THE LEGAL PROFESSION’S FAILURE TO DISCIPLINE UNETHICAL PROSECUTORS Angela J. Davis* I. INTRODUCTION White students at Jena High School in Jena, Louisiana, hung nooses from a tree at the high school, provoking a series of fights between groups of black and white students. Punches were thrown on both sides, and both black and white students were injured. However, the prosecutor, Reed Walters, charged one white student with a misdemeanor while charging six black students with serious felonies in adult court. In Douglasville, Georgia, a seventeen-year-old boy named Genarlow Wilson had consensual oral sex with a fifteen-year-old girl. The prosecutor charged him with aggravated child molestation and other sex offenses. Oral sex with a person under fifteen years old is aggravated child molestation in the state of Georgia, and consent is no defense. Wilson was acquitted of all charges except the child molestation offense, which at the time carried a mandatory sentence of ten years in prison. A judge later found that Wilson’s sentence constituted cruel and unusual punishment and ordered him released. But the prosecutor appealed the judge’s decision, and Wilson remained in prison for over two years until the Georgia Supreme Court ordered his release on October 26, 2007.1 Delma Banks was charged with capital murder in the state of Texas. The prosecutor in his case withheld exculpatory evidence and repeatedly coached the main witness on what his testimony should be. The prosecutor even threatened to prosecute this witness if he did not conform his testimony to the prosecutor’s version of the case. -

It's between different kinds of believers BY HANNA ROSIN ..... Richard Land is gloating, and who can blame him? When I called him a few weeks after the 2004 election, he said he'd been driving around his home town of Nashville with his cell phone ringing constantly, CNN on one line, Time magazine on the other—everyone wanting to ask the prominent Southern Baptist how his people had managed to win the election for George W. Bush. Yes, he told me, "we white evangelicals were the driving engine" of the president's victory. But then he veered into the kind of interview a quarterback gives in the locker room, in which he thanks the offensive line and the tight end and the coach and, well, really the whole team for bringing it home. "You'd be shocked," Land said, "at the number of Catholics who voted for this president. You'd be shocked at the number of Orthodox Jews, even observant Jews. This was a victory for all people of traditional moral values." "Moral values." The phrase has turned into the hanging chad of the 2004 election, the cliché no one takes seriously. Do the debates over Iraq and the economy not involve moral values? Is everyone in the exit polls who didn't check that box a secular hedonist? As a way of explaining the outcome of the election, the "morality issue" has been amply debunked as all but meaningless. -

In this article we will explore how HBO came to legitimatise a contemporary television culture through producing distinct divisions ad infinitum, framed as being rooted outside mainstream commercial television production. In creating incessant divisions in genre, authorship and aesthetics, HBO incorporates artistic norms and principles of evaluation and puts them into circulation as a succession of oppositions— oppositions that we will explore throughout this paper. -

Content from TNT, TBS, CNN, HLN, truTV, TCM, Cartoon Net and Adult Swim will be included, with availability planned through Xfintitytv.com, Comcast’s VOD service and Xfinity-branded mobile apps. Live streaming is also planned. And starting in the middle of this year, the Turner content on Xfinity platforms is expected to accrue to Nielsen C3 ratings across TV and the Internet (Cfax, 2/1), and eventually to phone and tablet devices. “This landmark agreement… really solidifies our partnership in this effort and really pushes forward the concept of giving consumers more access to quality on- demand content on any device they choose,” said Bewkes in a release.
