    WCTR AVIATION SAFETY AND THE INCREASE IN INTER-AIRLINE OPERATING AGREEMENTS KENNETH BUTTON The Institute of Public Policy George Mason University, VA 22030-4444, FAIRFAX, USA Abstract Air transport is becoming increasingly internationalized. This is not only in terms of rapid growth in international traffic flows but is also pronounced on the supply-side as airlines are beginning to lose their national identity as cross-equity holdings expand and as airline alliances grow. Alliances are also becoming a significant feature of many domestic markets. These structural developments interact with the commercial and the regulatory environment in which air transport is provided and also have potential implications for air transport safety. Although safety is generally treated as part of public policy, the commercial interests of the airlines themselves also influence it. The new market structure has brought forth considerable public debate on the economic implications of globalization and strategic alliances but less assessment has been made of the safety dimension. Even more lacking is a full consideration of the implications of the new situation for the way airlines view safety matters. This paper focuses on the changes in the private incentives that the growth in airline alliances in there various forms may have on safety.     13.2.2009 EN Official Journal of the European Union C 36/11 Commission notice pursuant to Article 18a(3)(a) of Directive 2003/87/EC Preliminary list of aircraft operators and their administering Member States (Text with EEA relevance) (2009/C 36/10) Pursuant to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a scheme for greenhouse gas emission allowance trading within the Community (1), as amended by Directive 2008/101/EC (2), aviation activities of aircraft operators that operate flights arriving at and departing from Community aerodromes are included in the scheme for greenhouse gas emission allowance trading within the Community as of 1 January 2012. Member States are obliged to ensure compliance of aircraft operators with the requirements of Directive 2003/87/EC. In order to reduce the administrative burden on aircraft operators, the Directive provides for one Member State to be responsible for each aircraft operator. Article 18a(1) and (2) of the Directive provides for the rules governing the assignment of each aircraft operator to its administering Member State. In accordance with those provisions, Member States are responsible for aircraft operators which were issued with an operating licence in accordance with the provisions of Council Regulation (EEC) No 2407/92 in that Member State, or aircraft operators without an operating licence or from third countries whose emis- sions in the base year are mostly attributable to that Member State. Article 18a(3)(a) of the Directive requires the Commission to publish a list of aircraft operators which performed an aviation activity listed in Annex I of the Directive on or after 1 January 2006 specifying the administering Member State for each aircraft operator.

    CASE COMP/D2/38.479: British Airways / Iberia / GB Airways On 10 December 2003, the Commission decided not to raise serious doubts against the alliance between British Airways, Iberia and GB Airways. As a consequence, these agreements are automatically exempted for six years. A summary of the Commission’s assessment of the alliance is set out below.1 1. PROCEDURE 1. On 22 July 2002, British Airways (BA), Iberia and GB Airways notified to the Commission a number of co-operation agreements, applying for an exemption under Article 5 of Regulation N° 3975/872. 2. The Commission services consulted a large number of European airlines, travel agents’ organisations and corporate customers on this case. After having established its preliminary analysis of the case, the Commission services entered into detailed discussions with the parties to see whether the latter could accept to offer suitable remedies to alleviate competition concerns. A “market test” was carried out with a view to find out whether the proposed commitments, in the form of slots to be made available, would be taken up by (potential) competitors. 3. On 12 September 2003, pursuant to Article 5 (2) of Council Regulation No 3975/873, the Commission published a Notice in the Official Journal4 summarising the main elements of the co-operation agreement and giving full account of the commitments proposed by the parties. Under Article 5 (2) of the Regulation, interested parties had 30 days to comment. According to Article 5 (3) of the Regulation, if the Commission does not notify the Parties within 90 days of the date of this publication that there are serious doubts as to the applicability of Article 81 (3) of the EC Treaty, the co- operation agreement shall be deemed exempt from the prohibition under Article 81 (1) EC for a maximum of six years from the date of publication.
