REV. 685 (2021) THE CONSTITUTIONAL IRRELEVANCE OF ART* BRIAN SOUCEK** In Masterpiece Cakeshop, the baker’s lead argument to the Supreme Court was that his cakes were artworks, so antidiscrimination laws could not apply. Across the country, vendors who refuse to provide services for same-sex weddings continue making similar arguments on behalf of their floral arrangements, videos, calligraphy, and graphic design, and the Supreme Court will again be asked to consider their claims. But arguments like these—what we might call “artistic exemption claims,” akin to the religious exemptions so much more widely discussed—are actually made throughout the law, not just in public accommodations cases like Masterpiece Cakeshop. In areas ranging from tax and tort, employment and contracting discrimination, to trademark, land use, and criminal law, litigants argue that otherwise generally applicable laws simply do not apply to artists or their artworks. This Article collects these artistic exemption claims together for the first time in order to examine what determines their occasional success—and to ask when and whether they should succeed. The surprising answer is that claims of the form “x is protected because it is art” should never succeed. The category “art” is constitutionally irrelevant. In a post on the Conservancy’s website, President Toni Bandrowicz ac- knowledged that balloons are a bright and fun way of celebrating happy against balloons events, but asked residents to consider the negative impacts as well as the positive. “To protect nature in our neighborhood, perhaps it’s time for Swamp- scott to consider such a by-law — or at least a policy that bans balloons at town-sponsored events, on town-owned properties, or for any events requir- ing town approval,” Bandrowicz said. “The town should promote the use of non-disposable, reusable decorations for such events, not balloons and other single-use plastic decorations.” A handful of communities in Massachusetts have already enacted similar rules, including Chatham, Everett, Nantucket and Provincetown.     Issue 37 July 2015 Negro Leaguers in Service If they can fight and die on Okinawa and Guadalcanal in the South Pacific, they can play baseball in America. Baseball Commissioner AB "Happy" Chandler This edition of the Baseball in Wartime Newsletter is dedicated to all the African- American baseball players who served with the armed forces during World War II. More than 200 players from baseball’s Negro Leagues entered military service between 1941 and 1945. Some served on the home front, while others were in combat in Europe, North Africa and the Pacific. These were the days of a segregated military and life was never easy for these men, but, for some, playing baseball made the summer days a little more bearable. Willard Brown and Leon Day (the only two black players on the team) helped the OISE All-Stars win the European Theater World Series in 1945, Joe Greene helped the 92nd Infantry Division clinch the Mediterranean Theater championship the same year, Jim Zapp was on championship teams in Hawaii in 1943 and 1944, and Larry Doby, Chuck Harmon, Herb Bracken and Johnny Wright were Midwest Servicemen League all- stars in 1944. Records indicate that no professional players from the Negro Leagues lost their lives in service during WWII, but at least two semi-pro African-American ballplayers made the ultimate sacrifice. Grady Mabry died from wounds in Europe in December 1944, and Aubrey Stewart was executed by German SS troops the same month. He received postgraduate training in genetics and was awarded Doctor of Philosophy by The Chinese University of Hong Kong in 1999. Dr. Choy’s main research interests include the development of novel molecular diagnostic strategies and innovative applications of molecular analysis tools in prenatal diagnosis. His current research focuses on (1) structural genomic variation (including copy number variants); (2) development and application of the microarray-based Comparative Genomic Hybridization (array CGH) and massively parallel sequencing technology for prenatal diagnosis. In 2007 he founded the Agilent microarray core facilities in CUHK, which is the first centre of its kind in Asia dedicated to prenatal diagnosis with a focus on molecular basis of normal and abnormal fetal development. Dr. Choy is an Honorary Scientific Officer (medical) at the New Territories East Cluster of Hospitals, Hong Kong, where he is involved in the delivery of the laboratory diagnostic service. He is also the board member of the Hong Kong Society of Medical Genetics since 2009. Read Full License Page 1/11 Abstract The speed, expense and throughput of genomic sequencing impose limitations on its use for time-sensitive acute applications, such as rare or antibiotic resistant infections, and large-scale testing that is necessary for population- wide source-tracing, as in the COVID-19 pandemic. A major bottleneck for increasing throughput and decreasing operating costs of next-generation sequencers (NGS) is the ow cell that supplies reagents for the biochemical processes; this subsystem has not signicantly improved since 2005. Here we report a new method for sourcing reagents based on surface coating technology (SCT): the DNA adhered onto a biochip that is directly contacted by a reagent-coated polymeric strip. Compared with ow cells, reagent layers are an order of magnitude thinner while both the reagent exchange rate and biochip area are orders of magnitude greater. For whole genome sequencing (WGS), these improvements reduce turn-around time from days to twelve hours, reduce cost from about $1000 to $15, and increase data throughput by orders of magnitude.
