Aboriginal Criminal Justice As Reported by Early French Observers

BROWN* A common theme in the writings of European explorers, historians, and religious emissaries who were among the first to comment on the inhabitants of the western hemisphere was the absence in Aboriginal society of any concept of law. In some cases these early commentators may not have interpreted what they saw correctly, and they used French words with specific legal definitions that were not relevant in the context of the behaviour they attempted to describe. Evidence from their writ- ings, especially those of the Jesuits, shows that there was in fact law among the Native peoples of the northeast, and particularly criminal law, albeit of a different kind and process than French law. In France, with retribution or deterrence as the objective of the judicial system, the individual alone was responsible for his or her actions and suffered punishment accordingly. In contrast, apart from cases of sor- cery or betrayal, which were punishable by death, Aboriginal justice sought to restore social cohesion and harmony among the group by restitution, which was a collective responsibility. Yet, these terms were anything but fixed, certain or uncomplicated to contemporaries. This dissertation takes as its subject the exercise of authority in New France through proprietorships and companies to get to the political, legal, and ideological heart of French empire building. Organized chronologically, each chapter corresponds to a different constellation of authority, ranging from a proprietorship in which the titleholder subdelegated his trading privileges and administrative authority to two separate parties to a commercial company that managed both jurisdictions. Engaging with cutting-edge international literature on sovereignty, empire formation, and early modern state building, this thesis resituates the story of the colonization of French North America in an Atlantic framework. It relies partly on civil suits that arose in France during the first three decades of the seventeenth century over powers and privileges in New France. This frequent litigation has traditionally been ignored by historians of New France; however, my research suggests that it was an integral part of the process of ii colonization. -

Wachtel 2013 Abstract My dissertation connects the Jesuit missions in Canada to the global Jesuit missionary project in the late sixteenth and early seventeenth centuries by exploring the impact of French religious politics on the organizing of the first Canadian mission, established at Port Royal, Acadia, in 1611. After the Wars of Religion, Gallican Catholics blamed the Society for the violence between French Catholics and Protestants, portraying Jesuits as underhanded usurpers of royal authority in the name of the Pope—even accusing the priests of advocating regicide. As a result, both Port Royal’s settlers and its proprietor, Jean de Poutrincourt, never trusted the missionaries, and the mission collapsed within two years. After Virginia pirates destroyed Port Royal, Poutrincourt drew upon popular anti- Jesuit stereotypes to blame the Jesuits for conspiring with the English. Father Pierre Biard, one of the missionaries, responded with his 1616 Relation de la Nouvelle France, which described Port Royal’s Indians and narrated the Jesuits’ adventures in North America, but served primarily as a defense of their enterprise. Religio-political infighting profoundly influenced the interaction between Indians and Europeans in the earliest years of Canadian settlement. -

Les Nouveaux Mondes juridiques is nothing if not ambitious. Interdisciplinary to the core, geographically expansive, and eager to flout standards of periodization, this collection takes its readers on a tour through connections between law and literature in an age when legal pluralism swept into and transformed the European political imagination. Early encounters with indigenous American societies, of course, triggered the greatest outburst of thought and theorizing about alternative forms of government, the meaning of life under natural law, just war doctrine in a world of hard-to-interpret legal systems, and the juridical status of non-Christians. But, as Lombart’s book demonstrates, these sixteenth-century reflections were rooted in medieval encounters with Islam and the mysterious civilizations of Asia and the Indian Ocean world. Beginning in the late eleventh century with the foundation of Outremer on the eastern shores of the Mediterranean, the problem of legal pluralism not only informed specific strains of European writing on matters juridical, anthropological, and religious, it also formed “une matrice dans la production du texte (qu’il soit ou non de fiction)” (p. 9). In other words, debates over law in an expanding world transcended the particular to shape multiple medieval and early modern genres and modes of thought. -

Les Récollets Au Québec 1
Les Récollets au Québec 1 Les Récollets ont été présents au Québec de 1615 à 1629 et de 1670 à 1849. Au début des années 1970, l’histoire de ces missionnaires se résumait, dans les manuels d’histoire du Québec, à la seule mention de leur venue en Nouvelle-France en 1615 et au fait qu’il s’agissait de la première communauté religieuse en terre québécoise. Aucune explication n’était fournie pour justifier le moment de leur arrivée et le choix de la communauté elle- même. D’ailleurs, aucune synthèse de l’œuvre des Récollets n’a été réalisée à ce jour. Notre exposé vise à répondre aux questions suivantes : qui sont les Récollets et pourquoi ne sont-ils apparus dans le paysage de Québec qu’en 1615, soit sept ans après la fondation de Québec? À ces considérations, nous présenterons les faits historiques liés aux principaux établissements des Récollets en Nouvelle-France, plus spécifiquement à Québec, à Trois-Rivières et à Montréal. Nous nous attarderons aux bâtiments conventuels qui constituent autant de lieux d’établissements de la communauté. Nous conclurons cette présentation avec un court bilan du patrimoine laissé par les Récollets, sur le plan de l’architecture et des écrits. Les Récollets sont constitués en ordre dès la fin du XV e siècle; ils sont issus d’une branche réformée de la communauté des Franciscains créée en 1209 par François d’Assise. En 1897, le pape Léon XIII met fin à la communauté des Récollets en les intégrant à l’ordre des Frères mineurs, appellation officielle des Franciscains. -

This work was reprinted in 1620 and 1627 with variants of uncertain origin and reliability. In 1632, republished with variants in 1640, the account was substantially repeated in a composite historical summary covering the period 1603 to 1629, "Les Voyages de la Nouvelle France occidentale, dicte canada, faits par Ie Sf: de Champlain ..", Paris 1632, supposedly the work of Champlain at least in part (J. Home Cameron (in) Champlain III:xi-xii, IV:viii). The controversy as to the authorship of the variants, changes, and side-notes, and the motive for them, particularly the deletion of references to the Recollets from the 1632 work, is yet unresolved, but need not be investigated here. It is sufficient that Champlain unexpectedly spent the whole of the year 1619 in France, and "During this enforced leisure" (Trudel 1966:194) he there wrote his "Voyages ...", for the period 1615 to 1618, and saw the book published in 1619 while he was still there (Figure 1).
