Dear Mr. Robinson:

Enclosed are the results of a wetland delineation conducted on the above referenced propefi. Fieldwork was conducted on January 23, 2AL4 by Enviro-Utilities, tnc. (EU) using the Routine Determination Method as outlined in the 7987 Corps of Engineers Wetlond Delineotion Manuol. Wetlands and Waters of the US were found on the subject property and flagged. ln addition, the flags were lo\ated using a sub-meter GPS system. The autocadfile containing the wetlands boundary was embiled to you on January 27,2014 under separate cover.

Pertinent data was extracted from several information sources in an effort to expedite the onsite investigation. The USGS Topographic Quadrangle Map for Dinwiddie County, VA was used to locate the site and identify drainage patterns. Additionally, the 5o/ Survey of Chesterfield County, V4 indicates that this property is underlain primarily by uplands, non- hydric soils. The field evaluation conducted confirmed the soils map. A "Routine Onsite Determination" was performed along the defined topographic drainage ways. l Areas subject to jurisdiction by the U.S. Army Corps of Engineers (USACOE) and the Virginia Department of Environmental euality (VDEQ do exist within the property limits. please note that if impacts are proposed within the jurisdictional areas identified during the wetlands delineation, a permit or permits may be required from the regulatory agencies. lf you have any further questions on this matter, ptease don't hesitate to contact me.

Enviro-Utilities, Inc. is pleased to inform you that the threatened and endangered species and cultural resource reviews have been completed for the above referenced project.

A review of cultural resources was completed on January 29, 2014 using the Virginia Cultural Resource Information System. The completed project review was submitted electronically to the Department of Historic Resources (DHR) Office of Review and Compliance on January 30, 2014, which initiated the 30 day review period. A total of zero (0) archaeological records were returned within a 0.5 mile radius of the project location. A total of fourteen (14) architectural records were found within the 0.5 mile radius. Of the 14, one record is located within the project location, but is not of concern as it is the existing Dinwiddie County Health Department building. The remaining sites are located within the buffer and will not be impacted by future development of the Government Center.

A review of threatened and endangered species was completed on January 30, 2014 using the U.S. Fish and Wildlife Service (Service) Project Reviews in Virginia protocol, the Virginia Department of Game and Inland Fisheries Fish and Wildlife Information Service database and the Virginia Department of Conservation and Recreation Natural Heritage database. The completed project review was submitted electronically to the Service on January 30, 2014, which initiated the 30 day review period. A total of six (6) protected species were identified within the project location; 4 fish species and 1 bird species. Due to the intermittent characterization of the on-site streams and the nature of the forest vegetation, we do not believe that any protected species will be affected by future development of the Government Center.

The enclosed species list identifies threatened, endangered, proposed and candidate species, as well as proposed and final designated critical habitat, that may occur within the boundary of your proposed project and/or may be affected by your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended (16 U.S.C. 1531 et seq. ).

New information based on updated surveys, changes in the abundance and distribution of species, changed habitat conditions, or other factors could change this list. Please feel free to contact us if you need more current information or assistance regarding the potential impacts to federally proposed, listed, and candidate species and federally designated and proposed critical habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the Act, the accuracy of this species list should be verified after 90 days. This verification can be completed formally or informally as desired. The Service recommends that verification be completed by visiting the ECOS-IPaC website at regular intervals during project planning and implementation for updates to species lists and information. An updated list may be requested through the ECOS-IPaC system by completing the same process used to receive the enclosed list.

The purpose of the Act is to provide a means whereby threatened and endangered species and the ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2) of the Act and its implementing regulations (50 CFR 402 et seq. ), Federal agencies are required to utilize their authorities to carry out programs for the conservation of threatened and endangered species and to determine whether projects may affect threatened and endangered species and/or designated critical habitat.

A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). For projects other than major construction activities, the Service suggests that a biological evaluation similar to a Biological Assessment be prepared to determine whether the project may affect listed or proposed species and/or designated or proposed critical habitat. Recommended contents of a Biological Assessment are described at 50 CFR 402.12.

If a Federal agency determines, based on the Biological Assessment or biological evaluation, that listed species and/or designated critical habitat may be affected by the proposed project, the agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service recommends that candidate species, proposed species and proposed critical habitat be addressed within the consultation. Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle Protection Act (16 U.S.C. 668 et seq. ), and projects affecting these species may require development of an eagle conservation plan (http://www.fws.gov/windenergy/eagle_guidance.html). Additionally, wind energy projects should follow the wind energy guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and bats.

General Occurrence Comments: A comprehensive survey of its distribution in Virginia was conducted from 1976-1978. Cavity trees were located in Virginia Beach, Southampton, Isle of Wight, Surry, Sussex, Brunswick and Prince George counties. Birds were observed only in Isle of Wight, Sussex and Prince George counties, with nesting verified only in Sussex county *456*. They are found only in Sussex County and Suffolk *4291,9577*. One adult bird was sited in a residential area of York county in the spring of 1987 *9290*. It is a very rare permanent resident south of Chesapeake Bay and the James and Appomattox rivers *8511*. In Virginia, this species is extremely rare, with only five currently active colonies, all in Sussex County. The status of one colony in the City of Suffolk is uncertain at this time *9286*.

Resident Occurrence Comments: This is a rare permanent resident on the Coastal Plain south of the Chesapeake Bay and the James and Appomattox Rivers, decreasing in recent years, at present most nesting sites are in Sussex County. There is one record for western Virginia: Cumberland Gap, Lee Co. 21 October 1973 *700*. There are no known historical or present records for most cities with the exception of Suffolk (portion which once was Nansemond County). The present distribution is limited to Sussex County and Suffolk *4291,9577*. These records are from the Virginia Game Commission Red-cockaded Woodpecker Project. One individual adult was observed in York County through the spring in 1987, but no nesting behavior was observed *9290*. In Virginia, this species is extremely rare with only five currently active colonies, all in Sussex County. The status of one colony in the City of Suffolk is uncertain at this time *9286*.

Seasonal Occurrence Comments: This is a permanent resident in Virginia *700*, non-migratory *436*. In Sussex County, eggs are present in nests from May 8-27. 1973: The setting of the courthouse is enhanced by a broad lawn in front which slopes down to the highway (U.S. Rt. 1). ------1973: The lawn is planted with shade trees, and on its eastern edge is the 1904 Clerk's Office. Behind the courthouse is the early 20th- century Sheriff's Office and Jail. To the east of the complex is the small frame Episcopal Church (026-0002) noted by Sheridan. Surveyor Assessment: 1959: Raided by Sheridan's Cavalry.

1973: The Greek Revival-style Dinwiddie Court House stands as the architectural and historical focal point of its venerable Southside county. Set at the head of its broad lawn the dignified building has housed the county's government and courts since it was completed in 1851.

In Nov. 1858 the county resolved that the building was to be remodeled and enlarged. This alteration was interrupted by the War between the States, and it was during this period that the court house witnessed its most significant historic events. In March of 1865 Union Gen. Phillip Sheridan, bringing his troops from the east as part of the drive on Petersburg, passed through the courthouse village but was driven back by a fierce attack led by Confederate Gen. George Pickett. This action has been designated the Battle of Dinwiddie Court House. Sheridan withdrew to Dinwiddie and the next day advanced to attack Pickett, and defeated him in the decisive Battle of Five Forks. In his personal memoirs Sheridan gives both a detailed account of the action at Dinwiddie Court House.

Although the building has been much altered and added to over the years, it preserves its simple ante-bellum dignity. its setting has changed little in characted from the time that Sheridan's troops camped on the square. 1968: Brick, 2 stories, gable roof, gable end front with projecting pedimented Tuscan portico. Mid-19th century; later rear addition. 1973: The original portion of the Dinwiddie County Courthouse is a 2-story, brick temple-form structure approximately 37' wide and 78' long including the front portico. Designed in a simple Greek Revival style, the front and side bays are framed with Greek Doric pilasters supporting a Greek Doric entablature without triglphs. The center bay of the three-bay facade is widened, making the pilasters appear paired rather than evenly spaced. The portico columns echo this spacing. As originally completed in 1851 the courthouse apparently was the more typical one-level building instead of being the present two-level one. A court order of November 1858, however, resolved that the building was to be so remodeled as to have "...three rooms on the first floor for Clerk's office and sheriffs office & peoples room--and that the materials of the old clerk's office be used in the said work..." This remodeling was interrupted by the War between the States, and the incompleteness of the project was noted by Gen. Philip Sheridan in his 1865 description of the courthouse village. Sheridan observed that the roof was tottering under "the unusual burden of new repairs and improvement thereupon..." He further mentioned the large timbers placed to brace the building's eaves while the remodeling was being carried out. He confirmed the fact that the building was divided into two stories by that time with his description of the interior spaces. A contemporary engraving showing Sheridan at Dinwiddie Courthouse illustrates the building with a two-run divided stair leading up to the second-floor door in the center of the facade. The top landing is shown serving as both a small balcony and a shelter for the first-floor entrance. This exterior stair lasted apparently for little more than a couple of decades as it was replaced before the turn of the century by an interior stair. A small iron balcony now occupies the former position of the stair's top landing. if indeed the court house originally had only one level, it is assumed that the side bays were altered during the 1858 renovation to have their present two-tiers of windows to reflect the new two-level scheme.

Interior Description: During the early part of the 20th century the building's interior was further altered so that most of the present interior trim such as window and door architraves, doors, flooring, and fixed furniture dates from that time. The court room's handsome stamped metal ceiling also belongs to the early 20th-century period. it was during this period that the building was first painted gray rather than its former red .

The battlefield is situated in rural Dinwiddie County. ------April 2009: None. Surveyor Assessment: Hoping to cut Lee's supply route into Petersburg, in February 1865 Grant ordered two army corps led by Major Generals Gouverneur K. Warren and Andrew A. Humphreys to seize the Boydton Plank Road. The Confederate corps commanded by Major General John B. Gordon successfully blocked Warren's attacks at nearby Dabney's Mill on 6-7 February, and Warren's corps withdrew to its previous position. The brief Union campaign enabled Grant to extend his lines, and cost the Confederates the life of Brigadier General John Pegram on February 6.

Entered 2004:

The fighting in the Hatcher’s Run vicinity during February 5-7 developed from Grant’s ongoing strategy of supply interdiction. Grant ordered Gregg’s Division of Union cavalry on a raid to Dinwiddie Court House to interfere with Confederate supply wagons along the Boydton Plank Road. The Union II Corps moved to a supporting position along Hatcher’s Run near the Vaughan Road crossing, while V Corps took position about two miles to the south of II Corps. The two corps maintained a corridor for Gregg’s retreat, while offering one another mutual support to prevent a Confederate flanking countermove. Heth’s Division of Confederates mounted a determined attack against II Corps from the north in the late afternoon of February 5, but was beaten back. On February 6, the Union V Corps made a reconnaissance in force along the Dabney Mill Road, while Pegram’s Division of Confederates, supported by Evans’s and Mahone’s divisions, advanced along the same road to make its own probe. The two forces clashed, and after a seesawing struggle, the Confederates were forced to retreat. Additional skirmishing took place on February 7. In the aftermath of the fighting, the Northerners dug in permanently as far west as the Vaughan Road crossing, so that Grant’s strategy of extending the siege lines was also brought into play (Trudeau 1991:312-322; Greene 2000:143-149).

The surveyor made use of the recent secondary histories by Trudeau and Greene. The 1992-1993 NPS study identified three discrete battlefield core areas, viz., a large one to the northeast for the February 5 fighting, extending across routes 670, 674, and 613, a small one to the west for the February 6-7 combat along Dabney Mill Road, and an additional small area to the south on Gravelly Run, said to represent other fighting on February 6. The Trudeau-Greene research indicated that it would be appropriate to extend the large northeasterly 1992-1993 NPS core area to the eastward by about .4 miles to fully include the area of the February 5 attack by Heth’s Division against II Corps. The NPS 1992-1993 core area on Dabney Mill Road evidently reflects the February 6 fighting fairly accurately. The Trudeau-Greene research did not refer to fighting farther south on Gravelly Run, suggesting that this was probably cavalry combat on a relatively minor scale, associated with the withdrawal of Gregg’s Union cavalry behind the cover of II Corps and V Corps. A 2004 field survey found that the battlefield core areas were intact, as regards the density of non-contributing resources that interfere with the interpretation of the battleground. There are modern residential properties scattered in some sections of the core areas, but not in such density as to be disruptive of these areas’ sense of historic feeling. The surveyor recommends National Register boundaries for the battlefield as shown on the attached map.

April 2009: Today, the battlefield contains historic road beds, period buildings, and earthworks. Although portions of the battlefield contain modern residential properties, they are situated far enough apart to not diminish the historic setting of the battlefield. Due to the fact that this resource retains much of its integrity, it is recommended that Hatcher’s Run Battlefield is still Potentially Eligible for the NRHP under Criterion A for its association with notable Civil War events in this area. During Dovetail’s survey Vaughn Road was investigated for its significance during the Civil War. This road was travel by troops during the Battle of Hatcher’s Run and the Battle of Peebles’ Farm and still follows its original alignment and retains much of its historic setting and feeling. In 1996, the Virginia Transportation Research Council (VTRC) published an historic context and determinations of eligibility for non- arched concrete bridges in Virginia built prior to 1950. As part of this context and eligibility study, the VTRC recommended Bridge No. 6083 as not eligible for listing on the National Register (Miller et al. 1996). VDHR confirmed this recommendation in its 1997 Memorandum of Agreement with the Virginia Department of Transportation concerning the eligibility of bridges.

In the opinion of the current surveyor, Bridge No. 6083 does not appear to meet National Register significance and integrity criteria, and is recommended not eligible for the National Register under Criteria A, B, C and D.

February 2012: The Carson Road Bridge over SAL is a three-span, vehicular bridge carrying Carson Road over the SAL corridor. The structure is a common example of highway bridge constructed throughout the Commonwealth of Virginia during this time period; it has no outstanding architectural significance or merit nor does it have any known association with an important event or individual. This bridge was determined not eligible for individual listing on the NRHP by DHR staff on April 25, 2005. However, the Carson Road Bridge is located within the NRHP-eligible SAL corridor and reflects the increasing development of transportation facilities in the mid-twentieth century. It also functionally relates to the SAL as a component of the area’s expanding transit network and was likely constructed to meet certain railroad regulations. Bridge No. 6083 consists of a three span vehicular bridge carrying two lanes of State Route 703 over the former right-of-way of the Seaboard Air Line Railway north of the town of Dinwiddie. The bridge spans a total 113 feet and features concrete t-beam construction, concrete piers, and cork railings. This bridge was previously documented by the Virginia Transportation Research Council (VTRC) as part of its survey of non- arched concrete bridges in 1996. February 2012: The Carson Road Bridge over SAL was constructed in 1940 to provide vehicular access across the railroad tracks (SCL 1981). The three-span bridge, featuring a simple span design, is constructed from reinforced concrete with slab-poured, rectangular, haunched beams. The beams and deck were poured on-site, joining the bridge components into a unified superstructure. The spans are supported on the east and west by concrete abutments. The superstructure comprises a two-lane asphalt-clad deck and a precast concrete railing. The substructure features two bents each with paired reinforced concrete column piers. Lee's Petersburg defenses. A steady downpour turned the roads to mud, slowing the advance. On March 31, Major General W.H. Fitzhugh Lee's cavalry and Pickett's infantry division met the union vanguard north and northwest of Dinwiddie Courthouse and drove it back, temporarily stalling Sheridan's movement. With Union infantry approaching from the east, Pickett withdrew before daybreak to entrench at the vital road junction at Five Forks. Lee ordered Pickett to hold this intersection at all hazard.

The fighting at Dinwiddie Court House on March 31 was an episode in the final Union effort to outflank the west or right end of the Confederate line that had commenced on March 29. Sheridan’s cavalry corps of three divisions, formed the most advanced or westerly element in the Union force. Anticipating such a move, Lee sent General George Pickett with his own infantry division and W. H. Fitzhugh Lee’s cavalry to head off the Union flanking movement. On March 31, Pickett struck Sheridan’s force on its left flank, about three miles north of Dinwiddie Court House, and succeeded in gradually driving the Federal troops most of the way back to the courthouse village. The day thus resulted in a limited success for the Confederates, but Pickett’s force was stretched too thin to cover such an extensive section of unfortified line. Pickett withdrew during the night to Five Forks, setting the stage for Sheridan’s victory on April 1, which in turn enabled the Union breakthrough of April 2 (Greene 2000:225-235).

The surveyor used Greene’s 2000 secondary history of the closing phase of the Petersburg Campaign. Greene’s research indicated that the battlefield core area developed in the NPS 1992-1993 study extended approximately one quarter-mile farther to the northeast than was appropriate to include the area of battle action; otherwise the recommended eligible battlefield is congruent with that identified in the 1992-1993 study.

A 2004 field survey found that the NPS battlefield core area was intact, as regards the density of non-contributing resources that interfere with the interpretation of the battleground. There are modern residential properties scattered in some sections of the core area, but not in such density as to be disruptive of these areas’ sense of historic feeling. Surveyor Assessment: Start Year: 1865 Date Source: Site Visit Type: Historical Event ------On March 29, in the opening moves of Grant's spring offensive, Sheridan marched with the army's cavalry followed by the V Corps toward Dinwiddie Court House to turn the right flank of Lee's Petersburg defenses. The Union V Corps under Major General G.K. Warren crossed Rowanty Creek, moved up the Quaker Road toward the Boydton Plank Road intersection, and encountered Johnson's Confederate brigades. A sharp firefight forced the Confederates back to their entrenchments on the White Oak Road.

Entered 2004:

The action at Lewis’s Farm was an episode in the initial phase of Grant’s final drive to outflank Lee’s Petersburg force. The Union V Corps and II Corps were assigned to join Sheridan’s cavalry corps in extending the left flank of the Northern army westward. The 1st and 2nd divisions of V Corps spearheaded the movement of the Union infantry. These two divisions met substantial opposition in their advance after crossing Gravelly Run at Quaker Road, from Anderson’s Division of Confederates. A series of counterattacks by either side developed, which resolved with the Southerners being driven back and the Union troops entrenching along the Boydton Plank Road (Greene 2000:206-215).

The surveyor relied on Greene’s 2000 secondary history of the final phase of the Petersburg Campaign. Greene’s research indicated that the battlefield core area developed in the NPS study of 1992-1993 was accurate.

A 2004 field investigation determined that the battlefield core area was largely intact. There are a number of modern residential properties situated along Quaker Road, which runs through the center of the core area, but not in such density as to be disruptive of the area’s sense of historic feeling or of the ability to interpret the battlefield. Interstate 85 passes through the periphery of the core area on its southeastern edge, while the Seaboard Air Line Railway line (not present in 1865) extends through the core area periphery along the northwestern side of the area. These two transportation corridors lack the integrity of setting and feeling necessary to contribute to the eligible battlefield, hence they are omitted from the boundary recommended as eligible by the surveyor on the attached figure. Hargrave Store property contains a frame store erected around 1900 and eight additional structures located along the northeast side of Courthouse Road (State Route 619) just west of the former Seaboard Air Line railroad right-of-way on the eastern outskirt of the town of Dinwiddie. ------The property includes a plant building, four storage buildings, a feed mill, a scale house, and an equipment shed. Surveyor Assessment: Start Year: 1900 ca Date Source: Owner Type: Original Construction ------In the opinion of the surveyor, the Hargrave Store property does not appear to meet National Register significance and integrity criteria and is recommended as not eligible for listing on the National Register. Built around 1900 in order to take advantage of the adjacent Seaboard Air Line railroad’s freight delivery and hauling capabilities, the store and its related structures now serve a clientele reliant on faster, truck borne deliveries and shipping. According to state gazetteers, nearly 60 general stores, including Harris & Hargrave and four others in Dinwiddie, operated within the county in 1906 (Hill Directory Co. 1906:374). While the present building may relate to the broad historic theme of commerce and trade, it conveys no significant historical information related to the theme. The store’s additions and most of the outbuildings appear to be younger than 50 years old, and the dismantling of the depot further removes the property from its historical relationships to the railroad. The store has also been greatly altered by the appending of new additions and the application of modern materials over original door and window openings, and thus does not meet National Register Criterion C, embodiment of characteristics of a type or method of construction. In comparison, Olger’s Store (026-0174), an early twentieth- century commercial building located within the three-county SEHSR project area and determined eligible for listing on the National Register by the VDHR, possesses a high degree of integrity. Research has not identified any relationships between the store property and significant historical events or persons (Criteria A and B). The property has not yielded, and is not likely to yield information important to our understanding of history (Criterion D). A small, one-story hipped roof bay window protrudes from the store’s southeast elevation. The bay’s window and door openings(southwest, northeast, and southeast elevations) have been covered with siding but the sills of the openings remain visible on its exterior walls. The gable front displays a lobbied storefront protected by a full-width hipped roof porch supported by three turned posts set on top of a poured concrete deck. The storefront features centrally placed, paired three-panel wood doors crowned by a two-light transom and flanked by large display windows set above paneled aprons. Two thin hopper windows once penetrated the southeast elevation’s first story, while two larger windows occupied the second story; all have been boarded shut. Boarded window openings are also visible in the second story of the northwest elevation and southwest gable end. The store possesses a one-story shed roof addition along the full length of its northwest elevation. A one-story, gable-roofed warehouse with corrugated metal siding and 5-V metal roofing connects to another shed roof addition appended to the store’s northeast elevation. The roof of the attached warehouse is set perpendicular to the main store building’s ridge.

The store’s interior features an open floor plan with shelves and display cases to facilitate the retail sale of farm and home supplies. The original store’s northwestern wall has been removed and the northwest addition’s floor space incorporated into the main structure’s shopping area. An ell-shaped portion of the northwest addition’s northern corner has been enclosed for use as an office.

It includes an off-center raised section flanked by lower wings. The coping and window surrounds are of cast stone. The taller section, probably the waiting room, is provided with a large window framed by stone. It is filled with five steel awning window units. The long wing to the north contains the medical examination rooms and offices, while the related short wing to the south probably contains service rooms. Support rooms across the rear include a furnace rooom with chimney. The fenestration in the lower wings take the form of horizontal strip windows with three or four awning windows in each stone-framed opening. A door framed with stone gives access to the north wing in the north end. The main entry is sheltered by a flat-roofed porch supported on the north by a brick pier and on the south by a small enclosure. It is lined with stone. The roofs are drained by

Architecture Setting: Rural Acreage: No Data Site Description: Feb 2010: The house is sited on a large landscaped lot on the edge of the small Dinwiddie Court House community in an impressive grove of full-grown oak trees. A curving drive lined with granite stones and boxwoods passes through a carefully planted lawn to reach a wide circle and a parking area beside the garage. ------Feb 2010: The house is accompanied by a brick garage corresponding in date and form to the main house. Surveyor Assessment: Feb 2010: The Hargrave House is an unusually well-preserved example of a Tudor Revival-style dwelling built on the outskirts of the community of Dinwiddie Court House. It is one of the best of the numerous examples built in the inter-War period in Dinwiddie County and the larger region, inspired by published plans. The first owner was the clerk of court, Miller Hargrave and his wife, Virginia Dix Hargrave. Mrs. Hargrave wanted to have an "Old English" house. She had seen one in eastern Virginia that she wanted to emulate or copy. The Hargraves hired a Richmond-based contractor named Gwalthmey, who provided plans. The houses to either side were the homes of the sheriff and other county officials. Mr. Hargrave cut walnut from his farm and stored it for 17 years for use in the interior. onamental iron hinges. The gable ends and the sides of the dormer are sheathed with wavy-edged waney weatherboards. A screened porch projects on the east side.

The interior features a narrow passage with a stair in the center and a living room in the projecting gabled section with an arched firebox flanked by bookcases. The entire first floor is treated with vertical board-and-batten walnut wainscot. The door and window trim features square corner blocks. The door between the passage and living room has an arched top and central keystones on each side.
