    — — — — — — — — — — — — — — — — — — — — — — — — — — “They Punish Murderers, Thieves, Traitors and Sorcerers”: Aboriginal Criminal Justice as Reported by Early French Observers DESMOND H. BROWN* A common theme in the writings of European explorers, historians, and religious emissaries who were among the first to comment on the inhabitants of the western hemisphere was the absence in Aboriginal society of any concept of law. In some cases these early commentators may not have interpreted what they saw correctly, and they used French words with specific legal definitions that were not relevant in the context of the behaviour they attempted to describe. Evidence from their writ- ings, especially those of the Jesuits, shows that there was in fact law among the Native peoples of the northeast, and particularly criminal law, albeit of a different kind and process than French law. In France, with retribution or deterrence as the objective of the judicial system, the individual alone was responsible for his or her actions and suffered punishment accordingly. In contrast, apart from cases of sor- cery or betrayal, which were punishable by death, Aboriginal justice sought to restore social cohesion and harmony among the group by restitution, which was a collective responsibility. Yet, these terms were anything but fixed, certain or uncomplicated to contemporaries. This dissertation takes as its subject the exercise of authority in New France through proprietorships and companies to get to the political, legal, and ideological heart of French empire building. Organized chronologically, each chapter corresponds to a different constellation of authority, ranging from a proprietorship in which the titleholder subdelegated his trading privileges and administrative authority to two separate parties to a commercial company that managed both jurisdictions. Engaging with cutting-edge international literature on sovereignty, empire formation, and early modern state building, this thesis resituates the story of the colonization of French North America in an Atlantic framework. It relies partly on civil suits that arose in France during the first three decades of the seventeenth century over powers and privileges in New France. This frequent litigation has traditionally been ignored by historians of New France; however, my research suggests that it was an integral part of the process of ii colonization.

Dionne The Makers Of Canada: Champlain CHAPTER I CHAMPLAIN'S FIRST VOYAGE TO AMERICA SAMUEL CHAMPLAIN, the issue of the marriage of Antoine Champlain and Marguerite Le Roy, was born at Brouage, now Hiers Brouage, a small village in the province of Saintonge, France, in the year 1570, or according to the Biographie Saintongeoise in 1567. His parents belonged to the Catholic religion, as their first names would seem to indicate. When quite young Samuel Champlain was entrusted to the care of the parish priest, who imparted to him the elements of education and instilled his mind with religious principles. His youth appears to have glided quietly away, spent for the most part with his family, and in assisting his father, who was a mariner, in his wanderings upon the sea. The knowledge thus obtained was of great service to him, for after a while he became not only conversant with the life of a mariner, but also with the science of geography and of astronomy. When Samuel Champlain was about twenty years of age, he tendered his services to Marshal d'Aumont, one of the chief commanders of the Catholic army in its expedition against the Huguenots. When the League had done its work and the army was disbanded in 1598, Champlain returned to Brouage, and sought a favourable opportunity to advance his fortune in a manner more agreeable, if possible, to his tastes, and more compatible with his abilities. In the meantime Champlain did not remain idle, for he resolved to find the means of making a voyage to Spain in order "to acquire and cultivate acquaintance, and make a true report to His Majesty (Henry IV) of the particularities which could not be known to any Frenchmen, for the reason that they have not free access there." He left Blavet at the beginning of the month of August, and ten days after he arrived near Cape Finisterre.

Wachtel 2013 Abstract My dissertation connects the Jesuit missions in Canada to the global Jesuit missionary project in the late sixteenth and early seventeenth centuries by exploring the impact of French religious politics on the organizing of the first Canadian mission, established at Port Royal, Acadia, in 1611. After the Wars of Religion, Gallican Catholics blamed the Society for the violence between French Catholics and Protestants, portraying Jesuits as underhanded usurpers of royal authority in the name of the Pope—even accusing the priests of advocating regicide. As a result, both Port Royal’s settlers and its proprietor, Jean de Poutrincourt, never trusted the missionaries, and the mission collapsed within two years. After Virginia pirates destroyed Port Royal, Poutrincourt drew upon popular anti- Jesuit stereotypes to blame the Jesuits for conspiring with the English. Father Pierre Biard, one of the missionaries, responded with his 1616 Relation de la Nouvelle France, which described Port Royal’s Indians and narrated the Jesuits’ adventures in North America, but served primarily as a defense of their enterprise. Religio-political infighting profoundly influenced the interaction between Indians and Europeans in the earliest years of Canadian settlement.

    Les Récollets au Québec 1 Les Récollets ont été présents au Québec de 1615 à 1629 et de 1670 à 1849. Au début des années 1970, l’histoire de ces missionnaires se résumait, dans les manuels d’histoire du Québec, à la seule mention de leur venue en Nouvelle-France en 1615 et au fait qu’il s’agissait de la première communauté religieuse en terre québécoise. Aucune explication n’était fournie pour justifier le moment de leur arrivée et le choix de la communauté elle- même. D’ailleurs, aucune synthèse de l’œuvre des Récollets n’a été réalisée à ce jour. Notre exposé vise à répondre aux questions suivantes : qui sont les Récollets et pourquoi ne sont-ils apparus dans le paysage de Québec qu’en 1615, soit sept ans après la fondation de Québec? À ces considérations, nous présenterons les faits historiques liés aux principaux établissements des Récollets en Nouvelle-France, plus spécifiquement à Québec, à Trois-Rivières et à Montréal. Nous nous attarderons aux bâtiments conventuels qui constituent autant de lieux d’établissements de la communauté. Nous conclurons cette présentation avec un court bilan du patrimoine laissé par les Récollets, sur le plan de l’architecture et des écrits. Les Récollets sont constitués en ordre dès la fin du XV e siècle; ils sont issus d’une branche réformée de la communauté des Franciscains créée en 1209 par François d’Assise. En 1897, le pape Léon XIII met fin à la communauté des Récollets en les intégrant à l’ordre des Frères mineurs, appellation officielle des Franciscains.

This work was reprinted in 1620 and 1627 with variants of uncertain origin and reliability. In 1632, republished with variants in 1640, the account was substantially repeated in a composite historical summary covering the period 1603 to 1629, "Les Voyages de la Nouvelle France occidentale, dicte canada, faits par Ie Sf: de Champlain ..", Paris 1632, supposedly the work of Champlain at least in part (J. Home Cameron (in) Champlain III:xi-xii, IV:viii). The controversy as to the authorship of the variants, changes, and side-notes, and the motive for them, particularly the deletion of references to the Recollets from the 1632 work, is yet unresolved, but need not be investigated here. It is sufficient that Champlain unexpectedly spent the whole of the year 1619 in France, and "During this enforced leisure" (Trudel 1966:194) he there wrote his "Voyages ...", for the period 1615 to 1618, and saw the book published in 1619 while he was still there (Figure 1).

    Dan Mathis 4/22/2015 "Les robes noires et les pères récollets: Jesuit and Franciscan Missionary Competition in Early New France" Introduction In 1615, four Récollet friars embarked from the French port of Honfleur in high spirits for their journey to New France. Their ambitious goal, as their Spanish Franciscan brothers had done before them, was to be the first to carry the word of God and plant the cross of the Catholic Church in the New World colonies of their patron kingdom. France was a country still recovering from the fires of religious war that engulfed the 16th century, and the Récollet's reformed order emerged as one of several groups determined to spread and solidify the authority and influence of Catholicism, even in an era of relative toleration after the Edict of Nantes. The prospective missionaries had this duty in mind as they boarded the St. Etienne. On May 25, 1615, Joseph Le Caron, Jean Dolbeau, Denis Jamet, and Pacifique du Plessis landed at the trading post of Tadoussac to begin their missionary work with all the "zeal and charity as great as the universe."1 They had the support of Samuel de Champlain. They had enjoyed the close royal support and patronage of Henri IV and the successive regency under Marie de Medici. They had been given express papal permission to spread French Catholicism to the Native Americans. They established their missionary work with every sense of optimism and with seemingly every political advantage.     JOSEPH LE CARON (1586 – 1632) Joseph Le Caron, missionnaire Récollet, qui célébra la première messe du Québec, est mort de la peste de 1632 au couvent Sainte Marguerite de Trie dont il était le supérieur ; C’est donc à ce titre que lui est consacrée cette petite biographie sur le site de la commune de Trie-Château. Les origines : Né près de Paris en 1586, fils de Louis Le Caron, valet de chambre du roi, il est baptisé sous le prénom de Claude. Il est ordonné prêtre à Paris le 22 décembre 1607. Par sa naissance, mais aussi par ses connaissances et ses mérites personnels, il jouie d’un certain crédit à la cour et devient précepteur du « petit prince sans nom » car non officiellement baptisé, « Monsieur d’Orléans ». Petit prince auquel cependant les historiens ont donné le nom de Nicolas, qui décédera à l’âge de 4 ans en 1611. Enfant attachant, fortement handicapé à qui Le Caron a apporté tout son dévouement. De par cette position il lui arrive de donner des leçons de catéchisme à son frère, le futur roi de France, Louis XIII, son ainé de 6 ans. « Il avait eu l’honneur, étant au monde, d’enseigner au jeune roi Louis XIII les premiers rudiments de la foi» commente Gabriel Sagard également frère missionnaire en pays Hurons en 1623 et premier historien religieux du Canada . A la mort précoce du prince de France, il fait sa profession et rejoint les Récollets en 1611. HANNAN, M.A. Location Old Huronia,1 the country of the Hurons, is the section of hilly land enclosed by Matchedash Bay, Nottawasaga Bay, and Lake Simcoe. Its area is about 800 square miles, within the townships of Tiny, Tay, Medonte, and Oro of Simcoe County.2 The Indian name for this land was Wendake, and its people were the Wendot or Wyandottes. The French coined the name, Huron,3 as a nickname. It was suggested by the manner in which the first party of the tribe that they met dressed their hair, in ridges, ‘hures’, which reminded them of the head of a boar. At the time of Jacques Cartier’s first voyage to Canada, the Huron-Iroquois nation appears to have inhabited the valley of the Upper St. Lawrence,4 but the known history of Huronia begins with the early 17th century after Fr.
