepreneurship) with University Honors from Carnegie Mellon’s business school. He received a B.A. in Economics from Swarthmore College.

Prior to joining Analysis Group, Mr. McLean was an Analyst for Putnam, Hayes & Bartlett, Inc. He has also worked with entrepreneurial companies, helping to develop financial projections, business plans, and marketing strategies.
