1.Call to Order Bob Phillips called the meeting to order at 9:05am. Mike Klemens did a roll call of those in attendance.

2. Approval of the Minutes With a first from motion from Mayor Ryback and a second from Bob Ells, the minutes of the October 22, 2020 meeting were approved unanimously via voice vote.

3. Agency Reports a. IDOT Bureau of Programming- Katie Herdus was unable to attend the meeting but sent a status sheet. The items in bold font on the status sheet are the changes made since the previous update to the sheet. Katie provided comment that email is the best way to reach her, the Bureau of Programming is still working remote, and that they are currently working on IDOT’s multi-year program. Mike Klemens will forward the status sheet shortly following the meeting.

b. IDOT Bureau of Local Roads and Streets- Alex Househ provided an update on the status sheet and noted that there were five changes (Item #3- Grant Township, Item #15 – Lake Forest, Item #16 – Libertyville, Item #17 – Libertyville Township, Item #21 – Round Lake Beach) needing an update on Phase I and/or design approval. Email is the best way to reach Alex as IDOT staff is still working remotely.

A Question was asked about the Rebuild Bond Fund asking if the money requires a resolution similar used for a MFT resolution. Mr. Househ responded that the amount received is going to be the MFT account but a different account. Any funds taken from the bond will lead to the local agency going to their board to approve a resolution to take whatever is available from the Rebuild Illinois Bond similar in what is done with the MFT. To keep track of the bond local agencies can use the same forms that are used from the MFT.

A question was asked about where one can learn about the qualifying expenses for a project that uses Rebuild Illinois Bond Funds and what items participating items are. Mr. Househ explained that one can find this information on the Circular Letter 2020-16 that was sent out by IDOT on October 20th, 2020 that states any project used for MFT can also be used for Rebuild Illinois Bond Fund. Mr. Klemens added that another Circular Letter sent on January 12th asks for local agencies to submit an online form for each project that a local agency anticipates using the Rebuild Illinois Bond Fund for.

A question was asked about who to contact to get more information pertaining to the Rebuild Illinois Bond Fund. Mr. Househ answered that anyone can contact him directly and asked that the local agency or the

County to provide an explanation of the location, description of the project, and to reference Circular Letter 2020-16 in the letter head via email and pdf.

A question was asked if the bond funds have to expended and spent by 2025 or committed to a project by 2025. Mr. Househ answered that they have to be expended.

A question was asked asked if Phase II/III qualifies for RBI funds. Mr. Househ confirmed this is the case.

A question was asked if the bond funds can be used for the local match. Mr. Househ confirmed that was the case for federal projects. c. Illinois Tollway- Kelsey Passi provided a report on the budget. The Tollway Board of Directors approved a balanced 2020 Budget in December 2020 with $1.4 billion in revenue that was allocated to maintenance and operations, debt service, transfers, and capital investments for the I-294 mile system. The 2020 budget will allow the Tollway to commit 1.5 billion in capital spending. Operations from COVID-19 has Tollway staff currently working remote still. Toll collection is handled via I-Pass, Easy-Pass, and through the Tollway’s website. Perform and Relief in June 2020 a tolling initiative was launched that reduced the costs of missed tolls from $20 to $3 per missed toll that lasted through the end of 2020. The initiative saw a lot of success which led to the Tollway Board granting a 6-month extension on the initiative to June 2021. For construction, the Tollway moved forward with all scheduled construction projects. d. CMAP- Mary Weber gave the CMAP report. CMAP is accepting funding applications for regional transportation projects through Friday, March 5th. CMAP is gathering information to inform a collaborative capacity building program focused on helping make permanent pandemic-inspired improvements that communities piloted in 2020. CMAP would like to hear what communities did in 2020 and explore how to help other communities in 2021. CCDOTH has announced a 5th round of Invest in Cook funding and the 2020 application period is open through March 12th. Program information on Invest in Cook can be found on the Cook County website. e. RTA- There was no RTA report. f. Metra – Rick Mack from Metra gave the report for Metra. Rick began with local Lake County Metra projects. For the Waukegan Station, Union Pacific is going to begin rehabbing the bathrooms next week and it is expected to take two to three months. For the North Chicago Station, it is scheduled for an overall rehab and construction is expected to begin in the first week of April and be completed in four to six months. Rick moved onto other news noting that the Metra Board approved purchases of up to 500 new modern rail cars offering increased reliability and reducing operating costs. When the pandemic began ridership dropped to 5% of pre-pandemic levels. During the Summer of 2020 ridership increased to 10-15% of pre-pandemic levels but decreased to 8-10% in the Fall and these levels have remained roughly the same to this date. Congress passed the Cares Act back in the Spring to get Metra through roughly $480 million and Congress passed a stimulus bill in December that had roughly $14 billion in transit nationwide. Metra currently doesn’t know how much will be allocated to the Chicago land region at the moment. Latest developments in Congress include the current administration’s proposal of $20 billion in transit nationwide.

Bob Phillips asked for Metra’s position on municipalities that have an agreement with Metra who are not plowing or maintaining their parking lots at the stations due to parking lots being underutilized due to the pandemic. Rick responded that Metra is allowing and supportive of municipalities to have the option to not plow and maintain up to 50% of parking spaces during the winter.

g. Pace –Tim Dilsaver presented Pace’s Report. Pace North Shore Garage was presented with a prestigious award by Waukegan Township that recognized outstanding service provided during the COVID-19 pandemic. A video-presentation on the award was shown.

A question was asked what the ridership is looking like. Linda Soto responded that in the Fall ridership dropped to 40% but paratransit has been holding steady at roughly 50 to 55%.

4. Lake Council STP Program Mr. Klemens gave the committee a report on the current Lake County STP Program. The council has a little over $440,000 available to be reprogramed in FY 2021. LCDOT staff has gone through the Active Management Policy and recommended the available funds be reprogrammed to the Village of Libertyville’s Rockland Road project. Mike added that some favorable bids came in on projects during the November letting which potentially may lead to some additional funds becoming available later this year. The low bid funds will come back to Council and the Council will have the rest of FY2021 and FY2022 to spend those funds providing some flexibility on projects.

Bob Phillips asked for a motion on the recommendation. A first motion was made by Kildeer and a second by North Chicago. The recommendation was approved unanimously via voice vote

Mr. Klemens transitioned onto the Quarterly Status Updates. Mike noted several communities did get their status updates submitted after the deadline. However, with the first time going through the new deadline changes, CMAP is making an exception this time. The next quarterly status updates are due in March.

5. CMAP TIP and the NEPA Process Mr. Klemens gave the committee an update on an enforcement of an existing rule. A federal regulation for projects that are going through the NEPA process and are being processed as a categorical exclusion or above, in order for the Phase I to be approved a subsequent phase of the project needs to be in the active years of CMAP’s TIP. CMAP has a Q&A on their website for more information on this change.

6. 2021 Call for Projects STP-Shared Fund, CMAQ, TAP Mr. Klemens informed the committee that CMAP has an open call for STP-Shared Fund, CMAQ, and TAP open until March 5th. For a project to be approved for STP-Shared Funds, a project needs to be in an approved plan, cost at least $5 million in all phases, or have three participating sponsors, and be one of the eight approved project types. For CMAQ, typical projects involve reducing congestion. For TAP, typical projects involve bike-facilities. To apply to any of the programs, projects must have phase I substantially complete, a design approval, and draft-PDR with solid scoping cost estimates into IDOT. CMAP has done two webinars on the programs which are available for viewing on CMAP’s website. Mr. Klemens transitioned to the Council Priority Points and noted that Council’s received 25 bonus points two years ago that could be awarded to projects in the STP-Shared Fund. The 15 bonus points has been changed so that now those

points are made part of the 100-point scale. Mike added that there is a scoring system in place for awarding those points and asked if the Council would like to continue with the system being used.

Bob Phillips responded that keeping the scoring system is consistent with the Council’s past and present practices.

7. Other Business Mr. Klemens mentioned in October there was a STP Sub-Committee created to review the council rules and the first meeting was held the previous week and added that some proposals will be brought back for review related to the scoring methodologies.

8. Public Comment No public comment was received prior to the meeting or raised during the meeting.

9. Next Meeting The next meeting of the Transportation Committee is scheduled for April 22nd, 2021 at 9am.

Board of Directors Governor JB Pritzker has appointed Jacqueline Gomez Fuentes to fill an open seat on the Tollway’s Board of Directors. Gomez Fuentes serves as the Director of Supplier and Workforce Diversity at the Obama Foundation where she is responsible for the implementation and management of the Foundation’s diversity and inclusion programming. Previously, she worked as the Director of Contract Compliance for Cook County and the Vice President of Business Development and Marketing at SUMAC Inc. In 2018, Gomez Fuentes received the Advocacy Award for business diversity and inclusion from the Hispanic American Construction Industry Association.

Cashless Tolling – What Customers Need to Know In March 2020, the Illinois Tollway halted cash toll collection in an effort to help mitigate the spread of COVID-19, protecting its customers and employees from exposure points to the rapidly-spreading virus. Since then, the Illinois Tollway has taken extensive measures to better serve customers who previously relied on cash payments, including measures to provide relief during the pandemic.

Moving forward, Illinois Tollway drivers will continue to have the option to pay tolls with I-PASS, E-ZPass or pay online with the Tollway’s Pay By Plate service. The Tollway continues to maintain a 14-day grace period – one of the longest in the nation – allowing customers to pay unpaid tolls without additional fees or fines prior to being mailed an invoice.

Using Pay By Plate, customers simply enter their license plate, payment method and dates of travel, and the Pay By Plate system takes care of the rest. This service has been leveraged by over 650,000 customers to date demonstrating the quick and seamless transition for many cash customers to the new service.

With regard to the future of our toll plazas, over the last year changes were made to ensure the safety of our customers, and throughout 2021 more changes will be made to improve th e customer experience. These changes include additional signage, striping and other changes to reduce our maintenance costs and further improve the service to our customers.

This work is common across all toll plazas on the Illinois Tollway system. A long-term plan for each site will be developed to assess the potential to better serve our customers, and as those changes are announced we’ll be sure to share them with you.

Operations during COVID-19 Since March 2020, extensive protocols have been in place to protect employees, keeping our essential and front-line workers safe and the entire agency working. The Illinois Tollway Board of Directors has continued to meet virtually each month to keep all business, roadway services and construction activity moving.

The agency is continuing to work closely with contractors to ensure the proper safety precautions are taken to protect workers engaged in outdoor construction activities along our system. Tollway contractors and consultants continuing their work are always required to have comprehensive safety plans in place, and those plans have been updated to account for the safety precautions during the COVID-19 pandemic.

In-person customer service centers are currently offline; however, we are working on a plan for reopening service. In the meantime, the Tollway Customer Service Call Center is operational and assisting customers.

Move Over Law Once again, we are asking for your support to help draw attention to the state’s Move Over laws. Two years ago, the Illinois State Police lost three troopers in one year, two of which were members of the Tollway’s own ISP District 15. Trooper Christopher Lambert and Trooper Gerald Ellis – were lost in senseless accidents serving our agency as well as the overall mission of the Illinois State Police.

When driving, we must take care for everyone who works on our roadways, from our troopers, to our roadway and HELP Truck drivers. And remember Illinois’ Move Over Law requires drivers to slow down, move over and change lanes, if possible, to make extra room when approaching ANY vehicle with lights flashing, stopped on a roadway.

Construction The Illinois Tollway has kicked off the 2021 construction season as the 10th year of the Move Illinois capital program begins with some of the biggest and most challenging projects lying ahead.

The Tollway’s 2021 capital program calls for investing $1.53 billion in the region’s infrastructure. This includes more than $451 million to continue planning and advance construction for the new I-490 Tollway and new interchanges connecting to the Jane Addams Memorial Tollway (I-90), Tri-State Tollway (I-294), the Illinois Route 390 Tollway, as well as providing direct access in and out of O’Hare International Airport as part of the Elgin O’Hare Western Access Project.

Work to reconstruct and widen the Central Tri-State Tollway (I-294) will continue in 2021 with more than $690 million budgeted to continue design and construction of the roadway, as well as the new BNSF Railway Bridge, the new Mile Long Bridge and to begin work to reconfigure the I- 290/I-88 Interchange at I-294. In addition, $78 million is allocated in 2021 for ongoing work to complete the final ramps for the I-294/I-57 Interchange.

The 2021 capital program also provides $312.2 million for systemwide roadway and bridge repairs to keep the existing Tollway system in good repair. Several local projects include replacing the Deerpath Road Bridge over the Reagan Memorial Tollway (I-88) in Aurora, rebuilding the Stearns School Road Bridge over the Tri-State Tollway (I-94) in Gurnee, and building a new Windsor Road Bridge at I-88 and I-294 in coordination with roadway improvements by the Village of Oak Brook.

Lake County construction projects: • Edens Spur Tollway (I-94) reconstruction has been completed and wrap-up work for local road improvements will be completed in early 2021. • The Stearns School Road Bridge over I-94 work has begun with a full closure and detour. STP Shared Fund Bonus Points Allocation Policy

Background from the approved STP Shared Fund Application Booklet:

“In order to give consideration to those subregional priorities, each council and the City of Chicago (through CDOT) are asked to identify their five highest priority projects from the eligible applications received during the call for projects. These projects will be assigned subregional priority points as follows:

The Lake County Council of Mayors will rank projects from our local Council that have applied to the STP Shared Fund. Given the limited number of points available and the competitive nature of the STP Shared Fund, the Council will award 15 points to the highest ranked project and 10 points to the second highest ranked project. If there are not enough projects located within the Lake County Council to allocate the full 15 points available, the Council may look to allocate points to projects outside the Council on a case by case basis using the same ranking system. The projects seeking Lake County Council of Mayors bonus points will be ranked using the following criteria:

AT-RISK PROJECT PRE-AGREEMENT AUTHORITY FOR PRELIMINARY ENGINEERING (SECTION 1440 OF THE FIXING AMERICA’S SURFACE TRANSPORTATION ACT)

HISTORY & INCEPTION: In March 2019 the Federal Highway Administration (FHWA) provided a Memorandum entitled “At-Risk Project Pre-Agreement Authority for Preliminary Engineering”, which clarifies Section 1440 of the Fixing America’s Surface Transportation Act (FAST Act). This Memorandum sought to clarify Section 1440 of the FAST Act authorizing the FHWA to reimburse projects for Preliminary Engineering (PE) costs incurred prior to project authorization, with the firm understanding that the costs for these projects are for eligible activities on eligible projects. Understanding the importance and opportunity this Memorandum provides, the Illinois Department of Transportation (Department) worked closely and in partnership with the Illinois Division of the FHWA to then craft the attached policy.

PURPOSE & POLICY With the continued intent and focus to provide updated, consolidated, and more useful means of providing an enhanced streamlined series of policies and procedures within the Bureau of Local Roads & Streets (BLRS), the attached policy was created. The policy summarizes a new optional tool that our Local Public Agency (LPA) partners can employ to commence preliminary work earlier, with prior approval, than the current existing methods when the project is eligible and includes Federally funding. While this work provides a series of flexibilities and advantages to our LPAs, this policy does require the LPA to assume all risks for the Preliminary Engineering (PE) costs incurred before project authorization, and to later be reimbursed for those PE costs, provided, all federal regulations and polices are followed.

POLICY DETAILS, RISKS & REQUIREMENTS Section 1440 of the FAST Act (Pub.L.114-94) allows the FHWA to reimburse Federal funding for eligible preliminary engineering costs incurred prior project authorization. In essence this allows the LPA to begin engineering work earlier in the approval process than currently exists. This Section 1440 Policy will now provide the LPA the option at the initiation of a project to select the Section 1440 procedure, or to follow the traditional process where agreements are approved, and federal authorization is obtained prior to the notice to proceed. If Section 1440 process is selected, the LPA must declare that it seeks to follow Section 1440, and submit this request to the District Bureau of Local Roads, along with the Statewide Transportation Improvement Plan (STIP) or Transportation Improvement Plan (TIP) number. The LPA shall understand and accept that the LPA assumes all risks for preliminary engineering costs incurred before federal funds are authorized. Importantly, until a project is authorized with the FHWA, there is no guarantee of Federal funding for any work performed prior to federal authorization. However, to minimize this risk the Department, in conjunction with the FHWA, has developed procedures and approval templates (herewith attached with this Circular Letter) to aid the LPA in meeting the requirements of Section 1440. These conditions, restrictions, and procedures are outlined in the attached policy.

The primary risks and conditions in utilizing Section 1440 include but are not limited to the following, and are summarized as follows:  All Federal laws including the Qualifications Based Selection (QBS) requirements of the Brooks Act (23 CFR 172) and requirements under the umbrella of the National Environmental Policy Act of 1969 (42 U.S.C 4321) shall be adhered to throughout the life of the engineering contract. Failure to do so will nullify federal participation in the preliminary engineering work;  LPA’s will be required to initially pay for preliminary engineering costs until agreements are executed and federal authorization is obtained; and  Projects will be required to be in the Annual Program and included in the STIP or TIP prior to issuance of the Notice To Proceed (NTP).

EFFECTIVE DATE: The use and implementation of this policy will be effective on March 15, 2021.

Section 1440 Procedure and Policy – FAQs

1. If a project is in the STIP or TIP, and includes Federal Funds as part of its funding equation, does this consitute eligibility to utilize the Section 1440 Procedure? Response: Projects that have a STIP or TIP number with federal fund participation does not necessarily constitute eligibility of such projects for Federal reimbursement, as all Federal requirements must be followed during the PE phase such as QBS and NEPA to be eligible for reinbursement.

2. If Section 1440 is applied for and accepted by IDOT and the FHWA on an existing project with PE work performed prior to federal authorization, does this procedure replace the “forgiveness” provisions of Section 1.9(b) of Title 23, Chapter 1, Section 1.9(b) of the Code of Federal Regulations? Response: Yes. Upon enactment, the provisions in Section 1440 established the exclusive method for addressing reimbursement of PE costs incurred prior to project authorization.

3. How far back in time would charges be eligible for reinburesement, if the Section 1440 Procedure is approved? Response: Projects can only go back to the same date as to when the FAST Act become the reguation, namely October 1, 2015.

4. Who has the decision as to if a Project is submiited for consideration on the Section 1440 Process? Response: The LPA has sole discretion on either to request Section 1440, or to follow the existing established process.

5. What is the definition of Preliminary Engineering? Response: Preliminary Engineering that is applicable to engineering work leading to a National Environmental Policy Act (NEPA) decision (Phase I), and completion of the project design (Phase II). These can be separate or combined in contracts for these services.

6. Does the Section 1440 Procedure apply to Right Of Way, Construction, Construction Engineering or Non-Infrastructure work? Response: These work elements are not eligible for the Section 1440 Procedure.

7. When can a request to use the Section 1440 Procedure be made? Response: A request to use the Section 1440 Procedure can be made at any time during the PE Phase, including at the completion of the PE phase, provided that all eligibility requirements remain met.

8. Does the Section 1440 Procedure apply for IDOT initiated State jobs, or only for those initiated by LPAs? Response: Presently only jobs undertaken and initiated by Local Public Agencies will be eligible for the Section 1440 Procedure.

9. How does an LPA go about obtaining a formal request for consideration of the Section 1440 Procedure? Response: As stated in the attached Section 1440 Procedure, the LPA should decide as early in the process of a project if it desires Section 1440 to be used. If desirable, the LPA should communicate with their repective District Bureau of Local Roads Engineer team, and submit both the STIP/TIP number and a request in writing. In addition, the project must be programmed properly.

10. If during the NEPA process a “No-Build” option is concluded and selected, if approved, would this remain eligible? Response: Yes, the project would eligible for reinburseemnt under this Section 1440 Procedure.

11. What date is used when applying the “10-year PE rule”? Response: The date of federal authorization of the PE.

Bureau of Local Roads & Streets Section 1440 Process At-Risk Project Pre-Agreement for Federally Funded Preliminary Engineering

1.0 Purpose

1.1 This procedure describes the process for Local Public Agencies (LPA) to initiate the flexibilities and advantages provided in the Federal Highway Administration (FHWA) Memorandum entitled “At-Risk Project Pre-Agreement Authority for Preliminary Engineering” dated March 19, 2019, which clarifies Section 1440 of the Fixing America’s Surface Transportation Act (FAST Act). 1.2 This procedure permits the LPA to assume all risks for Preliminary Engineering (PE) costs incurred before project authorization, and to later be reimbursed for those PE costs with Federal Funds after project authorization, provided all federal regulations and polices are followed. 1.3 This procedure is afforded to the LPA for the purposes of reducing up-front processing time such that engineering work can commence at an earlier date.

2.0 Authorizing Authority

2.1 Section 1440 of the Fixing America’s Surface Transportation Act (FAST Act) (Pub. L.114-94).

3.0 Risks and Requirements

3.1 All Federal laws including the qualifications-based selection requirements of the Brooks Act (23 CFR 172) and requirements under the umbrella of the National Environmental Policy Act of 1969 (42 U.S.C 4321) shall be adhered to throughout the life of the engineering contract. Failure to do so will nullify federal participation in the preliminary engineering work.

3.2 The LPA will be required to initially pay for PE costs with non-federal funds and seek reimbursement after the funding agreement is executed and federal authorization is obtained (see Section 4.3 of this process).

3.3 Projects will be required to be in the Annual Program and included in the STIP or TIP prior to issuing the notice to proceed for use of this Section 1440 Process to be valid and to remain eligible for reimbursement

3.4 Phase II engineering activities may not commence until Phase I work is complete. In addition, capacity changing projects in Non-Attainment Areas must be conformed prior to commencing of Phase II under this Section 1440 Process.

4.0 Procedure

4.1 Project Planning

4.1.1 During the planning phase the LPA will determine if Section 1440 procedures will be employed.

4.1.2 Should the LPA determine and prefer to employ this procedure, then the process and procedures described within this “Section 1440 Process” shall be followed

4.1.3 Should the LPA select not to employ this procedure; engineering agreement approvals and Federal authorizations will be required as is traditionally executed prior to initiating work per the Bureau of local Roads and Streets Manual (BLRS Manual).

4.1.4 The LPA will notify, in writing, the respective District Bureau of Local Roads (BLRS) of the decision to utilize this Section 1440 Process, accompanied with the STIP or TIP number.

4.2 LPA Programming / Project Initiation

4.2.1 The LPA shall contact District BLRS to ensure the project is included in the annual element of the local program and included in the TIP or STIP.

4.2.2 Once programmed, the BLRS will notify CBLRS of the LPA’s intent to utilize Section 1440 procedures in writing.

4.2.3 Based on the BLRS recommendation and verification of programming requirements, the CBLRS will issue a Notice to Proceed letter to the LPA.

4.2.4 Upon issuance of the Notice to Proceed by the Department, the LPA shall follow Federal Qualifications Based Selection (QBS) procedures outlined in Chapter 5-5.06(a) of the BLRS Manual for consultant selection (if the LPA chooses to perform engineering with in-house forces, QBS procedures are not required). Once the LPA consultant contract (or LPA in-house engineering agreement) is executed by the LPA, work may commence.

4.2.5 The LPA shall send a copy of the executed engineering agreement to District BLRS for review, which will then be forwarded on to CBLRS. The Department will conduct the standard financial review and validate that the QBS attestation statements and qualification requirements were met. QBS attestation statements and qualification validations shall consist of the submittal of the following information:  completed QBS check-sheet; Page 2 of 5

 copy of the public notice;  criterion and weighting for evaluation;  composition of the selection committee;  listing and rating of the top three firms; and  selection justification.

If satisfactory the CBLRS will respond with a letter stating the upper limit of reimbursement and review of the QBS requirements.

4.3 Funding

4.3.1 The LPA in conjunction with District BLRS shall initiate a draft joint funding agreement and forward to CBLRS for review.

4.3.2 Once CBLRS has reviewed and returned comments to District BLRS on the joint funding agreement, the District BLRS may instruct the LPA that they may locally execute the agreement.

4.3.3 Once the agreement is locally executed it shall be returned to District BLRS for review, and then forwarded to the CBLRS for Department execution and filing. Accompanying the joint funding agreement, the LPA shall provide a summary of expenditures incurred to date and the date engineering work commenced.

4.3.4 The Department will certify in the FHWA FMIS system that all Federal requirements were met prior to the authorization request. The following language shall be included in the FMIS remarks section with appropriate dates and cost information. “The State requests authorization for reimbursement of prior incurred preliminary engineering costs in accordance with Section 1440 of the FAST Act. All Federal requirements for such costs were met. The costs were incurred beginning xx/xx/xxxx.”

4.3.5 The CBLRS will send out the fully executed joint funding agreement to the District BLRS and the LPA. The transmittal letter will indicate the date of Federal authorization pursuant to Section 1440 requirements and instruct the LPA to submit a reimbursement request.

4.3.6 Section 1440 is not applicable for any work completed after Federal authorization of the project.

4.3.7 Upon execution of the joint funding agreement the CBLRS will initiate a Contract Obligation Document (COD) with the Illinois Comptroller.

4.4 Reimbursement of PE Costs

4.4.1 The LPA shall submit a request for reimbursement to the District BLRS with appropriate backup documentation (see Chapter 5-10 of the BLRS Manual). The District BLRS will create an invoice for submission to the CBLRS.

4.4.2 Upon review and acceptance, the reimbursement request will be processed, and payment will be made to the LPA by the Illinois Comptroller’s Office

5.0 Definitions

5.1 Engineering Agreement – The contract between the LPA and their engineering consultant to complete preliminary engineering services for a particular project.

5.2 Joint Funding Agreement – The legal mechanism between the department and the LPA by which funding is obligated and paid by the department for preliminary engineering work.

5.3 Execution – The process of securing all appropriate signatures on the joint funding agreement to allow release of funds for a project.

5.4 Contract Obligation Document (COD) – This is the state obligation of funding which allows reimbursement payments from state Road Fund to the LPA.

5.5 Federal Authorization – The means by which the department requests an obligation of Federal funding for an individual project.

5.6 Reimbursements - Once a reimbursement is made from the Road Fund to an LPA, the department will in turn submit a Federal reimbursement request to the FHWA for reimbursement back into the Road Fund.

5.7 Department – The Illinois Department of Transportation

5.8 Preliminary Engineering - Defined as the engineering work leading to a National Environmental Policy Act (NEPA) decision (Phase I) and completion of the project design (Phase II). Preliminary Engineering contracts may be structured as a combination of Phase I and Phase II engineering, or work may be segregated into separate contracts for Phase I and Phase II.
